with police, police gave an order they were to leave by 10:00 last night but the demonstrators are still here. at the time police generally stayed ahead of the protesters who were marching up market street but when they began walking in between cars police began to push people out of the street, drag them out of the street after they refused orders to leave the street. a lot of people were accusing police of heavy handed tactics. the reason they are having people move out of the street and one of the reasons they want to move them out of this plaza is the safety issue involved. >> there are issues about open flames, about tents erected on the sidewalks, it is a public

the gunman. officers were called to ross circle shortly before 9:00 where they found an 18-year-old man had been shot. the victim was taken to a local hospital where he later tied. police are not releasing his name. so far there is no suspect or motive. >> there have been six officer involved shootings this year the worst number since 2004. the worst happened on sunday when police killed somebody at the parkside apartments. the number stands at 35 and that compares with 20 for all of 2010. san jose police identified a suspect at a hells angels shooting, but that gunman may be dead.
