terantino is being evaluated by a doctor, due to be released and at 1:00 he will speak to the meeting. we will have the full story later this afternoon. a hospital spokesperson says matt finance monterrey is doing better today, better than saturday when he was shaken up mentally and physically. he says the 27 year old agreed to let media protographers photograph him and read a statement to the media but says he will not answer questions. the shark bit him on his neck and arm off marina state beach early saturday morning. take a look at his surf board. look what the shark did to his surf board biting it in one or two places. according to the spokesperson at the regional medical center, the bite missed his carotid artery by two millimeters. a friend and another surfer helped him out of the water and he was airlifted to the regional medical center on saturday where he's been since. we just got the word from the

hospital spokesperson that he is going to be released and at 1:00 he will give a statement to the media and we'll have that for you later on on channel 2 news at 5. reporting live, ktvu, channel 2 news. >> thank you, craig. the iraq war veteran injured by a police tear gas canister at an occupy oakland march remains in the hospital. 24 year old scott olson transferred to an undisclosed hospital on friday and after he was admitted to highland hospital last week. now olson's roommate tells the tribute olson is expected to make a full recovery. olson remains listed in fair condition. his family is asking for privacy during his recovery. hundreds of occupied protesters are back camping at oakland city hall and they say they have big plans for later in the week. as part of our continuing coverage of the occupy protest, ktvu's noel walker tells us about a promise the mayor is making to the protesters. >> reporter: urban camping is pretty peaceful at 4:00 a.m.

>> tonight is my first night today we tradded the comfort of her oakland loft for a tent at oakland occupy. >> well it seems great. it seems very peaceful. people are actually really aware and responsible with what they're doing. >> the 99% are back to occupying 100% of the plaza less than a week after the city abruptly evicted the campers. >> this is like the rebirth here, now so there's time for us where we're actually seeing what we need to do and motivated to do it now. >> oakland is fairly hands off with the city within a city but there are daily fire and safety inspections. >> so tell me what they're looking for? >> well the inspectors came out to look for safety hazards to make sure everybody is okay. say good morning and look for anybody with open flame stuff and anything that's a potential hazard. >> so far so good? >> everything is great.

>> there were reports that occupiers threatened to march on the mayors office if the city didn't return medical supplies taken in last weeks sweep. occupy says someone passed its e-mail discussion group to make the bogus post. >> it's not true. we have no such plans. nothing like that is happening. that's what's called a false brag. we don't know who it is. >> the mayor has promised to return the medical supply today and in the meantime occupy oakland is planning its general strike on wednesday. the fliers are up all over the plaza and their goal? to shut down the city of oakland. noel walker, ktvu channel 2 news. san francisco protesters are meeting with city officials and they hope to get official approval for the justin herman en can'tment to remain there. the occupy santa rosa outside city hall is getting a reprieve. the city council ruled over the weekend it's okay for protesters to camp out, at least until the council's next meeting. previously, city officials said

protesters could not camp out. protesters say they were worried the city could send in police to shut the camp down. there are no major changes in the occupy protests in san jose and other bay area cities. we will have continuing coverage of the occupy movement on ktvu newscasts and we also have more on our website at ktvu.com and click on the occupy protests tab. the chp is investigating a highway death on a freeway near martinez. it happened around 11:30 last night on 680 just north of highway 4. the chp says a 53 year old woman from concord got out of her car and started wandering on the freeway. she was immediately hit by several cars and killed. those drivers all stopped and are cooperating with investigators. the chp believes the woman was under the influence of alcohol. her name has not yet been released. republican presidential candidate herman cane says he,

"has never sexually harassed anyone." a political report out late last night suggested cane has been accused of sexually harassing at least two employees when he was the head of the national restaurant association in the 1990s. he says he was falsely accused and that the claims were investigated and found to be baseless, but political reports the trade association paid financial settlements to the two women. a major investment bank, mf global filed for bankruptcy this morning after a shares in the company plunged last week. the firm was lead by john korsign, the former new jersey governor and former chief executive of goldman sachs. analysts say it's a stunning failure for him who tried to run, tried to turn the more than 200 year old firm into a mini goldman sachs. a new analysis says the key to a bay area economic recovery is more hiring and high-tech. according to the times, over

the first nine months of 2011, the technology industry added 26,000 workers that is 65% of all the jobs created in the bay area, and according to one analyst, high-tech workers are more likely to buy a home, make home improvements, eat out more often, and all that pumps more cash into local economies. a peninsula congresswoman this morning is challenging herself and others to try to live on food stamps for a week. >> can i afford it? that's the question. >> congresswoman jackie speer went grocery shopping this morning on a very tight budget. for the next five days, she will try to live on food stamps spending just $4.50 a day. she said the exercise shows her what it's like to walk in the shoes of someone living in poverty. >> there's so many of us that live comfortably, we have no idea what it's like.

i mean all of a sudden i was thinking how am i going to drink coffee? >> congress is planning to cut funds for food stamps by 20% of the time when 15% of americans are living in poverty. this halloween night will be a busy one for california parole agents due to operation boo. california attorney general harris introduced the details this morning in san francisco. the agents will be out in force making sure registered sex offenders are not using halloween treats to lure young trick or treaters into their homes. the crack down involves hundreds of parole agents and law enforcement officers across the state. we'll hear from harris and others on ktvu.com and ktvu channel 2 news at 5. but for many young ghosts this will be a fun and exciting halloween. some neighborhoods are going all out when it comes to decorations while others are trying to tone down the celebrations. ktvu terre moriarty joins us

stone road on beth el island around 5 this morning. they found the motorhome completely engulfed in flames. the fire also spread to a nearby tree and took down a power line. two burn victims were flown to uc davis medical center in sacramento. the cause of the fire is under investigation. calling it a danger to patients, president obama has an order for the fda involving drug shortages. last year, the fda reported 178 shortages, including some cancer drugs. today the president signed an executive order to try to ease those shortages, protect patients from price gouging, and to make sure the government has an earlier heads up about possible problems. >> as part of this we're going to require the drug companies let us know earlier about the potential for drug shortages so that we can respond successfully. >> todays order is the latest in a series of executive orders signed by the president. the white house says it's a way to get around congress'

inaction, but republicans say it's another example of excessive government regulation. two year old conjoined twins will be separated tomorrow in palo alto. angelina and angelica are joined at the chest and abdomen. they will undergo an eight hour operation to be separated at the sternum, liver and diaphragm. a team of 20 doctors and nurses at lucille packard children's hospital will perform the surgery. if all goes well the twins could go home within a few weeks from now. an anesthesia expert is back on the stand in the trial of michael jackson's doctor. the expert is testifying for dr. conrad murray. under cross-examination today by the prosecution, he admitted that murray deviated from the standard of care. dr. paul white testified that he has never heard of a case in which the anesthetic propofol was given to a person in their bedroom to help them sleep. the city of valejo plans to

clean up a homeless en can'tment next month but it is causing concern among the camp. as many as 15 people who live in the en can'tment along wilson avenue south of highway 37 will be displaced, but city officials say they are taking action after receiving a number of complaints about noise and trash. the city has been working with non-profit groups to reach out ahead of the planned clean up but we spoke to people this morning who say shelter space is limited. >> there's really not enough room for all of us there and their program doesn't really fit the formats of what a lot of people want or need, and so i don't think that's going to help the problem at all. >> some of the camps residents say they plan to return to the site after it is cleaned up. officials say the work will cost $25,000. california transit leaders who are weighing the fate of the high speed rail line will receive a crucial report

tomorrow. that report could finally determine whether it's time to kill the $45 billion projector start building the tracks for the bullet trains. critics worry about cost and safety but supporters are excited with the prospect of riding the rails from san francisco to los angeles in two and a half hours. >> i like it. it would be nice to be able to travel back to la. that's where i'm originally from, on a high speed rail and not to have to get to the airport hours in advance. >> i've heard a lot of things like about having the wrong stops or a lot of bureaucracy issues. >> if approved high speed rail would be one of the biggest transit projects in california history. there would be 800 miles of track and at least two dozen stations. another small earthquake has shaken the bay area, the 2.4 magnitude quake struck at 2:42 this morning, two miles east of berkeley. we have not heard any reports of injuries or damage. berkeley has been the epicenter of several small earthquakes in the past two weeks.

a uc berkeley professor trying to disprove global warming now says it is happening. richard mulley says his research shows the earth is 1.6 degrees warmer than in the 1950s and that matches findings from nasa and other agencies. the conservative foundation actually helped pay for part of muller's research. he's set o outline his research today at a conference in new mexico. lots of sunshine out there, very thick fog came in this morning and it's peeling back but it's barely holding on, just a little bit of a rope down the coast. most of it doesn't have much to hold on to because we're starting to pick up a little bit of a northeast wind out in the valley and that's a sign of things to come as we head into tonight or tomorrow. some coastal fog but now there's not much, sunny and warm if you're away from that and that's most people. look sunny tomorrow, breezy to windy, in fact sunny by the coast but a big pattern change for thursday into friday. much colder system dropping

down from the gulf of alaska. looks like some rain but more cold than wind. you can see the fog going down the coast and that's a sign of things to come over the next 24- 36 hours so i'd be surprised if there's any there tomorrow morning. if there is there won't be much left. 70s already, some areas warming up nicely, 60s and 70s for everybody so coast bay and inland starting to jump up a little east wind now at sfo, northeast at fairfield, northwesterly wind at san jose but that easterly and northerly wind kicks in tonight into tomorrow. high pressure starts to build in and that's going to give us higher fire danger but take care of the fog and give us one more warm day before system up in the gulf of alaska decides to dive in. now the jet stream has been way to the north but it says you know what? i think i'll head to california but not until after wednesday so today some coastal fog but not much left. just a light breeze, slightly cooler by the coast but everyone else starting to pick up sun so mild to warm conditions. some coastal fog a little

bank stocks falling broadly after the security firm mf global filed for bankruptcy protection due to its large holdings of european government debt. still this is looking to be one of the best octobers on record. normally this is a month that is known for stock market jinx. right now the dow is down 208 on this last day of october and the nasdac is down 41 and s & p down 24. natural disaster is leading to a part shortage for honda. flooding such as this across thailand disrupting its supply chain. this morning the auto maker said it will scale back car and truck pro tuck in the u.s. and canada at least through november tenth and if they can't find a new part supplier by then it may have to stop all production. the japanese auto maker was starting to recover from

shortages stemming from the march earthquake and tsunami. you are looking at google's newest doodle that debuted this morning on their front page in honor of halloween. it features employees from the mountain view campus carving out half a dozen pumpkins to spell out google. they also posted a behind the scenes video on their site showing how the doodle was made. a recovery crew working off the coast of north carolina recovered another canon from the flagship of the pirate blackbeard. the one ton eight foot long gun from the queen anns revenge had been under water for nearly 300 years. it's the 13th canon the group has managed to salvage from thebottom. supporters cheered when the canon was raised above the waters surface. tonight at 5 passengers stranded on the east coast seven plane loads you'll hear the plea for help from a pilot and what a bay area passenger rights activist is saying about
