i'm thinking we're going to have water outside, some music outside. >> reporter: others like pizza man can't afford to close for a day and interim police chief howard jordan says there's a plan to protect those business and the free speech of the occupiers. >> we have a plan to deal with the demonstration tomorrow, that's all i can say. >> do you guys have mutual aid called out. >> no we don't. >> reporter: both b.a.r.t. and ac transit move through this area and say they are planning regular season but will change that service if they need to. we have learned that workers inside the city hall have a new name for the occupiers, they are calling it quanstantinople in reference to mayor quan. coming up in 10 minutes we're getting reaction from the port of oakland where occupy protesters say they plan to shut down oerpgs tomorrow. meantime oakland police officers are slamming mayor jean quan for shifting her

stance. the police chief howard jordan responded by saying unlike the officers he's not confused. the board of supervisors call on major lee to make sure unnecessary force is not used on protester. today they met to talk about how they can keep that encampment clean and safe. the occupy movement has set up committees to discuss the issues. >> you can follow the latest, go to ktvu.com. public nudity also a subject of vote. they are regulating it. the legislation bans naked people from restaurants and

rats like that, it's pretty crazy. >> reporter: they've become so disgusted that he's taken it on himself to come out here and pick up anything that may attract the rodents. >> it's awful to think about the diseases out here. people bring food for the people who are homeless and not purposely, but end up causing a problem because people leave their containers. and sleep at the park, and it's a perfect food source for all the rats. >> reporter: people's park is part of uc berkeley, a spokesman told us by phone the university is concerned about the rats because of the potential health risk. the university says it does clean and maintain the park daily but it's planning to increase its maintenance staff assigned to the park. this new can was installed today and more is on the way. the university is working with those providing food to work on the problem. >> we're serving people off of

paper plates, even after everything there's still crumbs on there. >> we're doing everything we can, we're very conscious of it. >> reporter: we're back live. we want to show you an example of the problem. this was just left in the last hour or so, it's a tin of food and something that no doubt will soon be attracting rats. rob roth, ktvu channel 2 news. san francisco residents may have noticed an unpleasant change in their tap water today. the committee says a bad taste and odor are being caused by an algea bloom in the source reservoir. officials say they are monitoring the problem and that the water is still safe to drink. customers can get rid of the taste and odor by filtering or boiling their water before drinking it. phillip day pleaded guilty to charges in september. prosecutors say day and two other people diverted about

$95,000 to political campaigns supporting ballot measures that benefited city college. solyndra is on the auction block. new at 6:00, consumer editor tom vacar is live in fremont where he went inside the manufacturing plant that is now being sold off piece by piece, tom. >> reporter: the final breaths of solyndra will not come with a whimper, they will come with the bang of the auctioneer's gavel. today potential bidders previewed a dazzling array of equipment lots to be auctioned off starting tomorrow. it includes everything from office chairs to large robotic assembly lines to computers as well as thousands of the finished solar panels ready to install. industrial auctioneers famous for auctioning off enron's estate says this auction is special. >> the response has been overwhelming. because the company's name has

paying for it. reporting live, consumer editor tom vacar, ktvu channel 2 news. new court documents filed today shows solyndra founder and former ceo chris gromet received a half a million dollars severance package. he was terminated two months before solyndra said he was leaving. president obama hailed gromet as a greens job building when he gave solyndra a loan. the state government commission still has 80% of its federal funds, a total of $183 million in the bank. lawmakers say that money should be used to put people back to work. >> it's offensive to the 12% of californians that are still unemployed. millions of californians who are eligible for a job, hungry for a job. and to think those funds are sitting in a state bank account

is not feasible to me. >> $190 million remains from a federal grant meant to weatherize homes of low income families. a lawsuit has been filed against the reno air racing association. the pilots company and an aircraft parts maker among others. the plaintiff's husband was among 11 people killed september 19th. the ntsb is investigating the cause. police say a san francisco man is under arrest in an attack on a transgender man. officials say the suspect 38- year-old ricky hodge hit the victim with a cooler on halloween night. it happened on valencia street at about 9:45. the victims sprayed the attacker with mace and got away. hodge is facing attack charges with hate crime charges. pearls deluxe burger opened its doors this morning on market and sixth street. it's the latest step in the

officials have ruled out a natural gas leak as the cause of a powerful explosion at a home in richmond early this morning. the back wall of the house on ohio avenue blew out at about 2:20 this morning. authorities say one man inside suffered cuts and burns. he was released from the hospital earlier today. fire officials say they are now looking into chemicals and propane found at the home as possible causes. new at 6:00 tonight, occupy protesters in oakland say they will try and shut down the port of oakland at 7:00 tomorrow night during their planned general strike. now the port officials have just told us because of that threat at least one terminal

will be shut down. >> our seven marine terminals we've heard from one of them that they have decided to shut town for tomorrow. and in their announcement there was some reference to the november 2nd action. that terminal is the howard terminal. protesters plan to march to the port tomorrow night and try and shut it down before the night shift begins at 7:00 p.m. a possible shark spotted in the waves off ocean beach added an extra thrill today to the first day of the rip curl surfing competition there. david stevenson is there now with the big name who headed back to shore after seeing what he thought was a shark, david. >> reporter: the competition wrapped up two hours ago on a date filled with world class surfing and worry about sharks and surfing conditions. the rip curl surf brought some of the biggest surfers. >> you see we tried san francisco because we think the surf is sometimes right there in the backyard in the middle

of city. >> reporter: which made today's shark sighting surprising for some. dusty payne said he spotted a white shark while waiting for a wave. that prompted him to leave the water in the middle of a heat. >> we've seen dolphins earlier in the day it is really common to get them mixed up. >> reporter: still, they ordered a boat to monitor the waters. >> sharks are definitely in the area, however we have never had a shark attack out here at ocean beach. and rarely if ever we'll have a sighting of a shark. >> reporter: life guards say surf conditions caused a greater risk to those on the surf. >> these conditions, a warm day offshore winds and increasing swell, the rip tides are causing a greater and greater threat. >> reporter: it means a rougher ride here for surfers who will also be paddling out against these pounding waves. >> without that jet ski assist,

they're going to be making sure that they are getting more rest at night. that they're in paddling shape. it's going to be extra work. >> reporter: the shark sighting here comes a few days after a surfer was attacked by a 9-foot shark in monterey county about 100 miles from here. the rip curl prosurf continues through november 12th. reporting live in san francisco, david stevenson, ktvu channel 2 news. a san francisco woman says she is reoccupying her the foreclosed home. she says she was evicted by the company that acquired her home. >> for the last three years i have attempted to pay my mortgage, modify my mortgage and sue this bank. they have done nothing to work with me. >> reporter: the home has remained vacant so gauge and her supporters say they decided to take it back. so far there's no word on any effort to make her leave. >> bank of america is backing

down from its new debit card fee. bank officials say they listened to customer complaints about the $5 per month charge. several other banks including wells fargo and j.p. morgan chase have also indicated this they will not move ahead with planned debit card fees as well. the prime minister of greece says he is calling for a national vote on that rescue package. as a result, the dow fell 297 points to close at 11,657. the nasdaq lost 77 points closing at $26.06. building california's high speed rail will cost a lot more than originally thought. the high speed rail committee says it will cost more than double what officials said it would cost. the new estimate takes into account ridership, equipment and inflation cost. bay area residents we spoke with say now is not the time for the project.

>> so we should put it off until we're in a better situation as a state. >> it's so expensive, especially in the current environment when we have so many other needs like education. >> construction is slated to begin in the central valley next year. fire danger remains high tonight in parts of the bay area. we want to show you a live picture of mount diablo in contra costa county. not a cloud in the sky. a red flag warning is in effect right now. our chief meteorologist bill martin is monitoring conditions and joins us now from the weather center. what do you think here bill? >> first thing i notice is how bright the sky is. golden brown. the hills are very high, the winds are up and the red flag warning remains in effect. that wind is blowing from the north, that's a northerly wind. it's hard to tell. almost looks on shore. it's a northerly winds. the flags in the city have been blowing all day. that camera you're seeing, it's locked down, bolted down but it's shaking around. we have some strong winds.

especially at the higher elevation. the high buoy readings, san jose richmond bridge gusting to 25 miles per hour. the chp worries about high profile vehicles, right. look at what it does. you're going to get hid sideways. the wind is not quite as strong but they are still blowing in that orientation is perpendicular. same as the san mateo bridge. here's the don barton. when you get the winds blowing like that you get some traffic issues. gusts today 15 miles per hour, gusts tomorrow morning 16 miles per hour. you even notice the breezes today around your house. it was a little windier. as we go into tomorrow, very nice day. everything changes around as we
