a deadly shooting by police on a usually busy south bay street. that's our top story today at noon. good afternoon. i'm in for tori campbell. san jose shot and killed a pedestrian this morning after getting 9/11 calls that the man was walking around with a gun. police rerouted traffic around the 700 block of hillsdale avenue at highway 87. we're live in san jose where police have recovered the man's

weapon. janine? >> reporter: ja that, police -- jana, police have cleared the scene. they are trying to figure out what happened. now, the body shot by police was lying right on the sidewalk here. it was taken by the coroner's office earlier this morning. police received a call around 5:30 this morning that shots were fired on hillsdale. but when they arrived, they found nothing. a half-hour later people called back saying there was a man with a gun walking in the area. officers came back and said that man made a threatening move with a gun and one of the officers then shot the man. this all happened in the central county occupational center, a vocational school. a teacher witnessed what happened after the shots were fired. >> i saw a person laying on the sidewalk. they were on their back fighting, like they were trying to -- like waking up from sleep and not realizing what's going on and then collapsed. >> reporter: the man died at the scene. police are not releasing his

identity, but they have recovered the gun that he had in his possession. at this point, they are not sure if that man had fired shots back at officers. witnesses say the man appeared to be young between 25 and 30, and he was only wearing boxer shorts. officers searched the area to see if anyone else was involved. three of the officers are on paid leave. back out here live, classes were cancelled today. the teacher and staff were relieved that they were not here at 7:30 this morning when the shots were fired. that's when class starts. back to you. >> thank you. this is the fourth officer- involved shooting in the south bay in less than a week. this past saturday, a deputy fired at a suspected car thief on park avenue. the 37-year-old suspect was not hit. he was found later hiding in a

fire trading center. on friday, a 27-year-old suspect wrestled a gun away from a san jose police officer. other there's -- other officers shot at him. he was not hit. and last thursday, deputies shot and killed triple-murder suspect shareef allmann. police received a call from the nation's hamburgers on washington avenue that a man was acting paranoid and scaring customers. police say that after -- police say that after officer tased the man, he began to have health problems. he was taken to the hospital and died. so far, the cause of death has not been determined. a weekend shooting has turned into a double homicide investigation. police still don't have any suspects behind bars. the 19-year-old man and 20-year- old woman were shot in their home on south third street.

it happened around 11:00 saturday morning. the man died at the scene. the woman died last night from her injuries. police have not released the victims' names but they say they attended san jose state university. police say they hope witnesses will help them make an arrest. a man found dead near st. mary's cathedral appears to have taken his own life. police say a pauser -- passerby discovered the poddy on geary this morning. investigators are baiting for the medical examiner's office to conclude their investigation and determine the cause of death. police say the man does not appear to be homeless but thief not established his identity. it will soon be illegal to carry a gun. the open ban carries -- starts january 1st. it's punishable by up to one year in jail and a $1,000 fine. this morning, law enforcement officials are cheering the

decision but open carry advocates say they are prepared to take this to court. governor brown also improved limits on police action at dui checkpoints. if a sober driver is caught without a license, police will be required to release the car to a qualified driver representing the car's owner. a new ban on teen tanning is set to take effect. it will make california the toughest state with the -- the first state with the toughest regulations. tara moriarty has more. >> reporter: well, the new law bans kids 17 and under from using the tanning beds. but the owner of this salon does not allow them in here anyway so she's not concerned. she says state regulators have been tracking down on tanning bed use since the 1980s. we've had problems in the tanning industry from tan hopping. they will go from one salon to

the other and there's no way for us to regulate that. >> reporter: so a new law signed by jerry brown banning minors from tanning beds is no surprise. >> kids will be kids. i think intervention is fine. >> reporter: kids have been able to fake bake if their parents say it's okay but come with this new law, you have be tole 18. >> you have to be 18 to vote. you have to be 18 to tan. >> i grew up in washington state where we didn't see a lot of sun. i would go to the tanning salons, but if i could go back, i wouldn't do it. >> reporter: researchers say those who use tanning beds before they are 20 have a greater chance of developing me lin know ma -- melanoma.

do you think there's pressure to look tan -- >> absolutely. absolutely. >> reporter: now, if salons violate these new laws, san francisco police tell us that the public health department is gonna be the one enforcing the law and handing out some big fines. live in san francisco, i'm tara moriarty, ktvu channel 2 news. >> thank you. another bill signed will require insurance companies to cover certain autism therapies. also alcohol sales at automated checkout centers will be banned. and the governor vetoed a bills that would require the large stores like walmart. and those you can be a minor to get std vac nation without paren tal consent.

prom's jobs plan is -- this weekend administration official said this tax would raise about $450 billion. some influential republicans are saying not so fast. >> i think doubling down on failed stimulus policies is the right way to go. >> if the jobs bill passes, the administration is planning to use the money to extend unemployment benefits, cut payroll taxes and pay for infrastructure projects. the occupied protests spreading across the country are continuing right here in the bay area. activists taking part in "occupy by san francisco" are still camped out at market. they are trying to call attention to economic injustice. we're told more people are joining their movement and supporters are offering donations for those camping out

christians in egypt are blasting the government today for a -- for allowing repeated attacks on their fellow parishioners. more than two dozen people have died and others have been injured since last night. the group of christians were staging a sit-in outside a television station in cairo, egypt. an army ranger from salinas has been kaled -- has been killed in afghanistan. ricardo serras, junior was killed saturday in afghanistan. insurgents attacked his unit using small arms fire.

he was 24 years old. if you received a red light camera ticket in napa earlier this year, you may not have to pay it. more than 500 red light camera tickets from last spring and early summer have been dismissed. a superior court judge confirmed and earlier ruling that the city's old contract with the camera provider violated state law. as a result, the court wiped over $250,000 in pending fines out. they've signed a contract with a different provider in august. tickets issued since then p must be paid. netflix announced it's dropping plans to separate the dvd rental business from the online streaming businesses. the company said last month they were gonna break off the dvd side of the business and put it on a separate site called quickster. that made some customers angry. today's message means they will be able to keep one password. >> they shouldn't have

separated it. keep it in one system. >> i think it makes sense, if a company decides they've made a mistake, they listen to their customers and make it right. >> the ceo has apologized for this. the stock is rebounding slightly with today's announcement. apple said it's getting a record number of preorders for the iphone 4s. the new phone is set for release on friday. so far, apple has had 1 million requests. that tops the previous one-day record. this makes this phone the most successful product ever for apple. customers can preorder online but it won't ship for one to two weeks. you can wait on friday -- wait in line on friday when the applelies store shelves -- when the phones hit the store

him use some of the land to grow the pumpkin. >> they let me use the land after work. that's what i do. i do pumpkins. that's what i do. >> reporter: at 1,704 pounds, not only was this pump -- pumpkin the winner at this festival, it's the second largeert pumpkin weighed in the -- largest pumpkin weighed in the world. it's not all about the weight. at the weigh-in, there were prizes for the most beautiful color and the biggest pumpkin drone on the coast. we like to -- grown on the coast. >> we would like to keep that going. >> reporter: this man packed up his pumpkin today. >> it's a little bit emotional because it's been four baby for a few months. >> reporter: at 755 pounds, he won the prize for biggest coastal pumpkin. all will be on display ready to pose for plenty of pictures.

allie rasmus, ktvu channel 2 news. well, fleet week is coming to a close. several military ships are open for tours today before they leave the bay area tomorrow. san francisco's naval celebration over the weekend drew tense of thousands of people -- drew tens of thousands of people to the waterfront. of the course, the big draw was the blue angels. people lined the embarcadero and climbed on rooftops to see the performance. yesterday's show was cancelled because of fock. >> speaking of fog -- because of fog. speaking of fog, we have some around the bay and it's a steady drizzle for some. yet towards the south bay, you can have some cloudy conditions and very mild muggy-like conditions. there is a lot of moisture in the air. cloudy skies today, mild, tropical feel for some, but a steady rain, especially up the russian river.

drizzle for many. we'll carry that in to tomorrow morning, and then clear it out. wednesday, thursday, machine. should see some mid- to upper 80s. today is -- the air mass is just saturated. the system is drags across. a little bit of a south wind as well. the live stormtracker2 shows there is a little bit there. most of it is falling below the radar beam. you can see the moisture. i will get out of the way so you can see it. there is a lot there. there is a bag edge. a lot of this should start to thin out. i don't think we'll lose all of the cloud cover. if we had more sun, it would be in the mid- to upper 70s. because of the cloud cover, 60s, 70s. san jose, 70. very muggy, humid conditions. santa rosa sitting at 63 degrees. the system will continue to march off towards the east and south, producing some very light rain or drizzle into tonight and i think tomorrow morning we'll have to deal with clouds. but all systems go for sunshine and warmer weather after tuesday morning as this system

builds in. there's some pretty good rain starting to come into the north. so cloudy to mostly cloudy. rain has developed for some. it's mainly drizzle. there is a lot of fog out there. temperatures, 60s and 70s. any breaks in those clouds and temperatures would be warmer. your forecast, rain to the north, drizzle elsewhere. take it into tuesday and wednesday, thursday, friday, we wart to -- we start to warm it up but then it looks like we'll cloud it up and maybe some more rain by sunday morning. >> right in time for the weekend. >> i'll see what i can do. >> work your magic. >> you bet. >> thanks. >> you bet. the legacy of al davis is expected to be highlighted when hue jackson holds his weekly news conference.
