>> let's check in with meteorologist rosemary. the storm is winding down and looking at a nice sunday, just a few showers expected through the morning hours. partly cloudy skies to mostly clear in some spots and the south bay dealing with mostly cloudy conditions. we'll remain understood settled throughout the afternoon. looking at sunday and patchy fog in a few moments. a nurse is attacked by a patient and come tomorrow morning, the nurse's union will file a complaint against the hospital. it's a story you see only here. joining us live this morning on what happened. alley. >> reporter: according to several staff members here at summit medical center, it happened friday morning inside this hospital.

this is the summit medical center in oakland. a patient unrevoked lunged at a nurse and put her in a head lock and began hitting her in the head. security was called in after the attack and police did respond to investigate, however the patient was not arrested. the nurse went to the er and she's physically okay but shaken up by what happened. we talked to a nurse who was not working when the incident happened, but she's not surprised, dealing with unstable patients is one of the risks of the job. >> they put their lives on the line and as a nurse you put your life on the line especially if you work in the er, you don't know what is going to come through the door. >> reporter: the nurse's union

will file a complaint with cal osha tomorrow. they say they don't have sufficient security and the patient should have been in a psychiatric. they will be at odds because of some tense labor contract negotiations. the nurse's contact expired in june, nurses here went on a one- day strike and the hospital locked them out for the next five days. the spokeswoman said she hadn't heard of the information yet but will get back to me for the hospital's side of things. we're expecting to hear from some of the staff members that were working when it happened and we'll bring it later on in the show. oklahoma authorities are assessing the damage caused by a record-breaking series of earthquakes, one of the strongest hit last night

between oklahoma city and tulsa. it rocked buildings. they have recorded dozens of states in that region. a 4.7 yesterday. although the quakes occurred on a known fault line, people in oklahoma are not used to the ground shaking under them. >> he grabbed a gun, he thought there was an explosion or attack i'm not sure what he thought. >> watch out california for tornadoes, we're getting earthquakes here. >> seismologists are determining why the quakes are happening at this time. they predict more after shocks will happen in the next few weeks. the latest one hit yesterday, we'll hear about the heyward faults and how much the ground is shifting every year.

a solo vehicle crash took the lives of two people. it happened at midnight at perrer road south of santa rosa. a honda slammed into a large tree along the roadway. it's unclear if the rain was a factor. but the road was wet at the time of the collision. two men died at the scene. a two-car crash in richmond on richmond parkway close to brent road. police say that the man killed was pronounced dead at the scene. an early-morning shooting left two injured. east 18th street and rosedale avenue after receiving a report of gunfire when they arrived at the scene, they located 2 people inside a car, both were shot. the victims were transported to

the hospital. conditions are not known at this time. police are investigating a copper wire theft that turned into a deadly shooting. crime tape surrounded this home yesterday. investigators say that the owner of a vacant home interrupted a burglary in progress. they believe that the suspect threatened the owner, leading the owner to shoot and kill the suspect. >> it's been a year now. >> what do you think of this happening? >> i don't know. >> neighbors describe the homeowner as frustrated after recent burglaries. the owner is cooperating and has not been arrested. police trying to figure out a motive behind a drive-by shooting that left one dead.

it happened friday night on the lawn in front of an apartment complex. police say that the victims were walking on the street when they were attacked. the suspects are gang members but the victims were not afailuated with gangs and not targeted. it is the first homicide in two years. the mayor of one city is clearing out after a woman taking part in the protest died. the woman was in her 20s was found yesterday at occupy vancouver. police say she was transported to the hospital where she later died. the cause of death has not been determined. some protesters she died because of a drug overdose. police would not confirm the reports. the wet and cold weather hitting the bay area is making things a bit soggy here.

some occupiers hit the bongos hoping to drive the water away. others say they're homeless and used to the wet weather. >> now we have tents. before you would get arrested for sleeping on the street corner. right now, they're in the most defensive position. >> some tell us that the camp has a limited number of tarps and tents. some on the south bay spent last night in the dark. 1400 customers were affected. it went out last night and crews spent several hours restoring power. we do not have word yet on what caused the outage. crews worked to patch a water main break in san francisco. it began yesterday afternoon with a transmission line. the break happened near general hospital but there was no flooding inside. crews did have to divert water

from near by mains to supply the neighborhood. good morning to you. a live look at the sunshine. it's been about half hour now since the sun rose and a cool start. most of us will be dry. we're not out of the woods completely. let's head to storm tracker where you see some moisture over the bay area near san jose, picking up returns, looks like evergreen, for the afternoon, this system continues to move out of the area but it leaves in the possibility of a lingering shower now and again. what were the rain totals? pretty impressive. santa rosa. 3/4" over the mountains. 1-3/10 reported in some spots.

. good morning, a live look outside. a little bit of patchy dense fog over the north bay. the heyward fault remains active. a quake struck yesterday afternoon. it was 3-miles northeast of downtown berkeley and part of a series of quakes there many the past month. scientists say there's a 30% chance of a major earthquake there in the next 30 years. the ground is moving at a rate

of 4 1/2 millimeters a year. >> you can do it from the north end of san pablo eventually it goes under the bay. >> they could lessen the size by shifting some of the energy away. two and a half months after the the earthquake rocked the east coast, some are finally receiving help from uncle sam. representatives assisted homeowners, the 5.8 quake caused about $100 million in damages to one county. some homeowners who couldn't pay for the repairs say they had almost given up. >> i have no money to do anything with and it made me feel like i didn't care no more. >> some virginia counties are offering property tax relief and building fees for quake-

damaged homes. the labor department announced that the country's unemployment rate is down to 9% but the new numbers show that most of the unemployed are no longer receiving benefits. at least 14 million people have been unemployed for 1 year or longer. congress is expected to decide by the end of the year whether to extend benefits up to 99 weeks. a demonstration against the california dream act brought out a large group of counterprotesters. deputies and officers in riot gear ordered the counterprotesters to move away from the barricades. it took place yesterday. they say that the california dream act is one more example of what they call lax u.s. immigration policy. the weak economy in the united states could be one

reason for a recent drop in illegal immigration. officials tell the newspaper that the number of illegal immigrants arrested in the tucson sector fell by 40% last year. 123,000 illegals were arrested. it was the lowest number reported since 1993. ten years ago, more than 600,000 arrests were made near tucson. some officials say that the deployment of national guard troops, and a weak economy are reasons for the drop. vallejo police investigating a shooting near a high school. it happened friday night near vallejo high school's field. a man picking up his two daughters says that someone shot at his car. he drove off and found that one hit the rear seat head rest narrowly missing his daughter's

part in the annual marathon. let's go live for a look at the streets, you can see they're all shut down and the roadway is clear for the runners to come through. we'll see when they make it through the portion of the course. the race did start about 40 minutes and 47,000 people expected to take part including athletes. over the history of the race, it's grown to thousands of people. it could become a two-day event because of a one-day event. officials are considering holding races on saturday and sunday in the future. the bay area has its own race, it's the tenth annual half marathon. this is the course they take this morning. they will cross the golden gate bridge and come back and end close to the starting point.

the stanford cardinals football team won their 17th in a row yesterday. there was a scary moment here. the second quarter, chris gets leveled. he suffered a concussion and would leave on a stretcher. it's the third time he's taken a huge hit. sanford beat oregon state, a huge game now set up for next weekend, down on the farm is the cardinal host. the big win, tough loss. >> the fans who went out had to brave some tough weather. the fans had some rain gear going. we're hoping for better situation. >> we're not expecting the soaking from yesterday, we're dealing with a few scattered showers, looking at this view, mostly clear skies in some cases, north bay dealing with

in. police were called in to respond and staff members say that the patient was not detained. the nurse involved went to the er to be checked out and she is physically okay but shaken up. this morning, we talked to another nurse who was not working when it happened but says she's not surprised. dealing with unstable patients is a risk of the job. >> i'm not concerned with my safety, if i know that this person is upset, i will get some help. we do have policies in place that when a patient starts to get agitated, we have a code we can call to get assistance. >> reporter: the nurse's union says the policies are not adequate and many members are concerned for their safety. they said that the patient should have been in a psychiatric union not in the

regular parts of the hospital. there's tense negotiations going on between the nurse's union about the nurses' contract. on accept they went on a strike. i contacted to the hospital's spokeswoman. she said she hadn't heard of the incident yet and would get more information, as of this morning, we have not heard back yet. a teenage girl is dead after getting hit by two cars in san jose. police say that a honda civic and a mazda hit the pedestrian shortly after 8:00 last night between pearl avenue, it's not known what led up to the accident, but investigators say that the drivers remained at the scene. it's not believed they were driving under the influence. the southbound lanes of 101 are back open this morning after a four-car crash that

left 7 injured. it happened 1:30 this morning. a volkswagen bug and limo were involved. three of the victims were taken to the medical center. soaring transportation costs for california. a state commission study concludes that california meets half a trillion dollars to maintain roads in the next decade. they're already floating the idea of raising the gas tax for the first time since 1994. more confrontation in oakland after occupy protesters tried to enter a wells fargo branches for bank transfer days. bank officials clashed with the protesters at the downtown branch. the protesters wanted to close accounts because of what they call corporate greed and

. a live look, 40s at this hour. >> election day is tuesday and voter turnout will likely be on the low send. 75% of the voters in the county usually mail in their ballots. so far, a lot of voters have not turned in those ballots. it's received 10,000 fewer ballots than excepted so far. you can hear the candidates making a push to get your vote in the polls. in san francisco mayor's race, we need to sort it out. pensions from jobs is there any way to keep track of who is in front and who is in second?

it's all confusing. >> you have it right. it's a race that is like family feud and x factor. the voting system for the first time really is going to decide the mayor's race. those polls, i think they're almost meaningless, we don't know what will happen. look at oakland where gene received only 22% of the vote and she's the mayor today. hard to make predictions. the interim mayor, the guy who said he wouldn't run is ahead in the polls, under this voting system that a lot of voters don't understand, they indicate their first, second and third choice, the candidate that gets the majority of the vote is the winner. then the bottom candidate is eliminated. that's created all kinds of complications in terms of how the races are run. san francisco could be in for a

big surprise on tuesday. >> that is right. you talk about oakland and people are still talking about how the rank choice affected who they thought should be the leader. do you think any candidates are going, okay, ed lee might be the favorite, can i be the second choice? >> that's exactly what is happening. it's a completely thrown out the book in terms of how they're run. you have complications, take the american vote, there's five different candidates, how will the vote be split? all of the calculations going in. now they're not just appealing for voters, they're appealing for second and third place voters as well. >> we talked about some of the issues, talking about the occupy movements going on, is that an issue they don't want to touch. are they trying to play it safe and they could be first or second or third?

>> this occupy issue has been delicate issue in san francisco. most of the candidates all agree that they're sympathetic to the concerns voiced by occupy but have different views on how it should be handled. we've seen in oakland, it's been an issue and battered her in the polls. everyone is looking at that, the fact that san francisco has some important issues to deal with, pension reform, there's two ballot measures that voters have to decide upon. the city's budget and deficit, $350 million. there's all kinds of complications too. the independent committees that weighed in at least supporters are facing investigations in money laundering and voter fraud. he says he has nothing to do

. one man is dead and two hurt after a house explosion. workers responded to the home. firefighters say when they arrived, the home was leveled and what was left was engulfed in flames. >> you couldn't see the house, it was just a fire and then a door that was launched 30 feet from the house and now it's shredded and you couldn't see the house any more, it was gone. the cause of the explosion is under investigation but they're concentrating on a propane tank in the house. an investigation to figure out what caused a helicopter to lose power and crash into a house. it went down in west palm beach. the pilot and another passenger was taken to the hospital.

receiving a report of gunfire, when they arrived at the scene, they located two people inside a car, both were shot and the victims were transported to the hospital, their conditions are not known and no word if anyone is in custody. a 14-year-old girl is dead and 3 others wounded after a drive-by shooting in morgan hill. police arrested four people. the shooting happened friday night in front of an apartment complex. the victim has been identified, she and the other victims were walking on the street when they were shot. there's the number on the screen. police are investigating a possible copper wire theft that turned into a deadly shooting.
