the front desk. in the classroom around the blind corner that is where they saw police enter and that's where the shooting happened. with their suspect at the back of the room. now here is what students had to say, about what they heard in their own words. >> i work in the lab and i was sitting there at the front desk and a group of police officers, maybe four or five came in. they knew, it seemed as if they knew there was someone of suspicious nature in the lab. and they went back into the classroom. >> i heard, i heard someone say drop the gun. and then i heard shots ring out shortly after that. >> i heard like five or six shots. like pop, pop, pop right away. >> it was loud and i haven't heard gunshots inside before. so it sounded like doors slamming very quickly is what it sounded like. and then when it became clear that it wasn't doors -- >> at that point i hit the deck and was kind of in shock mode.

>> we all dropped to the ground, and then after that everybody was motioned to get out of the lab. that's how we ended up here. >> i guess i'm puzzled by what's going on and what happened. i don't know if i'm shaken up or not, i'm just kind of puzzled. >> reporter: the police were alerted about someone who entered into that classroom after a staff member here at the university saw a man in an elevator with a gun in his backpack. now of the students we talked to, they say it is unclear to them just how many students were in that back classroom where the shooting occurred. none of the students we talked to while they did see police enter the classroom they did not see this suspect. the man who was shot by police. they did not notice when he entered the classroom himself. at berkeley, ken pritchett, ktvu channel 2 news. again the hass business school was evacuated after that shooting. this is the text alert sent to

students after it happened. a suspect is in custody and it warned them to stay away from the building. all of this happened just after 2:00 this afternoon. four students were inside the room when the shots were fired. authorities then shot the man several times. police were tipped off after a staff member saw the man hold the gun out of his backpack in an elevator. >> he looked at her, and then apparently reached into his backpack, pulled out an object which this person thought might be a gun, but didn't know for certain. was now know for certain it was a gun. and put it back into his backpack and then got off on the third floor. >> that suspect is now at highland hospital, we do not know about his condition. protesters are taking part in a general assembly. earlier they were taking part in a general strike. eric rasmussen is right in the middle of that crowd there at sprawl plaza. what's going on as we speak. >> reporter: this crowd seems

to be getting bigger by the minute. we're going to take a look here, like you said they are still holding their general assembly which has been going on for about an hour. we're showing you up there on the steps of sprawl hall. that's where speakers have gathered where they are talking about various things here tonight. we can even give you a view from chopper 2 to give you a sense of how large this crowd is. and students we've talked to say this protest is now certainly about more than just tuition hikes. >> reporter: uc berkeley students poured back into sprawl plaza tonight to cap off a day long strike. in addition to demanding the cancellation of classes, protesters marched down bancroft lane asking the banks to pay for the higher tuition. >> do i think something is going to happen? i don't know, we'll see. >> reporter: one student who was there insists it's all part of the same message. >> we pay for the maintenance of this campus, we also pay for

the salaries of the police officers who hit us, and this is our university. >> reporter: protesters recently displaced in oakland also hit the street marching toward berkeley. many say they have a lot of frustrations in common with the crowds joining at cal. >> i want to be a psychologist, med school will cost me 250 grand, but they want to raise tuition so it costs me 250 grand about 25 more thousand. but that's ridiculous. >> reporter: and as we come back out live, you can see several police officers are not far away from where all of this is happening right now. i also took a walk, kind of just before we came online, i've already seen one tent in the plaza. occupy oakland protesters have also set up camp outside frank ogawa plaza. this was the scene this morning on snow park whereabout a dozen

schools and stole necklaces from three girls. a witness says that the woman pretends to be a family friends and get it is girls to give up the necklaces. >> adults were around, this is the thing. this person is very, you know i want to say cunning. >> reporter: the suspect is described as a latino woman in her 30s with a medium build and brown hair. she has been spotted with a little boy. a december 7th court date has been set for an assemblywoman who is accused of shoplifting. she is charged for allegedly stealing $2,500 last month from a neiman marcus at union square. she claims she was talking on her cell phone and inadvertently walked out with the items. ktvu's robert handa is in

santa clara with the key decision before city leaders, robert. >> reporter: we are at santa clara city hall where people are just starting to arrive for the meeting that starts within an hour. the decision here tonight is considered a crucial state toward ground breaking of a new stadium. there is still a lot of work and money needed to turn the site into the mega million dollars complex the city and team want open for the 2015 season. tonight the city council is expected to approve $10 million to begin infrastructure work such as water and sewer lines. >> the coin toss if you like to put it. what it does is it moves all of our infrastructure outside of the footprint of the building to get it ready so the building is ready. >> reporter: people are upset the over all stadium cost was not revealed back in june. and point out there is still no contract with the 49ers and no public financing plan. for them tonight's vote is another slap to taxpayers.

>> they are spending our money without our authorization. if they so much believe then put it on the ballot. put it on the ballot. do you want us to spend $10 million for infrastructure in a parking lot. >> reporter: though the stadium still generate as -- generates a lot of support, the big chunks of spending are still worriness. >> it's hard to go after these nonessential types of items. >> in the current economic situation money would probably be better used for people and you know things that they need. >> reporter: mayor matthews says he still believes the stadium would generate jobs and revenue. >> there's doubting thomas, at some point i will let them take these people blindfolded and let them touch the stadium but it's going to happen. >> reporter: the plan is still attracting investors and a plan will be made public next month. dozens of people also came together in oakland to protest

cuts to state health care programs. demonstrators ralled on clay and 16th street this afternoon. they tell us the state the planning deep cut that is will most affect people who are already suffering. >> the rich, super rich that are living in high comfort while, while my sister is trying to fig fig -- figure out how to get a doctors appointment because she has bronchitis and needs to get it looked at. and the forecast is bleak for california's budget. a report by the department of finance show it is state has taken in about a billion dollars less revenue than lawmakers anticipated when they passed the budget back in june. another revenue report by the legislative analyst office is expected tomorrow. facebook is investigating reports of porn spam on some user accounts. there has been an increase of

a consumer watchdog group sued anthem for raising its deductibles too frequently. consumer watchdog filed a lawsuit against the health insurance company. one san francisco customer says

blue cross raised her premium, copay and deductible mid-way through her contract. >> we don't know what kind of coverage we're going to have. it's impossible to plan. we don't know, we can't budget for our house care. >> anthem blue cross would not comment on the lawsuit. they issue add statement reading in part, health plans are highly regulated and all changes were made with the knowledge of approval of state regulators. a san francisco elementary school is mourning the loss of one of its students tonight. a brave little boy who is battling a lifelong and life ending disease. david stevenson is live now at the school with how the boy thought his school about perseverance and determination, david. >> reporter: julie even until the end, this young man refused to let his disability keep him from living his life just like

a normal kid. children wrote their farewell to yohan castro. we first met yohan in 2009. >> he brought out the best in everybody. >> reporter: he was 9 years old when we met him and far smaller than other children in his fourth grade class. >> fearless, fearless guy. sense of humor, and he was able to laugh at his own condition. >> reporter: despite his blindness, joham became an enthusiasm skateboarders taking tumbles in strides. >> i didn't know how to ride it, so my first time, and i stand on it i didn't fall. >> reporter: i think kids learned compassion, because they always watched out for yohan and they always made sure that he was safe. >> reporter: his idol proskateboarder tony hawk even sent him an autographed

picture. but his illness continued to grow and on sunday he died at home in san francisco with his parents at his side. >> we'll miss him. you can see the love the whole community has for him. >> reporter: barron thought yohan math by tracing equations on the blind boy's back. >> we complained about little things but he won't complain about all the thing that is he had. we have a headache, we had a bad day, we have to get up and go through life. with his condition he did it. >> reporter: a memorial service for 11-year-old yoham barrios castro is set for saturday night here in the castro district. david stevenson, ktvu news. a new report shows california colleges have opened their doors to more international students than any other state in the union. the institute of international education says more than 96,000 foreign students are currently enrolled in colleges across southern california. new york came in second for the number of enrolled

international students followed by texas, massachusetts, and illinois. a new judge is taking a seat on a bay area federal bench. the senate today confirmed alameda court judge yvonne rogers as the new federal judge in san francisco. she was nominated to the seat by president obama earlier this year and is the first latina to sit on the bay area federal bench. a sonoma man armed with only his shoe laces stopped a man in his home. he has more on what happened with a man that has a long police history. >> reporter: he showed us how he detained a burglar using his whit. >> i got him on to his stomach on the ground we were grappling. i had his arm back here and bent like that and pulled back as hard as we could. >> reporter: armstrong used these string tieing techniques on this burglary suspect. jimmy george haywood who he

found in his home he shares with his girlfriend this past saturday. >> i see someone in a wife beater with tattoos all over him. and riding on a note pad sitting next to my dog. >> reporter: when he noticed his wallet missing he confronted the suspect who ran away down the street into this trailer. >> he's been incorporated with the exception of a very few months since he was 18 years old. >> reporter: the trailer belongs to his father, he says his son most recently convicted for assault with a deadly weapon was released from prison on sunday. he said he could only watch as armstrong read his son his rights. >> i don't everyone know if i said it right. i said it because i knew if he heard that that he would think that i was an officer off duty, under cover, you know just

something. - - >> i am just so proud of him. he is definitely improvised on that i don't know what i would have done if i would have walked in. >> reporter: sheriff deputies later formally arrested haywood on whom they found about $100 in cash believed to belong to armstrong. haywood is currently being held without bond in jail. in less than an hour the alameda city council is poised to give final passage to a far reaching ban on smoking. if approved the ordnance would prohibit smoking in apartments and condominiums including on balconies and porches. if passed, the ban would take effect on december 15th. san francisco's first in the nation ban on plastic bags could soon get tougher. supervisor ross pecarini has introduced legislation to

charge shoppers 10-cents per bag at check out. it would also extend to retail stores. proposal goes before the board of supervisors next tuesday. and a pretty nice day today, temperatures got into the mid- and upper 60s in some places. templetures are going to start trending down -- temperatures are going to start trepding down as we -- start trending down as we go into the next few days. up at point rays i have winds gusting at 20 miles per hour. that's a westerly wind. that sort of helps us keep a little bit warmer. it's that northwest wind that keeps us so cold or lack of wind. these were the observed highs today. santa rosa 70, 69 in san rafael. highs will be cooling in many bay area locations. we saw it this morning, when you get going tomorrow morning it'll be out there in the spots that you had it this morning.

so prepare a little extra time as you head off to school with the kids. especially in the north bay up around san helena and napa because it slows you down. it doesn't, if the traffic is snot slow you should slow down. if the visibilities get down low, you know that. tomorrow morning overnight lows tonight as i mentioned in the upper 30s, low 40s. nice dry day tomorrow. the extended forecast we come back into some rain. some shower activity as we get into friday. westerly winds kind of keeping things on track through tomorrow but slightly cooler day. 5degrees cooler. then this system rolls in thursday night into friday. and as it does, temperatures start to trend down. friday we've got scattered showers in the forecast. your morning commute could have some sprinkles. this is not a big deal. it shouldn't be a deal breaker on any outdoor activities just keep an umbrella handy. be prepared, well, unless
