good morning. welcome to mornings on 2. i'm dave. >> i'm tori campbell. it's thursday, november 17th. we go straight to sal, who is following developing traffic news from san bruno. >> we're looking at a live picture here of el camino real, near interstate 380, where police have closed off a section of el camino real between san bruno avenue and interstate 380. they're not letting people get off the freeway. we do know this has been closed for several hours. police are not saying much. the chp is there, just to allow san bruno police to investigate

this scene. now, apparently some cars are getting through. you can see these cars don't know where they're in coming from but the major part of el camino real is closed between san bruno avenue and interstate 380. it's a good idea not to try to get off the offramp. chp has closed off that offramp. one lane there of eastbound 380 ramp is closed if you're making a right turn some this is a major incident, and it's been there for hours. ktvu news crew is on the way to find out more. but right now this is had we know. stay away from el camino real near interstate 380. back to the desk. we are also following overnight news in the occupy movement. police in riot gear now guard, uc berkeley spirale plaza after a raid on the camp just a few hours ago. ktvu's claudine wong has been on the scene all morning and joins us now live. so are things fairly quiet there, claudine? >> reporter: they are. in the last 10 minutes the

police line moved back to allow people through the plaza. but they're still blocking the steps, this area here. they're still trying to clean it up. they've cleared away several tents and different items from this plaza, couple pianos and couches and now this group of protestors is waiting to get back on the plaza. they tried to get there before but police told them they could not go on. you're still waiting to get up there? and do you -- you'll be allowed to get up there? >> i don't care, like not at all. they say a lot of things and they don't really rule and through. so i mean, we'll see. >> okay. all right. thank you. this raid happened about 3:30 this morning, so we've been here for hours. we have obtained this from a student protestor who was sleeping in one of tents. when the police came in and gave them a five-minute dispersal order, he picked up his camera and started rolling. it moved pretty peacefully through there. five agencies came in to help

uc berkeley police. most people left, two people were arrested. one man, little difficult to see but he has a cat on his shoulder. he gave the cat to someone else. he and one other person were taken into custody. still very peaceful. i talked to police about how this raid compared to last week's raid, and they said it went much better. >> i think a lot of it depends on behavior this morning. the crowd was very, very peaceful and they were comply ants to police officers' commands to vacate. the two arrested were also submit to arrest peacefully. that was a big difference. crowd reaction. >> there has been clean-up underway for the last few hours since police cleared that plaza. and if we come back live, you can see a small group of pro testifiers still stepping out here, they're making signs, getting ready to head back in.

for most of the morning they've just sat at the police line waiting to go back in. but again as the day begins here, they want to get this plaza back open. they're power washing, just got a handful of officers, and standing by. the protestors we talked to say they'll have a meeting tonight. they do plan on going and sitting on the stairs but say they will wait to try to put up the tents again. claudine wong, ktvu channel 2 news. happening now, the original occupy protests in new york is heating up, this is a live picture from wall street. looks like quite a few police officers outside of a building. in the past two and a half hours, we have seen several scuffles between demonstrators and police. the occupy movement began exactly two months ago, and protestors are marking the occasion with a day of action. that includes this morning's protests, which we're seeing just part of, it also a rally at new york city hall. there are reports this morning that a group of occupy

in hayward. faculty members are walking picket lines here and at csu dominguez hills. they approved a one-day strike saying the administration went back on its promise to give faculty members pay raises. but the university says it cannot afford raises, due to state funding cuts. california supreme court will release a ruling at 10:00 this morning on a key element in the battle over same-sex marriage. the court will issue a decision on whether the sponsors of prop 8 have the right to defend the same-sex marriage ban in federal court. prop 8 supporters say she their allowed to take up the case because california's elected officials have refused to defend the voter approved law. coming up at 7:30, ktvu's pam cook will have more on what the decision could mean for gay couples hoping to get married. pleasant hill police arrested a 14-year-old boy after he led them on a brief

car chase yesterday. police say the young man stole a car from diablo valley college's student parking lot. police followed the car down contra costa boulevard, until he ditched the car and ran off near ellenwood drive. police chased him. they arrested him. police say the unman is a runaway who drove another stolen car to the campus. all right. let's check in with sal for some more on traffic and an update on the situation in san bruno. >> that's right, we're following this developing situation in san bruno, where we've had el camino real closed for two hours. this -- it's been longer than that for some sort of traffic incident, but it seems like a lot more than that, because they've been out there for so long. el camino real continues to be shut down between san bruno avenue, 380, and also between -- so if you're driving southbound on el camino you won't be able to get by steve

lane. you may be forced to make a right and you will not be able to make a left and it's a good idea to just avoid the area completely. let's go out and look now at westbound 237. we have some stop and go traffic here crossing 880, with no major problems in the south bay. but just slow. northbound 101, san jose, we have slow traffic there as well. we look at the commute, there was an earlier crash right at interstate 280. 280 northbound up to highway 17, slow traffic there, and northbound 17 -- no, northbound 85 backed up through saratoga to cupertino. hayward, southbound 880 slow from 238 down to about tennyson. and on westbound highway 4, slow traffic antioch, slow in by point. sunrise over the big city, cooler today, nice yesterday. upper 60s to near 70. not the case today. this is not a rainy system or

systems that's coming in, but it does have some much cooler air. so we say good-bye to 70s like livermore did yesterday, 71. not today. santa rosa 59. not a big change there. coast never knot got that warm. livermore down to 64 and san jose 64. tomorrow temperatures highs in the 50s. so the colder, cooler air is on the way. most of this will slide east and south of us, but increasing clouds today and not a lot but low cloud deck is increased. some light rain or drizzle north bay this afternoon and evening. but cooling has begun that will take us into tomorrow. again there will be some hit and miss showers tomorrow. but this is not a big rain producer. highs only in the 50s some it will be breezy and colder, if there's any available moisture the snow level could by friday night get down to 3,000 feet possible but not a lot with this. there's more cold air. one system slicing through right there. about an inch of rain at crescent city but that's the cold air. look where it's driving,

towards portland, seattle and not us. so it's going to move in. we'll be on the southwest edge. but still possibility of rain is there. nothing too heavy but starting to light up a little bit towards mendocino county. that will slide into napa. 40s and 50s on your temps so there were some 30s for a while but some of that fog now moved in. the breeze picked up. so most locations are in the 40s or 50s. again, it's just going to be a cooler pattern so low clouds and densing if. chilly morning, not as cold as we've seen but sun for a while. then increasing clouds, mainly low clouds but it's a colder pattern. today starts it all. then we'll feel it into the weekend as temperatures on the high side stay in the mid-50s. some sun, some fog, clouds, it will be cooler. light rain possible to the north but 50s and 60s now. there won't be that big of a difference anymore, five or six degrees from top to bottom. some sun, some clouds, some rain takes us into friday but it will be colder and breezy with weekend in view. chilly and breezy saturday. sunday looks like rain wants to favor the coast.

occupy wall street protestors. they were blocking traffic, leading into the financial district. our reporter is live at the nasdaq to tell us the impact of what is happening. carter, how was it for you going to work? >> reporter: well, for me it baby much of a problem. right now i can she you outside the nasdaq from our camera across the street, and take a look. we really don't see any of these protestors here right now although there was a threat and word going around they might be dressing up in business suits and trying to blend in with the crowd. but it appears they're primarily at wall street right now. let's show you some video from that earlier today. there's a huge crowd. this is the two-month anniversary of this occupy wall street movement. and as you know, the protestors were removed from their location where they've been staying the last couple months, so that park is pretty much empty right now. they cannot sleep there. what you're seeing is them in front of wall street,

surrounding the new york stock exchange. within a stone's throw of the new york stock exchange. but there's a huge police presence there right now as well. mounted police officers on horses also to keep the crowd under control. for the most part, we understand that the crowd is being relatively civil. there are some arrests, and mainly the people getting arrested are those who are blocking physically blocking people from getting to work. and apparently, they are picking and choosing who they believe should be able to go to work and who shouldn't be able to go to work. one account that i heard at wall street is they were blocking people who were dressed up nicely in business suits and professional business attire, and for example a man pushing a food cart, they said make way, working man coming through. so they're trying to distinguish what they believe are the people they're actually fighting and protesting against and those they are representing.

so that's one of the things that you're seeing down there today. but as far as the opening bell, they were not successful in stopping the opening bell. and i don't think anyone really here in the professional community or the city politicians or police thought they were going to be able to do that today. even though you don't see any people outside the nasdaq right now, they are taking precautions and they have been taking precautions because you just really don't know what can happen in this case. and we do expect at some point people could make their way up here as well. the interesting thing is, though, in all of this is just distracting today for good economic news we got, the weeky hundred employment numbers are in. 388,000 people filing new application for unemployment benefits, better than expected, and it's below that key 400,000 mark for three weeks in a row now so we're making progress. applications for building permits are up, and the outlook from philadelphia federal

reserve is up as well. so our economic news at home is looking pretty good today, although it's overshadowed by the debt crisis in europe and that's one of reasons you see red behind me. but the losses aren't very significant right now. >> carter evans live, thank you. a new controversy surrounds a railway company that may be a key player in the high speed rail project. the company, sncf, owned by the french government, deported thousands of jews to concentration camps during world war ii. holocaust survivors testified before house committee yesterday that they should be allowed to sue the rail company. the company says it's interested in bidding for the first phase of california's high speed rail project. while the bay area high speed train project is not affected, other high speed rail proposals across the nation are in jeopardy this morning. the republican-led congress is on the verge of killing funding

for the program. president obama had requested $8 billion for the upcoming fiscal year, and $53 billion over six years. republicans say the program is too costly. they favor high speed rail in the northeast, rather than in national network of trains. new at this hour, energy secretary steven chu is for the first time testifying before congress about the federal loan given the fremont based solyndra. a hearing started just a couple minutes ago. ktvu's allison burns is in washington keeping an eye on things. allison. >> reporter: dave, secretary chu will be launching an aggressive defense of his actions in the solyndra loan decision, a decision that could end up costing taxpayers a half billion dollars. but first, members of congress are having their say. this is a live look now at the house energy and commerce committee hearing. the committee leaders are making their opening statements, republicans contend

says hybrid cars do a better job of projecting passengers in an accident compared to the same cars gas powered model. auto safety experts say the risk drops 25% for people in a hybrid involved in an accident. the highway safety institute says the extra weight of the batteries causes the hybrids to be heavier, and that may be one reason why they're safer. >> interesting. >> little more expensive but for some people maybe the safety is worth it. >> interesting! some high marks for silicon valley today. who son the new list of the most educated cities in california? plus, why it's taking months to clear a massive rockslide in santa cruz county. >> good morning. right now san bruno is a mess. just got a picture from a viewer about how this traffic jam, collision here is creating a big traffic jam just north of here.

it's 7:23. santa cruz county officials are struggling to find money to clear a rockslide in scotts valley. back in march, rocks came crashing down on to nelson road following heavy rain. neighbors are getting the by with a temporary bypass road. a geologist report to determine how to proceed with clearing rocks has yet to be completed. the county is now turning to the california transportation commission for help after fema denied a request for assistance. new report is out says silicon valley is home to some of california's most educated people. the state finance report shows the four most educated cities in california are in silicon valley. palo alto, number one on the list. almost 80% of adult residents have a college degree. los altos, saratoga and cupertino follow close behind. on the other end, watsonville, 35% of its adults have college

degrees. palo alto tiny little school there, we have picture of it. i america to sal knows that also. but sal joins us live with a look at traffic. >> traffic is going to be affected by an incident in san bruno. we're been talking about it all morning. apparently, it's been there for hours, just about three hours for this police activity that happened here on el camino real, just less than a block south of interstate 380. and police cars have been lining this block between san bruno and sneed, and we just got a picture from one of our viewers. she was in a traffic jam here in san bruno and i just looking at the picture, we'll show you coming up -- megan, thank you for sending the picture. she showed us a big traffic jam getting through around the area because one of these major streets here, el camino real, is closed in san bruno. let's go out and look at 280 northbound. you can see slow traffic there as you drive up to highway 17

it. will stay slow to the lawrence expressway. this morning's commute will be slow as well on 80 between pinole, a lot of slow traffic between pinole near pinole valley road to el cerrito. steve. >> thank you. low clouds or dense fog, and temperatures today will cool down. there's some sun breaks already, we're not expecting a big system to come in here. this is a weak system but it's bringing in cooler air and it is enhanced the fog bank so temperatures will be coming down more upper 50s now and low 60s than anything else. most of the rain sliding east of us, but some light rain or drizzle could make it into the north bay later on. not much to this system as it moves south. but it is picking up fog. 30s and 40s to 50s, so big difference in some temps. 39 santa rosa. our system moves through the first one, there's a secondary one on friday but most of that is heading to east of us. if we're in portland i would say very low snow levels. for us it's just going to get cooler. light rain to the north is

ice 7 clone 30. developing news outs of san bruno. police are investigating a multi-vehicle wreck at a rental car business. kraig debro arrived at the scene just moments ago. what can you tell us? >> reporter: this is happening at the offramp to i380, at el camino real southbound. you'll see a couple different cars, one is the black car and there's a red honda out there,

it looks as though having not spoken to police there was a t- bone incident here. a bunch of san bruno cops out in the street, as well as the highway patrol, and there's a lot of shattered glass here. of course, the street is blocked off all the way past the 380. so basically, north of 380 at the el camino real on the north side of the freeway. that is closed all the way through down to what i believe is either cherry or -- i think that's cherry down there. so that's kind of a long way. then in the middle of the commute, that could be a problem for some people around here. but essentially, it looks as though it happened in front of the car rental place. it doesn't look as though the car rental place had anything to do with this. but again i'm going to as soon as we leave here, i'm going to go over and talk to police immediately. see if i can find out what happened and when the section of very valuable roadway during the morning commute might be open again.

reporting live, kraig debro, ktvu channel 2 news. also happening now, a noisy protest is underway on the cal state east bay campus. christian joins us live from hayward. christian, sounds like the main sticking point is pay increases. >> reporter: that is the major issue. you can see faculty members here marching across this crosswalk at one of the main entrances here to cal state east bay. if you look to the right you can see what they're doing here is blocking traffic trying to come into the university. they'll allow people a few cars through at a time. they're letting few cars through right now. then they'll stop the cars. they'll have to wait there at that protest line as folks here make their point. this site is one of the two sites where they're holding strikes. the other is at cal state dominguez hills. faculty members from all 23 cal state schools are on hand. the faculty members here say

they were promised pay raises for the 2008-2009, and 2009- 2010 school years but the raises never materialized. >> enough is enough. we've spent a long time trying to highlight problems in our contract negotiations, and problems on a larger scale than csu. and we finally got to a point where we need it take a concerted action, that we voted on by or membership is to take a one-day strike here. >> despite this one-day strike, a spokesperson from cal state east bay tells me the campus is open for students and classes are in session unless the instructsor tells students otherwise. the chancellor's office has a representative here and he said the faculty should have returned to the bargaining table long ago since drastic cuts to the budget mean the school can't afford the pay raises. >> if you think about a billion dollar cut does to an institution. what that does to its

priorities and the costs for the students. and really, it's been everything we can do to try to preserve access for classes -- for students, provide course sections, and provide services. >> back to our live shot, you can see the long line of vehicles here waiting to get on to this csu east bay campus. you can see the protests still underway here. this is a one-day strike, organizers say they will be here from now until 5 this evening. we'll continue to monitor the situation here and bring you the latest. christian protestors clashed with police yesterday as cal state university trustees approved the controversial 9% few, hike. tuition will now be only $6,000 a year. the board's 9-6 vote happened behind closed doors after the violence erupted. four people were arrested and two campus officers were hurt.

lieutenant governor newsom, who sits on the csu board, is calling for the board to hold another vote in public next month. and there's more bad news for california schools. state revenue fell short of expectations by almost $4 billion according to the legislative analysts office. the shortfall is expected to trigger $2 billion in automatic cuts. the uc and csu systems along with public schools stand to lose millions of dollars. also affected, funding for senior services, the disabled, and childcare assistance. overnight news, to avoid a kaine front takes with police occupy protestors in san jose took counsel their tents this morning. some officers visited the camp late last night. demonstrators were told to leave or risk being arrested or cited. about 15 of the protestors moved their tents from in front of city hall it across the street at the beginning of the month to try to avoid such a

confrontation. demonstrators say they were trying for a permit but now feel betrayed. they will gather at san jose state at 5:00 this evening, then march true downtown. meantime, a man not connected with the occupy movement is still on top of a 30-foot structure next to city hall. he says he'll continue his one- man protest for 99 days. camping permits will no longer be given out to occupy protestors in santa rosa. beginning this afternoon, anyone without a camping permit will be told to take their tents down. that's according to the press democrat. the latest development comes after occupy protestors rejected the permitting process, saying they were just too many restrictions. protestors who don't have permits who do have permits, by the way, will be allowed to stay. if you're looking for continuing coverage of the occupy from tests, we have got you covered. you can find the latest at

port. crabbers want 250 a pound. processors are offering $2. both sides say pressure is mounting for an agreement with demand expected to increase as thanksgiving gets closer and dave, you can believe it's just one week away, turkey day! >> wow. sneaking up us on? have you figured out what is going on in san bruno yet. >> fortunately, for us, we have our kraig debro there getting -- trying to get information from san bruno police. but el camino real is shut down at 380. i want to show you a picture from megan, who is one of our twitter followers here. she sent us this picture of the traffic jam on southbound el camino real, approaching 380. right in front of the mall. and it's just obviously not a very good place to be if you're trying to drive through san bruno. i would avoid el camino real and use another route. 380 is not affected unless you happen to be want to go get off

at el camino real. wouldn't recommend it. in some places, some of the turns are not allowed at this point because of this police activity. you can always send us a viewer photo and we'll use it especially if it's something we want show the viewers. the toll plaza backed up to the macarthur maze, about a 20 to 25-minute delay. and also, on 80 westbound we have slow traffic from highway 4 now all the way out to richmond so it's pretty slow. it's beginning to get a little better in some areas. as we move the map down to the toll plaza area, there's a backup at toll plaza. 880 southbound also a little slow heading down to a minor crash near 23rd. let's go to steve. >> thank you, sir. cooler today, low clouds around but still some sun. and temperatures, warm yesterday welcome i mean, we upper 60s to 70 degrees. nice. not today so much. this will be okay. but we'll be cooler.

good morning. welcome back to mornings on 2. it's thursday, november 17th. at this hour, there's developing news on the peninsula where part of a major roadway has been closed for most of the morning. the reason, several cars smashed up near an interstate offramp. kraig debro joins us live again at el camino real in san bruno. >> reporter: it's such a widespread area, wide separate accident hear behind me at 380, south of -- on el camino real, south of 380. two cars involved in the accident there, maroon car and

then a darker colored car, five brown paper bags is evidence, and then you may have seen officers on the side with a stick, measuring distances. but if you look at the southbound direction, you can see that it's blocked off, before or the north side of 380. lot of traffic problems caused up there. here's what police say happened. around 4 a.m. this morning, that maroon car was coming off this exit here, which would be the el camino real exit, going eastbound on 380, and this black car was coming southbound on el camino real. the black car struck the maroon car, and the cars went spinning around ended up in these positions. police on the scene did confirm that the driver of that maroon car, female, was killed in the accident. her name is not released because they're trying to notify next of kin. but again, a lot of police officers out here because happened on san bruno city streets. this is a san bruno investigation, although chp is

three uc police officers still standing here as this one protestor who had packed up her tent this morning has been trying to get back on the steps. she said she won't set up a tent. they're not allowing them to get up on to the steps or put anything out here. you can see they have all of their stuff out here they want to get back on the stairs. they have been want to go get back there since the raid happened, which happened at 3:30 this morning. let's show you video of that raid. very peaceful from everyone we talked tom they came in at 3:30 this morning, uc police and police officers from five other agencies who came in to help. they went in, they gave the protestors a five-minute warning. they told them they could pack up their tents and take them with them or also tents would be confiscated. we're told about two-thirds of those tents were taken away. they confiscated about seven. two people chose not to leave. they were arrested but said that was done peacefully as

well. those protestors just want it make a statement and so they did. they were arrested for failure to disburse, and for illegal lodging on the steps of the hall. you're waiting to go back up there. what have they told you? >> they said once it's clean, we're allowed to go back up there. >> is the plan to try to put tents back up again or are you goes going to follow university policy? >> that's a decision that will be made in our general assembly at 6. we have a meeting at 10, in order to decide how we're going to do some outreach for our 5 rally in order to build morale for the 6:00 rally so we can get a lot of people there so a decision can be made with a lot of people. >> got about a dozen people left. are you expecting the crowds to come back now that it's been cleared out? >> we basically got the word on twitter, on text messages, we've called people at 10:00 the meeting will happen and

demonstrators. these occupy protestors swarmed the lobby of the bank building at 50 california street and once inside wrote on the balls and the desks, set up a tent. police warned them to leave or be arrested. dozens show the stay inside. while no one was hurt, police did arrest about 95 protestors. they face several charges, including trespassing. happening right now, in new york occupy wall street protestors. look at this, they have -- it's like a small army of people through the streets of lower manhattan in new york. now, the demonstrators are saying they are as strong as ever. they've been at the park but you're looking at live pictures of new york. i can't even count how many people may be filling the streets right now.

and demonstrators, and the plan they say is to occupy some 16 subway stations this afternoon, and then at 5 p.m. local time they say they'll go to foley square, by city hall, and the courthouses where three say they'll have a huge rally, perhaps 10,000 or more demonstrators, and they expect then to cross the brooklyn bridge and the whole point here is to create some chaos and make sure that people hear their voices. >> rick, i'm curious, the point is to impact the financial markets and the traders, corporate greed. has it had any impact on trading or financial industry down there? >> reporter: well, the bell rang on time. wall street is open. but they're impacting some. people trying to get to work. there are a lot of confrontation with people, brokers and the like trying to get in their offices and demonstrateddors blocking entrances saying come join us! in some cases the people going to work calling names with the

time is:30. welcome back. developing news from the peninsula. the traffic mess in san bruno should be cleared up in about 90 minutes from now. ktvu's kraig debro is out there just talked to police, he is back now at the interstate 380 and el camino real. so what did the police say, kraig? >> reporter: when i talked to san bruno lieutenant, he said that he hoped to have this part of el camino real open by 10 a.m., which is earlier than they thought. just south of 380, before we look at the full crime scene, we've decided not to show one of the cars in the accident because one of people involved in the accident died and the next of kin has not been notified. this happened around 4 a.m., a car coming off the east el camino real offramp on 380 right here to your left, a black car hit the car that was coming off the freeway. the black car actually was traveling southbound on el camino real and hit the second

car in the accident as that car was coming off the freeway, off the eastbound direction, and turning northbound on el camino real. the woman in the car died at the scene. the man driving the black car right now is at san bruno police headquarters. he's not only interand interviewed by police but they're trying to determine if drugs or alcohol are involved. one person died here at the scene. next of kin not notified. the second person at police headquarters interviewed by police. kraig debro, ktvu channel 2 news. happening now, faculty at two cal state universities are stapling a noisy strike. christian joins us live and tells us that protesting pay raises that never materialized. christian. >> reporter: that's right, that's one of major sticking points here. look at that protest now, you can see they're letting a few

cars through. that's been the m.o. here, and once they let a few cars through they retake that crosswalk and block traffic here. you can see the long line of traffic trying to get into cal state east became we talked with the driver, it takes them about 12 or 13 minutes just to make it up on to the campus. this site is one of the sites here at cal state east bay. the other site is at cal state dominguez himself in southern california. faculty members from all 23 cal state schools are on hand here for today's protests. faculty says they were promised pay raises for the 2008, 2009 and 2010 school years, but they say the pay raises never materialized. >> the chancellor is able to find plenty of mine to give pay raise dozen executives, campus presidents, he gave $1hundred,000 raise to a president in san diego state. but for some reason he is unable to find any money for faculty. >> despite the strike, a spokesperson from cal state east bay tells me that the

hours from now. pam. >> reporter: it's an important decision and it will be made right here in san francisco. at 10:00 this morning, california supreme court will announce its ruling on a key element of proposition 8. the court will issue a decision on whether the sponsors of prop 8 have the right to defend the same-sex marriage ban in federal court. prop 8 supporters say they should be allowed it take up the case because it goes along with was california voters want. they approved prop 8, the ban on same-sex marriage, back in 2008. those against say it's been a long and confusing battle and that voters were also confused by the wording in the proposition. now, a ruling in favor of the prop 8 supporters will likely send the case back to the ninth circuit court of appeals for a decision on the constitutionality of the same- sex marriage ban. they're still debating that. the constitutionality of the issue. basically, we're still probably at least one more court

decision away, even after today, from same second marriages happening in california or not at all. but again, we're waiting for the california state supreme court decision written opinion comes in at 10:00 this morning. reporting live, i'm pam cook, back over to the studio. overnight news, berkeley firefighters quickly figured out what sparked a house fire. the fire started around midnight on the back patio of a home on the 2000 block of parker street. neighbors woke. the homeowners after noticing flames. quickly fire marshal says the fire was caused by hot ashes from the fire left outside in a paper bag. >> it could have been a lot worse. so again, this time of year, we need to be aware of how we're taking care of our fireplaces. >> firefighters sifted through the damage after putting fire out. the fire destroyed the back deck and spread at the home's

officers standing here but they said the protestors are free to go back up on the steps. the clean-up finished, just a short time ago. but no one is going on the stairs. i can show you there are still pro festers here, still sleeping on a sleeping bag, with their dogs and their cats and their paraphrenalia they still have. but they're not moving up on the steps. i just asked them why not. they said we'll wail until the general assembly tonight. all occupy encampments have the meeting where they decide that what to do. now you have one person who decided to at least get on the steps, who is now yelling bring back the tents. the tents went away early this morning in a raid at 3:30 this morning. uc police told me they just decided that today was the time to do it. so you're taking a look amount video as they moved in, with five agencies, and told everyone inside they had five minute to leave. they could take the tent with

them as long as they left the steps of the plaza. so that's what most of them they say did. two-thirds the tents were taken down by the protestors and taken off the steps. they confiscated about seven tents. two people refused to leave. those people were taken into custody on charges every illegal lodging and on failure to disberse once given a dispersal order. police say everything went peacefully. protestors we talked to in large part also agreed it went peacefully. very few people told us we were surprised by the crackdown, but again at this point the question is, will they go back on to the steps? the told me they'll have a 10:00 meet this is morning, then have a 5:00 meeting in rally, then a 6:00 general assembly. at that point they say they'll vote on their next course of action here at occupy cal. claudine wong, ktvu channel 2 news. >> thank you, claudine.

there's conflicting information about whether mike mccrery contacted police about witness what he said was former penn state defensive coordinator jerry sandusky rape a boy in a locker room shower. yesterday we ran part of an e- mail he sent to a friend saying he did talk to police after witnessing the allegations 2002 incident. state college's police chief and the university spokeswoman says no reports were ever filed with their police departments. the new york sometimes is reporting pennsylvania attorney general office first contacted mcqueary a year ago after reading a post on a penn state message board. meanwhile, a pennsylvania lawyer representing one of the 8 alleged victims in the penn state scandal called jerry sandusky a coward and said that sandusky's comments on television backfired. the client pursued sexual assault charges against sandusky.

the lawyer added more alleged victims are prepared to come forward. sandusky has denied the sexual abuse charges. time is 8 8:48. later today the final reported on the cause of a deadly plane crash in east palo alto last year. three employees of tesla were killed when their cessna went down in a residential area. no one on the ground was hurt. earlier report by the national transportation safety board last month showed the plane's propelsers and engines were working properly but that report did not name the exact cause of crash. a 15-year-old boy is at the contra costa juvenile hall this morning after being arrested for a carjacking. pleasant hill police say it happened near the intersection of oak park boulevard and pleasant hill road last night about 10:30. police say the young man told the driver he had a gun. the driver was not hurt. this morning san pablo police spotted the car and they pulled him over. investigators are looking for the cause of a house fire

in san francisco's moistureas neighborhood. firefighters contain the flames in less than 30 minutes. two elderly people inside were overcome with smoke. they were taken to the hospital. we don't know their conditions. it's 8:49. a veterinarian has determined a large mountain lion is responsible for the deaths of three goats in san mateo county. their remains were found monday night in woodside. authorities have now certainty out a neighborhood alert that the mountain lion may still number the area. bart will again examine its cell phone blackout policy today. they want to cut off cell phones when unlawful activity can cause serious problems. bart has been working on an official policy after the backlash it received when it interrupted service before a planned protest in august. bart could also vote on a new proposal to change weekend

service today. the change would extend service by a half hour on friday night and delay the first train saturday morning by a half hour. there's also talk of running buses instead of trains during those hours. bart has been surveying its riders about the proposal. two-thirds are not happy about it. the board will meet this morning. yosemite officials ended the search for two people swept over the falls in july. yesterday a team of divers couldn't find the bodies of 21- year-old and a 27-year-old. both are from the central valley. if the water level of san francisco bay rises faster than expected, most of the bay area's current marshlands could be gone in the next hundred years. scientists say the rate depends on two things, how quickly the ocean rises and how much sediment runs into the bay. the ocean levels risen about 7 inches in the last 160 years,
