they just don't know if the lot is the best place. >> my daughter hangs out here. she of loves occupy oakland but i'm not comfortable with a camp right here and i know a lot of people aren't. we need to do a better job. >> reporter: >> reporter: orange organizers say they have community support to set up a new support. one said that when they first voted for the idea of that camp in that new location that some of the people who voted for it live near it. we just spoke to the mayor over the phone about a half hour ago after about this -- the idea for this new camp and the mayor repeated the city's position that camping here at the plaz after or any lot anywhere in the city isn't allowed. the mayor said that the city does -- and the police have a plan to prevent new camping from springing up. live in downtown oakland.

>> the san jose protesters say they are keeping up their demonstration. san jose police say no structures being allowed and they are strongly enforcing that. last night one protester moved her tent on top of her car parked next to city hall. >> it's a symbol that we are still here. you put that asterix on my first amendment right. >> we also saw supporters sending supplies up to shaun okelly the man on top of the wall at city hall for 27 days now. he aid he plans to stay 99 days in support of the 99%. >> the holiday lights along san francisco lit up minutes ago but some say the camp nearby is casting a dark shadow. new at six david stevenson spent the day talking to nearby businesses about their concerns for this holiday season.

>> reporter: we are waiting for the lights to come on but tonight occupy san francisco and the big holiday festival is sharing space during what both hope will be a peaceful holiday period. santa came to san francisco this afternoon at the 25th yearly winter carnival aimed at getting shoppers in to the area. immaterial people see it though it's a week before thanksgiving they see it as the official cakeoff in the bay area. >> reporter: this year the celebration is sharing with the occupy san francisco movement. >> i'm calling the city a slumlord for not cleaning that up immediately. >> reporter: the head of the city's building owners and managers association said crime and conditions in the camp are hurting neighboring businesses. >> not only are sales down but they are getting ripped off, we are seeing leasing tours curtailed because we don't see people wanting to talk about leasing space in that area. >> reporter: police stats indicate the number of crimes reported with in five hundred feet of the plaza jumped 49%

since the camp was established here october 15th. today as he visited the mayor acknowledged the anger felt by some businesses but said he is proceeding carefully. >> i don't think the small business owners would want that kind of reaction that happened in oakland. >> reporter: occupy members say they have made big strides to keep the camp safe and clean. this is what it is. we don't need to affect their business and we don't want to. >> i think that there is plenty of room for everybody and we really are focused on kicking off the holiday spirit. >> reporter: managers at the holiday ice rink say so far business has been good, the rink is open here through january 8th. reporting live in san francisco, david stevenson. >> thousands of people remain evacuated tonight near reno as firefighters try to control a wind driven wildfire. it started just after midnight southwest of the city.

an arrest in a beating assault. it happened back in february. police say a 56-year-old was walking home from work when a man forced her into a basement and attacked her. dna evidence pointed investigators to 18-year-old derek parks. he was already in custody for an aassault. he is now charged with rape. an 18-year-old girl from brentwood was killed in a crash along highway 24 in lafayette. the crash happened at about 3:15 this morning on the eastbound 24 near pleasant hill road. investigators say the victim sydney plumber was a passenger in a ford focus that hit another car. they say after the crash she got out of the car and then was hit by a passing vehicle. the crash closed three eastbound lanes for two hours. >> most california residents say the higher many indication system is going in the wrong direction. the public policy institute found 62% of people hold that
