this. mostly cloudy. much cooler today. off and on light rain. highs in the 58-60. santa rosa will be the coolest trapped in with cold air. maybe low 60s down toward mountain view. here is sal. steve, good morning. we are looking at a fatal crash in lafayette eastbound 24 blocking the three left lanes there pleasant hill road. these are live pictures. it's a three-car wreck. it looks like some cars are getting through. they have opened up one more lane so it's two lanes opened on eastbound 24. we want to let you know so far traffic is light on westbound 24 driving past the scene. also the morning commute is looking pretty good on 880 north and southbound as you pass the coliseum. if you are driving this morning to the bay bridge toll plaza it's light. let's go back to the desk. the city of vallejo is in

mourning following the shooting of a veteran police officer. 45-year-old james capoot was a former marine that has been with the police department for the past 19 years. he was married with three daughters. claudine wong has the story. >> reporter: we came out here where all this happened this morning. we wanted to see if the neighborhood has been back open. it has been shut down for most of the night. your mother lives on this street and you were not sure if she would get back in today. she spent the night with family. >> that is correct. >> reporter: was it difficult not knowing when she would get back in? >> yes, it was difficult because you know she takes oxygen, she takes a lot of medication, she was nervous. of course she wanted to make sure her home was secure to come in so she wouldn't be nervous all night. >> reporter: she will be relieved this morning. thank you. okay this neighborhood is back

open. obviously the focus of the investigation this is where officer jim capoot lost his life yesterday. we want to take you back to the scene yesterday. we will talk to you about what happened. the 45-year-old officer was chasing a suspect who was suspected of a bank robbery. officer capoot was able to stop him. >> officers were arriving just moments later. heard several shots fired. >> reporter: officer capoot was found wounded in a backyard on janice avenue and pronounced dead at the hospital an hour later. since then the investigation has moved forward but the mourning continues as everyone tries to deal billion his loss. the police department said they were flooded with calls and well wishes and bringing cars

to let them know how saddened they were for the loss of officer capoot. 45 years old. an officer of three. he worked for the police department for 19 years. he was a basketball coach at vallejo high school. his contributions to the community have been told over and over again. his loss certainly being felt this morning. live here in vallejo claudine wong. this morning occupy oakland will lay out details of a mass day of action that includes a plan to set up a new plant. kraig debro joins us now. >> reporter: that new camp won't be at the plaza this morning. the deputies are making sure monday's evictions hold. there are a couple of people who are sitting on a park bench earlier but no tents here. it's unoccupied at the time. that will change later on today with the announcements. the announcing plans for a march and rally tomorrow and

occupy oakland is looking for a vacant lot for their next encampment. on monday oakland police backed up law enforcement from all over the bay area. the city made it clear there would be no more camping but people with occupy the plaza at any time. the movement now has plan to occupy a vacant law nearby. the group says it wants to start a new encampment here at 19th and telegraph. it's not clear if this is city property or if it's in the process of being developed. police say they do have a plan in place right now to prevent any new encampment. the movement suffered a set back in court yesterday. they filed a motion for a temporary restraining order on behalf of occupy oakland and against oakland police. they wanted to keep police from using excessive force in violation of their own crowd control procedures. the judge denied that request but a hearing on a preliminary

hearing on that same matter is set. i will try to find out if that land is city owned or privately owned. kraig debro. >> occupy santa rosa protestors are putting out a call for more people to join them outside city hall this morning. that is after officers handed out eviction notices. they could be subject to arrest. that prompted some people top take down their tents but others are vowing to stay. the city is no longer issuing permits siting health and safety issues 37 in san jose more than 100 people turned out for a rally outside city hall. protestors there say they have no plans to leave the plaza and they want to set up more tents. right now about 20-25 people have been camping out including shawn okelly. he is vowing to stay on the

wall for 99 days. city officials in san francisco are ordering occupy protestors there to remove tents on the sidewalk along market street. the city issued the order yesterday saying the tents in front of the federal reserve building are in violation of city code. mayor ed lee says the tents need to be taken down immediately but he will not say whether police will step in if the tents remain. mayor lee calls it unsustainable. >> in the long-term you can't sustain a living quarters overnight for any length of time without seeing everything from flees to dog diseases to freeze sees. >> reporter: some businesses say they are worried about the protests will effect the on coming holiday shopping season. we will have continuing coverage of the occupy protests throughout the morning. you can find more information

on our website ktvu.com. in overnight news oakland police are investigating a shooting. police found the victim lying on san pablo avenue near 34th treat at 12:30 this morning. police tell us the victim had been shot at least once. they don't believe he was shot near 34th and san pablo because they could not find any shell casings. the man was taken to the hospital and is expected to survive. oakland firefighters spent the night putting out an apartment fire. the complex was empty at the time and no one was hurt. the cause of fire is investigation. we do continue to follow breaking news this morning in lafayette. emergency crews are on the scene of aphakial crash. we arrived here on eastbound 24 just east of

pleasant hill road about 15 minutes ago our photo journalist bringing you the live pictures of the deadly accident along eastbound 24 just east of pleasant hill road. as you can see one, two and three lanes are all closed. here's what we though. it was a multivehicle accident. we heard one person was ejected and killed. chp have called for the coroner to come on out and conduct an investigation. and we know that again one person so far has been confirmed dead at the scene here. no word on exactly how long this investigation may take. so this may very well effect this morning's commute. the other incident -- as we said this may effect the morning commute. as you can take a look looking at the westbound traffic here on westbound 24 light at this

money will cover the cost of repairs and salaries during the two-days the school was shut down. no one was hurt in the august, 2009 attack. authorities say youshock detonated two pipe bombs before they caught him. another college sports program is investigating claims overchilled sex abuse. syracuse placed bernie fine on administrative leave. two former ball boys say fine molested him. one says he reported the abuse in 2003. the detective told him the statue of limitations ran out. syracuse says they investigated the allegations at the time but did not find any evidence of wrong doing. today while in indonesia president obama announced that hillary clinton will travel to

myanmar. >> it can forge a new relationship with the united states of america. >> it will be the first visit by a u.s. secretary of state in more than 50 years. president obama says there have been flickers of progress in myanmar since new civilian leadership took power in march. president obama is in bali, indonesia to attend the east asia summit. this is new video of the president arriving for a dinner at the summit just 15 minutes ago. president obama is the first u.s. president to attend the east asia summit. he believes asia is now the best source of trade in jobs for the u.s.. the federal government avoided another shutdown with the passage of a temporary spending bill. the senate approved the bill in a 70-30 vote yesterday shortly after it was passed in the

house. the measure will keep the government operating through december 16th. it now heads to the president's desk for his signature. 4:46 is the time right now. the utah man accused of shooting at the white house has been charged with attempting to assassinate president obama or members of his staff. according to court documents oscar ortega hernandez called the president the devil and wanted to hurt him. he's suspected of firing shots at the white house last saturday. the president and first lady were away at the time. it carries a maximum penalty of life in prison. z mean-time herman cain has the protection of the secret service. the department of homeland security approved the deal for the security detail yesterday. cain has reportedly received some threats. secret service protection is given to each parties presidential nominee but can be provided earlier if approved by

homeland security. the legal case over prop 8 california same sex marriage ban heads back to federal court. that is after the california supreme court ruled yesterday that supporters of prop 8 have a right to appeal a ruling. both supporters and opponents of prop 8 say they are pleased the case can move forward. >> ultimately they said it comes down to a matter of procedural fairness. >> i think what is great about the ruling today it hastens the whole process toward reaching the merits of the decision and the constitutionality of prop 8. >> now the case goes back to the u.s. ninth circuit court of appeals. it is likely any decision will be appealed to the u.s. supreme court. many san francisco restaurants are not using all of the funds collected through the healthy sf health care

surcharge. ktvu news combed through documents obtained in a public records request to see how restaurants were complying with the city's landmark health care program. some businesses are putting tight restrictions on how employees can use the funds. we found that $50 million paid into the program last year was returned to businesses instead of being used on employee health care. >> it is simply wrong for businesses for these restaurants to charge consumers for health care when in reality they are not providing it. >> next week the board of supervisors is said to approve guidelines that will extend the time period before unused funds is returned to the employer. the los angeles county sheriffs department -- they have received new information about the 1981 drowning death of actress natalee wood. the west side story star

drowned after a night of partying with her husband robert wagner and actor christopher watkins. today's l.a. times reports this new development involves the captain of that yacht. the spca is offering a $500 reward to find out who abandoned six puppies at a royal oaks recycling plant. the two-year-old puppies are receiving medical care at the spca. when they found the puppies they were hungry, dehydrated and flee infested. 5:50 is the time right now. billions of dollars lost in california's high-speed rail funding. how the cuts effect the future of the project. and the apparent prank played on police. !

occupy wall street. >> new york police arrested 65 occupy protestors after they tried to block traffic on the brooklyn bridge. this happened last night after a day of action where hundreds of others were arrested. two months have passed since the occupy movement began with the original encampment there at wall street. new youtube video this morning shows an apparent prank at the occupy camp. someone wrapped chains around police barricades put up at the plaza. no word if anyone has claimed responsibility for that prank. congress cut $8 billion in high-speed rail funding yesterday. california high-speed rail authority says the cuts were effected and won't effect the beginning of inspection. but the news from washington

has many of the observers raising new questions about the projects ballooning cost. >> it's definitely a sign but california will have to decide before they get anymore signs. >> earlier next year the state legislature is going to re- examine the cost. bart is working on a proposal for a bus service to run during its early morning hours. it's part of a plan to extend service past the midnight hour. some bart officials say a few issues still need to be addressed including how to pay for the bus service. bart passengers can look forward to riding on new seats. the bart board of directors approved replacing some of the seats with vinyl. the replacement is scheduled for next spring. that almost cost about $2 million. but, sal, i heard that comes

after a study about really how gross the seats were. there was a lot of bacteria and such. >> i don't want to think about it. so we will just go with the noncloth seats. thank you very much, bart. let's go outside. we want to talk about a crash on the freeway on eastbound 24 at pleasant hill road. there is an investigation of a fatal accident as the police are still there blocking at least one lane of eastbound 24. for awhile almost the entire freeway was blocked. now it's only down to a couple of left lanes there on eastbound 24 just before pleasant hill. so watch for traffic. this is actually very close to the 24 interchange. so we will have a live report from the scene coming up to let you know what happened. moving along and taking a look at interstate 880 in oakland. this is not a bad drive. you can see traffic is moving well in both directions. there is no major problems southbound or northbound coming
