>> reporter: the man hurled racial terms. >> he assaulted the women, assaulted the men when the men tried to protect the women and assaulted the children as well. >> reporter: atabe assaulted the 3-year-old in the head. security guards from the near by arts institute of california managed to detain him. he was arraigned today on three counts of assault. one count of endangering a child and one count of battery. four of the counts come with hate crime allegations attached. >> we pled not guilty to those charges and we're going to do a full investigation. >> reporter: the attack comes after a saturday night hate crime in the city's mission district. investigators say five latinos attacked three men standing outside of this taqueria. >> one of the men yelled what are you doing in our neighborhood and yelled homo

-- homo phobic slurs. reporting live in san francisco, david stevenson. a group held a demonstration this afternoon against what they say is police brutality. the group showed off photos of oscar grant, harding and others killed by law enforcement officers. organizers say tomorrow they will hold demonstrations across the country as part of a national day of protest. the city of oakland tonight has put occupy protesters on notice they must break up camp and the clock is ticking. christien kafton is live in oakland with the order handed

down from city hall just about 90 minutes ago, christien. >> a little while ago, late this afternoon the city issued a new notice notifying the protesters they must leave. protesters gave us a tour of the occupy location saying the city has no reason to kick them out. occupy oakland moved in ten days ago, this afternoon the city issued a second notice saying the occupiers have to go. >> our goal is to have the protesters leave peacefully. today we put them on notice this will no longer be allowed. >> reporter: there's been reports of rats, violence. >> we're not breaking the laws. this is the city, what would you rather have the drug

dealers that were here. >> reporter: occupiers say they've been some issues of violence but say they've handled themselves rather than call police. >> the only conflicts here are within each other. and we deal with them internally. >> reporter: the occupiers brought in an independent inspector who gave the park a passing grade. and as for the rats, they say the rats were here before they arrived. as for the protesters, they have a rally planned here for tomorrow at 11:00 a.m. and a march at noon. we're live in oakland, christien kafton.

the occupy camp was cleared out last night after eight arrests. police say demonstrators were told several times to break up their camps at city hall plaza. they were arrested around 3:00 this morning. five are now facing charges for illegal camping. two others for staying at the plaza after 11:00 p.m. and another protester is facing felony vandalism charges for allegedly scratching a police car. police are looking for a bank robber who hit a bank in albany today it happened just after 9:30 this morning at a bank of america on solano avenue. police say the masked gunman went up to a teller, pulled out a handgun and demanded cash. witnesses describe the robber as 6'2" tall and about 230 pounds. he was last seen running from the bank wearing a dark brown shirt, dark leather gloves and dark pants. police say they arrested 50 wanted fugitives in a sweep. officers rounded up the suspects wanted in 47 felonies

and 13 misdemeanors. they included parolees at large and people wanted on assaults with a deadly weapon. >> in our commune if there are any crimes of -- in our community if there are any crimes of any kind or they are not checking in with their parolee agents we're going to check for them. >> reporter: police was assisted by marshals and parol agents. the department says officers took simon aguilar at her home at 7:00 this morning. they found property from several burglaries there. officers are investigating nearly two dozens burglaries since september 1st. an east palo alto teacher who struck and kill add little girl now says she was minded by the sun. the palo alto news reports alicia white parker told police that the sun was in her eyes. police have not decided whether

to charge her with a crime. ktvu shot this video today at bay road and gloria way which is where the girl was hit and killed. a crossing guard and pedestrian sign were in place as children walked to school. president obama announced today the conflict in iraq is coming to an end and all u.s. troops will be home by the holidays. >> the last american soldier will cross the border out of iraq with their heads held high, proud of their success in knowing that the american people stand united in our support for our troops. some 40,000 troops remain in iraq nearly nine years since the war began. today's announcement comes as negotiations between the u.s. and iraq over whether to allow a contingent. ultimately iraq would not promise them immunity from prosecution in iraqi courts. more than 4,400 u.s. troops have been killed in iraq since

the war began in march 2003. 23,000 americans forces have been wounded. it's estimated more than 2,100 iraqs have died. the cost of the war has climbed to over 403 million. we're grateful for them serving this country but also we're grateful that they're coming home now. i would say that we have a really important and moral and ethical responsibility to make sure that they don't have to fight when they come home. >> congresswoman lee added that she is glad that the president kept his campaign promise to end the war. the two earthquakes along the hayward fault have many people wondering if they are precursors to something bigger. john fowler is live now with the answers bay area geology experts are offering tonight, john. >> reporter: i'm on a hill just

above the epicenter. that's the hayward fault going just beside me. the strain is building up on the rocks faster than they can release. scientists say it's building twice that much strain. yesterday's quakes were six hours and only a few hundred feet apart. >> fairly typical for the hayward fault. we've seen this happen before. particularly in 2006-2007. >> reporter: many people took the quakes in stride. >> apparently it's good when the little ones happen, it means good things to me. it means there's not a big one. >> reporter: could they be four shocks, precursors to the big one? >> there's no way to know if these are forshocks until the big one happens. >> reporter: the chorus singing about to launch into earth moving terror. >> supplying music, we were

test their response. ktvu.com has more news on yesterday's earthquakes. you can also find resources to be prepared for the next big quake. unemployment dipped slightly in california last month. the state unemployment development department says the jobless rate now stands at 11.9% down from 12.1%. california gained nearly 12,000 jobs in september. but job creation remained sluggish. >> if we continue on this pace it could take us 4.5 years to regain all the jobs. the momentum needs to pick up. california still has the second highest unemployment rate in the country behind nevada. an up tick in hiring brought unemployment down in half of u.s. states last month. florida had the biggest job gain in the country with more than 23,000 new jobs. florida was followed by texas and louisiana. strong corporate earnings

helped push stocks higher today. mcdonalds increased by 9%. the dow ended the day up 267 points. the nasdaq was up 68 points. parents magazine has just released it's top ten list of healthier cities. san francisco was honored for getting rid of sodas at schools. the search for a injured hawk continues as the reward climbs to $10,000. the bay area weather pattern is changing. coming up though the areas that will be the chilly for tomorrow morning. the one direction temperatures head this weekend and when the fog resurfaces on the bay area forecast.

federal investigators said they could not recover any usable online video from an air show in reno. technicians are still trying to recover flight information. they are also recovering pictures and video taken by spectators. a group of 50 people tied teal colored ribbon this morning. that's where police say a woman was sexually assaulted a week ago. investigators say the woman was out for a walk last friday night when she was attacked by two men. >> we just wanted the victim to know that we're supporting her and that if anybody has seen anything to please call the alameda county sheriff's department. >> police say the woman didn't get a good look of the men

because they attacked her from behind. wildlife rescue volunteers tried once again to lure a hawk with a nail in its head out of hiding in golden gate park. jade hernandez with why experts say this hawk could be running out of time. >> reporter: this is a watch, wait and listen game in the search for a hawk up in those trees. >> i can't tell if the nail is in him. >> reporter: what she's talking about is this. a golden gate park gardener discovered this hawk with a nail in its head. >> yeah, under the jaw and comes out of like the beak. i was bummed because here i called him to trap him and they couldn't do it. >> but i'm a gardener, i'm not

an animal rescuer. >> reporter: demetric realizes this hawk is not the one they placed traps for. she says the injured hawk stands out. >> he's definitely weak too. his wings are a little droopy. his flight is not as strong as it should be. >> reporter: demetric say it is hawk is still eating squirrels but could fall prey to an infection the experts cannot remove the nail. >> if a person has a nail in its head, the sooner the better. the same for the animal. >> i haven't seen any hawks out, i live in the neighborhood. and i hope they catch who did it. yeah. it's sad. >> reporter: rescuers hope people in the area report any sightings because they didn't see the injured bird today. the group is offering a $10,000 reward for any information leading to the conviction of the person who harmed the bird. jade hernandez, ktvu.

the california highway patrol is reporting a significant fall in the number of dui deaths. 534 people were killed, a 25% drop from the previous year. the highway patrol is crediting a new enforcement program which included more than 240 sobriety checkpoints. the next time you drive through fairfield you may notice something new. work crews were putting the finishing touches on this 350- foot tall wind turbine at the anheuser bush brewery. it's all part of the company's plan to go green. that wind turbine will be topped off and when it is topped off that turbine will provide 20% of the power at that brewer brewery. right now on the maps, no storms out there just patchy fog way down to our south.
