steve paulsen with a look at the weather. >> a lot of 40s this morning not just the north bay but the east bay as well, we will have high clouds and low clouds clear and breezy and 60s and s -- 70s, back to the news. we have our developing news this morning, 90 minutes ago, police arrived in riot gear at the occupied oakland encampment where the protesters have refused to leave. allie rasmus joins us with the situation and it looks much calmer now, alley. >> reporter: it is calmer than it was ten minutes ago. franklin is a block south of ogawa plaza anded and the

protesters are telling everybody to reconvert. there were 100 people converging and a dozen motorcycles showed up and pushed the crowd back. it appears the crowd that was here and protesters and supporters who had been here up until 10 minutes ago have dispersed or moved further south to 1st and webster and you go a couple of blocks more and you are getting closer to another area. but all of this started from about a block away from where we are and that's 14th and broadway, it has been completely shut down to traffic in all four directions since police arrived and when they arrived police officers with riot gear they went into the encampment and our cameras were there as it was all happening.

there were people arrested and you can see people being led away with zip ties behind their back and we have a preliminary number which a television spokesperson said 40 people have been arrested and we did not see any fights or confrontation but one thing we did see were three plumes of smoke from the encampment, we don't know what it was, whether it was tear gas, but all we saw from our vantage point was three plumes of smoke from the encampment and i can tell you tents are flattened, there is nobody left, a lot of protesters have been arrested and those who were not were told to meet at 14th and franklin and we talked with this person, police arrested that woman and it looks like

there are some barricades and traffic is allowed to go through. 14th and franklin, we will keep an eye on the situation and this is obviously having an impact on the downtown traffic in oakland, we will have go sal for more on that. we just got word a lot of the oakland employers are being asked by their employees to come to downtown late because of this activity in frank ogawa plaza and we want to show you a map, of one of the busiest stations in oakland are closed, trains are moving through and not stopping so you can't go there and you can't get off there, you have to go to 19th street instead. i want to show you a view, in fact it is kind of dark but some people are walking down

the street in traffic and i'm not sure who that is, are those police officers or are those people walking on the streets. you get the idea it is not a good place to be as activity is going on. at 604 let's go back to the desk. a man sat atop a wall with a sign that reads stand up for what you believe in. he wants a meeting and wants to come to an agreement over an encampment. >> i don't feel i am breaking the law because i am here expressing how i feel about this movement, with that being said, you can't make an omelet

valley. here is what his itinerary is scheduled to look like. the president will then attend a fundraising event. tickets start at $5,000 and hundred people are expected to attend. it is a very quick stop because the president is scheduled to leave there at 3:10 p.m. and head back to denver. the street is already closed right in front of the hotel and you will also want to pay attention to the entire area of third an hour street. this will will be at least until 4:00 p.m. so if you need to be in the downtown area into the evening you will want to pay attention and of course give yourself some extra time downtown.

protest and police response. that's right, pam and dave, we are looking at all the traffic and we want to let you know bart is not stopping at the 12th street city station until further notice. it is a long walk as we watch for traffic on the bridge nothing reported on the bridge and you will see some slow traffic already. northbound 101 coming up to the 80 split, it is a nice looking drive, you heard our reporter say that the area at 3rd and howard is an area to keep on your mind, it is a good area to avoid because of the president's visit. engine company 1 which is one

. time now 6:14, this is video of some of the protesters being arrested this was just about an hour ago. other enforcement agencies moved into that encampment after protesters refused to leave frank ogawa plaza. this particular protester would not leave and had to be dragged away by officers and we will have more of this in just a bit. hurricane rina strengthened to category 2 overnight and

could become a major hurricane by overnight tonight. the hurricane watch has been issued in that area with maximum sustained winds. thailand is getting worse, authorities say water has started creeping into bangkok and it sounds like the airport is closed after thousands of people are being sheltered after rising waters forced them out of their homes. two commercial airlines have suspended flights because of that flooding and flooding over the last three months has killed more than 350 people there and caused billions of dollars in damage. congress takes a look at legalizing online gambling, allison burns has more and says this could be a good thing for the economy, allison? >> reporter: right now the laws

are very confusing, you can bet with horse racing online but casino games are illegal. congress will hear arguments for and against legalizing online gaming in the united states. proposes say -- proponents say they are using online gambling. >> this is a risky virtual world war they stop u.s. laws. >> reporter: they are allowing gambling sites which would help boost the economy and some in song only want to legalize poker with games like roux let or blackjack. critics say it will only encourage a dangerous addiction. reporting live allison burns ktvu channel 2 news.

well the national advocacy news is calling for more science teaching. west education, they found 45th found, the emphasis on english and math is helping education. they are looking for more teacher training in the sciences to help with that problem. they have been asked to leave that school district. they have become incident schools and they say they could have more control over their individual education and financial plans if they became charter schools. now if the school district approves for them to become charters, they would loose up to $8 million and 400,000 in state funning. there is a list that band

sty a foam. if approved, styrofoam will be banned from county facilities along with several restaurants in unincorporated areas. there are more than 50 cities statewide. a lot happening in traffic this morning and of course sal has it covered, sal? all right, dave and pam, we are looking at downtown oakland from news chopper 2 and it is not a normal day as police, several hundred of them moved in to remove the occupied protesters from in front of city hall in front of ogawa plaza and they have let employees know they should show up a little late today because it is still a situation where a lot of these streets are closed, bus lines are not getting through and the 12th

street bart station is not open. you don't have to go to downtown oakland as long as the mail streets are affected. there is already a back up at the toll plaza, no major problems on the bridge but traffic will be a little bit slow getting on to that bridge. and this morning if you are driving in antioch, we do have slow traffic on highway 4 coming up to pittsburgh not to bay point yet, 80 westbound looks good to richmond and if you are on 880 traffic looks good approaching 92 with a little bit of a slow down, let's go to steve. a little cool, lots of 30s and 50s, some hire clouds will give way to sunshine which is warm. that will clear out the area

vantage point. >> if you take a look behind me, you can make out that truck and there is a line of officers and there is a wagon where they had people with zip ties and then they were being loaded on to the bus and being halled a way to jail. the protesters most of them were arrested right after the raid which went down at 4:45, it was pretty frantic, there were a lot of helicopters above, a tense feeling and hundreds of officers all over the bay. hayward, fremont, alameda county sheriff's deputies were there, they steamed down and stormed into the plaza. protesters were being on drums. some of them did leave

peacefully and others stayed. the idea for that raid had been going on for some time. most officers were told to lineup at 2:00 this morning. they did go into formation at the oakland coliseum. 400 protesters have been living right there in front of city hall for two weeks as part of the occupied oakland movement. officials have been worried about health and safety, we will check in with police officers and try to figure out how many arrests have been made and we will of course bring it back to you. >> tara moriarty on one side, jefferson, 14th and jefferson, broadway as well and we will continue to update that story this morning. it is a rallying cry across the nation. what one new york man is doing to stake his claim and why you may end up paying for

. the streets right now are not a good place to be in downtown oakland. well a new york man is trying to capitalize on the occupied wall street movement. robert has filed a trademark claim for the slowing began and wants to -- slow began and wants to keep it out of corporate hands, it could be plastered all over bumper stickers and earlier, there was a phrase, we are the 99%. the father of a good samaritan who was killed over the weekend is sharing memories of his daughter with us. she died saturday on interstate 880 in hayward. she stopped to him out drivers involved in a two car crash,

that is when another car stopped hit and killed her. he doubt her daughter how to drive but regrets not teaching her not to get out of a car on a freeway. >> you are riding with traffic but if you get out of the car and you can feel it and see it, you will understand how dangerous this is but i never got a chance to do that. >> now chp advices all drivers never turn your back to traffic if and when you get out of your car on a freeway. well we have continuing coverage of the occupied raid. several people have already been arrested and it's definitely a figuring downtown people in oakland in surprising ways. we have live team coverage next.

also in overnight news, there is word just out of libya, the body of muammar gaddafi has been buried in a secret location. muammar gaddafi's body has been on did i play for days along with one of his sons and a top aid. all three were buried and islamic prayers were red over the bodies, they are looking into the circumstances surrounding his death. sunday's massive earthquake, there is some hope, you've got to see this, at least two people rescued from their trapped car this morning and earlier we showed you a video of a little baby a two- week-old, rescued out of a collapsed building alive. 266 people are known to be dead

after that quake and several people have been injured. >> they have handed out their petition and they want to recall them because of the city's ongoing crime. she has been on the job for less than a year. former police chief anthony bass. >> it is clear, they seek to recall mayor jean quan. she did not comment but for the recall to proceed, they need at least 50 signatures of oakland registered voters and then to force it, oakland organizers have 160 days to get 20,000 signatures. let's go back to ktvu

channel 2 news' allie rasmus from oakland as the police have moved in on those occupied encampments, allie, you are back with us and take it from there. >> reporter: that's right police moved in two hours ago and it was 4:30, when we saw police officers in riot gear and helmets. they started walking towards the encampment at frank ogawa plaza and at least 300 to 400 people have set up encampments for their two week long protest. now you can see the encampment is a lot of flattened tempts and a lot -- tents and a lot of people are being led away with their hands behind their backs. there are still arrests being made not so much in the encampment but our cameras were there while all of this was going on. you can see they started

arresting people. we don't have a firm number of the number of arrests but officers said 30-to-40 people have been arrested and as we just showed you people are being arrested as we speak. police are breaking down the encampment and protesters are trying to talk with polic >> we are here too, we -- [inaudible] don't you see we care about you guys too. we care about you guys too. >> reporter: in the encampment, we did see three plumes of smoke and we don't know what kind of smoke it was whether it was tear gas or who set it off, i spoke to a spokesperson earlier trying to confirm whether she knew whether it was

tear gas and she did not know at this point so if you take a look back out here live, this is 14th and broadway and there is still a large law enforcement presence. if you look here there appears to be a large truck with city workers and it appears that the cleanup of ogawa plaza and the encampment will start to be cleaned up, tents are flattened cleanup is going on and there is still law enforcement it looks like several dozen police officers in riot gear and they are leading away more protesters and more arrests are happening as we speak. that is the latest as we speak at ogawa plaza and there is a lot of street closures working

14th and broadway on this end all the way passed the tell graph broadway, all the way to broadway and 17th street and that has also shut down traffic south of here franklin and jefferson having some street closures and arrests continue this morning. live in oakland allie rasmus channel 2 news. time now 6:37 some newly released audio recordings, police say the suspect reached for what turned out to be what turned out to be a fake gun. how the situation unfolded in the stairwell of a san jose hotel. and a deadly police shooting, several officers shot and killed an armed fugitive during a confrontation -- confrontation at a car port. he died at the scene, police have not told us his name but

the resident had two warrants for his arrest, one was for burglary, the other was for violating his probation. we want to check in on traffic. the good news, it's now reopened, right? >> that is right and the streets are going to get better, you can see a lot of lined police officers at one of the intersections and oakland city has been asking employers downtown to allow their workers to come in a little bit later this morning because of the disruption to city street traffic in downtown oakland just because i would be simply it is not a great place to be if you are trying to walk tow walk you are not going to be allowed to stroll by police officers. this is a picture from the

cloudy morning and once it clears it will be sunny and breezy. >> nice for the weekend, there is no rain in site. it will be cooler first weekend in november and it will stay to the north. if something changes, it is not doing much and it will be a little warmer forecast, yesterday we bottomed out, 72 to santa rosa, a little warmer and again when you get the high fire danger, that is not forecasted for tomorrow, just mid-70s.

his waistband. he was passed out on the stairwell sunday morning. he had been at a costume party and was wearing medical scrubs. when police woke him up, they say he reached for that gun police opened fire thinking that gun was real. >> 5 copy, shots fired. >> shots fired... shots fired... >> police say he will survive the shooting and in the meantime the officers involved have been placed on administrative leave. continuing now, tara moriarty is at 14th and jefferson, tara, we understand there have been more arrests? >> right now we are at 19th and harrison, we are actually at snow park and if you look

behind me, you can see all the officers behind me. we thought everything was calmed down while all of these arrests were made and these splinter groups came into the park. let's look at the video we shot just a few minutes ago. >> so again, if you look behind me, you can see there are tons of officers and this has been as you can imagine a very tense morning and they have a lot of different officers involved all over the place, san leandro, alameda sheriff's deputies and this is speaking for all of the people being booked and a couple are still trickling in and they are putting ties on their hands, giving them their

avoid today, third and howard, likely to be a lost closures and good area to get to using public transportation. and this morning in san jose, so far so good, just a little bit of slowing down through downtown and 85 is slowing down. we have a look at the peninsular and if you are driving in hayward, it is moving along nicely there too. >> nice sunrise steve. >> yes, i was looking at the flooding in thailand. low clouds, temperatures will be in the 60s and 70s and breezy conditions today. look for this more northerly later on. 60s and 70s and temperatures will start to go up a little bit. we will get that northerly wind tomorrow but i think today, 60s and 70s on the coast.
