they just determined that it was safe to reopen the area. the postoffice tells me that why this is a central place to process mail in the south bay, work was continuing and trucks were using the backside of the building to transport mail. again a suspicious package at the main san jose postoffice, we'll let you know when there's new developments. tonight three people including a 1-year-old boy are in critical condition. but despite all of the people who saw what happened, no one is talking. we have team coverage tonight, ken pritchett has more on the victim's. first to eric rasmussen with more on the dramatic surveillance video of that shooting and the possible connection to local rap artists. >> reporter: police confirmed today that a group of people had just finished recording a video. they blew out the tires on this car, and they hit seven people.

and all of it was caught on surveillance video. surveillance cameras captured the moments that gunshots sent people scrambles. look closely and you can see one man on the ground shooting back. a second camera around the corner recorded three of the shooters from behind. one of them continued shooting as he backed away. when the shooting stopped, seven people had been hit including 1-year-old harem lawrence. >> it's tragic for a little kid like that to be shot at such a young age and he didn't do anything. >> reporter: local wrapper kafani says the young victim is his cousin. oakland police confirm people in the crowd had just finished recording a music video, but even though a promotional van with kafani was there, he wasn't. >> i can't tell you what video was being shot. but i was not there. >> reporter: oakland police

chief howard jordan and other city and community leaders urged witnesses to come guard. >> if you've seen something, say something. >> reporter: officials say they are following leads, and even this chilling video are leading to a motive. >> persons of interest, a clear and concise suspect is completely different and we have several persons of interest. >> reporter: there's also a $5,000 reward police say for any information leading to a suspect. i can tell you officers are not the only ones out here trying to track down those who are involved. we're putting that part of the story together for 6:00. eric rasmussen, ktvu news. we're here to tell you more on the conditions of the shootings, including that 1- year-old boy. >> reporter: lawrence is just a few weeks shy of his second birthday. he was shot in the head and his family says he remains in a

coma. this is a photo of hyrum lawrence provided to us by his family. all day today hyrum's family walked in and out of children's hospital oakland waiting for news. but there was little change in the child's condition since he was shot last night. >> he's a fighter. i mean he's in critical condition but he is fighting. he's going to get through it though. just keep him in y'all's prayers. that's all i ask. just keep praying. >> reporter: norman babino was the only family member to talk outside the hospital today. the father's child was also here, his hand was bandaged. you can see in the video, the child was in his child's arm. babino says that hyrum was cradled over his father's shoulder when the shots rang out and both father and son were hit. the family says it is no closer to knowing why the shooting happened. >> this was like, they need to cut this out. like this, like they ain't got

no remorse. it's sick. like, i'm getting read fed up with this. seriously. >> reporter: the child underwent surgery last night. but the hospital is not providing any information about his condition. what we know we know from his family. in oakland, ken pritchett, ktvu channel two -- channel 2 news. oakland major jean quan is asking the community to break the code of silence. he knows there's somebody out there that knows something. >> there were plenty of people in that parking lot last night and we need people to come forward. because even though we have video we need people to come forward and identify the shooters. the mayor also talked about the shooting death of 3-year- old carlos nava in east oakland back in august. she says in that case people broke the no snitching rule of the streets and that helped lead police to the suspected

gunman. our coverage will continue during the ktvu channel 2 news at 6:00. you can also go to our website 24 hours a day and learn about this story and then ongoing investigation by clicking the story underlating headlines. the man accused of shooting a police officer pleaded not guilty today. smith said nothing during his arraignment this morning. he is accused of killing james kapoot. smith's public defender entered pleas of not guilty to murder of a peace officer with enhancements that include robbery and waiting in wait. today work crews set up equipment for officer kapoot's memorial. organizers expect up to 4,000 people to attend. among them the 30 members of the vallejo high school girl's basketball team. officer kapoot was their coach.

the school is holding the memorial because kapoot was a friend of the school. >> that's the main reason, part of the reason we're here today. he's being honored here as a community member at vallejo high school for the great things that he's done. >> tomorrow's memorial service for officer kapoot begins at 11:00 a.m. two dozens students and community members filed a lawsuit in u.s. district court today in connection with the police response to occupy protesters at cal earlier this month. during the demonstration uc police officers were seen using batons on the demonstrators. today the plaintiffs called the attack unwarranted and politically motivated. >> the violence was to deter students from exercising their first amendment rights and we're saying that's completely unacceptable. that's not the kind of country we want to live in. >> the plaintiffs are demanding the resignation of uc berkeley's chancellor to drop all of the charges against the

protesters who were arrested. there's something new at the site of oakland's occupy protest but it may not be there long. we have pictures to show you here of a teppe being put up by protesters but police are poised to take it back down -- tepee. here's what's happening. lauren blanco now there with the stand off of the officers and protesters continues, laurane. >> reporter: the source of contention now is a tepee. it's up right now but tonight it's set to come down, again. >> you want to help us build a tepee, come on. >> reporter: smiles as the city

gives protesters the tempee and meant the retaking of frank ogawa plaza. they plan to hold a vigil. no sleeping, no tents, just a constant take over. the new permit only allows the tepee to stand between 6:00 a.m. and 10:00 p.m. >> it's a regional problem with the previous structures there's no lodging in the plaza. public space, everybody has a right to use it. >> reporter: because it's a public space, occupy attorneys think the occupiers have a right to use it. >> we're going to reserve the right to challenge the curfew. >> reporter: now city officials told us they plan to enforce

the permit at 10:00 p.m. tonight. if the protesters don't take down their tepee cops will take it down and they'll cite the protesters. laurane blanco. >> reporter: protesters in santa rosa are taking down their tents at city hall. at last check just about 30 minutes ago still there were still about 17 tents remaining at the site. one week ago police evicted one dozen protesters who did not have permits. student protesters at uc santa cruz have left the campus building they've occupied for the last 10 days. tonight is what you may call a truce at that campus. coming up, we're going to hear from ktvu robert handa he is in santa cruz and tells us what happens next may all depend on one thing.

the bay area is putting up the hatches, waiting for snow. the utility crew says it does this work all yearlong but stepped up itself efforts ahead of the windy weather. the goal is to keep branches from taking down the lines. >> 90% of those winds in trees are actually healthy limbs on trees. so we really have to look out for the ones that are lying close to the lines. >> our chief meteorologist bill martin is watching our conditions. how strong are winds going to be here. >> they'll be blowing, 60s, maybe 70-miles-an-hour over 1,000 feet. winds aren't here yet, and they're not going to be here until well pretty much tomorrow afternoon. i suspect we'll start to notice those winds kick up. east bay hills will be the windiest. there'll be winds in the other hills. the down sloping winds will really get gusting as we go through the night.

tomorrow the winds really pick up. that's when we'll see the strongest winds with gusts to 60 and 70 miles per hour. what we can do right now is check the live storm tracker 2. the wind observations are calm. when those winds pick up, you see the fog in the central valley it is going to scour out that dense fog advisory that we've seen literally the last couple of mornings in a row. so there is an upshot to the wind. fire danger should not be an issue with this one but the wind will be howling. you notice on wednesday afternoon and evening and you will most likely notice them in their strongest form thursday morning early. so when i come back we're going to look right at your forecast, we're going to have different winds at sea level. we'll talk about how strong the winds will be in the big cities. home prices across the country are falling again as a new report suggests the troubled housing market remains deep and won't recover any time

soon. according to standard and poors, home prices dropped 13% in september compared to the same month last year. would be buyers have been deterred by high unemployment and weak job growth. >> on wall street worries over the european debt crisis has stocks moving up and down of positive territory today. investors were trying to gauge the news. finance managers are meeting in brussels. the dow was up 33 points the nasdaq was up 12. joe biden is in iraq tonight on a surprise visit. the two day trip comes as the u.s. prepares for a full withdraw of troops by december 31st. the vice president is expected to meet with iraq's prime minister. the country's president and other leaders to describe the

ktvu news has learned that a major milestone on the fore bore project has just occurred and we have the pictures. tom vacar live at the new tunnel now with breaking news on a breakthrough, tom. >> reporter: let's just go to those pictures right now. though caltrans is not sharing it's video with the media until tomorrow. i just got these still pictures

from the contra costa county transportation authority. they show the breakthrough that occurred at 2:37 this afternoon about 200 feet from the east end of the new fourth bore. this is an event some commuters have been waiting for for nearly 40 years and tonight there truly is light at the end of this long anticipated and awaited tunnel. >> the 3,400-foot bore began on the contra costa side 16 months ago and last month it began on the oakland side. >> for this risky of a project everything is going pretty much on schedule. >> reporter: with this task now completed, cutting out and finishing the roadbed of one of the large east largest recovery act projects can move forward. of the nearly $40 million needed, contra costa county voters passed measure j raising 125 million of those dollars. >> this is one of the shining

stars of why they voted yes on measure j. >> i would like to see more of these projects. but it's provided a lot of employment to contractors and that's a good thing. >> reporter: for the folks in orinda it can't come soon enough. >> it was a problem the tunnel, it was a probable. even we don't want to go there because we think, traffic. it's sure going to help. >> reporter: most of the prospective buyers that come out here are looking for commute time and if you put in that fourth bore, it will help the commute for a perspective buyer coming out from the oakland hills, the berkeley hills area. >> my only concern is that with more access there'll be more traffic. >> reporter: the new fourth bore is scheduled to be opened at this time about two years from now. reporting live, consumer editor tom vacar, ktvu channel 2 news. the bay area is one step closer to having an early

warning system for earthquakes. the gordon and betty moore foundation donated to sensors that would give crucial systems of warnings. the complete system would cost $150 million. the $6 million grant would go to uc berkeley and the university of washington to begin work on the system. dense fog hovered over the region today making it very difficult for drivers on bay area roads. the national weather service issued a dense fog alert for this morning and visibility as you can see here was very limited in fact, on the bay bridge it was down to about 300 feet and it was less than a half mile in many other areas. dense fog is also being blamed as the likely cause for a deadly accident on i5 in stockton early this morning. the highway patrol says a man was trying to push his car off of the freeway when another vehicle slammed right into him killing him instantly. visibility was only about 100 feet at the time of the accident. officers say there was currently no shoulder on the

side of the road where drivers can pull off because of construction in the area. the low fog ceiling also affected air travel and is still causing flight delays at the bay area airport. we just got off the phone with san francisco airport officials who say there's been delays all day. flights are currently 8-1/2 hours behind schedule. airport officials are reminding travelers to call ahead and check with their airlines on the status of their flight. you can see the fog there hanging in the air. i just checked on the airports website and it describes the conditions as fog and mist but again we were told that all flights schedules have returned to normal. let's talk more about the fog with our chief meteorologist bill martin.

are we talking about more fog this evening, bill? >> we should see more fog. i talked about how quickly due points can form and how dangerous the fog can be when it's on the bay like it was again today for the second day in a row. we had bridges that were impacted. we had ferry businesses impacted. imagine those big tanker and container ships coming in the bay with visibility in some cases down to 100 yards. it was really an unusual day. we don't get these all the time when we have fog on the bay like that. what's the common denominator. i put up the observations. winds are staying calm everywhere. that's why fog forms, right when the winds are calm. what's going to happen, what i was just talking about? there's the current wind gust in the last hour or so. you can see winds already coming out of the east in sacramento. why is that important bill? because those easterly winds are the precursor to these strong winds. winds were calm, these strong northerly winds are going to

come out of the valley and the hills and number one they're going to get the fog the heck out of here: you can kiss the fog goodbye. i think there'll be patches of it this morning. because the wind is not really going to material. the toughest parts of the wind are not going to occur until tomorrow afternoon or tomorrow evening. there might be some patches of fog in the north bay, a little wind chester valley. i say might, i think there will be valley fog, it will not be as extensive as it was this morning. the fog is going to burn out of here quick because those winds will start to ramp up. and by tomorrow night, when those wind advisories kick in, we will see winds at 60 to 70 miles per hour up in the oakland hills. there'll be a lot of winds flying around at sea level. at the surface the winds will be blowing up 25 miles per hour as well. but be prepared for that early morning valley fog. for my morning the valley fog is one of the most dangerous

republican presidential candidate herman cain today says he knows he's at the center of a fire storm and says new sexual accusations have forced him to reconsider his bid for the white house. herman cain told the white house that he is looking at whether there's too much of a cloud to continue in the race. yesterday a new woman came forward with an accusation against cain. toáet newt gingrich called cain a -- today newt gingrich called cain a personal friend who's in a difficult situation. >> i think this is a very difficult situation for he and his family. my heart goes out to him. i hope he reaches whatever decision is best for him.

occupy protesters at uc santa cruz called off their protest today but at the same time they made some very strong demands. >> we'll get to that in just a moment. but first breaking news, we're told that police in san francisco are poised to move

into the occupy camp there. ken wayne is on location. what is going on there. >> reporter: it's unclear what's going to happen. i have a license agreement between the city of san francisco and occupy sf. this agreement would allow occupy sf to accomplish a new encampment on mission street. but occupy sf has to sign this agreement to take effect and we don't know if that's going to happen. you can see the encampment. there's supposed to be a general assembly at 6:00 in just about a half hour. we expect this item will come up for discussion but what exactly happens and what kind of vote takes place isn't clear. i talked to a couple of occupy sf people and they said they're really not sure what's going to happen and how long it might take to come to some kind of a decision. if occupy sf comes to an agreement between then in all likelihood they will begin

packing up with the assistance of the department of public works and move to mission street, possibly as early as tonight. if they do not agree to this, then we are getting a sense that there's a possibility and i'm saying this is a possibility because we don't know for sure, that police and sheriff's deputies would be moving in here tonight sometime later tonight to enforce some kind of a deadline. that it's a take it or leave it kind of a deal. occupy sf moves to the mission or they have to disband this one way or the other. we'll have to wait and see what happens during the general assembly at 6:00. it could be hours before we have a decision. they had a general assembly last night that lasted five hours. so we don't know how long it's going to take for a vote to take place and whether or not there will be a deal and whether or not police will move in. we're just going to have to wait and see. ken wayne, ktvu news. now back to the demands the students at uc santa cruz are making and how it appears very unlikely those demands will actually be met. robert handa is on the campus

tonight with what the students want and what could happen next, robert. >> reporter: well right now protesters and the university are observing a sort of truce. the occupation demonstration did end today. but what happens on the campus next depends a lot on the response to the protesters demands. >> business as usual has failed. >> reporter: student protesters along with occupy santa cruz occupiers took over the han building closing off services such as financial aid. >> there's deadlines that need to be met with the financial office here. so in that regard i feel that the protesters didn't keep that in mind. >> reporter: protesters said they called off the occupy because of the problems it costs students. at the rally the group made public demands such as disbanding the police department because of police action at uc berkeley and uc

davis and also demanded tuition fees be rolled back to 2009 levels. >> the person on the right shouldn't be trampled especially on campus that is have such a huge history of movement. >> uc santa cruz acknowledges protesters did not do any significant damage to the han building during the occupation and expect to resume student services here tomorrow. as for the demand, some such as scaling back tuition goes beyond their authority. >> the tuition hikes really have been set as a system wide level in respond to massive reductions in state support to higher education. >> reporter: officials also say they do not plan to disband the police department, protesters say those issues will take center stage at a general assembly this monday and more demonstrations have not been ruled out. at uc santa cruz, robert handa. closing arguments are set to begin tomorrow morning in a federal civil rights case

involving former b.a.r.t. police officer mehserle. defense attorneys and the prosecution rested today after the last expert defense witnesses were called. the trial lasted a week. mehserle is one of five current or former b.a.r.t. officers defends themselves. we told you earlier about the plans for a public service tomorrow for slain vallejo police officer james kapoot. today family and friends of the police officer remembered him as a private service. james kapoot funeral mass was held at st. basil the great catholic church. there were support from other law enforcement agencies. that included the solano police, and the san francisco bomb squad. as we mentioned earlier the public memorial for officer

kapoot begins at 11:00 tomorrow morning at vallejo high school. at the vallejo police department flowers filled the front steps in a memorial for officer kapoot. inside the wives of his fellow officers sold special bracelets. the money raised will be given to the family. prosecutors wanted the maximum sentence and they got it. >> the court has determined that the appropriate term is the high term of four years imprisonment. >> reporter: the judge sited murray's lack of remorse after jackson's death when handing down the sentence. a judge found murray responsible for the death of jackson who died of an overdose of propofol. a powerful anesthetic the doctor gave the singer to help him sleep. >> dr. murray create add set of

discuss plans to improve safety along the road where a 6-year- old was hit and killed by a car. neighbors want a stop sign at the interception. traffic consultants recommended walking signs and restrictions. the streets of san francisco can be very dangerous for pedestrians which is why the dea went public today to remind everyone about staying safe education perkily during the holiday season -- especially during the holiday season. george gascon says this time of day there's more people on streets as they take part on special holiday traditions. san francisco has a high rate of accidents involving pedestrians and bicyclists and he blamed factors including

san francisco is set to offer a new way for drivers to feed parking meters by using their cell phones. under the new service, the city will alert drivers with a text message when their meters are about to expire. the drivers will also be able to put more money remotely by phone. a fee will be charged for every phone transaction. the city plans to try out the plan in the mission district. the high speed rail authority gave lawmakers a look

at the new plan. the price is now $99 million. that's the new price tag. >> we looked at high speed rail not as a luxury item that would be great to add to the mix to have cool fast running trains in california, but really to suggest that it has to be looked at in the context of alternatives. >> the state legislature must decide in the coming months whether to allocate money from california's high speed rail bonds to begin the central valley portion of that system. >> car sharing companies zip cars now offering more than cars in the area. zip cars have added vans to their service. it's a test to see if the idea will be as popular in the u.s. cities as well as it is in london. zip cars can be tested for $99 for a full day. a new study is suggesting that hitting a soccer ball too

mitt romney leads, but the fortunes of other candidates has changed. here is how things stood a month ago. mitt romney first with 30%, rick perry with 22%, gingrich with 7% and ron paul with 7%. now this is the way things look like now. romney is still on top with 26% but he's dropped. knew gingrich comes in at 23%. herman cane is down to 9%. republicans who live in coastal california back romney over gingrich 30% to 20%. but those in inland counties prefer gingrich 29% to 21%. and things could change again
