>> we're having an earthquake right now. >> at this very moment. it's 5:36 in the morning. and our studios were just rocked by a jolt. >> absolutely. >> reporter: many are hoping the small earthquakes will lessen the chance of a bigger one later on. they say unfortunately it doesn't work that way. this week's earthquakes have not released a significant amount of strain to avert the possibility of a much larger event. the good news, the smaller earthquakes don't necessarily mean the big one is imminent. >> any time you have a sequence of earthquakes, there's a chance it could continue for several days or a week or more. and there's also a very small but not zero chance that they could be a precursor to a larger earthquake. >> reporter: this morning's quake was felt all over the area and has driven some to prepare for a more serious quake. we're having little packs ready by the door ready to go.

>> reporter: and now having earthquakes right here near the major, i can't say that word, the retrofit work here at uc berkeley hasn't been lost. as a matter of fact, the earthquakes have not delayed the opening of the memorial stadium. that is slated for september of 2012. live in berkeley, ktvu channel 2 news. >> the earthquake this morning is the third minor quake in a week to rattle the east bay. yesterday, a 3.0 hit. and last week, two quakes hit. a 4.0 last thursday afternoon and a few hours after that, a 3.8 aftershock hit the same area. none of the earthquakes did any significant damage. the bay area isn't the only place rocking and rolling. a earthquake hit nevada last night followed by a series of aftershocks and in about 15 minute, you will hear from two people, one of whom said she was really freaked out.

san francisco officials this afternoon defended what they're calling a training exercise that had heavily armed officers mobilizing to move on occupy protesters the. mayor and police chief faced reporters over the incident that took police this morning. several officers were brought out to raid the camp, but that never took place. now the mayor says the police officers were on stand by. >> they had to get ready because of what they saw in oakland. they thought that there was going to be hundreds of people coming from oakland to san francisco. either walking over the bridge or through the stop. >> the mayor lee said the encampment is unsanitary and unsafe and the city could move to clear it out in a matter of days. at the san jose site, the man who climbed a 36-foot wall is spending his fourth day atop that perch. he goes by the name cracker.

he says he will come down with the mayor and city manager agree to meet with him. after a violent few day, crews cleaned up the occupy oakland site. this afternoon, some protesters returned and began setting up again. about a dozen tens have reappeared and some say they plan to rebuild the tent city that was raided tuesday night by police. occupy oakland organizers plan a vigil for the veteran injured during tuesday night's from test. a projectile hit him in the head. friends say he served two tours in duty in iraq. the group is calling on other groups to hold similar vigils. he remains in fair condition this afternoon. and our health and science editor talked with a woman who was right there when it all happened. and he is at the hospital now where there is a growing group of supporters. >> reporter: in the last five minutes, we learned that he is now awake and alert. his parents flew in this afternoon from wisconsin.

they have inside for three hours. and we spoke with an eyewitness. video shows the 24-year-old marine veteran injured, falling to the ground. moments later, a 20-year-old protester is at his side. >> i held his hands, or held his face in my hands while he was bleeding out of the mouth. unconscious, eyes rolling in the back of his head. >> reporter: and as fellow protesters move in, you can see a officer flash what appears to be a flash bang grenade at the group. she says it hit her leg. medic! medic! . >> reporter: protesters carried the veteran away, suffering a fractured skull. protesters say from a police tear gas canister. >> you know, i went to the protest last night. and i think a lot of people are now doing this. >> reporter: she said she returned his marine hat to the hospital today. the veteran says she kept

vigilant at the bedside last night. >> so hard to believe that he went to two tours of iraq and didn't get hurt and comes back to a peaceful protest and gets hit with a projectile. he was the most peaceful, very mellow guy. >> reporter: an iraq army veteran brought flowers. >> we were each other's family in the military. >> reporter: she disputes that police were responding to protesters' attacks. she acknowledges there was an order to dispurse, but protesters initiated no violence. >> mayor, you are disgusting and you are going to go down for this. >> reporter: [ bleep ] >> reporter: he left the marine corp. in 2010. now the oakland police review board has yet to announce whether there will be an official investigation of the incident. you can hear more about the press conference that we expect

plan that includes raising the retirement age to 67. >> there's a lot of great years left in your 70s. >> reporter: but many are not laughing. this state worker thinks it's unfair. >> 67 years is too old to get retired. >> reporter: the governor says his plan will save billions by cutting taxpayer costs in half. and it eliminates so-called pension spiking where state workers pad their pay. >> any spike manage the system should be fixed. because no one should spike the system. 9.9% of workers after 30 years will make between 24,000 and $30,000. >> reporter: the public employee spokesman rejects the proposal that state workers pay half of their pension contributions. >> no, makes no sense to me whatsoever. none whatsoever. and we say to the governor, no. >> reporter: the governor says he's trying to balance union desires and those who want deeper cuts. >> i try to do something that's legal, that will save a lot of

money going forward and i think is fair. >> reporter: the governor says he will need voter approval to pass the plan. he says he believes that republicans and democrats can work together on this issue. but on such a controversial issue here at the capital, working together on something like this would seem a rarity. ktvu channel 2 news. a group of women filed a class action lawsuit against wal-mart in san francisco federal court. it applies to 95,000 female workers here in california. it claims wal-mart denied pay raises and promotions because of their gender. it's a scaled back version of the suit struck down by the supreme court in june. a lot of positive reaction this afternoon of the european plan. the stock market skyrocketed today and president barack obama was optimistic. >> the message that they are going to deal with this in a serious way has calmed markets

around the world. >> european leaders announced the deal today. it will cut greece's debt and beef up a bailout fund for other countries in the union who are at risk of default. secretary of state hillary clinton noted that greece is taking painful cost-saving measures. >> the greek people are making major changes and big sacrifices to return their country to financial health and economic come pettiveness. >> under the new deal, banks have agreed to forgive half of greece's debt. >> that greek debt deal not only calmed financial markets as the president said, it sent them surging higher. >> stocks soared in a broad rally as investors reacted to the new deal. it was the strongest day in more than three week. the dow jumped almost 34 points. i apologize, the graphic is wrong, but the numbers are wright.

the dow closed at 12,208. nasdaq rose about 88 points. republican presidential candidate mitt romney is surging ahead of the pack. a new poll fines that the former massachusetts governor is ahead of or tied with business man herman cane in the four early voting states. iowa, new hampshire, south carolina and florida will be holding caucuses or primaries in january. romney has a wide lead in new hampshire with 40% support. in florida, 30% of voters back romney, but with a margin of error of 5%, it's a dead heat in iowa and south carolina. 24% of iowa republicans back romney. 21% support herman cane. and in south carolina, 25% back romney. 23% support cane. california medical marijuana advocates today filed a lawsuit against the federal government in at the forts to stop the crack down.

the suit asked for an junction to keep the department of justice from interfering with dispensaries that meet state and local regulations. they said they were going to go to dispensaries that operate as fronts for illegal activity. a group of gay and lesbian service members is suing the federal government. the eight same-sex military families filed the lawsuit today in washington, d.c. with the goal of getting full military benefits for their spouses. the suit claims the government's defensive marriage act violates their constitutional rights. they are now seeking the same health care, housing and family support that straight military spouses already receive. >> you say to somebody, i go to afghanistan and don't come back, my wife doesn't get benefits, they understand. i want to know that they'll be cared for. it's not special treatment. >> the lawsuit comes five weeks after the pentagon ended the don't ask, don't tell policy that banned gays from serving openingly in the military.

the sheriff deputies say a woman reported that a stranger choked her this morning on the campus of the college. investigators say the woman described her attacker as a white man, 5 feet 4 inches tall, wearing a green sweater and blue jeans and speaking with a russian accent. the woman said the man approached and asked for help and that as they got near a

parking garage, he grabbed her, choked her and she passed out. she awoke surrounded by strangers asking if she was okay and that's when she called authorities. the list of oakland school closures is out. five schools will be shut down in june, leaving hundreds of students in limbo. we are live in oakland with why these closures could be just the beginning. >> reporter: here in front of sante fe elementary school, a handmade sign is still up, but it's too late for sante fe and for four other oakland schools. one teacher here described today as like being at a wake. and this mother of a kindergartener says she's so frustrated the school is closing, she is considering an alternative for next year. >> i might home school my daughter. that's what i'm thinking about. because i never know what other school is going to close down. >> reporter: the school board voted last night to close the

school along with four others at end of the school year in june. >> people are trying to be upbeat for the kid, but everybody is sad. >> reporter: in this first grade class, it was business as usual, but parents are worried about sending their children to other schools. >> going to be very difficult to go to another school with new friends, new environment. >> reporter: the school district says closing the five schools will save $2 million. so these are some of the faces affected by state funning cuts to education. the district is also fighting declining enrollment. parents battled and pleaded for months to keep the schools open and some vow to fight on. and if their efforts fail -- >> take all funds that we have and make them go out with a bang. have a great year. let's not focus on the ening and just start on the new beginning. >> reporter: the school district says it plans to

eliminate as many as 30 schools over the next two years. the big stick is about to go on its final assignment. the battleship uss iowa will soon become a floating museum. tom. >> reporter: well, take a look at this. it is 900 feet long. and it weighs as much as 100 fully loaded 747 jumbo jets. its 16-inch guns can blast a volkswagon 25 miles, but soon you can come aboard. tonight only, the port that hasn't birthed a battleship since world war ii. it's one of iowa battle wagons along with the missouri, new jersey and wisconsin. >> those things mean a lot to me. they really have being a veteran. >> reporter: this veteran was on the iowa when it was fully commissioned and armed as part of a tour many years ago. he's pleased that tomorrow it's

off to the port of richmond for three months to be converted into a museum piece and available for limited tours. >> the sheer history of the thing, big part of the history of this country. represented from the world war ii era on. >> reporter: it will be birthed at the port of los angeles' cruise terminal. >> projecting within three or four years to have a million people a year visiting. live aboard, we're going to have a education programs going. >> quite a history right there. >> reporter: quite a history indeed. when the ship is ready for tours in rich monday, we will let you know and that will be soon. reporting live from the port, ktvu channel 2 news. a moderate earthquake and a series of aftershocks rattled through nevada overnight. the 4.7 earthquake hit just before midnight about 20 miles northwest. no errors of damage or injuries, but it was enough to jolt a lot of folks out of bed. >> it was a big rock slide that

happened on the ridge that was above us. so we freaked out a little bit. >> we heard a whistling kind of sound. and then am of a sudden, everything -- and then all of a sudden, everything started shaking. the windows were shaking hard. >> one state emergency official said it's not surprising that a earthquake would hit the area because falls run throughout california. this one hit on the valley fault. turning to the bay area weather now, i don't think anybody in the news room today left the house early without a jacket. bill, we needed one. >> boy, it was chilly this morning. temperatures down into the mid- and low 30s. frost in bay area locations. what you can sigh here is live storm tracker 2 showing some of the temperatures out there. and certainly what you're seeing is no fog right along the coast. and without that fog, we're looking for a very, very nice pattern as we go into the next couple of days. as a matter of fact, let's take a peak now, we're going to look at the forecast for tonight.

overnight lows, that's story. very cool, patchy frost showing up. some of the coolest mornings all year. and you will notice it tomorrow morning. 35 in napa. these are conservative. up towards forestville, you're right down there at 34, 33 degrees. i kid you not. very chilly. a lot of frost tomorrow morn, especially in the inland valley. storm track north, high pressure in charge. and friday and saturday, it's a dry pattern with chilly mornings continuing. and temperatures 6s right at the coast. that's not bad. low 70s inland. nice area weekend coming up. we're not that far. one more day. forecast highs tomorrow, yellows are 70s. lots of yellows tomorrow. plenty of yellows, upper 60s as well. friday looks like a beautiful day. forecast highs, above average temperatures, fire danger not off the hook. no red flag warnings, 78. 75 in napa. big swing from overnight lows

threatened species. they called her the freeway hero. and today the city of san francisco officially thanked a woman who risked her own life to save a traffic accident victim. [ applause ] they are sharing a hug. a thank you. and the applause of city leaders today. mayor lee gave her san francisco's first ever good samaritan award. one week today, the mother was driving her little girl to when she saw a truck flip over and burst into flames. she pulled other, rushed to the truck and pulled him away from that burning truck. >> for some reason, that particular moment, this beautiful lady decided to stop. to me, he's my angel. >> i prayed the whole time as i was getting you, please just nothing else happen. and i'm glad you're standing. >> he suffered only minor injuries. >> congratulations to her. mark is here now with

sports. game six, rangers on a roll here. >> yeah, i'm hoping it will pick up where it left off, the rain yesterday. is a couple days rest. and it was really, really starting to get tense and entertaining, a lot of subplots going on. but as it stands, the weather is just fine back in st. louis. they'll get the game off on 5:05 as scheduled. the rangers trying to wrap it up, they lead three games to two. and you know, the cardinals down the stretch, boy, they had the pressure on them, had to win every night just to stay in it and get in the post-season, so the win or else position is something we're accustomed too. >> we played this game. i mean, literally, have played it a couple three times and a bunch of other times we knew we could lose another game that soon. if we lose a couple, things are over. so guys are responding. so we'll respond today.
