>> good morning. welcome to mornings on 2. it's saturday, december 10th. a cold morning out there, but clear for the lunar eclipse, the total eclipse we've been watching. rosemary joins with us a look at what we can expect, and might be some rain in our forecast too? >> yes. by the second half of the weekend. that lunar eclipse just wrapping up but we'll bring you the video on that. this morning, a very cold, patchy fog and frost once again. afternoon highs are expected to be a little cooler, again we do have a storm now approaching the coast. not going to get us until tomorrow, we will be dry today, temperatures falling back just a few degrees in some cases. with high clouds overhead. we'll talk more about what you can expect outside this morning, and when that rain will arrive, coming up. we are following developing news in oakland, where police are investigating an early morning shooting that left one man dead. allie rasmus is live on the scene with the latest on what police are saying. >> reporter: police aren't

saying much at this point. i can tell you this shooting happened at 3:30 morning and there are still evidence markers in the middle of road and investigators are in and out of the apartment. on the first floor of this home, we have seen some people investigators all morning walk income and out of this home. and still gathering evidence as part of this investigation. this is a home on 11th avenue, and east 28th street. i spoke briefly to the adult son of the victim of this shooting. he was upset and didn't want to talk on camera and a short time ago we saw the family walk back into the home, escorted by police. but he told us he says he is -- his father was a victim of a drive by shoot this is morning. he says his father was sleeping in the bedroom on the first floor, they saw it and heard a car drive by. they heard gunfire. the son tells us that a bullet went through the wall of this home and struck and killed his father. police would not confirm this

for us yet this morning, but told us it's still too early in the investigation to make any of the details of this investigation public just yet. >> there's not a lot of information i can put out at this point. so -- other than the fact that we had a shooting here, and we got the person who was -- shot, that's about all i can give you at this time. you got to keep it close to the vest, as far as the investigation goes. >> now, investigators tell us that the victim is in his 40s, and they are interviewing other members of the victim's family who were also home at the time of the shooting. but as for a suspect vehicle, or a motive, police wouldn't even -- tell us at this point if they think this was random or if they do in fact think there was a motive here or if this was a drive-by shooting. at this point, police say they just can't give out any details just yet. live in oakland, allie rasmus, ktvu channel 2 news. this morning, shooting comes as the community mourns the death of a one-year-old boy killed by gunfire.

hiram lawrence was taken off life support yesterday afternoon. he became the city's 97th homicide victim this year. he was among seven people shot during a gun battle two weeks ago. no arrests have been made in what investigators believe was a gang-related attack. ktvu has -- >> extra officers in the area, in the where it happened in some of the surrounding areas. >> i don't want nobody else to go through what i'm going through. i'm sitting here, not crying -- it's hard, but i got to be strong for my baby. >> ktvu has is also learned' woman and a teenage boy were also wounding both remain hospitalized in critical but stable condition. community leaders held a peace march last night to remember homicide victims. hiram is the second child killed in violence. a schoolteacher is behind bars accused of having sex with an underage girl.

41-year-old andrew bruce cattrell faces charges, including statutory rape and lewd acts with a minor. he was arrested yesterday in clayton, where he teaches math and science. police say he carried on a year- long sexual relationship with a former student, a girl between 14 and 15 years old. >> i'm thankful that my daughter didn't have this teacher. yeah, just heard about it like everyone else, and it's awful. >> he's a lovely guy. i've always thought he was lovely guy. i'm shocked. absolutely shocked. >> neighbors say cattrell is married and the couple has two really boys. police believe he had a relationship with only that one girl. cattrell is held on nearly a million dollars bail now, and automated phone message went to parents in the district informing them of that arrest. a funeral is held today for a transgender person shot to death in west hollywood. a candlelight vigil was held for nathan vickers, who

identified as cassidy, was raised in east palo alto. on november 18th he was shot in what los angeles police are calling a hate crime. they believe he was killed by the same man that tried to rob a second transgender person on the same night. he will be laid to rest in menlo park this morning. investigators still do not know what prompted the latest deadly shooting at virginia tech university. >> my heart breaks for officer crouse. >> the school held a vigil last night for the patrolman killed thursday. a few thousand students and faculty turned out on a cold winter night to offer support to the family of the officer. he leaves behind a wife, five children and stepchildren. he joined virginia tech police just after the 2007 massacre, where 32 innocent lives were taken. authorities say this man, right there, 22-year-old ross ashley, gunned down crouse before killing himself.

the officer had pulled over another motorist when ashley approached and opened fire. he was a part-time business student at a school and did not have any ties to virginia tech and did not know the officer. a shocking story from southern california. one man is dead after he opened fire on a los angeles street. witnesses say he was yelling and saying he wanted to die. coming up at 7:15, the disturbing video of the shooter as he tack aim at unsuspecting drivers. boston police are evicting occupy protestors. officers began moving in around 2 a.m. pacific time. they're taking down tents and arresting some campers. the city set a deadline earlier this week that waited until this morning to clear the area. demonstrators have been camping at boston's square since september. one of protestors said he felt helpless watching the spirtuality tent being torn down. we have new video of the last lunar eclipse that will be visible on the west coast until 2014. it occurs when the moon passes

accident involving live crab. that all happened around 11 p.m. last night near half moon bay. both lanes of traffic will close after a big rig spilled the crabs all over the highway. police say another vehicle was involved in the accident and a telephone pole was hit. but again, all those lanes got back open about 2 this morning. this morning 2500 runers will pound the pavement for walnut creek's first half marathon. that run which started 15 minutes ago began on south broadway near the whole foods market. runers will head down broadway on to pacific, then turn down ignacio and run down airs road before they turn around and finish up at civic park. people should expect road closures and detours in that area this morning. a northern california woman accused of faking her own rape, how she did it and why police say she made it all up. and a warm and fuzzy edition to the family of a politician about to do hard time. the pup picked out by illinois former governor and the unusual timing of it all. look! here she comes!

good morning to you! another bone-chilling start out there. widespread 30s around the bay area. sitting in the upper 30s, low 40s in oakland. police are investigating whether the abduction of a 17- year-old girl was actually a hoax. an amber alert for 17-year-old christina almona was called off yesterday afternoon after she was found. at this point, police are saying they cone believe any crime was committed. two others were questioned but none arrested. she disappeared on wednesday, her family received a voice mail saying she was being held captive by several men. a former prison psychologist is facing two felony charges accused of fake a rape attack and police say she set up the whole thing just to move to another

neighborhood. last april, police responded to the home of lori ann martinez. they found her on the floor with her shirt ripped open, lips split and knuckles scraped. she said a strange man knocked her unconscious, raped her and robbed her. >> we believed something happened to her, she was injured, very emotional. then her friend came over and comforted her. >> police say during questioning, martinez admitted she had staged the whole attack so her husband would want to move to a different neighborhood. they say she used sandpaper to scrape up her knuckles, ripped her clothing and hey friend hit her while wearing boxing gloves. she was arrested last week on two counts every conspiracy is out on $50,000 bail. she is scheduled to be arraigned on monday. kansas police are mourning the loss of one of their own. police say yesterday afternoon, sergeant david was shot and killed by a 25-year-old man who then turned the gun on himself. he was serving a nuisance order and later died at the hospital. police say he was a 24-year

veteran of the force and is survived by a white and two daughters and an investigation is ongoing. los angeles police are searching for a motive behind a shooting spree. we want to warn you that some of this video is graphic. police say the man you see in the video was -- standing in the middle of a hollywood street. witnesses say he was shooting at those cars and yelling, kill me, and i'm going to die! >> he was trying to kill. >> police say cars were peeling out of the intersection, trying to avoid the gunfire. police did respond to the scene and shot and killed the man. they say the driver of one car was shot in upper body taken to the hospital but no one else was injured. a federal investigator says a helicopter that crashed in nevada had engine work before the accident. the helicopter plunged into a

canyon killing all five onboard. investigators say the day before the crash, the aircraft engine other parts were changed during routine maintenance. the investigation will continue through the weekend. this includes further evaluation of the maintenance work and a looking at the pilot's life, 72 hours before that crash. intelligence analysts believe russia and china are now inspecting a important piece of american technology. they're showing the spy drone that went down over iran last week. a senior u.s. official says the c.i.a. and the military tried to retrieve or destroy the aircraft, they drew up plans including sending in commandoes or calling in an airstrike. but president obama rejected those ideas, fearing it would be viewed as an act of war against iran. >> the russians and the chinese have probably already got inspectors there, so it is going to close a gap that we have ahead of both the chinese and the russians on very

valuable bolt stealth technology and sensor technology. >> the unmanned drone can fly undetected for hours at 50,000 feet. it gathered intelligence for the raid that killed osama bin laden. president obama tried to apply pressure to congress through his weekly address. >> congress cannot end the year by taking money out of the pockets of working americans. now is not the time for playing politics. now is the time to do what is right for the american people. >> mr. obama criticized republicans saying they are standing in the way of a balanced plan to extent the payroll tax cuts. a unless a deal is reached, nearly 160 million americans will see their taxes go up at the ends of the month. a fox news poll shows more than half of voters now disapprove of the president's job performance. 44% say he's doing a good job, 51% disapprove. 66% say the economy is in bad shape, that's the worst rating ever measured by that survey.

house speaker john boehner says the president has failed to kick start the economy through job creation. >> nearly three years ago president obama promised a stimulus plan to keep unemployment below 8%. well, it didn't work. and because of policies aren't working, the president is asked the congress to pass legislation that will extend unemployment benefits and payroll tax relief for working americans. >> boehner says congress will act on a jobs bill next week that extends payroll taxes and unemployment benefits. he says the republican legislation cuts government spending and does not raise taxes for business. the iowa caucuses are less than four weeks away, and the g.o.p. candidates for president are busy meeting with voters. texas congressman ron paul held a town hall meeting yesterday in mason city. that's where he stuck to his familiar libertarian themes, calling some government spending and programs unconstitutional. >> take, for instance, the constitution, don't you think it would be a good idea if we

went back and obeyed the constitution? >> rights now polls show paul in the top three among the republican field in iowa. other g.o.p. candidates busy campaigning in that state this weekends, including mitt romney, michele bachmann and rick santorum. texas governor rick perry also in iowa where he made another campaign gaff. he met yesterday with the editorial bothered of the des moines register newspaper. during the meeting he told the board there are eight supreme court justices, not nine. he also couldn't remember the name of justice sonia sotomayor. after a gaff in november when he couldn't remember one of the three federal agencies he wants to eliminate. just days after receiving a 14-year prison sentence, former illinois governor rod blagojevich is adding to his family. yesterday he, his wife and two daughters were seen at a chicago animal shelter picking out an 8 week old puppy. they selected a mix between a maltese and poodle.

juwan to show you new video we're getting the itch a car that crashed into the front of a home in oakland overnight. look at that. that happened just after 4:00 on congress at 47th. we're told the driver tried to flee after seeing a police officer and then crashed right there in front of that home into a planter there. he was taken to the hospital. it's still not known why he tried to run from police. winter weather is slowing down drivers in nebraska. police say the roads are very slick and it is causing a bunch of accidents out there. they say at one time they stopped responding to accidents where no one was hurt and the problems are expected to continue with temperatures in the 20s, forecasted for the weekend. drivers are asked to slow down and really only drive if it's necessary. starting to learn some of the financial costs to last week's southern california windstorm. damage is topped at $40 million. but that number will rise as more cities and agencies turn in their surveys. the city of pasadena suffered nearly $20 million in losses

shots ring out on an oakland street this morning. police are still on the scene trying to figure out what happened and who is responsible. good morning. welcome dock to mornings on 2. oakland police are investigating the early morning shooting that left one man dead. it all happened in east 28th street. allie rasmus is live on the scene and just talked to neighbors. >> reporter: the victim's family lives in an apartment that is on the ground floor of this home. you see here behind us, this is 11th avenue and east 28th street. and this is where we've seen investigators taking photos, gathering evidence. you can see they're still out in front of the home. they've been here since 3:30 this morning, when this shooting first happened. one man was killed. about 40 minutes ago, we watched the victim's family being led back into the home. the victim's adult son told us off camera that he believes his father was a victim of a drive- by shooting this morning. he says his father was sleeping in the bedroom, and then around 3:30 the family heard gunfire and tired screeching.

the son says one of the bullets went through the wall of the home and struck and killed his father. police would not confirm for us that this was a drive-by shooting. they just told us at this point it's too early on in their investigation and they don't want to make too many details about what happened here public. but we did talk to neighbors, who were won't up by the gunfire this morning. >> it was definitely a drive- by. so close by, you hear tires screeching. just -- something like in the movies. unreal. >> you can see this street is closed off. this is the intersection of 11th and east 28th street. and the middle of the street you can sigh there are about a dozen evidence markers out here on the pavement. police wouldn't tell us how much shots were fired overnight. but again, you're looking at all the evidence markers here, many of them marking bullet casings from the shooting. at this point, police also say they don't know if there was a motive for the shooting, a particular reason it happened in front of this house, or if it was completely random.

allie rasmus, ktvu channel 2 news. despite the public plea for an end to the garcia fire, police are investigating two new shootings. last night officers responded to reports of multiple gun shotts at magnolia street between 32nd and 34th streets. the street was littered with shell casings, police say one victim went to highland hospital, his injuries not believed to be life- threatening. officers tell us one of the homes is owned by the former city administrator. before that at 6 blocks be blocks away, someone opened fire in the rear of an apartment complex. the victim also went to highland hospital with non-life- threatening injuries. a hang gliding enthusiast is recovering this morning from a broken arm and leg. a cal star helicopter was called in to rescue the victim in solano county. he went down near lake herman. steep terrain and wind conditions mike be make that

area a popular place for hang gliders. a 15-year-old arrested for stealing from a apple store. a officer noticed him breaking into the store with a pick ax early yesterday morning. police arrested him as he was leaving the store with a duffel bag full of apple products. he was booked into the santa clara juvenile hall on charges of commercial burglary and possession of stolen property. sheriff's deputies say this surveillance video shows the intense focus of people who robbed a best buy. police say the thieves forced open a security door and within 60 seconds were gone with two to 300 ipads. the thieves hit that store just before midnight on thursday. police say the ipads are rolled out of a fire door and on a steel rack. >> it's shocking. holiday season, not supposed to be stealing stuff. >> i just can't believe the audacity of people. everybody is having a hard time with the economy, and just for something like that to happen -- >> police say the stolen, i pads were worth more than

$100,000. they are warning people not to buy any ipads from people in the street because they could be stolen. if a deal is too good to be true, it probably is. police now have all three suspects in custody in connection with a black friday shooting at wal-mart. they're identified as tony phillips, watson and cueron forman, the suspected getaway driver. police say his mother made him surrender yesterday after seeing his picture on tv. the three men are accused of oning a 21-year-old man in the wal-mart parking lot. a trial date is set for three men charged in connection to the shooting death of a bay area biker. defendants gary rudd nick and ernesto gonzalez appeared in court yesterday, both men chained and wore bulletproof vests. a third suspect wore a suit as he is the only one on bail. the men pled not guilty on the killing of jethroe pettigrew,

the head of the hell's angels. >> i'm saying yes, by virtue of their involvement in a criminal gang and agreement to engage in a fight involving deadly weapons, they're responsible in part more the death of mr. pettigrew. >> the trio will be tried together in october 29th. a former gilroy councilman accused of stealing city funds. he entered a no-contest plea of grand theft after soliciting donations. authorities say he pocketed more than $8,000. he served on the gilroy city council from 2001 to 2010. we are hearing more from a newly elected mayor of east palo alto. at 27 years old, laura martinez is the youngest mayor in the city's history. she was elected to the city council when just 23. and last night made her second public appearance at a

basketball game of the police activities league. >> i bring a new perspective, i also can reach out to a lot of the young residents in east palo alto. >> martinez was elected earlier this week by the city council. she hopes to lower the city's crime rate and improve the jobs situations. she will serve one year and hopes to use her time to make east palo alto a better place to live. martinez plans to run for re- election when her current term is up in 2012. students at, c davis are getting ready to go home for winter break and that's now leading to the end of the occupy encampment on campus. the sacramento bee reports students quietly took down their tents yesterday. only 20 tents remained at the encampment, down from 70 just a few weeks ago. students say they're not sure if the camp will resurface after the winter break. the occupy movement received national attention last month when campus police used pepper spray on students just sitting there. occupy protestors mapped

out a plan for monday's blockade of the port of oakland. here's the time line. at 5:30 monday morning, the first group plans to march from the west oakland bart station to the port, then at 4:00 in the afternoon demonstrators will head to the port again after first staging a rally at frank ogawa plaza. a third wave of protestors plan to leave the bart station and join the march. oakland mayor jean quan will not give up our three sports teams without a fight, pledging to keep the warriors, raiders and sent a letter to major league baseball saying the a's should not relocate to san jose. she is proposing building a ballpark near jack london square or near the airport. that plan known as coliseum city would transform the area into a sports and entertainment conditional plex for the three franchises. >> that will be a potential convention and entertainment shopping and perhaps even housing regional destination.

welcoming nine new firefighters. yesterday the new class idea waited from the academy. this is san jose's second class of firefighters since last year's layoffs. in order to help close a $118 million city budget gap, 49 firefighters were given pink slips. eller this year, 22 of those laid-off firefighters were rehired. but mayor reed says that is not enough. >> our fire department is too small. we've had to brownout companies, we've had to close fire station and we need to save enough money to bring those back. >> the firefighters union has also accepted 10% pay cutts to help save money. the nine new firefighters will report to duty at 9:00 tomorrow morning. there's a plan to save hangar one. the structure was built at moffette field in the 1930s over the past several months crews have been removing the exterior panels. but now google founders want to save it. they say hangar one should not

overnight news. a shooting left one man dead, just after 3 lone 30 this morning near highland hospital. allie rasmus joins us now live with what the victim's son is saying about the violence. >> reporter: nearly five hours after this shooting happened, you can see the investigators are still out here on the scene gathering evidence taking photos. we want to point out something that just became noticeable to us now that it's daylight. this yellow house is where 40- year-old man was shot and killed around 3:30 this morning. but if you zoom in, you can see the outside of the home, you can see where a bullet pierced through an exterior wall, leaving behind a visible bullet hole. adult son of the victim told us he believes his father was a victim of a drive-by shooting. he told us his dad was sleeping in one of the bedrooms in this apartment, and the family was inside the house at the time and they heard gunfire and tires screeching outside. the son says a bullet went through the wall and struck and killed his father. several neighbors also told us the gunfire was loud enough to

this morning accused of having sex with an underaged girl. 41-year-old andrew bruce cattrell faces charges including statutory rape and lewd acts with a minor. he was arrested yesterday at diablo view middle school in clayton where he teaches math and science. police say he carried on a year- long sexual relationship with a former student, a girl between 14 and 15 years old. >> i'm thankful my daughter didn't have this teacher. yeah, just heard about it like everyone else and it's awful. >> he's a lovely guy. i've always thought he was lovely guy. i'm -- i am shocked. absolutely shocked. >> neighbors say cattrell is married and two two boys. police believe me had a relationship with only the one girl. he is held on nearly a million dollars bail and automated phone message went to district parents informing them of that arrest. police are investigating whether the an distribution of a 17-year-old girl was a hoax.

and killed in his home. that home located here behind us, a yellow house here near the corner every 11th and east 28th street in oakland. it happened at 3:30 this morning and you can see five hours later, investigators are still out here in the front of the home collecting evidence. one piece of evidence we have seen them focused on is on one of exterior walls of the house. we can show you where a bullet pierced through the wood panels of the house, leaving behind a bullet hole. i spoke to the adult son of the victim who was killed. he says his father he believes was the victim of a drive-by shooting. his father and the rest of the family was sleeping when they heard gunshots and tired screeching outside. the victim's son says a bullet went through the wall of the house, maybe the bullet hose we shoulder you later, but that bullet struck and killed his father sleeping inside. when i asked police whether they believe this was a drive- by shooting, they wouldn't confirm it for us. investigators said it's too early in the investigation.

they're still looking for suspects and information and they don't want to many details public just yet. but there morning we talked to several neighbors who heard the gunfire, it woke them up and they have no doubts about what happened here. >> it was definitely a drive- by. it was so loud, so close by. you hear tires screeching, just something like in the movies. unreal. >> police wouldn't tell us how much shots were fired but you can see out here in the middle of the street, it's still closed off. there are about a dozen evidence markers mark, some of the bullet casings from the shooting. police say they don't know if there's a motive for the shooting, if why this house if this house was targeted and why or if this was just completely random, what happened here this morning. allie rasmus, ktvu channel 2 news. this morning's shooting follows two others in oakland last night. at 8:30 officers responded to reports of multiple shots. the street was litter with

good morning to you! light breeze outside our doors. primarily offshore at this point, turning onshore later today. new this morning, 13 people are dead in the philippines after a plane crashed near a school. it happened earlier today in manila. authorities say the plane requested an emergency landing at the imairport. but it crashed before that could happen. the crash started a fire that spread to a school and 50 homes. most of the victims are believed to be children.

in fremont today. and it is centered around earthquake damage this. is fremont community center at lake elizabeth. it sits on top the hayward fault that caused this crack. right now the crack is 1 and a half inches wide but seismic activity is causing it to grow. that part of the build was closed in the 1970s, but is now part of a public exhibit called the faulted floor. >> it's part of our culture and history and we just felt it was a good thing for the tours and kids from the high schools and schools that are coming to learn about fremont. >> this is a free exhibit. and it is made possible by a group called the math science nucleus. it's going to be become part of a city-wide tour of other landscape attractions created by the fault. the group says the bottom line of the exhibit is to raise earthquake awareness. new this morning, a former 49er assistant coach will be the new head man at ucla. jim mora began coaching with
