good morning. there is a serious crash here at walnut creek right now where a car left the freeway and went off into a parking lot. the warning the government is issuing the cold weather in the north bay. what people around here are doing about it. the occupy movement takes a new turn today. the protest that hits home. copper thieves are making intersections like this dangerous in one bay area city. we'll tell you about the unusual way that city workers are telling residents about the city here. mornings on 2 starts now.

good morning to you. i'm dave clark. >> i'm tori campbell. it's tuesday, december 6. >> that's right, north maine, a car apparently lost control and ran off into a parking lot. this parking lot has the department of public works vehicles in it next to the freeway. and now there are injuries reported. the car ran off the road, it's not blocking the lanes. however, people could see it from the freeway on 680 southbound through pleasant hills. the thing about it, you don't need an alternative because the roadways are open. but if you want to get on to the freeways, perhaps you want to go up here and get on there, that could be an alternative for you. that way you could bypass everything without the commotions. 680 southbound, now, i would say the same thing if you get on the freeway here, it should

be a very small delay for you. you don't really have to do that alternative. but if you really want to and you live in walnut creek and you want to get on the highway, if you know the back roads, that could be an option for you. we'll have more information -- we'll have mores traffic for you. let's go back to the desk. >> thank you, sal. it is cold out there. kraig debro is out there where a freeze warning is in effect. >> if you take a look at the bank of the west side here, you'll see it is not only 7:02, but about 35 degrees fahrenheit. that doesn't mean people are not feeling the elias abuelazamfects of the cold weather. this is covered in condensation. the extreme contrast between the warmth on the inside and the cold on the outside creates the situation. if you look closely, you'll be able to see the frost build up on a far cars here.

there is a frost warning for parts of the bay area here. >> it feels cold. >> yes. >> reporter: you come out here every morning? >> i live right there. now, technically it is not freezing, but you can still go away with using the expression, it's freezing out here. cold enough that this homeless shelter opened up their doors early last night and something else happened at this time of the year that they first responded to. the heaters that have not been turned off in months are tested as needed. it was just returning from the call here about a gas leak. >> at this time of the year when they do get cold, they will turn their heaters on. and so you know, that will be tending to the sales. >> reporter: and the pets could get cold too, despite being furry. it could be particularly hard on the outdoor pets, recommending bringing the pets into the garage during the colder than normal weather. and now this morning, it is

cold, but people are taking heat and they are wearing layers and bundling up and wearing hats and gloves, some of the most important items. reporting live, ktvu channel 2 news. >> thank you, kraig. 7:03 and the red cross is helping people left out of the cold after the early morning house fire, which started around 2:00 this morning at the two-story home on 30th street and linden. the fire caused major damage. investigators are still looking for the cause. early evidence points to some type of electrical problem. time now is 7:04 and the overnight fire downtown danesville is under investigation -- dansville is under investigation. it appears that the fire was at a clothing store. and the firefighters have not confirmed that yet. also no word if anyone was hurt or if there was damage. 7:04 and a new mission for the occupy movement, helping underwater homeowners reclaim

their homes. it is a part of the nationwide day of action today to help people affected by the foreclosure crisis. coming up in a live report at 7:30, we'll hear what is being planned in san francisco and oakland for later today. a man was driving down the street yesterday afternoon when he spotted someone else driving his recently stolen car. and the man followed his stolen car and called police. the two cars crashed into each other near rock island drive. the man driving the stolen car jumped out, tried to run away and fired several shots in the air. and police caught up with him and arrested him. they found drugs and a handgun on the man and stolen property in the stolen cars. a woman riding in the stolen car was also arrested. and your time is 7:05. copper thieves in vallejo are causing big traffic problems there. it appears that the city work crews cannot keep up with them. we have a live look outside right now with the e details. >> reporter: good morning,

dave. we're at the intersection of wilson and daniels. there's a nice water front park out here to our right. where we're standing is a very long pedestrian walking trail. but when people walk up to this intersection and push the button, this is what they see, flashing red lights. the traffic signals at this intersection are broken and neighbors say they have been broken, flashing like this for the past three months at least. now the city of vallejo city works department knows the signal is out, but they don't have the resources to fix it right now. so that's a part of the reason why city workers put up signs like the one you're looking at across the street explaning why. it is not functioning because of copper wire theft. now, we talked to some of the neighbors here who told us their reaction to the copper wire theft problem here and the reaction to the city's fines. >> just throughout the course, you know, i think it's the recyclers that should be doing a better job as to who are

these people and why do they have this kind of copper wire or where did they get this stuff from? >> reporter: now, public works officials say usually people that steal the copper wiring resell it to the recyclers and only make about $25 for it. so not a big payout when you compare it to the fact that it costs the city of vallejo as much as $20,000 to rewire the traffic lights. public works official don't have the money or the manpower to fix all the intersections for them targeted by the copper thieves. now, this one, they say is not quite as busy as some of the others that they are having problems here. and that's why the repairs for this intersection have been put on hold for now, but the vallejo reports that a total of 77 lightning fixtures have their copper wire stolen since may. live in vallejo, ktvu channel 2 news. the copper thieves are keeping police busy, but they

are closing in on them. on sunday morning, the bart train was forced to stop. just to avoid hitting someone stealing copper off the tracks between balboa park. and that same person is also suspected in last week's copper theft from another drive. bart police say they know who this is, but they are not releasing the names yet. bart says a number of copper thefts have been going up. the thefts usually happen overnight and they are causing a hazard to both the bart systems. it is also dangerous for the thieves. 7:08, stiffer parking fines are being considered today in san francisco. the mta governing board is proposing a 25% increase for double parking fines that would raise the fines to $100. two other proposals are also on the table. one would double the $50 fine for drivers who block traffic. the other would raise the fine for illegally riding a bike on the the sidewalk to $100. >> wow.

>> that's pretty stiff. all right, 7:08. sal, we have a sad crash at walnut creek. what happened? >> that's right, a car ran off the road just north of north main into a parking lot. what's happening now, the freeway is clear. we do have a map of this northbound. but southbound, people may be able to take a look at this and that means traffic will be slow in this area on 680 southbound as you drive towards walnut creek. now, the alternative is to get on the freeway sometime after the three boulevard onramp. maybe you'll want to get on to the freeway here if you can. also, let's move along and take a look at, oh, sorry about that. this is a look at the westbound bay toll plaza. and traffic is backed up to the metering lights about a 15 to 20 minute delay. if you're driving out here into the santa clara valley, a little slower traffic there. also slowing on 101 and 85. and the morning commute for you is going to be busy if you are driving on the freeway between

hayward and union city. so stop and go traffic there heading south. 7:09, we'll go to rosemary. >> good morning to you. i can say bundle up. it is a cold one out there. we've got clear skies overhead. very calm conditions for you. boy, the difference a day makes, right? yesterday we were gusty. temperatures sitting in the 50s. now with the calm clear cold air mass in place, we're dealing with the freeze warning. at about 9:00 this morning, a frost advisory for our east bay valley location. the difference between the two. temperatures are ranging from 30 to 35 degrees over the east bay valley. the north bay valley location sinking into the 20s. we've got very calm conditions for you. so when we have the calm, calm atmosphere, it prevents any mixing from going on and the cold air just sinks and sticks. it has nowhere else to go, right? now that the sun is up, we will begin to see some recovery. that's good news. still, 31 degrees reported in santa rosa. 31 in napa if you're watching yesterday at this time.

sitting in the 50s for areas over the north bay with the winds on out there. 32 at livermore. 43 oakland. 40 degrees here at sfo. mid-40s for the city of san francisco. and san jose, 36 degrees. and so possibly the coolest we have seen it in the last fewhours. we're holding at 38 for some time. but again, the temperatures will begin now to rebound as we move through the afternoon, plenty of sunshine overhead. we're still in a holding pattern, continuing through this workweek ahead, meaning we will be dry and into the afternoon hours, seasonal for this time of the year. upper 50s to the lower 50s in the forecast. 51 degrees expected for berkeley today. 69 degrees expected for hayward. 62 for fremont, san jose also in the low 60s for the second half of your day. your extended forecast, a chilly start for this morning if you're thinking about lighting up a fire and the fireplace and you're free to do so. the air quality is moderate. it is a recommended burn day,

in this attack, the man blew himself up from the middle of the crowd. and you can see all of that and bids on copper and cold deposits in four areas of the country. leaders there are hoping that the mining industry will be generating billions in revenues for them to help it rebuild after years of the wars.

they plan to sell the rights up to five minds every year until 2014 when all the u.s. troops are scheduled to leave the country. they will push congress to extend the tax cut. and there is the president, boarding air force one just about 30 minutes ago. while in kansas, president obama will be speaking at the very same high school where the president back in 1910 delivered the new national anthem speech. that's where he called for a square deal for average americans. there is a new development for them this morning in the penn state university child sex scandal. the campus newspaper report, joe paterno had closed business ties with the board members for them of the charity second mile. and that is the charity that was founded by the alleged

child molester and the former penn state assisting coach. the investments included a luxury retirement community and the golf course. it is 7:18, the sentencing hearing for the former illinois governor is set to begin today. now, he is facing charges of 18 counts here of corruption including trying to sell president obama and the former senate seat. and they are asking for no more than a few years. that will be friendly and they have no problem going against the prosecutor's recommendation. two former workers are being investigated for stealing $635,000 for the agency. and they deal with the mosquitoes and other sources of

disease. and according to the distribute attorney, one of the suspects, they used to work as the district finance director. no charges have been filed yet. our time is 7:18. amanda knox once at the heart of the publicized murder charge in italy is here to tell her story to the world. and the 24-year-old woman is working with the lawyer who is well known for brokering the book deals for the high-profile deals including president obama. and amanda knox came home to seattle back on october, convicted in 2009 in italy on the death of her roommate that she was later freed after that conviction was overturned. they have given the green light now to a controversial plan to build the sports complex. and they report that the 4-1 vote took place here at 2:30 this morning. and after about some 70 people signed up to speak about this

project. now, it will add a $6 million sports complex at the park. and so right there on the oakland border. and it includes soccer and baseball fields, but not everybody's life is our idea. >> it is really beautiful. i think it would be sad to tear it down for the soccer field. they complain that they are worried about the traffic congestions as well as that. and however, supporters say that the sports complex is needed to keep up with the growing youth sports program in the area. so tell us how long the freezing weather will last. and also, a record number of people, they are heading to college. we'll tell you who is applying more than ever. good morning, traffic is moving along pretty well and getting up to the highway area here and until you get to that will e low pass and then it slows down. we'll tell you more about the morning commute and the bay

time now is 7:23, breaking news, a big fire is happening right here in los angeles. look at these pictures, they are battling a single-family home. and this is north of los angeles, one of the suburbs area. and that fire has gone pretty hot and heavy right now. and several firefighters on the roof, and we have not heard of any injuries, but we saw this as we wanted to show you this, this is the city here just outside of los angeles, the fire burning in a community there. again, on it, but it is not out yet. we'll keep them posted as we get more details from southern california. all right, 7:24 for the third straight year. a record number of undergraduates have applied to the california state university system. freshman and transfer students have admitted more than 665,000 applications for fall of 2012. that's up from 6211.

and let's go to steve. and that is the advisory in place for the valley locations for them and the east valleys and you don't need to be in the nooks and crannies to see them and we have 30s. the redwood city and the park. and campbell. and all reporting the low to mid 40s here. 28 degrees for them and fairfield and windy on out there. and the cold spot there. and the frost and the freeze advisories, it looks like the freeze warning for them and the valley areas and the frost advisory for the bay area and at about 9:00 this morning. and the temperatures will be on out there, anywhere from two to four degrees with warming and each progressing hour by about 10:00 and you should feel okay. the winds will be light for today, sunny skies. dry conditions. in the dry 60s for the

afternoon. and that will be almost there by about noontime and then the second half of our day, they will just sit pretty with our extended forecast here. and still, no rain in sight and i must say that anywhere from an inch to two inches below at this point and for the total rainfall seasons, which will be starting back here in july. and so you know, it will be a little bit of rain, but the extended forecast is all the way through the weekend. now occupy protesters and for the area's largest city and san jose for them and what they are trying for today.

good morning, now, we do have a problem for you in walnut creek where a car flipped over into a corporation yard at the walnut creek off the freeway now. and our crew, they had just arrived on the scene there and you can see that this is just the developing situation for them. that's a freeway up there and the road.

and it is hard to determine how the car came off and that, you know, we have pushed back, you can see at least a few cars were damaged, trying to figure out if anyone was seriously injured, but we'll let you know. and the police officers are on the scene. that is walnut creek along with highway patrol there. we'll let you know more about the developing stories in walnut creek. 7:30, let's go back to the desk. >> all right, thank you, sal. and the occupy movement is demanding that banks do what they promised and to help families stay in their homes. ktvu joins us live with more on today's national day of action, tara? >> reporter: that's right. at 10:30 this morning, protesters will be occupying from the closed homes. they will be headed up to a couple of houses belonging to the church leaders and the bus driver, trying to drop some attention to their flight. right now, we're in front of the federal reserve building. still a couple of occupy people hanging on out here. the original campus is just

down the street. you can kind of mix it on out there in the distance. we were there earlier, but one man was upset. and so we decided that it was best for them to leave. most of the occupy portland protesters that we have seen this morning have not been like that. they are excited about today, engaging in what they call the home defense. now, as you'll recall, november 22, some protesters in oakland, they were eventually kicked out and the homeowner did not give them permission and this time around, homeowners are united and later on this morning in oakland, one group is marching to the bank with a mother and her three kids are demanding a new loan. she's not the only one that is affected. >> one of the mothers today, they were called from work and from her kids who said that they had two minutes to pack up and get out of their house and ran home to see her kids on the sidewalk with two suitcases. and that's going to scar the kids for life. >> reporter: protesters say that 6 million americans have lost their homes and another 5 million are at risk.

and similar kinds of the rallies and the marchs are planned all over the city today, including chicago, philadelphia, new york, we're going to be live in the district come noon, so we'll show you exactly how the protesters are lending a helping hand to those homes who are being foreclosed upon. now, we're live in san francisco, ktvu channel 2 news. thanks. the occupy camp is growing. that's causing some concerns for the students here at nearby berkeley high school. and at about 100 tents are up here, which are right across the street from berkeley high. the principal sent a letter saying some students are spending time at the camps, which is complicating the supervision efforts. now, police say that crime is up at the camp and the mayor says there is no point for the raid. time now is 7:33. and a care holder facility is set to investigate this after the severely disabled resident became pregnant. the 34-year-old woman is

legally blind and they have mental disabilities and cannot feed or care for herself. and the deputies are saying that she is six months pregnant. and detectives are questioning the persons of interests, including the employees here at the care facility. and that investigation will continue. the search for his attackers have continued. this attack happened here right near the baseball field about 6:00 last night. and the 19-year-old man was stabbed several times. he is now at a local hospital, but we donate know his conditions. >> we have reported possibly three male subjects who were involved with the people that have been assaulted or the stabbed individuals. now, we don't know the police description of the suspect or the suspects or possible motives. if you do have any information, contact police. pleasanton police are

discovering the body found on the overpass. the body was found yesterday afternoon in the sleeping bag. and police say that it appears the man had been dead for several days. the officers are waiting for the medical examiner's report and to find out how he died. they don't believe foul play was involved. the lucky supermarket chain is warning customers to check their bank accounts following the discovery of the widespread credit card fraud scam. someone installed skimmers that recorded credit card numbers on the card swipe machines at the self checkout stands of several bay area lucky stores. warnings are going up at 23 stores in the bay area. and they are warning customers to check their bank statements and to close their accounts if something seems wrong. >> and the secret service tells me that, you know, it is the most sophisticated device that they have ever seen in the united states. >> and i guess i was just very

surprised, you know, that something like this could happen. >> the company says so far, that 80 people have reported money taken from their accounts and the amount is in the thousands of dollars. lucky says that they have now checked the card readers at all of their stores and they removed all of the skimmers. time now is 7:35. the city of san francisco and the plastic bag bans may expand by the summer. they include the large grocery stores and pharmacies. the expansion might be considered today by the board of supervisors banning the plastic bags at all retail outlets including restaurants. customers will also be charged 10 cents for using the paper bag. now, this is approved, the new rules would take effect in july. san francisco mayor ed lee admits that there is very little time left on the clock to e persuade the 49ers -- clock to persuade the 49ers. they are still hoping to shift the team away from the billion dollar facility planned for santa clara. coming up, pam cook will tell us about san francisco's last-

minute drive that is coming up for you at 7:45. it is 7:36 right now. water and sewer rates are going up. and the price that democrats are reporting the city council voted to raise the rates last night. the water bills are expected to go up about 3.8% in the new year. sewer bills will increase about 6.2%. and the increase is necessary for you to help pay for the investments in the water systems. and today, the san jose city council will decide whether or not to place the retirement reform ballot measure before voters. san jose says that the city could not keep up with soaring pension costs. he is recommending that the pension reform measure go up before voters during the june 5, 2012 presidential primary elections. but he says that the council should be putting off the scheduled vote that would declare a fiscal emergency. your time now is 7:37. a little dog that is missing from the santa cruz was reportedly seen being thrown

out of the car. it's a 1-year-old cream-colored poodle tearier mix called frosty. now, officials said that frosty is still out there on the loose and may be afraid to approach people. please call the santa cruz animal control. a man mite soon be locked up there. the 48-year-old pleaded guilty to smuggling drugs into the prison yesterday. he planned to sell that to prisoners in october, now scheduled to be sentenced on january 26. a new appeal's court ruling says that the prison could not be used as a rehabilitation program. yesterday's decision said that the federal judges cannot sentence one to prison or extend their sentence to help

promote their rehabilitation. and they said that prison is only for retributions, deterrence, and decapacitation. this case is brought by a man who was convicted of bank fraud violating the terms of his parole. now when the judge extepidded the 3-month sentence to two years saying he needed a place to sober up. it is 7:38 today. oakland plaza will be occupied by food trucks. they will be there with the council members. they are discussing their legislation to allow that for oakland to create the legal permit process that will allow the food trucks to operate in part -- operate in parts of the city to help spur job creations and the economic developments and make sure that no one will be hungry. lots of food. >> yes. time now is 7:39. you're busy watching that commute and you just see that fog working with you too, right? >> yes, that's right. we have our crew there, dave. and he is showing us the

pictures from the car that ran off the roadways and damaged a bunch of cars here at walnut creek where the public works people have parked their cars. can you imagine having that coming out and having your car parked and having a car fly off the freeway. and it ended up damaging all the vehicles here in the parking lots and the injuries, considering what happened, they were not as severe as we thought. someone was injured, but the injuries, you know, they could have been a lot worse as you can see it, chp and police officers are there. this is a live picture now for you and they are investigating a lot of these that people do own cars. you can see that this is walnut creek. and again, the walnut creek corporation. you are just off north main and the freeway is not blocked. the traffic on the freeway is getting by in both directions. let's go out and take a look now. it's about a 20-minute delay at the tolls. no major problems getting into

the city. this morning's commute in san jose, traffic is okay. now, we have an accident northbound 85 coming up towards the boulevard exit here. partially blocking the right lane and traffic is slow. now, look at 280. it is just a mess from 101 all the way on out here. just a bad morning for your drive across the santa clara valley into the west valleys here. 7:40, let's go to rose be mary. >> calm, clear, painfully cold in some cases. we have a beautiful sunrise for you that rose about half hour ago. and in the next half hour or so, we'll begin to see the temperatures finally turn around and then a pretty rapid warm up into about noontime. calm conditions for you. a shade of blue there if you are just joining us. a freeze warning over parts of the north bay valley as well as through the delta. parking is straight this morning. dealing with a frost advisory for you. they threw about 9:00. very calm on out there. and so as we know, well, it does not allow for any type of steering for the atmosphere,

just allowing the cold air to sink and stay until the sun will be coming along to warm us back up. 31 degrees right now in santa rosa and in areas right around napa. sitting at 28 degrees earlier. 32 at concord. 32 at livermore. a freezing start in many cases, even along the peninsula here. areas like the park, all reporting the low to mid upper 40s. campbell sitting right there in the 30s as well. 41 out here. mid-40s in the city. 43 in oakland and again, very calm conditions for you. when we allow that, well, i should say when the weather is allowed to sink and cool, we also begin to get that inversion layer where we are warming up above, putting the cap on our air and it could compromise our air quality. for today, moderate air quality. it is recommended, but you know, you're allowed to burn in the fireplace for today and a recommended no burn and that you are okay. it's not completely against the

law. frost and freeze advisories at 9:00 this morning. typically it generates temperatures anywhere from 25 to 30 over the north bay. 30 to 35 over the east bay in particular our valley locations. so for the afternoon, we do expect some pleasant weather. we will be dry, we will be fairly mild. and we are going to have less wind. satellite radar showing you just the clear skies overhead. ridge of high pressure will be continuing over the forecasted highs here from the coast into the bare and your inland areas as well. take a look at san jose. 62 for you today and 59 degrees in the city. your extended forecast, temperatures tomorrow morning they will be cold, but not as cold. possibility of maybe another advisory. but as you progress throughout the week, temperatures will bump up just a bit in the widespread mid to upper 30s in the overnight hours and widespread to the 60s. i'm fine tuning the lunchtime hours and how much you can expect coming up. >> all right, thank you.

police arrested a man inside the apartment on suspicion of homicide. he's been identified as the 52- year-old elliott frisbee. time now is 8:03. suing his estrange wife saying he is the victim of the set up scheme. she is trying to get a favorable custody hearing. they hired that investigator and claims that he allegedly hired a man who posed as a television producer who took the cats to the bar with the intention of getting them drunk. now according to the reports when they left the bar, butler allegedly alerted the deputies to pull them over for dui. they are both charged with several phony dui arrests in the city of danville. now, the chp is

investigating after the man was hit and killed in san jose, that happened around 6:30 yesterday evening near the road. officers say that the 34-year- old man was crossing the highway when he was hit by a pickup truck. the driver stayed at the scene and the officers say that the drugs and alcohol were not involved. copper thieves in vallejo are causing big traffic troubles. it appears city work crews just can't keep up with the crime. we've got a live look in vallejo with how they are impacting residents. >> reporter: this is the intersection of wilson it in vallejo. there is a nice park here and a pretty long walking trail that will be leading up to the intersection. but this is what they are going to see. flashing red lights. the traffic signals are broken here and neighbors say they have been broken. flashing like this for the past three months at least. the city of vallejo knows the traffic signal here is down, but they don't have the

resources to fix it right now. that's a part of the reason why the city workers have put up this sign across the street. let me show you a closer look at it. it reads, "traffic lights not functioning because of copper wire theft." this isn't the only intersection in the city of vallejo that is the target of the copper thieves. in fact, it's a big problem in this city that they have copper wiring stolen from their homes and their businesses as well. it's a huge problem. they stole the copper wiring to the building as to where we work in rhode island. they have come on to the ship and they sold copper and brass from there. >> and different reactions to the response of the problems and they are putting up signs here. >> that will be very important and that will be making people alert. >> reporter: that will be worse even now that i think about it. they need to spend more money for them to make a sign that

will tell us it is our fault. >> reporter: now, neighbors are telling us that there are other intersections with signs like this here in vallejo. we have contacted the city's maintenance superintendent to find out how many intersections have fines like this, talking about the copper wire theft problems. but we have not heard back from them yet. however, they report that 77 intersections and lighting fixtures have been the target of the copper thieves since may, costing the city about $200,000 in repairs. live in vallejo, ktvu channel 2 news. 8:07, the copper thief is also targeting bart tracks sunday morning, the bart train was forced to stop in order to avoid hitting the person, stealing copper directly from the track between balboa park and daily city stations. the same person is also suspected in last week's copper theft from another track. bart police say they know who the person is, but his identity is not being released. bart says the number of copper

and the principal sent a letter to parents saying some students are spending time at the camp and that is complicating the supervision efforts. crime is up at the camp, but there are no plans for a raid. the 34-year-old woman is legally blind and she has mental disabilities and cannot feed or care for herself. the sheriff detectives say she is six months pregnant. detectives are questioning the persons of interest, including the employees here at the care facility. and a stabbing victim at the park is at the hospital this morning where all the search for the attackers will continue. the attack happened at the park near the baseball field around 6:00 last night. and the 19-year-old man was stabbed several times. now being treated at the local hospital, but his conditions, they have not been released.

reportedly seen being thrown out of the car. the 1-year-old mix named frosty was last seen here on the coast guard pier running away. spa officials say that frosty is still on the loose and they might be reluctant to approach people. asking anyone that catches frosty or who witnessed the dogs being thrown from the car to contact the santa cruz spca. a man who used to work at the state prison may soon be locked up there. the 48-year-old pleaded guilty to smuggling drugs into the prison yesterday. and they worked as the warehouse supervisor. authorities said they plan to sell two bags of marijuana and six cell phones to prizers in october. he is scheduled to be sentenced on january 26. a new appeal's court ruling said that prison could not be used as a rehabilitation

program. federal judges cannot send someone to prison or extend their prison sentence. it will be the incapacitation. the case was brought by the man convicted of bank fraud who violated the terms of his parole by drinking. the drug extended the 3-month sentence to two years, saying he needed a place to sober up. today, food trucks are going to occupy oakland. they will be there today and they are discussing their legislations to allow the food pod events in the city of oakland, which will create a legal permit process that will allow the food drugs to operate in certain parts of the city. and they say that it will help spur the job creations as well as economic developments. and now ac transit is doing their part to make it a happy holiday season for the bus riders in the east bay. now, every year, the transit transforms one of their buses into a special holiday coach.

you see that right there? at 40 degrees fahrenheit at 8:47. just 45 minutes ago, it was 35 degrees. so a bit of a dramatic warm up for you. temperatures never got to freezing where we were, but that doesn't mean people are not feeling or seeing the affects of the cold weather. now, take a look at this, the windows on the coffee here on the house was covered with condensations. extreme contrast to the temperatures that are very warm on the inside. very cold on the outside. they create that situation as you look closely, you'll be able to see frost where you were seeing frost and a few cars are parked on the streets there. there is a frost warning for parts of the north bay this morning for 15 more minutes. >> it feels cold. >> yeah. >> you come out here every morning. >> i live right there. >> reporter: so technically it is not freezing, but you could still get away with using the expression, it's freezing out here. cold enough that this homeless shelter opened up their doors
