we're live in oakland where the prognosis for a toddler shot in the head is grim. the tough decision the family will be making later today. new questions involving the pepper spray investigation at uc davis. critics claim there's a costly conflict of interest. also -- a home invasion in the east bay turns deadly. "mornings on 2" begins right now. . well, good morning to you. welcome to "mornings on 2." i'm dave clark. >> good morning. i'm tori campbell. it's friday, december 9th. a lot of people running late for work after overnight work on the 880 ran late.

the lanes were just cleared. kraig debro will be joining us shortly. but we can go to sal castanedo right now for an update on the situation on 880. is there still a backup? >> the backup is dissipating. but the problems were very serious. i want to mention traffic has recovered here and what they are doing here on 880 -- i might be able to move a map to it. they are fixing the high street bridge. they are doing a retrofit project between oakland and hayward -- a $180 million project. i believe we might have kraig -- yes, we do. hello, kraig. how are you? >> reporter: hey, good morning, sal. if you look behind me, you can see what you were just talking about, the high street bridge. there's a problem earlier. it appears that traffic is

moving through here rather smoothly at this time. that's kind of odd because typically there is a residual effect that lasts all morning. especially if you take 880, you know that. the roads did not get opened up in time for the commute. there was this huge backup. here's what it looked like from newschopper2. just about 25 to 30 minutes ago, they finally opened the highway in the northbound direction for all cars to go through. as we were getting here, we were watching the chp do one of those traffic breaks, where they swerve back and forth to tell people behind them not pass. that was going on. i'm being hold by our newsroom that at one point, both directions were stopped. so -- and again, you heard sal mention this work was being done as part of the project

they are working on. even though they seal to be making a lot of progress on this -- seem to be making a lot of progress, if you have been down there, you see they have the whole section worked out. that's a -- that area is a new structure. they seem to be getting along. but we're told project from oakland to hayward won't be completed until 2014. reporting live from kraig debro, ktvu channel 2 news. in other news, a robbery suspect is dead after an attempted home invasion in richmond. police say two men broke into a house on south 35th street wednesday night. several people were inside at the time. now, according to police, there was a fight of some kind. someone inside the home shot the two suspects. one man identified as 19-year- old robbery ross junior was pronounced dead at the

hospital. another suspected robber was wounded. the shooter has not been arrested yet, pending an investigation. the police are still trying to determine why the suspect singled out that home. a third man was been hasted -- has been arrested. [ no audio ] the suspect is due to make his first court appearance this afternoon. police say ramirez and jose campos mendoza were involved in a shooting at a restaurant. investigators say ramirez and mendoza arrived together in the same car. both were seen with the gun that killed the other man. the toddler shot in the shootout? west oakland remains on life

support. the family is expected to make a very tough decision this morning. tara moriarty joins us live with more. >> reporter: the -- the family now understand what's going on and they are trying to go forward and get some peace out of this situation. at around 1:00 this afternoon, we understand the little boy will be removed from life support. as can you imagine, this is an incredibly agmizing situation the -- agmizing situation the -- agonizing situation the family went through. they were waiting for test results that confirmed that the little boy had no brain activity. they had reached a cross roads about the boy's treatment. doctors set from the get-go his prognosis is grim. so they got a second opinion

from their pediatrician. now, he was shot in the head while in his father's arms. six other people were wounded when three hooded gunman opened fire while filming a music video. police have detained half a dozen people on unrelated charges but have made no arrests. investigators say the shootout may have been the commute of a -- the result of a gang commute. we were able to check out the facebook page of the little boy's mother. her name is britney houston. and she recently posted, she wants her baby to keep fighting, that mommy loves you. so as a parent, a difficult situation. we're live in oakland, i'm tara moriarty, ktvu channel 2 news. 7:06. new this morning, an your-long video surfaces of a missing american who vanished in iran years ago.

coming up at 7:15, why the mysterious disappearance is being considered a hostage standoff. some are questioning the costs of an independent inquiry into the uc davis pepper spraying incident. investigators have been investigating last month's infamous incident and they are led by former l.a. police chief, brill bratton, who works for the security firm kroowl. krowl has worked with the uc system before and some say that's a conflict of interest. >> they are saying we hired krowl because we interest have a working relationship with them but they -- because we

already have a working relationship with them but they said before that it was disclosed. 7:07 sal and kraig debro have been all over what's happening on 880. how did that happen? >> it looks better. we're likely to see backups in the future where they are doing the 880 bridges. slightly different lane configuration on the high street bridge. things have recovered. you may have some coworkers that are a little late to work this morning because of what happened earlier. but at least now things are doing well. 880 is back to normal. i'm sure 5 0 may also be -- 580 may be back to normal. on we do have lighter than usual conditions. i want to move it over to the bay bridge to show you that the bay bridge toll plaza is much lighter thatten it norm -- than it normally is for this time. once you get on the bridge, it does move well into the city. checking out the south bay,

it's also looking very nice. there is a minor crash on northbound 85 at 17. it's on the shoulder. as we move the maps over to the livermore valley, we had an earlier problem approaching 580 from livermore to crass tro valley. that's gone and 580 traffic looks pretty good on the macarthur freeway heading over to oakland's main park, the macarthur maze. let's go to rosemary. >> good morning to you. while we slept, our temperatures sank. we have four minutes to the official sunrise. another hazy, spare the air day today, once again. a little bit of patchy fog out there. brig out the -- bring out the ice scraper. you may need it. these cold temperatures will be

lot approximately half a mile away were shot and killed with the same weapon. that weapon, which was a handgun, was found near the male subject in the parking lot known as the cage on duck pond drive. now, to review, it was at approximately 12:15 p.m. on thursday when virginia tech police officer derrick krause, had a vehicle stopped in the coliseum parking lot on wash street in the inter-- washington street in the intersection of spring road. he was approached by an unknown male and was fatally shot. the male fled the scene and from the course of the investigation we determined he ran to the greenhouses where he changed clothes, taking off a pullover cap and left clothes at the greenhouse. and then at approximately 12:45, when a montgomery county

sheriff was driving through the parking lot of the came, noticed a male pedestrian in the back of the parking lot, observed him by himself. there was nobody else in the parking lot acting a bit strangely. the deputy then drove to the parking lot to approach him. lost site of him -- sight of him at one point. when he did locate him, he found him on the grund and he suffered -- ground and he suffered what appears to be a self-inflicted gunshot wound and the hdge was found nearby. the -- again, the two shooting scenes were about half a mile apart from one another. the bodies of both officer krause and the male subject were transported to the offices of the medical examiner in roanoke, where the autopsy and examination are ongoing right now. we have a state police investigator right there -- there right now with the medical examiner's office. we are very confident we know who this individual is. however due to protocol, the medical examiner's office must make that positive

identification and then we notify the next of kin -- >> you've been listening live to a press conference at virginia tech following yesterday's fatal shooting of a police officer. we've just learned that they have identified the shooter but they are not releasing that publicly, as she just men hadtioned because of protocol -- mentioned because of protocol. the suspect was not a student there. the school went down to a lockdown situation and the scene was eerily similar to 2007's mass shooting. they seem very organized today, after the painful less ons learned four and a half years ago. the motive remains a mystery. we'll stay on top of this and bring you more information as we get it. in other news, he's the presidential candidate that everyone is attacking. who is now running an ad

efforts trying to get him free. alison burns is live in our washington, d.c. bureau with the latest details. alison? >> reporter: dave, robert levinson is a retired fbi agent who disappeared in iran years ago and it is still a very big mystery what happened to him. he was in iran as a private investigator working on a cigarette smuggling case. now, here's the website that his family has set up, helpboblevinson.com. on had today, his son and wife have posted a video. they make a plea to his unknown captors and for the first time they show this proof of life video that they received more than a year ago. levinson looks thin and haggard and talks about his health prob -- problems. >> i'm not -- i'll not in very good health. i'm running very quickly out of diabetes medicine. i've been treated well. i need the help of the united

30s right around the north bay locations, widespread 30s and 40s for the peninsula this morning. 30s and 40s for the east bay, our inland valleys are sitting in the east bay, like livermore, concord, your noontime numbers will be sitting in the mid- to upper 50s. a pretty big rapid warmup between now and noon and then as we move into the afternoon, upper 50s, low 60s in the forecast with mostly sunny skies. dry today, dry tomorrow. i'm gonna fast forward you to sunday. we do have a wet pattern that will take shape by the afternoon. you can see picking up about 2:00 in the afternoon. we have rain along the peninsula just creeping into the bay crew the course of the afternoon. it will become more widespread. it begins to move towards the north all the way to i-80 to sacramento. and this system sliding down the coastline sunday night into monday morning, you can see how it continues to drift south, the scattered showers will continue to taper off.

shot to death at knewal park saturday morning. this moving, the solano county sheriff's department is leading the search for a missing teenager from suisun city. investigators fear 17-year-old christina almanza may have been kidnapped. the teenager kidnapped yesterday afternoon. she later left a voice mail on a family member's home saying she was being held hostage by several men. the teenager was last seen driving a navy blue 1999 oldsmobile minivan. the license plate number is 4 eb 1066. san francisco police are looking for a man they are calling a person of interest in two sexual assaults in the mission district. police have released this video. one woman was attacked yesterday. another last month.

-- accused of pepper spraying shoppers will not face charges. she's accused of spraying 20 people, including children, during a very chaotic bid to buy discount x-box games. the d.a.'s office wouldn't say if it was self-defense except that prosecutors will review the video and concluded there's no felonies. the city attorney's office will now determine if they will seek merchandise charges. 7:36. a former san francisco crime lab technician has two court dates today. now, the hearings could lead to a trial date for deborah madden. earlier she pled not guilty to aols federal charges. she is accused of making off with cocaine she was supposed to be testing. she spent almost 30 years as a civilian employee of the lab at hunter's point. she did resign while under investigation two years ago. 7:37.

occupy protesters will hold a news conference today to discuss their next big move. on monday, they plan to shut down all ports up and down the west coast. that includes the port of oakland which is the fifth busiest in the country. how far, they will not have the support of the powerful union representing thousands of doc workers. reports from san diego to vancouver say they are doing everything as possible to make sure it's business as usual on monday. >> we've been working with our law enforcement officers at every level to make sure we can keep the port open and make sure people can get to work and got home. >> the goal is to repeat last month's chaos. thousands of occupy protesters shut down the port for more than six hours. an occupy sacramento protester who took up residence in a tree is back on the ground this morning. just after 1:00 a.m., joe carter left his 25-foot high

board, the dow is up 177. the nasdaq is up 40. s&p is up 19. the head of the european central bank calls it a very good outcome for the eurozone, which is made up of 17 countrys that use the euro. that's a subsection of the european union which is made up of 17 countries. after talks overnight, 26 of the 27 countries are open to sign a new treaty that allows a central european authority closer oversight of their budget. britain, which does not use the euro is the only holdout. britain's leader say a revised treaty would threaten their national sovereignty and damage london's financial services industry. 8:45. as we told you at the beginning of "mornings on 2," new details were released this morning about the latest shooting on the campus of virginia tech university. now we know there was only one gunman yesterday.

our reporter doug mcelroy was at the news conference and is with us live from the campus. we heard part of the news kf friend. what else did the police say -- part of the news conference. what else did the police say? >> reporter: well, the police are being extremely tight- lipped about the deceased suspect. highly unusual because he's dead and they've had 24 hours almost now to notify next of kin. it's very, very unusual, in my case. we know that ballistic tests have revealed that the same gun was used to kill officer krause, 39 years old, the father of five young children, what a terrible, terrible tragedy, given the fact that we're coming up on the holiday seasons and these kids no longer have a father, the same man to kill the accused gunman was used whose name we do not know -- the same gun was used

to kill the accused gunman whose name we do not know. between those two green houses, police dogs found a backpack belonging to the presumed gunman. inside that backpack was a change of clothes. inside the backpack the clothes that the gunman was wearing when he shot the officer. so he apparently changed his clothes at some point between shooting the officer and shooting himself. also this may prove to be very, very significant. written on the greenhouse wall, on the exterior glass of the greenhouse was this "sara, i'm so glad i left you and you didn't give me herpes. good luck and good riddance, mac." now, this might be totally irrelevant but it might prove to be highly relevant if the suspect's name is mac. we won't know until the medical examiner completes his autopsy in roanoke.

the next -- in the next couple of hours. tara moriarty is live with more. >> reporter: well, the attorney for the family of hiram lawrence said the parents have accepted the fact that their son has to be taken off life support. they are not giving up. they are hoping and praying and asking for people's support. just an hour ago on facebook, the hour wrote "giving my baby a bath while i whisper in his ear and tell him to keep fighting because we're a team." obviously a heart-wrenching past couple of weeks at children's hospital. we're hearing reports at 1:00 this afternoon, doctors will remove the 1-year-old from life support and pronounce him dead. but again, this family not giving up. there's some new photos that we received off of facebook and nearly every member of hiram has their -- has his picture of

their picture. the scans confirmed there was no brain activity, but wednesday they reached a crossroads. interests said -- doctors said that his opinion is grim but the family got a second opinion from the pediatrician, now on november 28th hiram was shot in the head while in his father's arms. six other people were wounded. at least two people in the group returned fire. now police have detained six persons of interest on unrelated charges but have made no arrests in connection with the shooting. investigators say the shootout may have been the result of a gang feud. now, we're gonna stay here throughout the morning and don't to -- continue to monitor the situation. we've seen them sort of in an out -- in and out of the lobby. we are gonna try to give them their space. they haven't slept much. we'll let you know if we hear
