outside the city hall and you can see still a crush of people including reporters and camera men. its been a strange day here, a bomb shell dropped here, the chief saying he is retiring from opd and stood there along with the mayor and city administrator, the chief made that announcement after just two years at the helm here in oakland. while saying he is leaving he listed his accomplishments including improved community policing, lowered violent crime and trying to bring the city into compliance with the negotiated settlement agreement that was brought on by the riders case a number of years ago. he feels he has accomplished quite a bit but said in the end he -- without naming names, he was careful not to name any names, say any one person responsible for him wanting to leave but said there is to much frustration in his job because he didn't have enough control. >> the reality is nobody wants to be in charge of something

and take responsibility without having the ability to do all the things themselves. this just come was the territory. >> i do think that things weren't what he thought it would be. i appreciate the fact he has other opportunities if he has made the decision. >> i think he is frustrated and has a right to be. so, you know we are where we are. he is resigning, howard jordon will be the -- the interim police chief. >> reporter: now, according to larry reed who is the president of the city council you just heard from he said the chief told him that he would be leaving some time next month and as you heard the mayor say howard jordon the assistant chief who was interim chief before -- after chief tucker, he will be stepping into take over in the interim until they find another chief who could be

the family. >> reporter: tonight he is being treated in a rehab center as he continues to recover. the 42-year-old paramedic and father of two was severely beaten outside dodger sad am offer the season opener last march. two men are charged. in may he was taken from los angeles county hospital to san francisco general. >> brian came here, he was in a com atose state and when he left he was beginning to speak and is starting to eat as well and making dramatic progress. >> reporter: he said he will be monitored for blood clots but his medications have been reduced and he is able to leave his hospital bed as his recovery continues. >> i think that while he had a rockier course than most over the last five months, i think he is starting to meet milestones and only time will

tell. >> reporter: again another look at him leaving san francisco general hospital this morning. officials wouldn't say where he has gone for rehab. they say they want to give him and his family time to adjust to his new home. reporting live. david stevenson. >> a carjacking, a crash, a kidnapping, and a teen in custody. fremont police say two teens stole a man's suv at gun point this morning. the man's 13-year-old son remained in the stolen car. it was later spotted by officers. there was a brief chase before this happened. the suv crashed into a pole. the 16-year-old driver and the 13-year-old victim suffered moderate injuries. the driver is facing a list of charges. the third teen wasn't found. >> the united states has kiss interrupt aid terrorist plot to kill a foreign diplomat on american soil and the attorney general said the iranian government had a hand in the scheme. >> plan alleges that it was

thought of, sponsored and was directed from iran and is a violation of united states and international law. >> reporter: two people are accused of conspiring the military to assassinate the saudi ambassador to the united states. one suspect was arrested last month in new york. the others still on the run. united states officials say they considered blowing up a restaurant the ambassador frequented. they also said it involved a drug inform isn't posing as a member of a drug cartel. >> reads like a script, the impact would have been very real and many lives would have been lost. >> a spokesman for the president of iran called the property a fabrication. the state department said the united states will most likely discuss the role in the plot with the security council and the treasurey department plans

customers famous waynes shoe shine were watching protesters campnd out. some dismissed the movement. >> the same people that demonstrate, everything else in san francisco just for the heck of it. >> reporter: christine disagrees, she is spending her day off to make a statement. >> are you going to sleep here? >> no. i'm very middle class. >> reporter: some who had to work were grateful to see people taking a stand. >> i think it's good that somebody is getting out and doing something about all the crap in the government. >> reporter: the people camped out here in front of oakland city hall have city officials blessings and say they are allowed to stay here as long as their demonstration remains peaceful. ktvu channel 2news. a group of san francisco demonstrators held a rally today demanding the release of a fellow protester. the attorney for a man known as purple tells us the man was arrested on charges including assault on a officer and

assault with a deadly weapon. protesters say he was waving sage during a demonstration and was just at the wrong place at the wrong time. the protest seems to be growing by the day. tomorrow more protests are planned for walnut creek, san rafael and palo alto. san francisco police are cracking down on protester who took over two abandoned buildings. come up around 4:15 the group behind the movement and why their message extending beyond the bay area. >> new york city a large group of protesters took their demonstrations to midtown manhattan for a millionaire's march. they marched past the cities of the rich eve residents wanting to bring attention to the fact that the wealthy will pay less in december when a tax expires. >> it's like a small village, like a small working community

not bombs who took over bombs. theyso far police say they haven't found anyone inside the 400 room hotel. >> new jersey governor endorsed mitt romney for the republican presidential nomination. he made the announcement with romney by his side at a new hampshire campaign event. he called christy a hero because of his record of cutting government spending in new jersey. you may remember last week christy rejected calls to make a run for the white house. michelle bacchman released her economic plan. she called for tax incentives to encourage companies to invest in the united states and would cut worker salaries for government workers, would repeal the health reform law.

now tonight eight candidates for president are taking part in the 7th debate of the race. this debate will focus on the economy. its being held in an over new hampshire. >> in san francisco the polls were open today as candidates and voters took advantage of the early voting. >> this is the first day we get to vote. the privilege. >> reporter: the mayor rallied supporters outside the elections office where early voting started in san francisco's 2011 election. the mayor candidates, cast their ballots today. a number of regular citizens also decided to try to beat the rush. >> for the african american community it's very important to make sure that we vote. i want wanted to be one of the first ones. >> san francisco may register to vote from now until october 24th. >> a los angeles meat company is recalling hundreds of thousands of pounds of ground

beef. federal inspectors found e-coli in some products the commercial meat company. the recall covers 3 75,000 pounds of ground beef produced between september 7th and october 6th and shipped to restaurants in california. nobody has reported getting sick. >> the wet weather that rolled through the bay area may have been a nuisance for many but for those who tend vineyards it can be a killer at this time of year. ken pritchett is in saint hele in, a. >> reporter: can you see where the leaves have been pruned? that's so the grapes are exposed to the sun that we have right now and the slight breeze to help them dry. it was done because of the rain. these grapes look fine. no rot, damage caused by that rain but there has been damage reported elsewhere. these grapes were rush from the vine to the hopper before to much damage could set in.

you could see the water damage. >> when we saw the rains a week or so ago we thought all right, we can get through this. >> reporter: but the president of the winery said that second storm made it worse. >> we have now made the decision to pick a couple varieties that we would have probably liked to have waits a few more day he is. are. >> reporter: those varieties more at risk for rot. some growers fired up giant fans to dry off the grapes to keep rot at bay. >> with all the rain and cold weather its pushing back harvest. we are running in to problem was mold, some varieties are getting bunch rot. >> reporter: michael what barber vineyards said they should have been harvested a month ago. >> we will try to ride it out until we get the flavors and that -- the sugars where we want them. >> reporter: rain and rot are the latest challenges to this vintage, a cooler summer

reduced yield with some vineyards down 60%. >> quality wise, i think it'll make a killer wine, we will just have a lot less. >> reporter: growers can spray the grapes if mold sets in to help control that rot. the question is how much damage was done. every vineyard is different so it's a hard question to answer. we probably won't know that until the harvest is in. napa ken pritchett. >> we see the sun is out and pretty much the day shaped up like you said. >> it started off with a few clouds, drizzle, then the sun came out and it's beautiful. actually throughout much of the day. when you get down to the avenue, the golden gate bridge, the tracker picking out the fog. there is the live camera and i asked the director to put this up. we are talking about a warming trend. remember what i said, i don't know -- if you watch every day, i hope you do. the idea is that north tower of

that golden gate bridge, 740 feet if you see what the fog is doing, it's pinching down. when it does that, high pressure is building in. you can -- you don't need me to look at that and say it's warming up. the tonight we see the fog pinch down and as we go through the next couple days the fog is going away as the winds start to go off shore. overnight lows in the 50s. patchy coastal fog, dense in spots, along the coast but then fades away into the distant memory. tomorrow sunny and warm. the extended forecast, sunny and warm. the weekend will cool off but you won't get shut down. a light off shore -- off shore flow is setting up, typically i would say fire danger, big deal. this is the time of year, oakland -- october, the winds are going off shore. they aren't that strong. temperatures go up, communities go down but we have rain, it's wet, moist, we saw the story in the north bay.

the forecast for the next few days, with limited fire danger, fortunately which is not often i can say that in early october is going to be for very warm weather that you can enjoy with great air quality, 83 in fairfield. 80 vallejo, 83 in walnut creek. a really nice day and again thinking back we have had a lot of year was early rain like this. i can't remember a year with rain -- we have had rain but must just the moist pattern is really giving us the fire season that i can't remember in 25 years where we had a season so mellow in northern california. the five-day forecast with the weekend in view, you notice the temperatures cool off a little bit for the bay area weekend but you -- basically the temperatures warmer the next few days. >> thank you. it's a sign of progress, check it out. what the placement of this box in memorial stadium means for cal football fans.
