wong has more. >> the ruling was unanimous. the supreme court said today that the people behind prop 8 has the right to defend its constitutionality. >> the issue was brought before the court by the 9th circuit court where the battle is now being raged. the question is a legal one. proposition 8 banned same sex mearnlg. neither the governor nor the attorney general would defend it. the backers of prop 8, protect marriage.com did. what the 9th circuit wanted to know was could they? in the decision filed today, the justices said, quote, we conclude that california law authorizes the official proponent to appear in the proceedings to assert state's interest and the initiative's

validity. protect marriage respond end saying that the group is delighted, saying that the ruling is a devastation for the homosexual, streamists. same sex marriage supporters were not surprised. >> that's not a great surprise. we were here for the argument and we did feel like there was a general sentiment at the court that day that the judges would uphold the initiative process in california while we are not shocked by the outcome of today's ruling at all. now, we go back to the 9th circuit and they need to argue merit. thinks their chance to finally do that. >> marriages first happened in san francisco city hall in 2004. here we are, looking at not until 2012 when we get a decision from prop 8 from the 9th circuit. so this does feel like a minor skirmish. >> reporter: this ruling is an advisory one. it is up to the 9th circuit to decide what's next. in san francisco, claudine wong, ktvu channel 2 news. >> thank you, claudine police moved in early this

morning and forced occupy protesters on uc berkeley came phil housley remove their tents from the steps of sprowl hall. protesters removed more than a dozen tends from the raid. police confiscated another seven when people did not take them away. ktvu was given this amateur video of the action. two people refused it leave and police arrested them for illegal camping and failure to disperse. protest organizers say that the raid took them by surprise. >> 150 cops in riot gear, around 150. very quietly came and swarmed us. people sleeping in tents and they basically just told them, you get out right now or you are being arrested. >> reporter: the pro terses say they will hold a rally at 5:00 p.m. followed by a general assembly at 7:00 p.m. to desite what to do next. two occupy san francisco encampments remain in spite of a standing city order to clean them up or to face eviction.

one is at 101 california street and the other two blocks away at herman plaza. the mayor said that they had to meet health requirements or the mayor would remove them. officers warned about 15 protesters they would have to take down their tents or face arrest. the rest of the pro terses removed their tents. they say that he plan to come back at 5:00 this afternoon for a rally and, again, at 7:00 p.m. for another rally. and the protesters up on the wall near city hall is still there. he says he plans to be there for 99 days. new york city police clashed with occupy wall street protesters this morning and they arresteddozens. this is the just the beginning of plan -- this is just the beginning of planned action and why the state is so significant about the movement. san francisco investigators are trying to find the cause of a house fire that left a

disabled woman with life threatening injury. flames broke out in a two-story house on santa rosa avenue just before 8:30 last night. firefighters found a woman on the sec floor she was suffering from smoke inhalation and was taken to the hospital. her condition has not been released. two other people suffered minor smoke inhalation. officials say that the fire appears accidental but the cause is under investigation. berkeley firefighters quickly figured out what sparked a house fire overnight in that city. the fire started around midnight on the back patio of a home on the 2000 block of parker street. neighbors work up the homeowners after noticing the flames. berkeley's fire marshal says that the fire was caused by hot ashes from the fireplace fire left outside in a paper bag. >> it could have been a whole lot worse. so, again, it's this time of year we need to be aware of how we are taking care of our fireplaces. >> reporter: firefighters say that flames destroyed the back

deck and spread to the home's siding. the crew also cut a hole in the roof. a 15-year-old boy is at contra costa juvenile home. police say he told the driver he had a gun. the drive was not hurt. this morning, san pablo police spotted the car and arrested the teenager. instead of classrooms, hundreds of cal state university teachers are walking the picket lines at two schools this afternoon as part of a one- day strike. ktvu's christian captain is live at cal state unfortunate where faculty members say that the big issue is money. christian? >> yeah, we're going to give you a live look right now at the picket line here. you can see that they are holding a kind of an organized dance in the middle of the road blocking traffic into cal state east bay. they have been chanting all morning long and only letting a few vehicles in at a time.

if you take a look down carlos b avenue, you can see that the road is entirely shut down right now, not a lot of vehicles coming up right number you can see one police vehicle coming up the road right now. hundreds of teachers from all 23 cal state schools are demonstrating either here or at cal state dominguez hill. >> faculty members started walking the line before dawn. they say they were supposed to see raises for the 2008-2009 and 2009-2010 school year. chancellors are able find lots of money to pay raises for the chancellor, campus president he gave a raise to a president in san diego state but he is unable to find money for faculty. >> reporter: for its part. the chancellor's office says that with more than a billion dollars in budget cuts in the last four years, the faculty needs to be realistic. >> in our new economic reality,

there is no additional funding from the state. the 20 million that the faculty union leadership is demanding on top of the 60 million that the faculty already received between 2008-it 2010 would come directly on the backs of the students. that's a false choice to say that tuition has to go up if faculty gets paid more. there is plenty of money to fund faculty raises. >> reporter: today's strike left the usually bill bristling campus. >> reporter: many say that they sympathize with their teachers. >> it's stupid. because chaps lowers are getting all this money and we have to suffer >> it's not fair. >> the protests are up in the air as well as down here on the ground. the dance performance seems to be drawing to a close right now. today's strike is, again, just a one-day strike.

released. officers took the first driver in for questioning. they wanted to know if alcohol or drugs played a factor in the crash. san francisco police are investigating two separate pedestrian-involved accidents this morning in the city. a more serious one happened just before 8:00 a.m. at darey boulevard and 10th avenue in the richmond district. an suv slammed into a 70-year- old man. he suffered a life threatening injury. another pedestrian was hit in the area off maple street. the victim's injuries are not believed to be serious. a study out today shows health care premiums are skyrocketing in california. a research group called the commonwealth fund says that premiums shot up 52% between the years 2003 and 2010. the afternoon cost went from $9100 to $14,000. that's nearly a quarter of an average family's income. researchers believe that businesses are passing on

family coverage increases to their employees. alameda county authorities this morning handed over towed raul immigration agents a mexican national arrested monday at occupy oakland. oakland police officer arrested francisco poncoh ramos as he meditated in vials of an order to disperse. a federal immigration database flagged his fingerprints as those of someone who might be deportable. his supporters asked alameda county not to hand him over but the chef river and district attorney said they had no authority to ignore the federal immigration hold. it has been two months since the occupy wall street movement started and, today, occupy protesters in that city are calling for a day of action to shut down wall street. they sat down in the streets near the stock exchange to block traffic this morning and police moved in to arrest them.
