baseball players accused of gang raping a 17-year-old girl in 2007. >> reporter: here at the da's office this admonish morning was obvious the da was ready to defend his decision. we got this long list of evidence before he made the announcement. >> reporter: the county da said it ok three months of research to decide if there would be any criminal charges charges in the case. it focused on evidence after a house party about four years ago when college baseball player was accused of gang rapes a 17-year-old named jessica. they said it was cons, nual. >> we can't prove a crime happened and will not file charges. >> reporter: the decision is the same one made by his predecessor and then state attorney general jerry brown.

two players targeted in a civil lawsuit were found not liable for damages causing jessica to break-in to tears, despite the investigation the bottom line remained, she could not remember what happened. >> even if there was a crime is it the right thing to do? in this case because we didn't know what, what or when things happened, in that room it was very difficult to go forward. >> reporter: in a statement jessica said she was disappointed in the justice system and said i didn't hide, i told my story and i am not embarrassed. i did all i could to help the truth come out and now i will move on. an attorney for one player said by phone the correct legal decision was made. >> we don't think the conduct was acceptable but every kind of unacceptable conduct isn't necessarily criminal. . >> reporter: the attorney said he is relieved to see the case ended but said everybody suffered regardless of whether charges were filed or not.

billion dollar federal loan guarantee. coming up at 5:20 what lawmakers say the energy department specifically did wrong. >> today federal appeals court blocked parts of alabama's new immigration law described by some as the toughest in the nation. the ruling preventing them from enforcing or requiring schooling to check student immigration status. it also blocks a requirement for immigrants to carry documents proving their legal status. the ruling temporary but weakened a law that's frightened many. >> we are all scared because young kids are scared because she always say i don't want nobody to take my momma way. >> still in effect a provision letting authorities detain immigrants they suspect are illegal. a final decision is still months away to allow time for more arguments. >> crews repairing a broken gas pipe near a daycare center. it happened on apple berry. authorities say a contractor

marchers going going around the streets of oakland city hall and through the downtown. it appears now that the marchers are essentially back where they started right in front of city hall. this group is part of the occupy wall street movement and you can see dozens of tent that have been set up. the first protesters is a lived at city hall this past monday. its been five-days, we showed you their marching was the first time it has gone mobile but it appears now it has landed right back where it started at oakland city hall. >> howard jordon completed his first day as the interim police chief. at least for this time around. he temporarily held the job before. yesterday he took the another to fill in for the previous chief who announced he would step down earlier this week. he has been a police officer for 23 years. >> the decision to step down leaves many wonder figure the city is back to square one in its struggle against violent crime. we are live in oakland where some are pointing to the

mayor's chilly relationship with the chief as one factor for his leaving. >> reporter: here in city hall the mayor was unavailable for comment today but in this week the mayor remains a hot topic of conversation. the mayor was quick to replace the chief who stepped down on tuesday. his retirement upset the city council. >> the frustration is really justified. we have a serious crime problem and there was nobody speaking out about what to do about it. we need to get a vision and we need to support the police chief. that's something that was not happening. >> reporter: they applaud the mayor on certain issues like the economy but not on crime fighting. . >> i want to see her lead but -- on the crime issue but i want her to listen to the law enforcement professionals. . >> reporter: the spokeswoman said she has done more for public safety than eye other

opening fire. eight were killed and one was wounded. today prosecutors called him a merciless killer. >> for almost two minutes he shot victim after victim, executing people by shooting them in the head and chest. >> reporter: he is charged with eight counts of murder and one count of attempted murder. a 73-year-old woman was the only person to survive. >> a prosecutor today is -- accused attorneys of putting on a changing defense. the remarks in a hearing without the jury present. the defense dropped its idea that jackson gave himself the injection. now they say he injected himself with it. the defense said showing the juror a photograph of his children at his funeral would be prejudicial. the judge decided to allow the images >> a drop in canteloupe sale

. the government responsibility office said air traffic controllers reporting more mistakes than they used to. the number of reported errors more than doubled over the past three years and many of them involved controllers directing

. fire crews preformed a daring rescue pulling two women out of a burning home. it happened in concord. we have details on how the firefighters got the two victims to safety. >> reporter: this is what firefighters saw when they ran in to the burning home at 1:30 this morning. it's dark with smoke so thick you can barely see. >> i are -- let's go. >> you can hear the people screaming, i have been a firefighter for 13 years and this is my first live rescue of two people. >> reporter: just 90 seconds litter the roof would have collapsed. the two woman couldn't have been rescued then.

>> it was intense but we are just a couple guys who work for a whole department of guy who are able to do what we did. >> reporter: this is the helmet, it was a camera and that's how firefighters were able to capture the daring rescue on tape. nick is able to walk one of the victims out the front door, a 79-year-old care taker, it's her first night in the home. chris is wearing the helmet camera, seconds behind. you can't see but is he carrying an 89-year-old woman. that woman had just gotten out of a rehab facility and couldn't walk. they were taken to the hospital to be treated for smoke inhalation but are expected to be okay. >> concord pd was on scene and they couldn't make entry into the structure because of the high volume of smoke. >> reporter: fire crew as lived in five minutes, flames had broken out in the attic and it was sparked by faulty wiring above the stove. >> to be there at right time. have the right stuff in place and preform the rescue. we have two people, a fire out,
