it happened around 6:00 last night at seventh and willow streets near interstate 880, near a van promoting a musician. kraig debro has been on the story all morning and joins us live to explain why information on this shooting is so hard to come by. kraig. >> reporter: tori, the two institutions involved aren't releasing much information. the hospital says it won't say anything about the one-year-old who was shot in the head and the police have not returned our calls except to say there will be a news conference in one hour from now. however, the video you're about to see tells a major part of the story. the surveillance video shows three men turn the corner and then turn their guns on people in a liquor store parking lot at seventh and willow in west oakland. some of those people defended themselves and returned fire. minutes before 6:00, police say neighbors called to report an argument. >> it was fairly large gun battle as far as we could tell, multiple casings, and i can't say for sure about what calibers were involved. >> the gunfire wounded eight

people, including a one-year- old boy who was shot in the head. he was with his father who was also wounded in the shooting. >> i'm feeling sad right now. based on the fact that my baby cousin was shot. >> oakland grown rap artist is his cousin and says he wasn't at the scene of the shooting but a promotionallal van with his name and picture was there. >> it's a promo van that hadn't been around for years, and one of my promo people drivers around and promotes my music. >> the one-year-old's cousin says he survived surgery overnight but after being shot in the head, doctors might not even be sure of his chances of survival. >> the mother is really hurt right now. so family -- tore up about this and it doesn't make no sense. have some respect for other people's lives, other people. it's just terrible. >> this is surveillance video from inside the liquor store at the time of the shooting. you can see the panic in those

people's reactions. the father also received a gunshot wound during last night's shooting, wounded in the hand, treated and released. he spent the night at children's hospital with his son. kraig debro ktvu channel 2 news. to the sentencing of michael jackson's doctor this morning. the judge was unusually blunt in his assessment of conrad murray and left no doubt about how he felt about the doctor and his care of the late superstar. new at noon, tara moriarity joins us live to explain why the sentence was not what the judge hoped to hand down. >> reporter: that's right, the judge said he felt that prison was an appropriate sentence, but legally he could only send dr. murray to jail. he went on with some call a rant in handing down the sentence, the harshest one on the table. >> the court imposes the high term of four years in problem. ment. >> he at times looked angry, the judge add admonishing the cardiologist for spinning a web

of lies, betraying his patient. but administering the drug are propofol in exorbitant amounts to treat michael jackson's insomnia. it's supposed to be used in hospitals settings and has never been approved for sleep treatments. >> he should maybe made very clear that experimental medicine is not going to be tolerated, and mr. jackson was an experiment. the fact that he participated in it does not excuse or lessen the blame of dr. murray, who simply could have walked away and said no, as countless others did. >> the judge said murray failed to take responsibility for the pop star's death in june 2009. murray was convicted earlier this month of involuntary manslaughter. and an attorney speaking for the jackson family read a statementing asking the judge not to grant probation.

>> we respectfully request that you impose the sentence that reminds physicians that they cannot sell their services to the highest bidder and cast aside their hippocratic oath to do no harm. >> murray blew a kiss to the courtroom as he left. his mother and girlfriend were present. he was then taken to the los angeles county jail, where he could serve half of the four years because of overcrowding in california jails. murray did not receive probation, he has lost his ability to practice medicine, and next january he will not be present when the judge will consider how much restitution he has to pay that jackson's family, which could be more than $100 million. later today, san leandro police will release new information about the shooting of a shopper in that city on block black friday. hours before dawn friday, outside the wal-mart on hesperian boulevard, a man in his 20s was critically wounded

during a struggle with his would-be robbers. that victim is expected to survive. police arrested one suspect, shortly after the shooting. they're still looking for two other suspects and a weapon. the man suspected of killing a vallejo police officer this month has just entered a not-guilty plea this morning. allie rasmus is live in vallejo to explain what happens next in the case and how the city will honor the fallen officer tomorrow. >> reporter: we're at vallejo high school and crews are just finishing upsetting up a stage, and they're setting up a sound system ahead of tomorrow's public memorial for vallejo police officer jim capoot. they already have the flags at half-staff. organizers are expecting from three to 4,000 people to be here tomorrow. they'll be seated out higher on the football field, and of course in the stands. it's taken place during the school day at 11 a.m. tomorrow. and classes will go on as scheduled. but many students are taking time out to attend, including all 30 members of vallejo high

school girls basketball team. officer capoot was their coach and helped them get to a division championship in sacramento. the principal told us the reason the public memorial will be here, it's not just because this is a large venue for vallejo but also because of officer capoot's close ties to the school. >> just a total supporter to vallejo high school, so that is the main reason and part of the reason we're here today. he's being honored here as a community member at vallejo high school for the great things he has done. >> capoot was shot and killed while pursuing an accused bank robber this month. 37-year-old henry smith of fairfield was arrested for the crime and charged with murder. these are photos taken from inside the court this morning. he pled not guilty and because of the charges smith could be eligible for the death penalty. >> will this be a death penalty case? >> that decision has not been made. >> smith's next court appearance is on thursday.

that's when a judge is supposed to decide whether or not to grant a gag order in this case so basically the attorneys on both sides would not be able to comment about it publicly. allie rasmus, ktvu channel 2 news. and you can go to ktvu.com for more on this story. that includes what happened in court today, with the suspect and additional details on tomorrow's funeral plans for officer capoot. today got off to another foggy start, making it difficult for travelers in the air and on bay area roads. the national weather service just lifted a dense fog alert a few minutes ago. it was issued late last night when visibility on bay area bridges and roads was limited. and some places, like the bay bridge, it was down to about 300 feet. it was less than a half mile in many other areas. we'll have more on the fog in about 10 minutes. fog is likely the cause of a fatal accident on interstate 5 in stockton. it happened just after 3:30 this morning near the march

lane exit. the highway patrol says a man was pushing his disabled car in the fog when another car slammed into him, killing him instantly. because of the construction on the freeway there was no shoulder for the man to pull to the side of the road. visibility was only 100 feet at the time of the accident. and a low fog ceiling is causing flight delays at some bay area ire ports. sfo is reporting one hour delays causing a ripple effect. flights are also delayed because of weather conditions in other parts of the country, like the midwest and on the east coast. mineta san jose says it's getting back to normal this noontime. a half dozen arrivals and departures were cancelled this morning due to dense fog. arriving flights also experienced hour delays this morning. and oakland international says the fog has lifted there and it has no delays. but it's what you should call ahead and check with your airline to be sure.

occupy oakland protestors plan to go back to the plaza today and begin a 24-hour, 7- day a week vigil. this morning we found some people sleeping on the sidewalks and at least one person up in a tree. occupy protestors say they intend to set up symbolic structures like a tepee in the plaza. but they say they will not sleep there. city councilman tells us here at ktvu the city will not allow even one tent to go back up. when we come back, luck may be running out for a casino in a battle with the city. in addition to watching the fog problems, steve paulsen is check to go see if there will be any rain, any time soon have. he'll have the forecast next. >> american airlines will be -- [not understandable] >> american airlines executives try to reassure customers that the filing for bankruptcy protection this morning.

towards iran. the scene comes two days after iran's parliament approved a bill that reducing diplomatic relations with britain. the decision followed london's support of stepped-up western sanctions on tehran. vice president joe biden is in iraq on a surprise visit. the vice president's trip comes as the last wave of u.s. troops pull out of that country. during the two-day visit, biden is expected to hold meetings with iraqi officials to discuss the new phase in the relationship between the u.s. and iraq. he'll also -- expected to meet with u.s. service members some 13,000 u.s. troops still remain in the country. the plan is to have all of those troops out of iraq by december 31st. police in san francisco are questioning a possible suspect in a shooting at a mission district bus shelter. it happened last night at 16th and mission. investigators say a 41-year-old man was wounded while waiting

for a bus. he is expected to survive. police arrested the suspected gunman after a foot chase. it's still not clear what led up to the shooting. san jose police are searching for the gunman who shot and injured a man overnight. police found the victim on apple blossom drive. he had been shot several times and was taken to the hospital where he is treated for non- life-threatening injuries. police are still investigating a motive and so far no arrests have been made. it is which is as usual today. american airlines continues to operate and honor tickets, even after announcing it's filing for chapter 11 bankruptcy. the parent company amr says the decision was not made because the company is out of cash, but rather it's a strategic move. according to the board of directors, chapter 11 reorganization is in the best interests of the company and its shareholders. >> i think we concluded that

the gap between -- true, and the rest of the industry have become too wide, and really just not something we can sustain any further. >> amr also says the economic turmoil in the global economy and the volatile fuel market combined to create a tough atmosphere to do business and stay competitive. we were at sfo this morning and the director of communications there agrees higher fuel costs are affecting the way airlines operate. >> the biggest trouble is the cost of fuel. every penny increases millions of dollars a day for the airline. so until they can get a grip on that, it will be very challenging for any carrier. >> american says passengers show it should not worry. the bankruptcy process is not expected to affect its flight schedule or frequent flyer programs. san francisco's district attorney made a public plea today for safer driving during the holiday season. >> whatever the reason for the

injuries and death is that all this is related to people not following the rules, people being distracted, and then the outcome is very tragic. >> he says the problem was not limited to san francisco, and about 36% of pedestrian collisions around union square shopping district involve out- of-town drivers. the district's attorney says his office will prosecute cases when appropriate. a legal battle between the napa valley casino and the city of american canyon could threaten the card room's future. the card room is an ongoing dispute with the city over a tax passed by vote last year. it imposes a $2 entrance fee on all card room visitors. but the casino argues the fee violates state gaming laws. >> how could it be legal? how could you charge somebody to go into a business? is there any business around here doing that? why she we be the only one?

>> the city has filed a criminal complaint for non- payment. tax. yesterday the card room won a reprieve from losing its license to do business. the city argues there's a discrepancy to the business name on the paperwork filed with the city. the casino's owner says the city is using that issue as retribution for the company refusing to pay the new tax. steve paulsen says we'll get windy weather tomorrow and pg&e is bracing for power outages. this was shot 30 minutes ago in oakland. it shows pg&e workers preparing for the high winds. they're trimming trees around the bay area to keep branches and limbs from falling on a power line. winds could reach up to 60 to 70 miles per hour in parts of the bay area this week, especially up in the mills. wind will be in our forecast but not until wednesday night or thursday. today it's the fog and a lot of fog.

now the fog has cleared, and a blanket over the ggb. above we had a lot of high clouds. that's not the case today. so if you're in the sun, ice in the 50s to near 60 degrees. if not, if you're stuck in the fog, it's 49 and 48 degrees. oakland cloudy and 48. livermore sunny and 60. so we had the fog this morning. the fog advisory has since been cancelled but they were extended from 9:00 until noon here. hazy sunshine, but still some fog holding on. not much of a breeze. what little breeze there is out of the east and northeast. you can see a combination of the two. not only coastal fog but valley fog. usually it's one or the other, not both. so the combination with the squeeze play on us. north wind at travis, a little east-northeast at sfo, that just brings the fog back in and even a west wind on the coast some there's a lot of cloud cover. look at the blue, that's the cold temperatures. 45 in fairfield. yet 60 in livermore. 46 in concord.

55 san francisco. 55 santa rosa. so for some they're warming up. for others it's gray and cloud. high clouds in southern california, but after the fog tonight we'll still have fog maybe even tomorrow morning, then we'll focus our attention on this system up to the north, which will dig into nevada, then eventually carve itself back towards southern california, and the end result will be wind. it will be pattern where it wipes out the fog but we have a footprint of it in the valley so that's not going anywhere tonight or tomorrow. so thick fog, it's cooler on some of these temps in that fog. but more sunshine today and that win out even though the days are short. dry pattern for a while. hints maybe around december 13th or 14th we may get into the rain but until then we'll have to deal with wind here in the next couple days. fog or sunny. if you get the fog it's not warm. if you get the sun it's not too bad. 50s for some. 60s for others. i mean, a space of even a quarter mile or less could mean a difference of 15 degrees in the temperatures some of it's just one of those ones if you get the sun enjoy, it if you don't, it will be very cold.

it's also looking like it will be very windy on thursday. and maybe in the friday and we'll clear out by the weekend. >> thank you, steve. san francisco police continue to look for the man they say deliberately ran over an iraq war veteran leaving him in a a. police released video from a jack in the box of the man who ran over 29-year-old al bartoll in a gas station parking lot on geary boulevard early thanksgiving morning. investigators say the man and bartoll fought inside the restaurant. it's believed the suspect is driving a late-model mazda with custom 12-spoke rims. we've posted the video on our channel 2 website, ktvu.com. for a closer look, click on the hit-and-run video link at the top of the homepage. drivers in san francisco will soon be able to feed parking meters with a cell phone. the new services is part of the sf park program. according to the san francisco chronicle, a 45-cent

convenience fee will be charged for each pay by phone transaction. the program will be tried out in a castro district first. if successful, pay by phone options will be expanded to other neighborhoods. starting today, zip car will offer more than just cars in the bay area. the car sharing company will now add cargo vans to its fleets of vehicles in oakland and san francisco. this is a test to see if the idea will be as popular in u.s. cities as it already is in london. the six zip vans will cost $99 a day, or a little less than $15 an hour. the fleet will expand to 15 vans after the first of the year. still ahead, new people who are trying to sell their homes don't want to hear. and two big headlines today for bay area based facebook. one involves plans for a public stock opening. if i can take classes year round

in home prices. the national average was 6/10 of a percent. it's the first overall decline in six months. the new report is just the latest evidence the troubled housing market is unlikely to recover any time soon. facebook has avoided paying a fine to the government to settle a privacy case. the federal trade commission charged facebook misled customers about the amount of information they share. publicly, the ftc says the network has agreed to get people's permission or approval from them in advance f privacy settings are changed. the news comes as the wall street journal reports facebook is readying to go public with plans for an initial public offering in the second quarter of next year. that move could set the company's value at $100 billion. coming up tonight at 5, we're following that mass shooting we told you about earlier in the newscast. in just about a half hour, police will hold a news conference. we will be there gathering new
