this was a blizzard of gunfire. and police say it started over here with dozens of people in this parking lot drinking and shooting a music video just after dark. police say the wounded were gone before they even arrived. driven to emergency rooms in private vehicles. even the child caught in the cross fire. >> we're aware of a 1-year-old boy who was shot, possibly in the head. is in critical condition right now. >> reporter: at least six people were firing guns in a crowd of 20 to 30. and it started in the parking lot of state liquor. about a block from the campbell housing projects. >> a lot of times it's a lot of people acting stupid over there. >> reporter: the lower neighborhood gets its share of police calls but nobody remembers anything like this gun battle. beforehand as the crowd grew getting louder, residents were worried. >> my husband called opd a

couple of times. and then a few minutes after that, heard all those gunshots. >> reporter: dozens of gunshots, they shattered this window at a chinese restaurant across the street. three customers were inside at the time. they ran with staff into the kitchen to get away. with b.a.r.t. trains running alongside and the postoffice processing facility just steps away, stray bullets might have hurt anyone. >> a mother is really hurt right now. a family is tore up behind this and it just doesn't make no sense. have some respect for other people's lives. you know other people. it's just terrible. >> reporter: as evidence technicians combed this scene i'm told this investigation is moving fast. a surveillance camera on the liquor store captured the whole thing and that is helping police identify vehicles and suspects. the lieutenant in charge of this scene told me just minutes ago they are making progress on a motive and they might even

serve search warrants before the night is out. we're live in west oakland, debra villalone. now to alex sadvedge where the 1-year-old boy was taken to children's hospital. >> reporter: i'm told that boy is just shy of 2 years old. anger and sadness as relatives gathered outside children's hospital in oakland tonight. looking for word on the condition of a 1-year-old boy shot in the head. relatives say the child was breathing after arriving and is now undergoing surgery to relieve swelling on his brain. police say the boy's father who was also injured by gunfire drove them both to children's hospital then later a third person also came here with a gunshot wound. >> you feel like he's going to

the ktvu morning news at 4:30 tomorrow. occupy oakland protesters say they intend to return to frank ogawa plaza to begin a 24 hour vigil. they say they intend to erect symbolic structures but do not intend to sleep in the plaza. we spoke to de la fuente and said he will not allow not even one tent to go up. the protesters went to federal court and argue had the the city council passed a prosecution with occupy oakland. legal activists say it's unlike the court will side with the occupiers. an exclusive new ktvu feel

no one has been charged. police say 29-year-old al bartell remains in a coma tonight. he was hit by a driver in a parking lot at gary boulevard and ninth avenue early thanksgiving morning. police released the suspected video of the driver. investigators say it shows a man at a jack in the box where he got into a fight with bartel. police have an imagine of the driver captured by cell phone. they think the man is driving a late model mazda cx with custom 12 spoke rims. you can get a look at that video, on our website. just look for the link on the top of the web page. they're responsible for over $20 million in fraud. a major fraud scheme with ties to the bay area. the major push to identify

in medicare scams. ktvu's ken pritchett talked to a federal agency with a new top ten list of accused medicare criminals and the connection to the bay area. >> reporter: this is 25-year- old ecetarina slikova of russia accused of living it up from money stolen from medicare. she was part of an organized crime network that stole over $50 million a crime that started with i.d. theft of medicare residents skr- z they will steal, they match those two together and they bill medicare for millions of the dollars of services they never provided. >> reporter: money was laundered through thousands of fake businesses including a bogus doctors office in this san francisco building. and a bay area doctors identity was stolen by the group. >> now they come knocking at your door and says, you owe tacks on $3 million of income

year affair. a woman says she decided to go public after other women accused him of sexual harass -pl. >> i didn't want to do this but i felt at the end of the day, it was the right thing to do. is it going to hurt a lot of people? yes. and i'm going to be one of them. >> reporter: cain has dismissed other charges of sexual harassment. liberal congressman rodney frank announced he will not seek reelection next year. the massachusetts democrat has served in congress since 1980. his legacy will include his fight for gay rights and same- sex marriage plus his leadership of the committee. there are other things he says he would like to do with his life. the protest at uc davis is showing no signs of slowing down. students called for a general strike today that continued right on into the evening. ktvu's ken wayne is live at the

asked for her resignation. the economic senate released four -- a stapding room only crowd showed up for the meeting. the resolutions condemn the police response on november 9 where officers were seen using batons on demonstrators. they also asked the university to take responsibility for that incident. the senate decided not to take a no competence vote on the chancellor. he did address the crowd. >> i'm extraordinarily disturbed that these events happened. i apologize once, i'll apologize again and frankly as chancellor take full responsibility. >> while the senate passed the resolution it opted not to send it to the full faculty for a vote. uc berkeley police issued an open letter to students, faculty and administration while defending officers response they also took aim at officials saying, please don't ask us to enforce your policies then refuse to stand by us when we do. new at 10:00, two east bay

who apparently killed his wife was a san jose police sergeant. ktvu's robert handa tells us what fellow officers are saying. >> reporter: the schimick family home is hauntingly quiet today. family and friends had called gilroy police late last night asking officers to do a welfare check because no one had been able to contact the schimicks during the holiday weekend. >> once we got into the home we found a female who had been diseased. we found a man who had died of a self-inflicted gunshot wound. >> reporter: that male was christopher schimick, the woman, his wife. the couples two teenage children were not home at the time. neighbors were stunned. >> a very nice affluent area, brand new high school, brand new homes, you don't expect to hear or see anything happening in this area. especially being a cop and a

shortest conviction. an initial exam found oscar hernandez to be competent. he's charged with the murder attempt of president obama. hernandez is being held without bail. on the monday after thanksgiving cold weather shelters open to house the homeless. lloyd lacuesta is live now at the national guard armory in sunny vale where many homeless are taking advantage of a warm bed. >> reporter: i've been told there are 89 men and women bedding. there's room for 129 beds and cots. it's not much but it's a warm refuge. among those that came in from the cold, emily patty who for the first time in her life found her in a shelter. >> where have you been staying? >> under the trees in the park.

i ended up in the hospital three times already. >> reporter: officials say these are the chronically homeless. don galvin says this is his second year. >> i like it. it's very clean. people are nice. >> reporter: the care includes medical care. there are more than 7,000 homeless in santa clara county on any given night. that's more than san francisco. but here they are not as visible. >> people are living in encampments, in their cars. they are folks you may be working with every day who may be living in their car and you wouldn't even know they were homeless. >> reporter: this woman sought shelter here, she now has a place to stay and works in the sheller program -- in the shelter program. >> i decided to give back what i got from here last year. >> reporter: some say while they're homeless they're not hopeless. >> i can't believe i'm in this situation but i will drag

myself out of this. i'm not -- will never turn this down when i get back up there, this is going to be my thing. to help the homeless. >> reporter: last year 52 people in santa clara county died while living on the streets. live in sunny vale, lloyd lacuesta. the ninth circuit court of appeals agreed to reconsider a legal challenge to an alameda county law that bans guns and am in addition on public property. back in may a three judge panel ruled in favor of that 1999 ban. but gun rights group says the law infringes on their rights to bear arms and argued on an appeal. now the 11th judge panel is expected to take up that issue. >> the walnut creek council is set to hold a meeting to talk about broadway plaza. it would include some housing

skateboarders in oakland are mourning the demise of a popular destination tonight the park had been there for about seven years, in 2005 caltrans reached a deal with the city of oakland and a nonprofit group representing skaters for a three year lease at that location. but caltrans says necessary safety changes were never made to the park and the city decided not to renew the lease. skaters said they were sorry to see the park go. >> totally bummed that -- i don't know, took a lot longer to build than it's going down. >> reporter: a spokesman for caltrans says the agency is willing to work with any group that wants to build a professional skate park at that site. the oakland man who claims he was beaten by b.a.r.t.

police officers took the witness stand today. kenneth corrothers says he's no angel but did not deserve to be beaten. he claims that mehserle grabbed him and kicked him to the ground. also in oakland prosecutors urged jurors to convict the suspected gang member of murder. last may, 17-year-old detained franklin jr. was shot and killed as he was riding his bike. prosecutors say his killer was michael franksman. frank franklin was about to graduate. franksman says that he killed franklin because he belonged to a rival gang. the lines appeared longer at the women only polls.

all. your forecast then for that thick fog to continue. dense valley fog in the forecast. visibility are going to go down to at least .25 of a mile. especially out by fairfield and napa, antioch and concord. really dense fog. the fog is forming right now. i mentioned earlier the dewpoints are running in the mid-40s. temperatures already in the mid- 40s. so i've mentioned this in an earlier show too. you know how you're driving around sometimes and you see that haze. you can see the fog forming. that's the point where the temperature has reached the dewpoint temperature and immediately you're seeing condensation right there. it's usually right at the ground level. that's why valley fog, radiation fog all the same thing. that's why it could be so nasty as you're driving around. the dense fog advisory in the area, it's nasty it's as bad as it gets in the bay. the shipping interest in the bay, the ferry boats. remember how bad it was in the

bridges this morning. potentially that bad again tomorrow. i've had reports down by redwood shores, a stanford woman's crew team they can't work out. the visibility is so poor you can't crew when you're out there. there's all sorts of interests that are impacted by this fog. i was talking to somebody who delivers newspapers until the morning, it's tough to see the addresses. light breeze in the forecast but no rain in the forecast. computer model doesn't do a great job picking up the fog in the north bay. tomorrow at 8:00 a.m. but you can see it picking up the big massive fog out in the central valley. that central fog extends south. if you have interest on highway 99 or 95 be ready for that. everything changes around as we head into late tomorrow night early wednesday when the winds pick up. a wind advisory will go into effect. temperatures will be warmer than these in some places on wednesday and thursday. but that wind what it will effectively do, scour out the

some good news to report tonight about that hawk found with a nail in its head last month in golden gate park. officials say the bird is doing great and back in the wild. the bird appeared in good spirits. she was released november 1st after a few days at an animal hospital. authorities are still looking for the person responsible for injuring the bird.
