. this is the 10:00 news, on ktvu channel 2 action news. family members speak out about a critically injured toddler. we are learning they are at odds with the hospital over his care. good evening, i'm julie haener. and i'm frank somerville. new developments involving the gun battle in oakland, that injured several people, including a toddler. police confirm they are questioning five people in connection with monday's shooting. new information in oakland, where there is a dispute on how to treat the little boy who was shot in the head, amber? >> reporter: frank tonight, the boy's mother told us her one-

year-old son is still in critical condition here at children's hospital, oakland, the family hopes for a full recovery. meanwhile, city leaders are handing out these fliers, asking witnesses to help police. this evening, brittany houston came out of the hospital to say that she is grateful to the medical team for her son, hiram lawrence's care, but the family is at odds with the staff over who should be done next. >> unfortunately we have come to a cross roads, and we have -- and we are unable to agree on the type of care for baby hiram. as a result, we are seeking support from patients' rights attorneys. >> reporter: the family wouldn't say exactly what the crossroads were, the hospital did not answer questions. >> we are really trying to guilty witnesses. >> reporter: the mayor went door-to-door late this afternoon in west oakland, where the shooting took place. >> it really has to stop, the

senseless shootings. >> reporter: but some say it is a waste of time. >> what is she doing? she is talking and doing nothing. >> reporter: police say they have not been able to identify the people in the shooting, which shows three people running with guns. but others were detained, on unrelated charges. but nobody has been arrested. >> there really have not been eye witness accounts. that is why we're here today, we want people that know who did it, saw who did it, to tell us who did it. >> reporter: as for baby hiram, his family says he is fighting for his life. >> i want to make sure -- absolutely sure that my baby receives every opportunity to survive this terrible ordeal. >> reporter: the baby's family is urging that the violence stop and asking that there be no revenge, reporting live, oakland, amber lee, channel 2

action news. and a new video tonight, a wild shooting in east oakland, that stretched for blocks along mcarthur boulevard, a woman was hit by flying glass, while another man was shot, then taken to the hospital. one photographer says he saw more than 50 bullet casing markers. police are still trying to sort out what happened. we are trying to gather information on another shooting just a few blocks away. police say two suffered gunshot wounds at 77th and bankcroft, at 9:15 tonight. and the oakland police department is hiring new officers. the city received 10 million for 25 officers and a police academy. four of the 25 positions will be filled by bringing back officers who were laid off this year. another 10 will be trained at the academy. the rest will be recruited. and authorities in contra

costa county in the 12th hour after a pittsburg apartment complex. it started at the belmont apartment homes on power avenue. pittsburg police say they're looking for an armed parolee who ran into the complex during a chase. and while tear gas and k-9 efforts didn't work, they believe he is still inside the complex. all the residents there have been evacuated. the contra costa county sheriffs have also been called in to help. and firefighters fighting the fire that was caused by winds near elcasa boulevard, shortly after 1:00 this afternoon. firefighters say when they arrived the fire was spreading quickly through the top of the condos. and one resident jumped out of the burning building. >> first he jumped out of the building, he was alert, when he landed. the first paramedic on team took him to the hospital. >> the injured man is listed in

fair condition tonight. and fire officials say six of the 10 condos sustained major damage. the other four had less serious damage. and new numbers on unemployment providing hope that maybe the economy is turning around. the labor department says the jobless rate has gone down to 8.6% in november. that is the lowest it has been since march of 2009. and the economy is also adding 100,000 or more jobs five months in a row. it is the first time that happened since april of 2006, ktvu's john sazaki says who is hiring in the bay area. >> reporter: this is going up in the san jose airport, set to open the first, and employ 227 people. the owner said by phone all the workers will make between 40 and $75,000 a year, including tips. that is a jackpot for people who are out of work. >> i thought i would get a job a lot sooner, i have been through this several times, you know, unfortunately in the last

five years owe owe. >> reporter: this is the work that feet feets the one stop center, which features 100 a day in the computer labs and workshops. >> from how to rewrite your resume, and perform in a job interview and give you those skills. >> reporter: news of the drop in unemployment from 9-8.6% is welcome here. >> i am glad to hear it, it gives me hope, the incentive to keep on trying. >> reporter: but a teacher who trains people for new careers says she sees little improvement. >> a lot of people come into the office that are wanting to know where their unemployment is, or they're looking for employment. or they're tired of looking for employment. and maybe have possibly given up. >> reporter: that is one criticism of the new figures, that some of the decline comes from the job hunters who are giving up, and no longer counting as unemployed. but in the south area, they are holding a job fair for people

in need of work. stocks finished the week flat despite the strong jobs report. for the week, though, the markets had their best showing since the middle of march in 2009. the dow was up 7%, the nasdaq was up 7.6%. and tonight on the facebook wall we asked if you think the jobless rate is a sign the economy is turning around. parker taylor johnson says i somewhat see the economy turning around, considering more people are actually taking time on the weekends to do shopping, and i mean that all this year. one said i won't until i get a job. these figures are deceiving. it doesn't take into the fact people working reduced hours just to keep their job, and therefore not getting benefits. tell us what you think, join the conversation on facebook. and is the policy employment news coming down to bay area stores? at 10:30 tonight, we talk to shoppers to see what they're

buying and spending. it appears that the 49ers' efforts to move to the south bay will move forward. today, the 49ers and santa clara say they are on the edge of getting the money they need to build the new stadium. the one billion stadium would be right next to the great american theme park. both sides say they lined up a lender to give part of the money, the rest will come from agencies and a hotel tax. and on the peninsula today, the last national guard returned home from iraq, the last of 15,000 guard troops who served there since the war began almost nine years ago. ktvu says the timing could not have been better. >> reporter: the plane that landed at moffett field couldn't contain them any longer. >> hi -- >> reporter: the excited soldiers came spilling out. some making it clear what joys

plaza, despite the requests to send them out. eric rasmussen has more on the campers. >> reporter: there was a huge presence by organized labor out here for a rally tonight. and you can see the latest change in the landscape here at the camp. that is a huge tower made out of police barricades made by protesters who have no interest in going anywhere. [loud noises] >> reporter: a crowd of close to a thousand took over the streets of san francisco. [loud noises] >> reporter: and at least for a moment, they took over the inside of this verizon wireless store. union leaders, teachers and others joined occupy protesters for this afternoon march, which included a 20 year teacher at usfc, mary winegarden. >> i am very angry about what is happening in this country, and the fact that we don't have enough money for education for the next generation. >> reporter: she also joined

the crowd to help sf. >> it brought attention, and people are claiming attention, and the claiming of the public space is an important part of that. >> reporter: should it be allowed to stay? >> yes, absolutely it should. >> reporter: the protester we found at the top of the police mountain barricades didn't seem overly concerned about another showdown with the police. >> i am sure they want the barricades back at some point, they have to admit it is cool. >> reporter: yet some passing tourists were not impressed. >> they want a confrontation, and later they will get one. >> reporter: and after that brief clash with police over the barricades last night, we have seen a much lighter police presence here tonight. and we have not noticed any arrests here tonight. live, san francisco, eric rasmussen channel 2 action news. in san jose, about a dozen occupy members protested outside bank of america branch. they chanted and made noise,

then three of them went inside a bank and talked to the bank official about the problems. after several minutes, san jose police arrived and convinced them to leave. the protesters then took the message down the street. it has been more than two weeks since the members of the occupy oakland can't left frank ogawa plaza. we talked more about when they think customers will come back to the area. and the man who pleaded guilty to stealing a picasso pled not guilty to other charges today. mark lugo was sentenced here, then sent to new york. prosecutors there say he stole at least six works of art worth hundreds of thousands. the picasso was later recovered and the other art was found in his apartment in new jersey. and a richmond man convicted in a deadly freeway shooting receiving a sentence of 50 years to life. 20-year-old brian king young was convicted of second degree

murder for killing 25-year-old rhonda white. she was driving on the state when she was shot and killed, four passengers wounded. a second person was convicted and sentenced to 36 years to life. and the department of justice released the annual homicides in california report. the data shows the rate for 100,000 people went down by almost 8% last year, compared to 2009. the total number of homicides in 2010 was 1809, down from 2009. the state solved 63.8% of the homicides last year, the highest since 2001. and richmond's mayor met with members of the community tonight to remember this year's homicide victims, the city's homicide rate for the year climbed to 25 in recent weeks, up from 21 at the same time last year. but the mayor says that homicides are down by about 50% from two years ago.

>> we you know come from a lot of inequity, a lot of social injustice, and low income population. but we're turning ourselves around. at the meeting tonight, mclaughlin read aloud the names and ages of the victims. the first of the month, mclaughlin has a meet with the mayor session. and planning to site citations, by o.s.h.a. they cited the fire department for four violations and recommended a fine of $21,000. the fire happened inside a home on berkeley way this past june, killing firefighters perez and vallerio. while the fire department plans to appeal o.s.h.a.'s finding, they also say they were cleared of responsibility for the deaths. >> o.s.h.a. said that the violations do not comply that our -- say that our department was at fault for the members that died. >> the fire department is still

conducting its own investigation into the firefighters' death, and plans to meet with state investigators next week. new at 10:00, new businesses in old store fronts in old oakland, and not by chance. ktvu jana katsuyama has more. >> reporter: yes, the holiday lights are up, and for some of the stores this is opening night. this whole idea of the pop-up hood is really a unique partnership that is all trying to bring retail back into the old oakland neighborhood. >> reporter: at 9th and broadway, where buses and cars breeze by, a bike shop is bringing new information to this part of old oakland. >> we want to create a better oakland, that is part of what our mission is. as small business owners. >> reporter: manifesto bike has been opened five days, but already there is more foot

traffic. >> we can help parts of oakland that should be re-developed. >> reporter: and that is behind this project that is helped to fill empty store fronts. >> these are amazing buildings here from the 1800s' with brick sidewalks and trees. it is beautiful. >> reporter: he worked with the city to give free rent for six months, while the city added a grant for marketing and building improvements. the tenants are trying to prepare their stores, a crowning achievement in just two months. >> kind of a dream come true, really, i wouldn't have been able to do it without pop-up hood. >> reporter: many of the stores create the store fronts, creativitying the economic ripple. >> this helps the job situation, not only for myself, my business partner, these are all local makers. >> reporter: attracting new customers to old oakland.

. a wild life scientist was killed by a falling tree in big sur. michael tyner died while working near north coast road. he worked for the wildlife society's condo recovery program. a forensic examination today showed that tyner died from head injuries. and today, fierce winds pounding the region in the last couple of days. in the latest update, pg&e says that 60 customer news the area remain without electricity, while the number is higher in the santa cruz mountains, 15,000 without power there. and we learned of the aftermath of the powerful winds. >> reporter: a lot of the trees were knocked over by the winds in the past days, many on top of homes, there were quite a

few close calls. one big tree fell on a house in brookdale alongside highway 9. the douglas fir is being taken out of there by boulder creek. workers say the homeowners nearly got crushed by the tree. >> we're so busy, the crew is working on other jobs, we got a call on the house, the lady was really lucky. she was laying a foot and a half away from where it hit. >> reporter: this area was hit hard, with power outages and roof damage to this home here, no injuries, another 100-foot tree fell near this golf course. one mountain resident was impressed, but not surprised when he looked at the tree root. >> it sure was a shallow root base for such a big tree. i'm very happy i was not under it. >> reporter: do you think that was why the wind was able to knock it down? >> yes, there was just too

much. and the resistance was cause for damage. >> reporter: repair crews expect to be in the santa cruz mountains throughout the weekend. they are happy to get a break from the wind because they have a lot of big jobs ahead of them. in scott's valley, robert handa, ktvu. and in southern california, they were busy there as well, following strong winds there. pasadena was hit hard with hundreds of downed trees. officials say the city lost 450 trees, not including trees in homes or city parks. about 100,000 homes remain without power tonight in southern california. and a 22-year-old woman from atherton says a man posing as a police officer stole her car keys, happening at 6:30 wednesday, near atherton avenue. the woman said the man pulled her over, with flashing lights, he asked for her driver's license, registration and keys.

he returned the license and registration but kept the keys. next he went back to his car and drove away. and san jose police say the two men here in the video have been arrested. after this crime that happened at ben bridge jewelers at the mall. the investigators say the suspects are wanted in similar robberies that happened in southern california, identified as mcknight and chiverra, both held in the san diego county jail. holiday shoppers hit the mall tonight in the south bay, and they have some concessions to make. and later, free trees for the making -- all details for this offer. and at first our camera is rolling when a shooting victim arrives at the hospital. what we have learned right after the break -dad, why are you getting that? -that's my cereal.

. developing news now, we have more information about that second shooting in east oakland we told you about earlier. these are pictures from highland hospital where one of the two victims now has been taken. police say the two people were shot at 77th and bankcroft at 5:15. earlier a man wounded in another shooting took himself to the hospital as well. no word yet on whether the shootings are related. and major retailers reporting strong sales in november, but really are counting on december. this is the time of year where they can make up 40% of their revenue. more from santana row in san jose, and how the people are in

the buying mood. >> reporter: these stores are closed, closed at 9:00. but earlier tonight the foot traffic for shoppers was pretty nice, tonight, though, when we spoke to people, most say they are not sticking to a budget. some walked with a purpose, knowing what stores to hit, others walk in the crowd, looking for the perfect gift. but every shopper we happened to stop tonight at valley fair mall says this. >> are you buying anything for herself? >> yes. >> i have sweaters and shirts. >> reporter: and you were not planning on buying this today? >> no, i just wanted to come in for the sales. >> reporter: the deep discounts and promotions are luring some shoppers to spend more than they planned. they're forecasting the sales to grow nearly 3% this holiday season, compared to last year, shoppers we spoke to estimated what they planned on spending. >> maybe like 1500. >> over a grand, close to two.

>> is that more or less than last year? >> probably a little bit more this year. on santana row, singers were getting shoppers in the mood, and larger stores reported an early surge. >> it has been great, the customers are out in full force right now, definitely doing their christmas shopping early. >> reporter: even though most people we spoke to are spending more, they're still looking for the best prices. >> this week, really, the best deals are popping up, that is why i bought a bunch of stuff. >> reporter: the retail federation reports that the number one gifts people want to get this year is a gift card, clothes came in second, and electronics came in third, reporting live from san jose, ktvu news. and the founder of the state's oldest medical marijuana dispensary has to decide whether or not to close

the fairfax facility. they lost a motion today to stop the dispensary's eviction. the judge rules they are required to comply with federal law, which forbids the sale of marijuana. the dispensary has been fighting to stay open since it became the target of a federal crackdown. there is news tonight that former presidential candidate george mcgovern has been hospitalized after he hit his head. the former south dakota senator was 89, and on his way to do an interview in mitchell, south dakota when it happened. no word on his condition. in 1972 he ran for president against richard nixon and ended up losing in 70 land slide. and republican presidential candidate herman cain says he will make an announcement about his future campaign plans. he returned to atlanta to discuss the plans with his wife. the two have not talked face-to-

face since a woman said she had a long-term affair with cain. and penn state is standing by its decision to fire long- time coach joe paterno. they say it was in the best interest to fire him and the university president, coming after allegations that the men knew that coach sandusky sexually abused children on the school property. > and a company defending itself on accusations of smart wear key strokes, they monitor the strokes on the mobile phones but the company insists it doesn't record or restore private messages, they say the software in the phones is designed to help users with problems. the company faces two class action lawsuits claiming that

the company violated federal wire tap laws. and a new survey showing that distracted driving is a big concern for people on the road. the office of traffic safety says that 39% of drivers are worried about people talking architecting while driving, more than double compared to last year. 46% of those surveyed say they made driving mistakes while talking on the phone. and 60% say they have been hit or almost hit by distracted drivers. it has been more than two weeks now since occupy oakland was cleared out of frank ogawa plaza. and as ktvu's rob ross shows us now, local businesses are left behind now, trying to get back on their feet. >> reporter: at frank ogawa plaza in oakland these days, the birds seem to out-number people. up until about two and a half weeks ago, the plaza was a tent city and a national focus of the occupy movement. now occupy members hold regular meetings but off the grass and no tents. >> by taking away the camp, it

is actually a serious blow to the movement's ability to reach the general public. >> reporter: across from the plaza, they look at the days when somebody would order 30 pizzas and have them delivered to the camp. many say they're happy the camps are gone. the chamber of commerce estimates losses in the hundreds of thousands to local businesses. and many of those businesses say they're just now seeing a rebound. >> reporter: the owner here of this jewelry store says that sales were down about 30%, he worries he has lost customers. >> they want to go where they feel safe. and maybe it is going to take a little while before they get comfortable again. >> reporter: at this restaurant and bar, the tables and chairs are filling up again. but the street protests, the tear gas, and finally a homicide near the camp has made it difficult to win back customers from outside oakland. >> the conferences that would have thought of coming to the marietta for the next

convention, the five or 10,000 people wouldn't come to the town because of the bad press out there. >> we can regret the past, say there were terrible weeks and it was not the right thing for oakland to do, but now the spirit is let's get it back in action. >> reporter: the business owners say they're confident they can weather the past storms, provided no more come their way. and a strange situation, the discovery in a german river that forced the evacuation of 45,000 people. back in her here -- here in just ten minutes, which day will be the warmer one, and freezing temperatures. and the minor incident that forced a bay area to close for a couple of hours.

. the dr. sentenced to four years behind bars for causing michael jackson's death, plans to appeal, signing a document seeking all records and transcripts from the case. it does not indicate what basis murray will argue to try to overturn his conviction or sentence, murray was sentenced to four years in jail for involuntary manslaughter. and the man accused of

running down an off duty firefighter on thanksgiving pled not guilty to an attempted murder charge. a san francisco superior court judge barred the cameras because the case of the man was still in the early stages, 29- year-old albert bartal is currently in a coma at a san francisco general hospital. and hope for a new reward to lead to the capture of the driver responsible. the family of casper is hoping for closure in time for the holidays. count picture was killed august 14 while jogging near river road. the chp says the driver of a ford pickup truck struck him from behind, then ran off. and a small plane running into trouble today when the landing gear collapsed after touching down. a ktvu viewer sent us pictures

of the twin engine plane. the right wing and engine were damaged, the two people on board were not hurt. the airport was closed for more than two hours while the faa investigated. and in news of the world tonight, in egypt, thousands rallying in cairo as the unofficial results of the elections were announced. the muslim brotherhood featured the most votes, while there others followed, one a liberal coalition. if the trend holds up, religious parties will hold a great deal of influence. and in germany, 45,000 people being evacuated. the nearly two ton bomb never exploded. there was a levee built around it to try to cause it not to blow up. but evacuation orders were ordered in case it blows up,

there was concern other bombs would blow up. and secretary of state hillary clinton met again in mynmar today in a show of solidarity. she would work today to promote reforms where she was a political prisoner for more than 20 years. clinton's visit was the first by an american secretary of state in more than 50 years. and this is protected beautiful space, but the public is asked to come here to cut down christmas trees, i'll explain. and warm today, chilly tonight, the chief meteorologist bill martin is tracking a big change in temperatures, and what to expect for the next five days whatcha lookin' for hon?

ktvu health and science editor john fowler tells us where and when you can cut one down for free. >> reporter: this native preserve, people can't remove anything. so why is it permitted to cut trees tomorrow? >> normally it is not allowed at all. but these trees are invading the area. >> reporter: the pines are selected to be removed. >> they are out commute the native plants that we're protecting. >> reporter: we found people out there today, looking for the red tagged trees like this 14-foot monterey pine. now that is a christmas tree. >> i think i have got one that i am going to show a picture to my wife and see if she approves of it. >> reporter: looks pretty nice, tomorrow it will be an event to help restore, but it is not a christmas tree lot. >> i love this park, i am glad to hear the people are keeping it healthy. >> reporter: this is an effort

to preserve the disappearing eco system. >> it has to be a balance, you are striking a balance between today's and what it used to be. >> reporter: this is not exactly free, to get a tree you must take part in the help. they have the saws they will provide. you must cut trees from other open spaces so that nobody should go home empty handed. john fowler ktvu. and traditional farms seeing on-line competition, retailers are selling the freshly cut trees on their website, they are cut and delivered to buyers. the national christmas tree association says that the on- line sales are only a fraction of the 27 million trees expected to be bought this season. some 33% of people prefer to cut down their own trees. and if you like a holiday light show, you may want to go to the zoo, it appeared to be a

just have fun. and i mentioned earlier the wind advisory is extended for the hills around the bay area, for tonight through tomorrow. the winds are occurring, we have right now north winds on the richmond bridge, gusting to 34, out of this direction, so if you're in a high profile vehicle, you're getting hit with the winds, and of course that can be a problem. i wouldn't be surprised if the chp doesn't issue some kind of a high wind advisory throughout the evening hours. winds nothing like we had a couple of nights ago, they're up at advisory levels, high elevations. you wouldn't notice it at san jose, nothing like we've seen. when the air blows like that and sinks, the temperatures warm, air rises, cools, gets more compressed and heats up. temperatures today, record highs, temperatures well above the average. the forecast as we head to the weekend, more of the same. sunday, cold, tomorrow morning, chilly, not that bad.
