forecast. >> how about nice and dry? hopefully you will approve of that this morning, off to a chilly start, not as cold as yesterday but you will need that jacket getting out early this morning in many cases. afternoon highs ranging from 60s along the coast to near 80 degrees inland. we will pinpoint your neighborhood coming up. >> about 30 pro terses are camped outside san jose city hall despite the threat of being arrested. allie rasmus is live with more on what those protesters plan to do. allie? >> they call themselves occupy san jose and this is their setup out here. last night, they had about 30 people out here as you mentioned. they are taking part in one dozens of protest across the country, condition demg what they say is greed and corporate corruption on wall street. they are get that go message across with some of their signs. there are five tents out here. these protesters camped overnight despite warnings from city officials and police that it is a violation of city

ordinances to do so. 11:00 last night was supposed to be the deadline for removing these tents but, so far, police have not come out. they have not cited any one here and they have not told the protesters to leave. they are staying put. an attorney for the group says that other pro at thes and activists have been allowed to set up their camp site to protest issues at san jose city hall plaza. their attorney says that telling these protesters to leave is selective process. they have applied the ordinance in the past to allow them to camp. my clients are being denied the right to be here based on the content of their speech. >> the city does value free speech. we have demonstrated that by trying to work with them to this point. it's that limitation on camping and overnight occupancy on property that we need to

enforce. >> reporter: right now, protesters with occupy sacramento have taken over parts of cesar chavez park. one person has been arrested. as the weekend continues, police say their resources are being stretched thin and are hoping that people drinking in the downtown area do not make the situation worse. >> crowds are going, people possibly driving under the influence, people are driving by, yelling, screaming. we hope that people don't join the protest just to do something on a friday night. that's what we were concerned with. >> on thursday, police arrested 20 people who had attempted to protest through the night. they say it is against the law to camp overnight in the park but protesters said they are not going anywhere. we have video this morning of a small plane making an emergency landing off the hawaiian coast. the pilot took off from monterey and noticed he was running out of fuel about 500

miles off the coast of hilo on the big island. the 65-year-old pilot left early. he radioed the coast guard for help as soon as he noticed he was short on fuel. the coast guard sent a plane to fly alongside him and a cutter as well. a rescue swimmer helped hoist the pilot to the helicopter. the pilot was taken to the hospital with minor injuries new restrictions are being enforced to three hotels known for prostitution. an alameda county judges ruled that the hotel owners must install eight foot fences and have cameras to record the faces of everyone on the property and make that available to city officials. the trial to shut down those hotels completely is set for february 10th at least three people are injured after a drive-by

shooting outside an oakland liquor store. police responded to reports of gunshots around 11:00 p.m. a car with an unknown number of people opened fire on the store at 90th avenue near olive street. one person was transported to the hospital. early this morning, two other people checked themselves into the hospital. so far, there is no word on their condition but police say their injuries do not appear to be life threatening. >> the city of san leandro is getting ready to offer a $10,000 reward for information on the warehouse party shooting that killed three people last weekend. >> there is so much stuff going on. >> friend of the three victims gathered yesterday for a small vigil. 23-year-old joshua alford, 19- year-old chanise keel and lanisha worthing ton have all been kill in that shooting. police are not receiving any tips. >> something is keeping

potential witnesses away from us. i'm not trying to get anybody out there who has information in trouble but i just want a name, get pointed in the right direction and our investigation will take care of the rest. >> the shooter is described as a young, slim black man with shoulder length hair and gold teeth. a crash happened in the northbound lane in the northbound lane near elowen boulevard. passers by pulled the big rig driver out of his cab. his condition is unknown and it's not clear what caused the big rig to overturn. this morning, b.a.r.t. completed a survey about changing the weekend service. the proposed plan is to delay saturday morning service by 20 minutes. the proposal includes an early morning bus shuttle to b.a.r.t.

stations. this morning b.a.r.t. workers were out getting feedback at four san francisco stations. the board is expected to vote next month. board members voted against a similar proposal in june. the major concern is that the changes would hurt saturday riders. >> the parade of ship also officially kick off today ales fleet week eend. giving you a live look right now. pat raid of ships starts at 11:00 a.m. followed by the air show at 12:30. this will include a performance by the blue angels. yesterday, they flew their fa- 18 hornets. after touching down, they went over to peer 39 for a seas meet and greet with fans. most people we spoke to said that the blue angels performance is a highlight of fleet week and the pilots agreed that this san francisco stop is one the best on the tour. >> if there is a better venue for an air show than san francisco, i have not seen it.

we have flown over some beautiful, beautiful places. the fact that golden gate bridge and alcatraz are the back drop, and people along the shore line, that ate great feeling. >> the pilots left the meet and greet promising fans a spectacular show this weekend. here is a look at this weekend's fleet week schedule. the air show takes place today and tomorrow starting at 12:30 with the blue angels performing at 3:00. and people can tour some of the ships before they head back out to sea the follow day. our weather for this weekend is, well, just about perfect. we've got a few low clouds here you can see. a little bit of patchy fog hanging out there over the coast. this is going to dissipate quickly. it is out there, especially along the coast line. most of us visiting with cloudy skies. 42 degrees right now, napa.

and she is awaiting word on her family at a nearby hospital. new zealand says that oil has stopped leaking from a ship. most of the fuel still remains in the ship. now, crews are scramble to remove it. a few sea birds have been found dead. there is still no word on exactly how much fuel spilled into the water. the department of wildlife and fisheries is dale another blow to the oyster industry. more testing is needed to make sure that the seafood is safe for people to eat. oiser fishingermen in louisiana say they understand the concern but since it happened, the oil spill has delivered a severe blow to their livelihood. >> i'm probably about 50% right now less than what i usually make in a year. >> once the at the timing is complete, louisiana officials have come up with a way to let

police told them it was time to go. good morning, everyone. welcome back to mornings on 2. i'm mike mibach. the time is coming up on 8:00. right now, those protesters remain camped out near some city hall. ktvu allie rasmus is there on why police are threatening to issue citations. >> reporter: protesters call themselves occupy san jose. they are taking part in one of dozens of protests like this across the country, condemning what they say is greed a and corruption on wall street. these tents have been here since sunday, so almost a full week. city leaders say they are not allowed to camp and set up these five tents here. the city says that's a violation of city laws. and 11:00 was supposed to be the deadline to take down the tents but the tents and

protesters are still here standing their ground. police did not come by last night. doug joins us with the group occupy san jose you have been here for at least a few days. you spent the night in this tent right here. >> yes, i did? what were you expecting last night. >> we were told that the police would be coming at about 12 or 11:30 and, at that time, they would be telling us we need to leave. but, you know, obviously we are still here and they did not show up for the evening. >> how did you all decide that you were going to stay here despite the threat of arrest and citation. >> we did have a general meeting out here yesterday evening. at that time, it was decide that had those people who were willing to and made the conscious choice to stay out here would stay. and, you know, knowing that there was a good chance of eier citation or arrest. and those people who wanted to made that decision at that time >> reporter: the city says that their ordinances are clear that, first of all, you can't camp on city hall plaza but if you want to conjugate, you need

to pay -- congregate, you had to pay for a permit. >> we were working on a precedent. there have been protest in the area who were not asked to pay for a permit. there was the protest which happened a couple of years back dealing with the -- dealing with the little saigon business district or naming controversy and they were not requested to get a permit. they were allowed to stay for well over a month. there have been in addition some other groups in the past which stayed out here and have not been required to do so. we are looking at precedent and they would be applying their laws ununiformly in doing so. >> reporter: in your mind, this is selective enforcement, telling you guys to leave when the city has not told other activists to leave in the past? >> yes, we see it that way.

>> reporter: doug jones with okay pay san jose. he has been here several days. he spnt the night last night and has been here since sunday. protesters plan to stay here indefinitely until they are cited or arrested by police. allie rasmus, ktvu channel 2 news parents in sunny vale are now demanding to know why city schoolwill reop thursday morning while a killer remains at large. on wednesday, schools were shut down while a manhunt was conducted for shareef all mapp, the man who police say had killed three coworkers. police advised the santa clara school district it was safe to reopen the schools. later that mornings allman was shot and killed outside of a home in a neighborhood where police had been searching.

we are now hearing from one of the men who was shot. michael ambrosio said that he was one of the luck yu ones will allman walked into a meeting, left and returned with an assault and rifle and assault weapon. that's when he opened fire on everyone. i was bleeding. i was worried about my brain. i kept on praying inside. >> ambrosio said he played dead hoping it would save his life. by the time allman stopped shooting and fled the scene, three people had sufort gunshots and six, including ambrosio was injured. he says he always will be haunted by what happened and what he could have done differently. >> and we are hearing from dispatchers as they learned about the shooting at the car why. >> the scene is not secure.

>> dispatchers can also be heard warning the first responders that the suspect is armed with multiple weapons and dangerous. they are being credit for remaining calm and providing important information to fire and police during that tense situation. you can hear that recording and the entire interview with the one victim who was shot. go to ktvu.com and look for the quarry shooting tab. >> parents are protesting the proposed closure of oakland's maxwell park elementary school. it is one of five schools that may close at the en of the year. a final vote by the oakland school board is scheduled in about two and a half weeks. parents say they plan to hold the protests at 2:00 this afternoon the federal government is ordering four bay area medical marijuana clubs to shut down within the next 45 days. the federal government says that medi-thrive anders are too close to schools and

playground. the precip pal at nearby marshall elementary school called the agency a good neighbor. >> i think the federal government has a lot other problems. my parent and my community were against it. we had issues. i feel much more strongly about it. >> the crackdown harass been announced by the department of justice. attorneys say that too many clubs are abusing the medical marijuana system and too focused on making money a san jose police officer is out of the hospital after struggling with a man who took the officer's gun. this is a booking photo of the suspect, 27-year-old jason evans who remains at valley medical center. evans wrestled the officer's gun away during a scuffle yesterday morning. police say that evans pointed the gun at officers prompting them to fire. evans was not hit but the officer whose gun was taken chased evans down with his patrol car and hit him bringing the incident to an end

yowsef bay ii will spend the rest of his life if prison. yesterday, prosecutors decided to stop torture and kidnapping to spare the witnesses from testifying and transfer bay to jail. it is expected he will serve his term at pelican day or even a prison at arizona and mississippi where california contracts out some of it prisoners. an end undercovering officer was pulled over. he was cited for impersonating an officer and arrested on and unrelated warrant. the man was only trying to ask the undercover officer a question, he says. >> catalytic converter thieves are at work again in petaluma.

police say that converters were stolen off three cars yesterday. there was a similar string of thefts back in april when thieves stole 20 converters. police have arrested two people in those cases many the exhaust devices can be resold for 40 to $200 and can cost as much as $2000 to repair. walnut creek is offering up free parking on four additional holidays but some say that's not enough to ease the frustration over parking problems. drivers will now be able to park for free and martin luther king day, president's day, columbus and veterans day. the additional holidays are part of an several bycouncil members a more parking friendly lace. >> we're going to make it easier for people to park in our parking garages, create flexible policies, create easier ways to pay. >> business openers say that the will be of parking is bad

>> very sad for the family. my thought are with mrs. davis and son mark, first of all, and all the rest of the family. pretty shocked, you know. al davis was quite a guy in my life and in the lives of hundreds of people that worked for him and played for him and thousands of people around the league. i -- you know, i realize he has been sick for a long, long time. he fought a good fight as you would expect of al. but, still, you hate to lose someone who has been that significant in your life. and that significant in the world of sports in particular football. >> that suggest in your life, raymond. why? >> well, impact. you know, from the time i was 22 years old, al davis has been in my life. and, you know, there has been all kinds of events.

he has been there and aware of pretty much all the things that have happened and that's the unique thing about al davis. i would dare say that al has had involvement, the right involvement, intimate involvement in almost every player that ever played for him's life. he is the kind of guy that knew the names of your children, your family. he knew events that would happen and he had an incredible memory for remembering these things. and bringing these things up in the middle of some very, you know, odd conversations. we could be talking about contract or sports or it could be 20 years after you play for him and he still would bring up a name or an event or something that happened to you in college. he had an incredible memory. and he was incredibly loyal to those folks that he considered

dave. he was that eye conditionic. he was that associated with the raiders. and usually, you don't think of an owner's name when you think of a team. he was that iconic. the thing that people might not remember about him as he was so instrumental in the merger, if you remember back in the days when the a f l and nfl were putting. and al was a mavericks owner of the raiders and the guy who really encouraged the other afl owners to go out and sign big- name flares plause they thought that was the way to force the nfl owners to recognize them. that action was what forced pete rozelle and the nfl, a more established league to bring the a f l in and create this most professional sport league which exists today which

is the nfl as we know now. there was nobody more iconic in the sport or more associated with the team, i think, than al davis. >> why was he so iconic? why was his name so attached to the organization whereas other owners not so much? >> he did things his way, no question about that. at a time -- i think we remember him now as what he became in the last decade or so but when he was a young and vibrant man, number 1, he was a football guy. he was a former coach. he was the one time commissioner of the a f l. and he had a way, if you remember those kinds of so-called wash buckling raiders team of the 60s and 70s when they were as dynamic as anybody in football. he is the guy who bucked the system, did it his way and won.

one of his most famous slogan, just win, baby. he had guys that may be rejects from other teams, maybe the other teams didn't like the way that the guys practiced or groomed their hair. and al said, if you can play, we like you. he was able to create winning teams that way. you think some of those guys like ted hendrickson, kenny stabler, lyle alzado. he made them fit in oakland. >> this is week 5. what do you think this means to this organization after a great start? what do you think happens? >> well, i'm sure that the raiders have seen this coming. hugh jackson said that he enjoyed his football class with al davis because, again, he is a unique open another that he was a former coach. he is a football guy. he is not a guy who made miss fortune somewhere else and

decided to buy a football team. he came up through the ranks. hugh jackson said even this year, he enjoyed talking football with al davis but again, just as well, i'm sure that the team saw this coming. the raiders are not an organization that talk publicly about the way there are' going to succeed or go on after sal's passing but i'm sure they have had a plan in place for some time. amy trask undoubtedly has been running the team for some time and she is a very, very capable executive. i'm not sure that they're going to miss him as a team except for that presence. >> joe fonzi, thank you very much. we'll see you a little bit late they are weekend. thank you moving on. a group of protesters are

camped out in san jose despite the threat of arrest. they are part of a movement called occupy wall street. the group held what they called a general assembly. then a group of about 30 people decided to leave their tents up, ignoring a law against camping out near city hall. >> what this is about is being visible, going out there and into the public occupying and getting more support and growing as a movement and letting us known. they say that the threat of arrest is on constitutional. >> the group occupy sacramento has occupied cesar chavez. one person has been arrested there. police say their resources are being stretched thin. they are hoping people heading to the cars over the weekend don't make the situation worse. on thursday, police arrested 20 people who had attempted to protest through the night.

they say it's against the law to camp overnight in the park. dramatic video of a small plane making an emergency landing off the hawaiian coast. 65-year-old pilot took off from monterey early yesterday morning and noticed theastles running out of fuel about 500 miles off the coast of hilo. he radioed the coast guard for help. they sent a plane to fly alongside him and sent a cutter to the area where they went down. he flashed down about 13 miles off the coast. a rescue swalier helped hoist the pilot into the helicopter. he was taken to the hospital with minor injure his a drive-by shooting outside of a liquor store injured one person. a car with an unknown number of people opened fire on the store at 90th avenue near olive street. one person was transported to the hospital. two people checked themselves into the hospital later on.

welcome back to mornings on 2. we are following the passing of al davis just about and hour ago. it's not clear at this point when or where davis died. the raiders say they will be releasing a statement later on this morning. former raider tight end raymond chester is joining us again on the phone. thanks again for joining us. first of all, your thoughts about this tremendous loss for the raiders? >> well, it's a tremendous loss for the raiders, obviously but a tremendous loss for the entirety of the sports world, particularly the nfl. you know, mr. davis was a pioneer. he was certainly iconic.

he was instrumental in obviously the merger of the leagues, developing the oakland raiders into a world recognizable name and franchise. he is a great family man. he really was. he was as loyal and dedicated to his family, personal family as he was to the raiders. you know, there is a lot of great things to say about mr. davis. unfortunately, what you heard about was a lot of controversial things related to his life and work but his body of work speaks for itself and the number of tremendous individuals that came through the raiders organization were developed as athletes. and his i am pack is so unlimited. there are so many lives that he touched. he did so many things for so

many people that will go unrecognized except in the hearts and lives of those people. he was not one to make a big deal about things that he did, of a charitable nature, but i can assure you that there were many, many, many differences that he made on behalf of people and in their support. >> raymond, each watching this video receipt now of al davis hoisting the super bowl trophy. i know the raiders drafted you back in the 1970 in the first round. had you a chance to play for a super bowl-winning team for the raiders. take us inside the locker room that day and talk about the joy in al's voice and face? >> i tell you what, you are talking about a guy who lived to win. for him, there was only one way, you know to, do it and that was to win. if you didn't win, he was unhappy. you know, contrarily, if we did

win, he was exciting. he was jubilant. he was the first one that wants to go and talk to each player and coach and congratulate them personally. you know, i will say this about him. he actually accepted the responsibility for any short comings that we had as a franchise. he carried a heavy burden for that. he says that when you win, you know, you get all the credits. but i can say that mr. davis absorbed a lot of arrows. he had that tremendous capacity to carry that load. he was truly the great man, no doubt about it. i don't care if you were a friend or a foe. no one can deny that he was truly an iconic and great man. >> how do you think the

organization responds? >> well, you know, i think -- someone asked me that question, was there a plan? the organization will respond with grief. we lost a few significant people in our organization, none of the magnitude of mr. davis. but we'll respond the same way we responded over the years when things happened that were not good, we got down, we bounce back. i think the organization will absolutely use this as a motivator to bring the franchise back to the top of the heap. i think the family, mrs. davis and mark davis certainly have a plan. i expect nothing -- nothing less than the best effort out of all of our players, staff, coaches and everyone in the organization. >> we are lg sees some pictures of him, not just early on but

also more recently where he was a little more frail. our joe fonzi mentioned that he had been having health problems for a while. that's a testament for him that he was there really to the end and really a presence there and such a strong presence. >> it's interesting because, you know, mr. davis, you know, kind of walked this talk. he expected us to play, you know, play through injuries. he expected us to be totally dedicated to the team and to the goals that we were trying to accomplish at that time. he certainly manifested his toughness in the way that he hounded his own personal illness. no secret that mr. davis has been ill for quite a while. you would never know him if you talked about business or football or some of the other things that he was concerned about. he walked his talk.

he was tough to the very end. he handlinged his illness with dignity with pride and with pause. >> before we let you go for those you just tuning in, former tight end with the oakland, former. if you walked to him in person or -- did you talk to him whether in person or on the phone if. >> i did talk to him. it was customary for mr. davis to do that himself. he welcomed me to the franchise and told me -- he surprised the heck out of me because he told me some things that he personally knew about my college career. it was a big football school. i didn't expect for the owner of a franchise of a

good morning to you. giving you a live look in sunny san jose this morning. a nice, pleasant afternoon in store. >> we continue follow the death of raiders owner al davis this morning. the team made the announce. on its website this morning with the mess am, al davis 1929 to october 8, 2011. nothing else is said except that the team will issue a statement later today. it is not clear where or what time he dade. 82-year-old davis owned the raiders for 48 years. he first started with the team back in 1963 as head coach and general manager he was considered the head coach behind the memberrer of the afl and nfl. he leaves the raiders with 28

winning seasons friday marked the anniversary of the war in afghanistan. theal want has been forced out. the u.s. and allies have worked to pro right new road and new schools. violence has increased in the country. more than 2700 coalition troops have died in the war in the past ten years. >> i think people feel that the situation is very uncertain. there may be a bit of progress today but what about tomorrow? >> we are doing a good job. we are here to help win over their hearts and mind and help the government out here. >> u.s. forces began handing over security responsibility to afghans this past summer in preparation for the schedule withdrawal of u.s. troops in 2014. >> the 10th anniversary of the war in afghanistan led to a protest in san francisco and demands that u.s. troops come home. >> dozens of people attended the protest yesterday at the new federal building at 2nd and mission. news chopper 2 caught

demonstrators marching down market street. those demonstrators staged a die-in to simbolize people killed in the war. and in new jersey, a church create add field of flags to mark the 10th anniversary of the conflict. 278 flags represented every american killed in afs and in the war of iraq. a dedication will take place today. country band sugar land will perform a free concert in indianapolis. this comes two months after a deadly stage collapse before the performance at the indiana state fair. the concert will be the final show. a strong gust of wind blue the stage over in august. five fans, a securedy guard and a stage hand died from their injuries. donations to a fund for the victims will be collected during the show. the king of pop la be

as we have been telling you this morning, long-time raiders owner al davis has died. ktvu's fred inglis has more on his life >> reporter: mr. al days was born july 4th, 1929. he was raised in brooklyn, new york, but he turned oakland, california, into his own nation. the raider nation. davis was just 33 years old when he joined the organization in 1963 as head coach and general manager. >> well, he was a very demanding man. he turned our organization into a professional football team. he turned the american football league into a real first-class football league. >> i want to win. that's my life. i've always won. i always will win. >> very tough, physical,

intimidating good football teams. i think that that's his legacy of being able to build that a little bit of a rein gait, a little pit of an outlaw, a little bit of, you know, i'll do it my way whether you like it or not. >> out of all the owners that i played with in professional sports, he has to be the nicest, most kindest, caring boss i've ever had. >> he also hired young unknown coaches like john madn who was just 32 years old when he became the raiders' head coach in 1969. davis also hired art shell, the first black coach of the modern nfl era and tom flores, the first latino head coach in nfl history. >> i'm not sure that any other organization has done as much for the revival of opportunities for minorities. >> in 1992, al days was
