open again. we'll show you pictures from news chopper 2. there was some pushing and shoving between the police and protesters here. the police tell me just moments ago that some of the officers did take some bottles that were thrown at them. and that some of the protesters tried to grab some officers' guns and batons. and at one point the lieutenant was trapped in between the doors as officers were trying to get into the lobby to arrest the protesters who are inside the bank of america. here is what was going on inside the bank, and here is some video of that. [loud noises] . >> reporter: the protesters got inside, chanted, there were reports of vandalism of graffiti being written on walls and the floor, even a tent was put up inside the lobby of the bank. the bank manager called for police to take the people out. they will be charged with

trespassing. that process is still going on as protesters were being arrested. we talked to some people here earlier tonight about what was happening here. >> i mean i guess the goal is to get attention towards the fact that the banks are benefiting a, from the crisis, and b, in particular from the accumulating student debt. and -- so i guess it is more of a pr thing to get the message out, to get people like you from the media to come here and to report it. and since it is totally peaceful so far, i think it is a good idea. >> i think it is a waste of taxpayer dollars. >> are the police involved here? >> yes, it has been happening all day, the news helicopters have been buzzing at the building. we're up there on the 27th floor. it hadn't been good. >> reporter: a short time ago, a police spokesperson told me that between 70 and 80 protesters will be arrested when all is said and done. many were taken away in some of the sheriff's buses here

earlier this evening. but there is still protesters inside the lobby of the bank. and i just went up and looked through the window a few moments ago. and there is still the tent inside the lobby with some protesters inside of that tent, maybe half a dozen or so. so police are in there one by one, arresting them, loading them onto vans and buses to take them to be booked for trespassing. it could be a while before the area is cleared out. live, san francisco, ken wayne, ktvu news. and after that con frontation, many expressed their anger about the tuition hikes and public education costs, they want more money for that. others say the protest was organized and peaceful. california state university trustees today voted to approve a 9% tuition hike. student costs to go up almost $500 to 5970 each year.

and we add in campus fees and the cost for an under-graduate to go to a state university, now it will be more than $7000 for a full year. compare that to 10 years ago when tuition was only $1600. this by the way is the 9th straight year for tuition increases. and in san francisco, several tents in the occupy camps were taken down this morning. now the question is will the rest of the campers be kicked out? ktvu live in the city where the officials there swept through the camp late today to inspect it. >> reporter: and gasia mikaelian, take a look at the tent behind me there, within the last hour we saw the occupy members take down tents, put up that free standing one. part of an effort to comply with the requests after the mayor indicated that protesters here may need to leave soon. >> i have expressed i need dramatic changes in the occupier's presence there.

>> reporter: hours later, mayor lee met with the protesters, saying time is running out for the health, and safety rules. >> i want the immediate situation to happen today. >> reporter: they look at an estimated 200 people, several dogs are living in 198 tents. and city officials say the growing camp is unsafe and unhealthy. >> the possibility that people can begin to transmit both the stomach issues and breathing issues is a concern. >> reporter: but the occupy members and supporters say that san francisco officials are sending mixed messages. this flier issued several weeks ago by the city indicated forms of camping are allowed. >> we are not okay with the city deciding who gets to be part of this movement. the only way this movement can get stronger is by the number of people growing within it. >> reporter: protesters say they're doing their best to keep the camp clean, while welcoming new members. >> the tactics that i see of --

mixed messages, exhausted people, is a set-up. it is a set-up for going in and raiding this camp. >> reporter: even with the expectation of another raid, they hope that the city will help them find a piece of private land to continue the protests, ktvu channel 2 action news. and in berkeley tonight, students continue to occupy the plaza on the university of california campus ♪ ♪ ♪ ♪ . i am ordering you to removal tents and other camping equipment. >> every hour, police used that bull horn there to order the group to remove their tents and other camping gear that they may have set up. but as often as that order is given, it is just ignored. demonstrators hope for strength in numbers. >> there is not enough people here, then the police could feel like they could come in and bully people. which is what you know they did last wednesday. >> and the uc police are refusing to say if a deadline

has been set to evict the group or comment on possible tactics. a spokesperson says that students are allowed to demonstrate around the clock, but tents and camping are against the university policy. our coverage continues on our website at ktvu.com. we are monitoring the occupy protests in san francisco and berkeley and will update the stories throughout the night on line. and we're learning more about the uc berkeley student behind the campus shooting at cal. we have more information about the student shot and killed by police, alex? >> reporter: well, chris travis had started a two year degree program here at the school of business. for some reason yesterday he brought a loaded handgun in with him to the computer lab on campus. the police officers ended up confronting him. and in the end they shot him. this is a facebook page set up to honor 32-year-old chris travis, the uc berkeley student killed by campus police

yesterday. according to this youtube video, he worked as a shift supervisor for a security company. he dropped out of school before but was giving it another try, hoping to pursue a career in national business. he was living in the house near campus. his neighbor says he was quiet, kept to himself. >> it does surprise me, interesting you know, you never really get to know the people you live around well enough to expect something like that. >> reporter: meanwhile, the room where those shots were fired yesterday, it is still closed off as a crime scene. the entire thing was captured on this surveillance system. this student watched it all happen. the students ducked for cover. >> i think it is justified i think, because -- i am not sure what he did, if he dropped it or not. but if they said -- they yelled at least three times, drop the gun.

>> reporter: police fired multiple shots and travis died last night at the hospital. the down of the business school, rich lions, says there were counselors on hand today to help the students and staff cope. he is giving credit to the alert staff member who spotted the gun and called for help. >> there is terrible scenarios that didn't happen. we're thankful that she showed courage. >> reporter: a police lieutenant told me it is not clear why travis brought the gun on campus. he says that investigators don't think he was planning to target other students. meanwhile, the campus police officer who fired the shots yesterday is on paid leave right now, while the department does a full investigation. live in berkeley, alex savage, ktvu channel 2 action news. and a union city man facing 50 years to life in prison after an alameda county jury today found him guilty of trying to kill an undercover fremont police officer.

in august los last year, they had to shoot at the man 10 times, he took off, shooting into occupied cars and later car jacking a vehicle. he was arrested the next day in san diego. the officer who was hit was seriously injured but did survive. barrietos is set to be sentenced next month. and a north bay college student sentenced today in a case of texting while driving that left a toddler dead. 19-year-old dunaway pled no contest in the death of murray. authorities say dunaway was texting when she hit the two- year-old and her mother, the mother suffering severe injuries, today, the judge sentenced dunaway to 120 days in custody, five in jail, the rest under electronic monitoring. >> i think there should have been more time in jail. but -- i don't get to make that choice and it hurts.

>> dunaway must also perform community service and pay restitution. and a new forecast predicts the state will be so far in the red next year it could force automatic budget cuts. one analyst is predicting a 3 billion shortfall by next year, the state will be shorten million, whether the cuts are triggered depends on the report to be issued by the department of finance next month. the cuts would target the university of california, cal state universities, public schools and inhome care, among other programs. stocks finished lower today, the dow lost 190 points on fears that the european debt crisis will affect u.s. banks. the dow closed at 11,905 points, nasdaq closed at 3539. and johnson and johnson

removing shampoo for babies after pressure. one is considered a health risk, and johnson and johnson said the products are safe and meets safety standards but they will get rid of the chemicals in the u.s. investigation of their product. and the california supreme court to release a ruling at 10:00 tomorrow on a key element in the battle over same-sex marriage. the court heard argumenting on whether the backers of prop 8 have the right to defend it in court. the prop 8 supporters say they had to take up the cause because the law was not continued. and suing san francisco over a controversial new law, the law is designed to protect women from deceitful advertising and misleading information from crisis pregnancy centers. but first resort pregnancy center says that the law is unconstitutional. they say the law singles out pro life centers and excludes

. there was another protest outside the state building on golden gate in san francisco, and a third protest at uc berkeley in found of spraul hall, we'll keep you updated and have full coverage on tv 36, as well as tonight on the 10:00 news. and millions of patients at a northern california chain are told about a data breach. they say the computers stolen last month in sacramento contain names, birth dates and other information for more than four million patients. patients from 11 bay area providers had data on that computer. the sacramento based sutter says it is notifying affected patients by mail. and closing argumenting happening today in the trial of a fairfield mother charged with second degree murder in an apartment complex that killed four children. james is accused of leaving her three young children and a two- year-old niece alone with candles burning back in april

of last year. the solano county district attorney said that james knew there was danger. her attorney said she didn't mean to harm the children, all who were under the age of four. and san jose police arrested two men suspected in burglary. clifton van tran and the accomplice were taken into custody yesterday afternoon, officers say there were over 100 marijuana plants inside the home. but they say it is not clear if the suspects targeted the house because of the marijuana. and tenants in a south bay trailer park say they will have to handle raw sewage and sickness when the cold weather arrives, unless the property manager helps. robert handa has more on the story, where they say it is the worst in san jose. >> reporter: well, a group of tenants here got our attention, making that claim. they say they are scared the park's sewage system will over-

flow when the storms move in. the groups marched through the western trailer park in san jose to draw attention to what they call dangerous and sometimes unclean conditions. they are angry that owners are not upgrading the park's sewage system. through a translator, they told us before christmas last year rain overwhelmed the pipes. >> the water of the assume system came into my whole house, it was flooding. i came into the trailer, i saw the water on the floor. and it was just a horrible smell. i was frightened and scared because i didn't know what to do to keep the water from coming out. >> the plumbing is at least 70 something years old. that needs to be changed and upgraded somehow, and they don't want to make to changes. >> reporter: the park manager says it is not true. he says after the vice mayor

intervened, they passed a code inspection in july. >> we don't have a faulty system, everything is 100% working in our property. >> they say it is about 60-70 years old, needs upgrading. >> we have upgraded each year, spent at least over 15,000 a year to work on it. >> reporter: we talked to one tenant who agreed. >> i never had that problem so i don't know if it is affecting a certain part of the park only or what the situation is, but i never have had that problem. >> reporter: owners there plan to resume the meeting. and the management put out the forms so that now all complaints and suggestions will be in writing. but it is possible nobody will find out which side is right until it rains, live, san jose, robert handa, ktvu. others gathering to help children in school with a new program. it is called a thousand hearts for a thousand minds, to match the adults with the students, to help the children learn

reading, math and science. >> there is an effort, four or six months at a time can have huge impacts helping a child catch up with grade level or more in basic reading and math skills. >> the project is targeting kindergarten through 8th graders in san jose, and is sponsored by the city and the silicon valley leadership group. and there are weather changes coming our way. you may have noticed a little bit today, cooler, tomorrow, cooler, clouds, by tomorrow night, possible sprinkles in your neighborhood. up north, picking out showers, by tomorrow night they make it down to the north bay valleys. and maybe as far south as san francisco, by the evening. but light showers, these are the highs from today. the deal tomorrow, about -- five to 10 degrees cooler than these, more clouds in this system moving in. it is a weak one -- notice there is not a lot of moisture

with it. you see the cold air? that is the key to this system. not a big rain producer, it will rain, but not five inches, or shouldn't. we'll see the widely scattered thundershowers, and the front will get closer, temperatures coming down, face one, face two as you get into friday, now the cool air comes in behind it. the computer model showing showers moving in by friday, snow levels drops by 3000 feet on some bay area peaks, and up around the shasta area, cold air in place, setting us up for an unsettled period ahead. tomorrow, not a bad day, clouds here, temperatures dropping, showers' thursday evening, shouldn't impact your commute either. as we get into friday now, things change around, here comes the cold air, there is the morning commute, dry except in the north bay. here is the afternoon commute. showers moving through, widely scattered showers, cold air,
