here late late last night in downtown oakland were anarchist. anarchist who tagged the corner of this building and attempted to set a building on fire not far from here. more than 400 officers spanned out over the streets of oakland overnight. fearing that the group were set on setting this building on fire, police changed tactics. using tear gas and gas grenades once they met resistance. >> there were fires set to prevent the officers from going into the structure. we were able to overcome that with the help of fire and fire extinguishers. my officers were pelted with rocks and bottles. >> reporter: these were some of the items police say were thrown at them. the mayor says occupier communication received last night in the form of tweets is

all that's needed to keep order. >> that kind of communication must continue. i remain, wanting to speak to the occupy oakland people, needing to speak with them and hoping that they will speak with us. >> reporter: city crews washed up graffitis and boarded what windows they could. >> the city of oakland is open for business. >> reporter: but city administrator santana says they are working to fine out how much this latest police action will cost the city. last week's police enforcement cost in the ballpark of about $700,000. reporting live in oakland, jade hernandez, ktvu channel 2 news. a handful of protesters remained at the port of oakland. a ktvu news crew took these pictures just before 6:00 a.m. you can see demonstrators urging port workers to turn around. there were some tense moments when protesters used metal

fencing to try to block the drivers. port officials say the port was back open after a few hours. protesters released a letter for mayor quan. the vandalism, business losses and general fear is not an acceptable condition for our great city. what is your plan? today oakland police blamed a splinter group for the overnight vandalism. officers fired tear gas to disperse protesters who broke into a vacant building and set fires in the street around 16th and broadway. police say in all they arrested 101 people after midnight. 25 women, 76 men. 32 are from oakland, 46 are from other bay area cities. most of the protesters were arrested for misdemeanor unlawful assembly. one man from elk grove is

facing felony vandalism charges and an oakland man was arrested on assault with a deadly weapon. and now protesters are trying to determine how to counter the violence. rob roth is live. >> reporter: the mood seems pretty subdue as many try to undo the damage from last night. graffiti covered many of the walls and wall fronts around frank ogawa plaza. so many protesters bought cleaning supplies and tried to remove it. they say by doing this they are also trying to remove an impression that their movement is filled with an that are --aa

anarchy and violence. >> we're not a bunch of anarchist. >> maybe we actually need to go up and take things out of their hands. like take the brick out of their hands. take the bottle, glass bottle out of their hands. >> we did not want the minority to speak for the majority through actions. especially actions like these. >> reporter: a group from occupy oakland met today and agreed to visit the small surrounding business throughout the day to express their frustration for what happened. >> get respect back and trust. >> reporter: we're back live now. a little while ago it was raining and people here say a little wet weather is not going to chase them away. reporting live in oakland, rob roth, ktvu channel 2 news. two occupy oakland protesters are still recovering tonight after being hit by a

car although it's still unclear if the driver is going to be charged. this cell phone video from 11th and broadway shows one of the protesters striking the car about 8:00 last night. then watch what happens, seconds later the driver moves forward hitting the man then backs up hits another protester. there you see it happening. b.a.r.t. police questioned the driver and released him. oakland police are now in charge of the investigation. it's unknown if the driver will be charged. both protesters are now out of the hospital. >> reporter: protest oakland protesters marched. about 100 nurse, students and other community members took part in a rally. it's aimed at raising support for a transaction tax on wall street trade. they say such a tax could raise

$15 billion a year. the wet weather is making for miserable conditions for oakland's best known protester. he has remained perched on a building for 30 days and says he will continue perched for another 87 days. from fire danger to storm watch, the weather can have an effect on protesters. bill martin is here now with a look at the weather. >> it's wet out, it's light showers but we're down 15 to 20 degrees over the highs we had yesterday. we go outside right now, you can see a little bit of light right now. the front has passed through but those roadways are slightly

wet. we go out toward berkeley now i80. and you will see that traffic is moving. the showers have basically ended in san jose. head lights are coming toward san francisco, red lights going up toward sacramento. the rain slick on the roads. we'll see where the rain is right now. you can see the rain moved through. there it goes right down to the south bay. out toward morgan hill and gilroy. we have slight scattered showers. none of this has amounted to much. it's definitely slowed traffic and put wet on the road. the other story, it's cool today. it is going to be downright cold tomorrow morning. when i come back we're going to look specifically at those forecast overnight lows and i think we'll be surprised of how cool it'll be tomorrow. a pleasanton mother is making an impassioned plea today. the girl was last seen tuesday with a 25-year-old man. >> she hooked up with this

character named gavin. never met him, never seen him. she just developed a relationship with him. >> shelby harris was seen with that 25-year-old man identified as gavin mcfate on tuesday. he faces several charges. he was last seen driving a late model honda. coming up on tv 36, more on why police consider mcfate to be dangerous. the san francisco public defender says new video he made public today shows police officers overstepping their bounds. new at 6:00, ktvu's david stevenson in san francisco where the public defender is also hoping to get elected as mayor just days from now, david. >> reporter: the city's public defender is alleges more cases of police misconduct. though he admits the events

come at add bad timing for him -- come at a bad timing for him. >> we're going to present several cases that show a disturbing pattern of theft. >> reporter: five people allege police stole cash and electronics. adachi also says richmond district officers used excessive force and lied on a police report after handcuffing grocery owner charles tran outside his store last august. >> the officer is the one that takes aggressive action against mr. tran and immediately takes him into custody. >> reporter: adachi held several press conferences earlier this year alleging police misconduct. he launched his mayoral campaign in august. today's allegations come five days before election day. >> i did consider delaying it until after the election to you know so there wasn't that perception, but you know after meeting with the individuals.

they expressed they wanted to go forward. >> i know he's very busy right now with his campaign so we traded voice mails until my captain of internal affairs was able to receive it. >> police chief greg suhr told us adachi's office turned over the complaint and surveillance video just before close of business yesterday. >> i don't think that there's the smoking gun here that mr. adachi would suggest. >> reporter: other officers seen on these surveillance videos released by adachi earlier this year are no longer working plain clothes operation and are being investigated by the fbi. david stevenson. san jose police and the santa clara district attorney's office say they want to reassure the public attorneys will reprosecute. >> people who are saying go back to where you came from, we don't want you here. go back to your country.

that's the plea from california's disabled residents and their supporters. they rallied in sacramento today protesting current and proposed cuts to home health care services. services they say help keep them in their homes. many fear they will be forced into facilities that will cost three times per person per year. a remarkable device is helping a bay area girl overcome a debilitating brain disorder. john fowler is live in sunny

house for documents concern solyndra. solyndra defaulted on a loan after it filed for bankruptcy. today's vote comes as the group americans for prosperity law launches an ad campaign against the president. a new filing shows that the average pg & e meter sends thousands of messages a day. the typical meeting sends 10,000 brief signals every day. those signals add up to 45 seconds a day of transmissions. some critics claim the meters pose a health hazard but pg & & e says that the meter is within policy. rain had workers at this livermore winery rushing to get the fruit harvested. weather from rain to very cold temperatures weigh heavily on

the minds of grape growers and wine makers. >> california wine makers say picking the fruit is not only crucial to making a good wine it's also very important to business. >> you can lose whole crops, if you're a small winery like hours we rely on the crop. >> reporter: 40-tons of grapes were harvested. when the rain passes the winery will pick some 20-tons more. this year's conditions have been less than optimal for grapes and that could affect prices down the road. >> what tends to happen when there are shortages the prices go up. >> reporter: at this liver mother wine shop, customers aren't clued into how climates can affect everything from selection to prices. >> i would say they have no idea. >> reporter: wine makers say this year's harvest is late

because of a wet june. in livermore, sal castaneda, ktvu news. and it was tough to call this rain. it was wet but it really came down like drizzle and a very light mist. most of the day, most areas had light scattered showers. i know we're going to get snow flurries there. i wouldn't be surprised if they have snow flurries for the lake tahoe area through tomorrow morning. live storm tracker 2 shows you where the showers are. as it moves off in this direction showers diminish rapidly. right now san jose you're getting a break. you get light drizzle and scattered showers over the last hour or two. that is tending down. we're going to get into a very cold evening. the cold front goes through. that's where the rain was. i just showed you on the cold front. behind the cold front is cold air. cold air is going to settle down and it's going to be cool

in the morning. low 30s, near freezing in some areas. probably some frost, temperatures during the day tomorrow say santa rosa you're just at 57 degrees for a daytime high. not 77 like we saw a couple of days ago or yesterday. but down into the 50s. here's that low pressure center. it's not strong but it's cold. so again, the big story in weather cold. the cold is going to linger. as it does you will notice nights and mornings and slight morning showers. morning showers possible. but i think for the most part you wake up clear. then you get into saturday, it's okay. saturday night into sunday morning. more showers from yet a second weak weather system. with that cold air in place we see snow flurries up in the lake tahoe area as well. with that we have a winter weather watch in effect. i suspect with this weather system they will issue another weather advisory. if you're going to the tahoe area it will not snow much but

i ride muni every day. i enjoy it the most when i'm with sidney. she doesn't notice that it's too crowded or that it can run a half hour late. i'm bevan dufty, and i'm running for mayor because it's not enough to just "get it done"-- we have to get it done better. sidney thinks muni is magic. we go underground and come out someplace new-- just us. i want all of us to see it that way.
