> violence at occupy oakland. the camera man rushes to the scene as the victim of a fatal shooting is loaded on to a waiting ambulance. >> i'm calling on the campers, i want to say this clearly. i'm calling on the campers to please leave voluntarily tonight. >> reporter: good evening everyone i'm frank somerville. >> and i'm julie haener. oakland major jean quan says it is time for the occupy encampment to end. the final straw, tonight's fatal shooting. we start with eric rasmussen on

the fatal shooting and the mayor's call for protesters to clear out. >> reporter: she is asking for demonstrators to clear out. the police tape finally came down. witnesses tell us this young man was shot just past these porta-potty's and our cameras were there shortly after it happened. as the shots rang out on frank ogawa plaza there were hundreds of witnesses just steps away all part of the occupy oakland camp. several told ktvu it started with a fight just before 5:00 p.m. involving four men attacking another man. >> the guy got free and ran. he just ran down here. and then i heard you know we heard the pops, pop pop, pop. >> reporter: john lucas a

volunteer medic at the camp started the first response. as police got there, some people were fighting the crowd. other witnesses tell ktvu the victim was not from occupy oakland but might have been looking to hide out until the camp. >> they were apparently looking for somebody and they apparently found that person. >> reporter: oakland major jean quan called a last minute news conference after it was confirmed that the man who was shot did not survive. >> i'm calling on the campers to please leave voluntarily tonight. i have city workers out there who have been offering vouchers to homeless shelters. >> reporter: many people here today are saying they are not leaving. we shot some video of a vigil they are having out here at the

oakland camp. but she wouldn't get specific; demonstrators here say they have not heard that message directly from the mayor tonight. there's no word yet on the shooter or victim. we also caught up from the president of the council. mayor reed wants the camp removed and he told us what happened tonight just emphasizes his point. >> you have that element to complicate the element that we're dealing with with the encampment. >> the oakland chamber of commerce also wants the occupiers to leave. the chamber pulled 1,100 residents. among those who have an opinion about 60% say the encampment should go. 63% say occupy oakland has hurt business and 73% say they

disapprove of the way major jean quan has handled the occupy oakland situation. nowhere has business hurt more than around the plaza. customers are staying clear of the area. john vacar joins us now live with what many businesses say needs to be done. >> every one of the major business people i've talked to around here say the occupiers are indeed peaceful. but they say they are concerned about the encampment is trouble. the open sign and empty seats speaks volumes. but just a couple of blocks away the cafe seemed busy but not bustling. >> we're doing okay, it's not the same as old times, i think those perceptions are real but

-- most will be from the information technology department. the company began the lay offs yesterday and says those i.p. workers are being given a chance to find other jobs within the company. >> there are allegations tonight of police brutality following a student protest at uc berkeley. we showed you the confrontation last night on the ktvu news. tonight ktvu's amber lee is live with the video of the police action that some say went too far. amber-- >> reporter: julie, student protesters tell us this you tube video is proof that police use excessive force and they're calling for changes in police tactics. >> proposed no outside police under any circumstances no matter what. >> reporter: hundreds of police gathered for what they called a general assembly at 6:00 tonight. they say tuition hikes are causing them to struggle so they're modeling their protest after the occupy movement. >> our representatives are not

listening to us. it does not matter if we flood their inboxes with e-mails or voice mails. >> reporter: tonight's gathering has been peaceful with police officers monitoring the protest on the perimeter. some students are calling for the campus police chief to resign. this is you tube video of last night's protest. some students say it shows that police use excessive force. >> officers and demonstrators were linking arms. officers were use ramming the baton in order to collapse. >> officers had to use physical force to move them away so they can remove the illegal tent and remove them from the area. >> reporter: officials say they respect their right to free speech. this morning a protester put up a tent. police immediately removed it and arrested him. if that means that we have to

be arrested and take some hits to expose how ridiculously absurd the system is. so be it. >> campus police say they are reviewing several sources of video including cameras worn by campus police officers to determine what exactly happened. reporting live here at uc berkeley, amber lee, ktvu channel 2 news. some students at san jose state are camping out tonight. but it's not an occupy event. 50 people are spending the night in tents for poverty under the stars. organizers say they want to bring attention to homelessness and a higher minimum wage in california. >> i think this makes a difference by showing people that there's an issue so it brings it to the forefront, and awareness is the first step. >> i have had three students this semester out of my 100 plus students that are living in homeless shelters, three of them. >> the message here is similar to the occupy movement and a few members of occupy san jose

are at the event. the university only expects people to remain for one night and say they will be talking to organizers and issuing citations if anyone tries to stay there longer. >> state comptroller says the state is taking in much less. spending exceeded projections by 1.7 billion. it remains to be seen if the gap can be bridged in the spring where the state collects huge amounts of income tax payment. if not there are automatic cuts built into the budget approved by the legislature back in june. >> munni's deficit is expected to increase next year. the agency will consider several revenue proposals next monday. they increase raising fares and start charging another 25-cents for use of a transfer.

messages, cutting spending by reducing government agencies. he says he's human and like many people had a brain freeze. perry is scheduled to appear on the late show with david letterman tonight. in pittsburg, police are expected to investigate the shooting death of a man. what police say drove a 39-year- old man to kill three members of his family and then himself. >> it started with a 4:00 a.m. 911 call from a man inside this home to pittsburg police. >> saying that he had just killed his family and he was about to kill himself. >> reporter: police arrived within minutes but could not contact anyone inside. this is a photo taken by a neighbor as the s.w.a.t. team moved in at around 9:00 a.m. >> we ultimately made entrance and found four diseased adults.

one appeared to be suffering from what looked like a self- inflicted gunshot wound. >> it's quite shocking for us because this neighborhood is quiet. >> reporter: neighbors cecilia abobo says she didn't hear any shots and only learned about it when police knocked on her door. >> they did a small steak -- stake out at our home. >> reporter: cecilia says she only knew her neighbors slightly and that the husband was in and out of employment. >> ultimately ended up shooting himself and the members inside the house. >> reporter: police say a facebook page linked to the shooter had a message detailing his financial problems. and police say that message was indicative of a suicide note. ken pritchett, ktvu channel 2 news. in live storm tracker two, picking up a few showers offshore. they are weak, as this system

using part time workers which leaves many without access to benefits. the workers are in the midst of contract talks. the united states senate today approved legislation that will help unemployed veterans find work. if it's approved by the house next week the legislation will extend tax credits to businesses that hire veterans. it would also provide funding for retraining older veterans. the obama administration estimates 200,000 troops. the big is part of obama's jobs package. tomorrow veterans all across the country will be honored but tonight there was an emotional preevent. lloyd lacuesta is in san jose and tells us how all of the veterans who were in tonight shared one thing in common. >> i'm at the veterans veterans memorial where a number of events is planned for

new information now on a deportation case we first told you about on tuesday. the board of immigration appeals has agreed now to consider a daly city man's request for appeal. came from the philippines with his family 16 years ago. but immigration officials previously denied his request for asylum. supporters say the appeal means h means -- means he will not be deported while his case is being reviewed. richport was just 25 years old when he pleaded not guilty to contest to shooting at south san francisco officers and then disappeared. now he is 67 years old, married with two sons and has a masters degree. today he turned himself in in redwood city to enter a guilty plea. >> this seems to be the right
