and good morning. welcome to mornings on 2. it's saturday, november 19th. let's get right to rosemary and that saturday forecast. good morning. >> good morning to you! the rain has stopped for you, mostly clear skies, and they have helped lead to very chilly conditions. from 10 to 20 degrees colder than where we started yesterday morning. some of us even freezing, little patchy fog, dense fog, especially over the north bay. for the afternoon, mainly drying, mainly cool but the rain returns tonight. we're going to break this all down for you coming up in just a little bit. there's concern this morning that an apartment building in berkeley that caught fire late last night could collapse. flames shot out of the building on telegraph and hay streets. allie is live where several streets are now closed off. allie. >> reporter: this building is

where this fire started. it started just before 9:00 last night, and up until about 10 minutes ago we still saw firefighters out here shooting their water cannon into the side of the building. they pulled that water truck and water cannon back so you can still see some of the smoke pouring from the outside -- second story window. at its worst it was a five- alarm fire overnight, and fire crews from a half dozen alameda county cities had to help berkeley fire with this. the fire chief estimates about 50 apartment units are in the building, a sign on the outside of the building says the sequoia apartments, and there are also three businesses on the ground floor. rallies pub and the popular cafe. the entire build something it heavily damaged and firefighters say it is structurally unsound. at this point, firefighters cannot go into the building. they can only put out the hot spots from the outside. and we're contacted the red cross this morning to find out how many people were evacuated,

how many people had to find new places to stay. we have not heard back from them yet but there were no reports of injuries. however, the fire just -- fire chief says she received no reports of any residents missing. however, because this fire spread so quickly, because two so intense and the buildings became structurally unsound, firefighters say they were not able to go through the fourth floor and make sure no one was still inside. >> do a primary search. go around a couple floors before the fire -- [not understandable] we had to back out. >> the smoke alarms were working in the build background that's how firefighters initially responded to this. and when they arrived, they -- it appeared the fire had started in an elevator equipment room. but later this morning, fire investigators will be here along with structural engineers. we take you back out here live. you're looking at the top floor of this building. the assistant fire chief says it was built in the 1910's, so

it's very old. that added to the challenge of trying to tackle this fire. you can see some of the of roof peeking out. the roof did collapse on the fourth floor but the engineer is supposed to come out today and determine whether the building should be condemned. they wouldn't be surprised if it's condemned. the fire investigation and the engineers will only be able to do their investigation and work from the outside of the building. no one can go inside. allie rasmus, ktvu channel 2 news. we want to give you a look at the street closures near that damaged building in berkeley. telegraph is closed before dwight and channing and haste at dana. this morning, firefighters in reno are advancing on a wildfire that chased thousands of people from their homes. it's burned more than three square miles and destroyed 25 homes. a 74-year-old man died from a heart attack as he was trying to escape the wind-whipped flames in. all, 16 people went to the

hospital, including a firefighter who suffered first and second-degree burns. fire officials say the worst is over, as snow flurries and falling temperatures moved in to help extinguish the flames. >> so they're evacuating, people on this street. but it's his and miss with houses it hit. it jumped over there to that -- those bushes and that house. >> your house is okay right now? >> my house is okay. i just don't have any power. >> investigators are not sure what caused the fire. they speculate winds may have taken down a power line, sparking the blaze or it could have been started by people in a homeless encampment trying to stay warm. more than 400 firefighters were called in to assist, including some from california. two men are in jail morning after a late night robbery at a vallejo fast-food restaurant. our cameras captured police officers responding to the call around p.m.

last night, when a couple stanford students called police saying two men robbed them at gunpoint at the jack in the box on callahan lane. shorted time later police tracked town the suspects' vehicle to grant and lemon, and then a short chase ensued. >> they managed to apprehend both subjects, and insides the vehicle we did locate some of the victims' long and, and we also recovered a loaded firearm. the two suspects are a 33- year-old parolee from pittsburg and a 35-year-old man from san francisco. police now say there is only one person responsible for the fatal shooting of officer james capoot. investigators say the suspect, 37-year-old henry smith, acted alone. authorities say smith robbed a bank, then led miss on a high- speed chase, before trying to escape on foot. it was during the foot chase that capoot was shot and killed. he is remembered as a man dedicated to his job and the community. he coached a championship girls basketball team at vallejo high, and yesterday one of his

players placed her jersey on the steps of the police station in his honor. >> he helped me to never give up on myself. basketball was the only reason why i could see going to school, do what i had to do. >> capoot's friends say he acted as a father figure to children throughout the community. he leaves behind a wife and three daughters. local civic leaders will home a vigil tonight at 6:00. police have also set. a memorial fund for the family. for more information, go to ktvu.com. the shooting that some people in vallejo asking if a shortage in -- in officers is jeopardizing officer safety. capoot was ride ago loan thursday when he was gunned down. fresh out of the bankruptcy, the city of vallejo has a sharply reduced staff of 93 full 25 officers. the city has far fewer -- than comparable sized cities. santa clara has 131. berkeley 167. and richmond has more than double that number of officers.

>> we can't determine if that's a factor not. we -- the officers typically work by themselves on day shift before we had these staffing issues. >> vallejo's manager says there's no money right now to add officers. measure b, a one cent sales tax on the ballot, would raise $10 million for the city. but a final vote count will not be out until next wee, week. new video shows police using pepper spray on a group of students during an occupy protest. it happened yesterday after the students linked arms and refused to leave that are their encampment. this morning uc davis is defending the officers. they warned students repeatedly they would use force if they did not leave. the spokesperson also says the other protestors began to surround those officers. occupy oakland is calling

for a mass day of action today, ending with okay pace of a plot of land by the fox theater at 19th and telegraph, leading to concern from parents and teachers of >> innocent children will be put in the crossfire between occupy oakland and oakland police departments. >> parents and teachers spoke out at occupy oakland's general assembly meeting last night and asked protestors to a been don their plan to set up the new camp. they say the camp would put neighborhood children at risk. mayor quan says she is also against the proposed encampment. >> would you ask people to get on with organizing and stop using valuable police resources on us having to clear these camps. >> despite the opposition, protestors voted to move ahead with the occupation. it's expected to start at 2 p.m. today, beginning with a march at 14th and broadway and ending

rise and shine. good morning to you, oakland sitting at 43 degrees. crisp and cool outside your door. from the bay area were killed in afghanistan. 21-year-old sean walsh died on wednesday after his patrol was attacked and host province. he is center san jose and served in the army national guard. and last night at a high school football game in danville, we learned that an ied killed joshua daniel corral. he graduated from san ramon high school about a year ago. he immediately joined the marines after graduation. no official word on his death from the pentagon. and while the fight continues for many american troops in iraq and afghanistan, some other u.s. service members are home safe this weekend. three soldiers with the california national guard arrived yesterday at san jose international airport. they had been in iraq for one

year. vietnam veterans, part of the patriot guard rider, showed up to be part of the happy homecoming with the soldiers' families. >> it's pretty overwhelming. it's hard to -- absorb all of this. had no idea. >> i think my mom was involved. and she's always over the top. so -- kind of thought it might be a little -- not this much. >> i'm really happy. i'm really excited. very proud. >> more troops are expected to come home in the coming weeks, as the u.s. winds down the mission in iraq. the afghan national assembly is meeting today to decide whether to approve a new security pact with the united states. the pact comes from afghan president karzai, and it would set conditions for u.s. troops after the year 2014 that. is when forces are expected to leave the country. the security pact does include some conditions, including the end of nighttime raids, which nato says is the most effective

weapon against insurgency. so far two-thirds of the assembly has approved the pact. new this morning, moammar gaddafi's son has been captured. a militia commander says saif was found today in a southern libyan city where two aides tried to smuggle him out of the country. he is the last of his sons to remain unaccounted for. gaddafi gaddafi was killed last month and international court prosecutor will travel to libya to participate in talks over how islam should be tried. president obama is on his way back to the united states this morning. the president's motorcade pulled up to air force one in billioni earlier today. hours before, the president wrapped up his visit at the east asia summit. that's where he met with the prime minister of thailand and other world leaders. one of those other world leaders included the chinese premiere, who met unexpectedly today, hours after meeting last night at dinner. a white house official says mr. obama and the premiere want to

continue their conversation about key economic issues between the u.s. and china. those issues include the value of chinese currency and territorial disputes. the australian government is investigating an embarrassing and potentially dangerous security slipup. they recovered this top secret book, describing his security detail. it breaks down his motorcade, which included counter-assault teams, a communications vehicle, and a truck that handles hazardous chemical and medical emergencies. the 125-page book also elizabeth the private cell numbers of dozens of top american and australian officials. the newspaper found the book lying on the street. that had been blocked off. before leaving indonesia, the president taped his online video address. his focus this week, exporting more u.s. goods to overseas markets. >> this is important because over the last decade we became a country that relied too much on what we bought and consumed.

another storm moves in in time for thanksgiving and the big drive. back to you. cloneup continues in the deep south this morning after a series of deadly tornadoes there earlier this week. weather experts say a twister that blew through south karl had maximum winds of 135 mimes an hour. its path stretched 2 1/2 miles long and 200 yards wide. the tornado wedged cars into trees and killed three residents in nature 60s. other states reporting tornadoes include mississippi, alabama, and georgia. two bay area rivals putting aside their differences, the issue that is bringing cal and stanford students together, ahead of tonight's game. >> firefighters still on the scene of an apartment fire in berkeley that started more than 10 hours ago. we'll tell you why firefighters are concerned the building could collapse.

the flames are out, but no one is going near a fire damaged building in berkeley. at this hour there are new concerns about the safety of that building. welcome back to morning on 2. right now firefighters are still on the scene of that apartment fire in berkeley. the fear now is that the building might be unstable and could collapse. the fire broke out on the corner every telegraph and hay street near the uc berkeley campus. allie rasmus is live this

morning where streets could be blocked off for hours now. allie. >> reporter: firefighters first respond to today a car about smoke alarms going off in this building. that call came in before 9:00, and more than 10 hours later firefighters are still here this morning. this is the building, you can see it from the roof there's still smoke coming out from the roof. all morning firefighters have had their ladder truck here, they've been shooting water cannons and putting out some of the hot spots here. and if we zoom into the windows on the fourth floor, you can see where there's some blue sky peeking through. the roof completely collapsed on to the 4th floor. at its worst, this was a five- alarm fire overnight. fire crews from across alameda county had to help with this. the fire chief estimates about 50 apartment units in the building. this morning we've contacted the red cross to find out how many people were displaced. we have not heard back from there them yet. but so far no reports of

injuries or residents missing. however, because this fire spread so quickly, firefighters were not able to do what is called a primary search, where they go through the floors and check to make sure no one is inside. they want able to do a search of the building, just the second and third floors, not the fourth and fifth floor. the smoke alarms were working and when firefighters arrived it appeared the fire had started in an elevator equipment room. >> elevator shaft opened sauces for the fire to travel. so by that time, it was working its way up. very old wood structure building. the fire already had a head start, work the way vertedically, spreading occupant horizontally. >> and that of course added to the challenge of putting on the this fire and is a big part of the reason why this building is considered structurally unsound this morning. on the ground floor of this apartment building where three businesses rallies, pub and the cafe, and they are destroyed and won't be opening for

business any time soon. fire investigators and the structure engineer will be out here later this morning, but the assistant chief says she would not be surprised if the building was condemned. requirement now this is a live picture from our mass camera. this building is about 100 years old. it was built in the early 1910's p because of the way the building was constructed it's a wood framed building, it is considered to be structurally unsound. so when the fire investigators and engineers come out later this morning, they're not even going to be able to do the work inside the build. the they'll center to do the investigation on the outside of the building. that's also the reason why the intersection here remains closed this morning. they're just concerned, firefighters are concerned that something could happen with this building. they think it's that unstable at this point. allie rasmus, ktvu channel 2 news. hoarse a look at the streets that will remain closed

because of concerns about that building time is 7:33. a fast-moving wildfire in reno remains out of control at this hour. more than 450 firefighters called, including 150 on duty overnight. the wind fueled fire destroyed 25 homes and elderly man died if a heart attack trying to escape the flames. a firefighter also suffered first and second-degree burns. the fire also forced 10,000 people to evacuate. >> you can see all the trees that were burned. >> very grateful we got a good fire department and they were here, and helping. i feel sorry for the people on didn't turn out as well. >> despite falling temperatures, firefighters say two thousand homes are still threatened. while investigators don't know what caused the blaze, they say homeless people are trying to stay warm or down power lines could be to blame. san jose police locking for

a driver who struck and killed a pedestrian then drove off after 6:30 yesterday afternoon at story road and bedford street. authorities say the man who appeared to be in his 60s died at the scene. so far no details on the suspect or the vehicle that hit that man. the incident marks the 16th time this year that a car has struck and killed a pedestrian in san jose. three people are recovering from injuries this morning after a police chase in oakland. it started around noon yesterday near grand avenue and macarthur. police say the driver of a mercedes did not stop when officers tried to pull him over. they say the driver sped down macarthur on on to coolidge, raise causing two cracks before jumping on the of the mercedes, gun in hand. he then forced a family out of their suv, then drove away, then crashed where he was taken into custody. danville police are looking for anyone who witnessed a deadly crash earlier this month. authorities think a pickup truck broadsided an suv on

november 7th on sycamore valley road. two women were killed. the driver is recovering. no charges or citations will be issued until this investigation is completed. the family of slain nursing student michelle le will come together today for a new cause. you'll recall she disappeared in may from the kaiser hospital in hayward. search volunteers later found her body in september near sunol. the family is creating a new support group called mission michelle. the family says it will help families with missing loved ones, including offering volunteers for searches. a meeting will take place at noon today at the san josely brim the occupy santa rosa encampment appears to be getting smaller. the encampment outside city hall now has about 50 tents, down from 100 just a few days ago. the decline comes as police have issued vacate notices to people for camping without a

permit. and occupy san francisco will hold a rare evening march later today. members are scheduled to march from union square to justin herman plaza at 9:30 p.m. an hour long rally will follow at 10 p.m., with several members from the american academy of religion. and as the encampment continues, some say the larger message of protesting corporate greed and economic inequality is getting overshadowed by the issue of chronic homelessness. we found one man who recently moved to the camp from an alley in chinatown. >> it's kind of the face of the movement, and it's -- it's not the proper face of the movement. it isn't what the movement is about. >> it is a problem for the city. wand to help us, okay? homeless -- why don't they help rather than condemned them? >> the mayor said camping at the plaza cannot go on indefinitely. sanford cardinal and cal bears face off today in what is considered one of college football's biggest rivalries.

but before that big game, students from both schools are going to come together. students are planning a march today to protest police brutality and stand for civil liberties. the joint demonstrations comes after some say police used questionable force last week while trying to break up the occupy cal encampment. >> it's about civil rights, human rights speech to express yourselves, your opinion against the system. >> it will be an interesting way to unify the two schools on what it normally a day that is -- based off rivalry. >> organizers of the demonstration are expecting 400 stanford and cal students to participate in the pre-big game rally and march. cal state university officials say they have no plans to reconsider a recent decision to raise tuition next fall. lieutenant governor newsom hack calling opted board of trustees to hold another vote of after a meeting in long beach was disrupted by protestors on wednesday. the board approved the 9%

tuition hike. officials say they did the best they could under the circumstances, at least 4 people were arrested during the protest. california voters are apparently not happy with the state of public schools. the new usc poll shows a majority believe schools are in bad shape or getting worse. they blame the demise on funding shortages, wasteful spending and bureaucrat, barriers to innovation. many said they want parents to have a say in how to change low performing schools. hundreds of volunteers will be picking up trash along by area freeways this weekend. it's part of caltrans' adopt a highway program. about 400 people will clean interchanges on six highways in the san jose area today. caltrans is asking drivers to make sure they obey the move over law, that means slow down and move away from highway or emergency crews on the side of the road. the eastern sidewalk of the golden gate bridge is back open this morning.

good morning to you! san jose, sunshine pouring in to the santa clara valley at this hour. it's a chilly one! santa cruz sheriff's office is revealing new troubles with the occupy santa cruz encampment. the office announced yesterday there have been 85 crimes and disruptions around that encampment in the past month. those include fights, assaults, thefts, drug use and vandalism. the sheriff's office supports the rights of free speech but some people are using that camp as a cover for criminal behavior. more police force against occupy oakland protestors, this time in portland, oregon. officers on horseback tried to clear protestors away yesterday from a chase bank, but those protestors refused to leave leading officers to use pepper spray. one man took this photo showing

welcome to mornings on 2. it's saturday, november 19th. it is blue skies for now, but don't put those umbrellas away just yet. rosemary, when is that rain coming back? >> too soon for some of us. this morning as we mentioned we've got sunny skies are and that clearing has really allowed our temperatures to plunge, freeze and subfreezing temperatures in some cases and little patchy dense fog, especially over the north bay and our valley locations. we're going to be mainly dry today, cool but that rain is coming back as early as tonight. we will show you at the latest models indicating for your neighborhood, coming up. huge apartment fire in berkeley is still smoldering this morning. that fire broke out just before 9:00 last night on telegraph avenue. allie rasmus is live where there are new safety concerns this morning. allie. >> reporter: firefighters furse responded to a call about -- alarms going off in the apartment building just before

9:00 last night. and more than 11 hours later firefighters are still here. that ladder truck there were still shooting water into the sides of the building a couple minutes ago, and right now you can still see smoke coming out of that second story window. if we pan over to the top floor of the apartment building, you can see the roof classed and there's still smoke pouring out of the roof here. at its worst, this was a five- alarm fire overnight. fire crews from across the county came in to help berkeley fire put this out. fire is under control now, but again they're still putting on the hot spots this morning. there are about 40 to 50 apartment units in this building. we've contacted the red cross this morning to find out how many people were displaced by the fire because everyone had to evacuate and get out. we have not heard back from the red cross yet this morning. the assistant fire chief says there are no reports every any injuries, and no reports of any residents still missing.

however, fire chief explained that because the fire spread so quickly, firefighters were not able to do a primary search of the entire building, only able to go the second and third floors to make sure no one was still inside before the firefighters had to get out as well. when firefighters arrived it appeared the fire gun in an elevator equipment room. >> elevator shaft open spaces for the fire to travel, so and i that time it was already working the way up, very old wood structure building, lots of field space. the fire had a head start working its way vertically, spreading out horizontally. >> on the ground floor of this apartment building are three businesses. those businesses have been destroyed in the fire. they're owned by the same man who owns the building. we talked to the manager of cafe, who showed up for work this morning and tells us he was in shock about what he saw here. >> we've been working for this

wildfire that thousands of people from their homes. the so-called colin fire has burned more than three square miles and destroyed or damaged 25 houses. a 74-year-old man died from a heart attack as he was to go to escape the flames. 16 people went to the hospital, including a firefighter who suffered first and second- degree burns. fire officials say the worst is over as overnight snow flurries and falling temperatures moved in to help extinguish the flames. >> i think people on this street, but it's hit and miss which houses it hits, like jumped over there to that -- those bushes and that house. >> your house is okay? >> my house is okay. i just don't have any power. >> investigators are not sure what caused the fire. they speculate winds may have brought down power lines sparking the fire or it do have been starred by people in a homeless encampment trying to stay warm. more than 4 hungary firefighters were called in to assist, including some from california.

police say only one person is responsible for the fatal shooting of officer james capoot. investigators say the suspect 37-year-old henry smith jr. acted alone. he was arrested moments after the shooting and is behind bars this morning on robbery and murder charges. authorities say smith robbed a bank and then led police on a high-speed chase before trying to escape on foot. it was during the foot chase that capoot was shot and killed. he is remembered as a man dedicated to his job and the community. he coached girl championship a vallejo high and yesterday one of his players left her jersey on the steps of police station in his honor. >> he helped me to never ever go up on myself. basketball was the reason i could see going to school. >> his friends say he acted as a fathering if to children throughout the community and leaves behind a wife and three daughters. a vigil is planned for 6:00 tomorrow night at city hall. the shooting has some people asking it there's enough police on patrol to ensure

officer safety. capoot was ride ago loan on thursday when he was gunned down. fresh out of bankruptcy, the city of vallejo has a sharply reduced staff of 93 sworn full- time officers. with the population of 115,000, vallejo has far fewer sworn officers than comparable cities. santa clara has 131. berkeley, 167. and rich man has more than double the number of officers. >> we can't determine if that's a factor or not. the officers typically work by themselves on day shift before we have these staffing issues. >> vallejo assistant city manager says there's no funding requirement now to add officers. measure b, a one yen sales tax on last week's bat, would raise $10 million for the city. but a final vote count won't be out until next week. new video shows police at uc davis using pepper spray on a group of students during an occupy protest.

player kidnapped and rescued in venezuela is now ready on to play baseball again help he made a quick trip back to washington, d.c. thursday night where he was groat by his teammates and checked out by team doctors. they said he is in terrific shape. he was kidnapped at gunpoint outside his family's home in venezuela last week. about 50 hours later he was rescued from his captors. >> happy to be here, happy to be with my family, and see -- >> police have charged eight people in connection with the kidnapping. ramos is now heading back to venezuela and will play again as soon as tuesday. mcdonald's has dropped one of its egg suppliers after an animal rights group released video showing animal cruelty. it follows a warning letter sent from the fda to the farms about serious food safety violations at five of their facilities.

this week. weather experts say a twister this blew through south carolina had maximum winds of 135 miles an hour. its path stretched 2 1/2 miles long and 200 yards wide. the tornado wedge cars into trees and killed three residents. tornadoes also hit mississippi, alabama, and georgia. at leave the six people were killed, and dozens injured in that storm system yow a tornado hit the town in bolivia yesterday. the twister ripped sheeting from roofs and uprooted trees. dozens of homes and buildings were damaged. there were to reports every casualties. no tornadoes hee but we have had rain in the area. rosemary, you think it's coming back tonight? >> it is coming back. we have another system outs of the gulf of alaska. this morning we're mainly dry but cold. mostly sunny skies, high clouds overhead. and little patchy frosted. patchy dense fog over the north bay. and as we reported a moment ago, freezing conditions in some of our valley locations. headed to the sierra this

a huge apartment fire in berkeley still smoldering this morning, and now officials are worried the building could come down very soon. quite possibly. and welcome back to mornings on 2, everyone. it took firefighters six hours to contain the flames. streets near the building re still blocked off. allie rasmus is live at telegraph and monitoring the situation all morning long. >> reporter: we have seen some changes just in the last 15 minutes. firefighters first got the call about a smoke alarm in the building 9:00 last night and 11 hours later they're still trying to put out hot spots. just in the last 10 minutes

they positioned their water cannon over the roof. the roof collapsed on to the four th floor and that's where we're seeing a lot of smoke coming out of that fourth floor. this is apartment building on telegraph and haste. now at its worst this was a five-alarm fire overnight. fire crews from across alameda county, oakland to albany, came in to help berkeley fire with this. there are about 40 to 50 apartment units in the building. and the sign outside says it's the sequoia apartment building. we contacted the red cross and haven't heard back from them to find out how many people were displaced last night. but everyone who lived here obviously had to be evacuated. the assistant fire chief says there are no reports of any injuries, and no reports of any residents missing. however, she told us because this fire spread so quickly, firefighters were not able to do what they call a primary search of the entire building. firefighters were only able to go through the second and third floor to make sure no one was still inside.

they didn't get to that fourth floor. the roof above the fourth floor collapsed. smoke alarms were working and when firefighters arrived it appeared that this fire began in an elevator equipment room. >> elevator shaft open spaces for the fire to travel, so by that time it was already working the way up. very old, wood structure building, lots of concealed spaces. >> and that added to the challenge of putting this fire out. the fire is contained but they're still putting out hot spots. on the ground floor are three businesses, and a cafe, and they have been destroyed. this morning we talked to the manager of the cafe who thinks the owner will rebuild but says that could take awhile, especially since this entire building will probably be condemned. >> i've been working for this place for 23 years, half of my life. and now it's gone.

>> fire investigators and a engineer are supposed to be out here later this morning to do an investigation, but the assistant fire chief said she would not be surprised if this building was not only condemned but had to be razeed to the ground. she says this building is almost 100 years old, build in the 19teens or early 1920s, and it is a wooden structure, so it did not survive the fire even though the outside it looks like it's okay. she told us this building is not structurally sound and that the fire investigators and engineers when they come out won't be able to go inside to do their investigation, it's that unsafe at this point. and that's also the reason why not only this intersection but some of the surrounding blocks have been closed off to traffic, not only are there still firetrucks working on the fire, there's still concern that if something happened finish the building did collapse, there are people in the area that could pose an obvious danger. so this area is shut down to traffic and we'll have more details on which street they're

shut down coming up after this. allie rasmus, ktvu channel 2 news. at a news conference this morning, authorities in reno hope to announce what started the cullen fire. firefighters say they made great progress overnight, there were 150 firefighters on the frontlines in the early morning hours and right now power has been restored to most hands still standing. the fire has damaged or destroyed at least 25 houses, and elderly man died from a heart attack while trying to escape the flames a firefighter suffered first and second- degree burns. the fire forced 10,000 people to evacuate. >> you can see all the trees that were burned. very gritful that we got a good fire department and they were here, and i feel sorry for the people who didn't turn out as well. >> despite snow flurries and falling temperatures overnight, firefighters say two thousand homes are still threaten. two men in jail this morning after a late night robbery at a vallejo fast-food restaurant.

we captured police officers son and to go the call around p.m. it all started when a couple of stanford students called police to say two men robbed them at gun point at the jack in the box. a short time later police tracked down the suspects and the vehicle, and also a short chase ensued. >> the managed to apprehend both subjects and inside the vehicle we did locate some of the victims' belongings and recovered loaded firearm. >> investigators tell us that the two suspects are a 33-year- old parolee from pittsburg and a 35-year-old man from san francisco. the man accused of killing police officer james capoot will be in court on monday. authorities say henry smith shot and killed capoot while return from a bank robbery. he could face a charge of murder with a special circumstance with murdering a police officer that. could carry the death penalty.

capoot a 19-year veteran of the force leaves behind a wife three daughters. the police officer's association is establishing a memorial trust fund on their behalf. a vigil will be held in front of city hall tomorrow night. funeral plans for capoot have not been finalized. san jose police are investigating another pedestrian death. this one was a hit-and-run. police say a man in his 60s was hit by a car around 6:45 last night at story road and bedford street. he died at the scene. so far there are no details of the vehicle or the driver responsible. san jose police say this is the 16th time this year that a car has struck and killed a pedestrian. as a second parolee is in custody after a wild police pursuit. police say officers tried to pull over the driver ever a mercedes around noon yesterday near grand avenue and macarthur boulevard but officers say the driver took off down macarthur and coolidge avenue, causing two crashes. police say the man got out of his car with a gun and forced the family out of their suv.

the suspect crashed that suv a short tile later. the suspect and two others were taken to the hospital with minor injuries. danville police looking for anyone who witnessed a deadly crash earlier this month. authorities say the pickup truck broadsided an suv on november 7th on sycamore valley road. two women were killed. a 72-year-old and her 51-year- old daughter. the driver of the pickup is recovering from his injuries. no charges or citations will be issued until the investigation is complete. the family of slain nursing student michelle le is coming together for a new cause. you'll water she disappeared in may from kaiser hospital in hayward. search volunteers later fond her body in september, near sunol. now the family is creating a new support group called mission michelle. the family says mission michelle had help families with

missing loved ones. the occupy santa rosa encampment appears to be getting a bit smaller. the press democrat reports the encampment outside city hall has just about 50 tents down from 100 a few days ago. but the decline comes as police issued vacate notices to people camping without a permit. occupy san francisco is going to hold a rare evening march later today. men's are scheduled to march from union square to justin herman plaza at 9:30 p.m. with an hour long rally following at 10 p.m. and as the epp amount at market continues, some say the larger message of protesting corporate greed and economic innie quality is getting overshadowed by the issue of homelessness. one man recently moved there from an alley in chinatown. >> it's the face of the movement, and it's not the proper face of the movement. it isn't what the movement is about. >> it is a problem for the

time is 8:55. we want to update you on our top story this morning. berkeley firefighters are still amount the scene of an apartment fire that started more than 12 hours ago. nobody was hurt in the fire at this building that broke out before 9 last night, but the roof collapsed into the fourth floor, and officials are worried that that whole building could come down. so some streets are still closed. that includes telegraph between dwight if channing and haste street between dana. the streets could remain closed
