the s.w.a.t. team was needed because a weapon is registered to somebody at the house. and the uc davis pepper spray incident was the talk at the capitol today. more where the uc davis president talked about the use of force on what appeared to be peaceful protesters. >> reporter: well, uc davis' president says that the university system needs to better understand or better define when force should be used, which obviously raises the question with so many confrontations between students and police, over the years' it took recent events for them to discover the need. it was this incident on the uc davis campus where the student was being pepper sprayed, and it dominated the hearing. the uc davis chancellor gave the key testimony before the lawmakers. >> did i direct them to use pepper spray? the answer is no. did i direct the police to use

force? and the answer is no. >> reporter: the uc davis pepper spray incident is under investigation, as is the use of baton on the uc davis berkeley students, during the protest. they said the images were upsetting. >> i certainly think we need more definition of when we use force, and don't, and when it is permitted. >> reporter: they say the investigations are under way. but after testimony, he didn't field questions from the press. >> i thought the hearing was fine, excuse me. >> reporter: the chancellor didn't win any points with students either leaving the hearing, as they began their testimony. >> i was very disappointed about that. we don't get a lot of opportunities to speak to them. >> reporter: at 6:00, we'll hear more from the uc davis chancellor who seemed to take the most heat in this testimony today over what happened, the pepper spray incident on her campus. in sacramento, ken pritchett. and the state superintendent of public instructions says he has a plan

to deal with severe budget cuts to education, such as those that jerry brown announced yesterday. he wants to put a tax on next year's ballot to fund public education, coming a day after the schools are to lose an additional 80 million or so after the beginning of the year, because the revenue didn't hit target levels. and california's largest school district taking an effort in court. the superintendent of the los angeles unified school district says the cuts would leave nothing left in his transportation budget. 35,000 students in los angeles rely on those buses, including 13,000 students who are disabled. coming up on ktvu channel 2 action news at 6:00, why many bay area school districts are doing better than southern california. and in san francisco, two city workers facing the possibility of several years in prison for allegedly taking bribes from hundreds of restaurant workers. ktvu's david stevenson is here now, and says how the alleged

scheme worked. david? >> reporter: frank, the pizza place behind me is a san francisco restaurant that says they were a victim in what prosecutors call a bribery scheme by the former public health department employees. marello's pizza general manager says she got burned in a bribery scheme by two former department of public health workers. >> we lost, and had to pay again, we didn't know it was something being done illegally. >> reporter: prosecutors say between 2007 and eight, stewart and sanders took brides from as many as 500 restaurant employees seeking certification as food safety managers. >> they were asking questions about the food, such as what temperature do you keep food at, if it is hot, or cold? >> reporter: the prosecutors say in some cases the men helped to fill out test forms. both face felony charges and

the safety certifications now are not valid. they did not charge any of the restaurant workers who allegedly paid the men. >> we believe that greater harm was from the public employees. >> great guy, could be trusted i thought thought. >> reporter: she says they came in on a saturday to give the test. >> i didn't question it at all. i really thought it was a new city service. i know that i did miss a few, but my results were still 100%. >> reporter: clifton sanders, and their attorneys declined comment this afternoon. both men entered not guilty pleas at their arraignments today, they're due back in court on january 4. david stevenson, ktvu. and new praise tonight for a new pipeline safety bill which won congressional approval last night. it comes after the deadly explosion in san bruno,

alleging safety violations and stopping investigations. pg&e calls the bill an important step forward in protecting public safety. california senators boxer and feinstein had a joint statement praising the law, saying the bill puts in place long over due safety improvements to the pipelines that run below the surface. they say it shows how little is known about the pipelines and how deadly the mistakes can be. and the housing area showing improvement, more than 360 homes and condos were sold in the area, an increase of 300% compared to a year ago, however, sales were down about 2% from october. still that drop was smaller than the steep declines typically seen from october to november. figures also show slower sales for high end homes and that helped push the median sale price down about 4% when compared to figures last year. and the forecast for u.s. job growth over the next six

months doesn't appear to be very promising, according to new surveys, that survey by the group, business round table, shows two thirds of the ceos from the largest u.s. companies say they won't plan to hire in the next six months. the round table group predicts the economy will expand 2% next year, but an lists say it is not enough to produce the job growth. and democrats could back off on their demands for a sur tax on millionaires, they had pushed for the tax regarding the extension on the payroll security tax cut. the sources tell the associated press they may be ready to compromise, the house has approved a g.o.p. back bill to extend the tax cuts and renew expiring unemployment benefits. the senate democrats promised to kill the measure, saying it doesn't extend the jobless benefits enough. and once again, the money impact in europe impacted wall street, stocks down for a third straight day, looking at

ongoing worries about the debt crisis in europe and the affect on the global economy. the concerns led to a sell off of gold and the euro, the dow dropped more than 131 points, the nasdaq also fell about 40 points. and president obama today paying tribute to u.s. troops coming back from iraq, the president and first lady visited fort bragg in north carolina, a base that lost more than 200 of its own. the president never tried to declare victory, but said it was the end of a noble fight as he cheered the troops coming home. >> they will cross the border out of iraq with their heads held high. one of the most extraordinary chapters in the history of the american military will come to an end. >> reporter: the president has pledged the u.s. will continue to help iraq, but all u.s.

troops are to be out of that country by december 31st. and san francisco mayor ed lee told ktvu news this morning that his city has a good plan b for the struggle in the new 49ers stadium. >> we'll be there, should there be less than expected financial support for a very expensive stadium. >> reporter: 49ers fans packed last night, santa clara city council meeting where a preliminary 850 million financing plan was approved. they will loan santa clara the money if the national football league kicks in 150 million for the project, mayor lee is still open to talking to the nfl about a two-team stadium in his city. and the shooting of an occupy portland protester looking at a change. ktvu has more after speaking with the officers and the man who was hit recover this is the site where scott campbell was

when he was shot in the right leg with a bean bag, the two officers have been temporarily reassigned. in downtown oakland, the strike continues, on the north end of frank ogawa plaza, where the video of scott campbell was shown. campbell said he was documented the riot police when an officer shot him in the right leg with a bean bag round. >> i looked through my cameras view finder, so i didn't see him raise the weapon. i just saw the flash, and right away looked at -- felt the severe pain. >> reporter: he says the injury still bothers him. >> it bothers me that somebody would feel justified, that would be the course of action. >> reporter: the officer who shot him and his supervisor have been both reassigned, although joiner said they are on loan elsewhere until the investigation is complete. >> that decision was thoughtful, constitutionally ethical, as well as regarding

. from this freeway here you can see here the oil tapinger truck slammed into an overpass and burst into flames, but the driver and passenger were able to get out of the truck, the firey mess shut down the freeway there. they are examining it to see if it is sound. and in a middle school, tonight people wondered about a situation, and who could do something like that. in vallejo, the police department has something thieves may not know about. >> reporter: that is right, the thief stole hundreds from this middle school, and soon, police may have something the thief didn't think about, video from surveillance video. while the students played inside the franklin middle school? vallejo police say a thief took the opportunity to steal while everybody else was distracted.

of supervisors taking a first step to ban bull frogs. they say they are a species from the east coast that eat up or drive out other amphibians, including other species such as the red legged frog, they say the bull frogs threaten to take over areas such as the pond north of the natural bridges. >> it is eating the wildlife, they have a high rate of disease, which kills about 100 species world wide. >> the santa cruz county supervisors will likely not finalize the bull frog ban until the february mating season. and here in the bay area, the air quality managing district says that a cold weather pattern is holding pollution close to the ground. this is the first spare the air

day this week, last week the district issued alerts four days in a row. burning wood is banned during the winter spare the air days, unless it is the only source of heat. and more on fog, clouds, and bill they make for an awfulle pretty sunset. it is pretty out there, the sun going down in a few minutes, clouds are moving into the area, showers, light showers unfortunately are going to raise a little bit of trouble on the morning commute. this is not a big weather system or what you would expect this time of year, i expect something with more teeth. there it is, the impact in northern california. here on the southern edge, more sprinkles of . it should show up in the early morning hours, outside, it is cool out there. we'll see a weather system in here, and you are not going to have much of an issue with fog, there is not a ton of wind with it. cooler air at the surface, i think we'll see very dense fog on top of this chance of

sprinkles in those inland bay valleys. the fog this morning, nasty, fairfax, wood acre, the ground fog i spoke of it last night. it is a night where it forms quickly, the visibility on the deck, a few feet in some cases, tomorrow morning it wouldn't be as bad. but there will be patches, you wouldn't expect it. it will be cloudy, sprinkles, patches of fog, temperatures out there right now, very cool, 48 in napa, 48 in santa rosa, clouds coming in with shifting winds, right now a bit of a wind, the winds will shift. that shift will allow temperatures to come up a couple more degrees, despite that, despite the clouds which usually warm us up, we're still looking at mid-to-upper 30s in the north bay valley. so that is very cool when you have an in-coming weather system. typically the numbers come up in the 40s as the southerly winds kick up. this is a unique situation, cold air at the surface, there all day. and as the system gets closer

recognition, landing on the cover of time magazine. today they showed the annual person of the year. and this time the person is actually a group of people known as the protester. >> all of these people -- in their own way and in their own countries helped to change the conversation. helped to bring attention to their -- causes in -- in a way that we have not seen before. >> time magazine's 2011 person of the year is more of a concept than an individual person. it recognizes protesters from the uprisings in egypt, syria and other arab countries to the occupy wall street campers in the united states and other countries. one occupy protester at uc berkeley welcomes the recognition. >> 2011 will be known as the year of the uprising from you know cairo and new york and beyond. i say it is totally appropriate, and i say let's make 2012 the year we win. >> reporter: and the time

county, and what they're taking has nothing to do with what they're seeing inside. they are not after purses or ipods, tonight, police are warning people about the continuing theft of catalytic converters. ktvu's robert handa has more on the story and how police are trying to stop the thieves. >> reporter: well, losgatos is a city where you just have to look down the street to see the opportunity for the recycling thieves. it is an area where a strategy is being tried in santa cruz county. this is the prize for the recycling thieves, a catalytic converter containing about 300 worth of platinum and other items. they are a target because thieves can get underneath. in losgatos, thieves hit at least 11 toyota vehicles, including six in one night. >> they can probably get into, and get under a vehicle and remove it within two to three minutes. >> reporter: today, santa cruz

police launched a program to combat thieves, the city has had 20 thefts in the last two months. so the department asked toyota of santa cruz to help. first, the dealership will free of charge work on the flande, so it can't be stolen, just by removing bolts, they can't take the units that have been cut. the workers put the license plate numbers on it. >> if they're stolen, we can match the license plate number or the police department can match it to the catalytic converter. >> reporter: the welding and the license number will make it a problem for somebody to steal and sell a catalytic converter, but law enforcement says it is still difficult to stay a step ahead of the thieves. >> thieves are able to sell these out of state, and they're in states that don't necessarily have as strict laws as california has. and because of the trade-in value it makes it worth the shipping, time and effort to get them out to the other recyclers and continue to take them. >> reporter: the law enforcement agencies are

supporting proposed legislation that puts more responsibility on relyinglers to keep records on sellers and keep possible stolen records. and oakland police released a sketch based on the woman's description of a man who she says assaulted her this month. the man is described as 30-39 years old, african-american, about 200 pounds. she told the police on december 4 she was walking on first avenue when the man pushed her against a vehicle and assaulted her. she said fortunately she got away. the oakland crime stoppers is offering a $2500 reward for information that leads to a conviction in the case. and uc berkeley trying to help students who are paying huge tuition costs, lorraine blanco has more on the new financial aid program. >> reporter: it has been the subject of many recent university protests, the rising

costs of getting a college education. but starting next fall at uc berkeley, a substantial portion will be paid by the school for middle class students. >> above and below this band, we've seen growth in the number of students that we've taken. and we've seen -- no growth in the number of students in this band. so as a percentage of our population, it is getting smaller. >> reporter: it is called mid cap, families with a gross income between 80 and 140,000 a year qualify. the program caps a parents' contribution at 15% of their annual income. students will be expected to pay for a portion through work studies and loans, but through this, they can pay the rest. help comes from donors. >> we're optimistic that the people of california will respond very positively to this initiative and will provide help for it -- hopefully given in the long run.

>> reporter: to see if you qualify, fill out the free application for federal student aid at this website. and more good news, this aid does not need to be repaid. so that means less student debt when they graduate. at uc berkeley, lorraine blanco, ktvu channel 2 action news. and a new national poll showing newt gingrich with a 10- point lead over mitt romney in the run for the republican presidential candidate nomination. the survey found that republicans favored newt gingrich over mitt romney 28% over 22%, but the poll found that both would lose to president obama and that newt gingrich's loss would be greater than mitt romney's. several other polls found mr. obama beating newt gingrich but in a tie with mitt romney. and on the campaign trail today, republican frontrunner newt gingrich was shouted down by protesters. >> -- >> mr. newt gingrich we're here

to protest you today. >> mr. newt gingrich was attending an event at the university of iowa, but here you can see he had a hard time of getting his message out. they said he had a bad attitude towards the poor, the protesters were led out eventually. and texas governor rick perry tried to convince people in iowa he should be the choice. he made a stop there where he told a town hall meeting he is an outsider who wants to change things in washington, d.c. >> it is this young man's future we're talking about over here, not just those of us who are working today and paying the taxes. it is the next generation, and probably they're children if we don't make changes in this election cycle. >> most polls of iowa voters put rick perry in fourth place among the republican candidates. starting today, drivers in at least one san francisco neighborhood can stop pulling for coins and pay for parking with their cell phones.

a cap is all it takes, visitors here no longer have to plug quarters into the meters. today, the pay by phone system was launched, operated by a private firm. drivers can set up a payment account, swipe the meter with a special pay by phone sticker, for a 45 cents convenience fee, they can load the minutes they need and even get a reminder text before the time is expired. part of what managing parking is about is making it work for neighborhoods, particularly for neighborhood commercial districts to keep the turnover moving, to make it convenient, if you're in a restaurant or shopping center, you don't have to run out. >> it will be paid at 31,000- meters throughout san francisco. and american airlines receiving the go-ahead to use apple's popular ipad in the cockpit. the faa says it will allow the pilots to use the tablets even

during take-off and landing in place of traditional flight manuals. american airlines began to test it earlier this year. now the faa's policy doesn't change the current policy with passengers, they still need to turn off all electronic devices during take-offs and landings. facebook on the move, what the company is not doing to mark the change of address. and it is sold at auctions, the contract that officially made apple a company. why the amount paid for it is raising eyebrows tonight. and a new surge in smoking marijuana among the high school students, how many of them now say they use it every day or almost every day? . facebook expected to complete the move from palo alto to the new headquarters by the end of this week. hundreds have already moved out of the palo alto facility, which facebook has called home since 2004. the new site is at the former sun micro systems campus, the address is reportedly one hacker way, the company says there won't be an official celebration of the move. and the piece of paper that created apple has been auctioned off for major than expected. in the bidding in new york city, the original 1976 contract signed by steve jobs,

wozniack and wayne went for a final bid of 1.6 million. the auction house thought it would only bring in about hundred thousand. the buyer was from south america, edwardo cisneros. >> it just shows the importance of the document, the social history and technology history. >> the third name on the piece of paper, ronald wayne, he sold his 10% interest in apple early on for just a few hundred, if he was still in on it today, it would be worth more than 2 billion. and many finding the content on the internet not totally reliable. the study found that 75% of users see the web as an important source of information. but only 15% said they found much credibility in the on line

content. they say it is very true for social networking sites. they say the trust grows when it comes to established media outlets and established websites. and the obama administration releasing figures on the health care law, helping more than 2 and a half million young adults get coverage. since it happened last year, the number of uninsured 25-year- olds fell down to 8 million, from 10 and a half million. the group ofamericans historically lacked the health care coverage, and analysts say it was driven by a single provision in the law that allows them to stay on their parents' health care plan until they are 26. and the university of michigan study released today shows one in 15 high school seniors reported using the drug on a daily or near daily basis. researchers say that teenagers are viewing the drug as less risky than our activities.

many reported using synthetic marijuana, the study found a decrease of alcohol use and smoking among teens. and drugs used to lower cholesterol could help people sick with the flu. according to the study today, the hospitalized flu patients were 41% less likely to die if they already were taking statins, researchers are looking into studies regarding the common flu. and we found a contra costa neighborhood where experts say health risks makes building more homes a bad idea. and there are a few sprinkles in the forecast for thursday. i'll show those on the latest computer models

. a young man from antioch is dead after his car crashed on a foggy east bay road, about 7:00 this morning. a passing driver spotted a car in the field off highway four, the highway patrol officers and firefighters later found the body of 28-year-old matthew steven reid just outside the car. the investigators are trying to determine just what caused his car to go off the road. and bay area researchers released a report showing areas at risk from health problems from diesel exhaust. more from concord, on how what the planners may do about it. >> reporter: it is no surprise that breathing diesel highway

fumes is a health problem. but some bay area neighborhoods, including one we found in concord have added risks. just off 680 at monument boulevard, lots of truck traffic, stores, warehouses and concord fair oaks neighborhood, where some residents say asthma is a serious problem. >> it is not good for -- for the kids or people who live around here. >> reporter: the neighborhood lies in what is called a priority development area, blue on this map, slated for affordable housing. but the yellow shows high pollution risks. >> like diesel that contributes to cancer, asthma. >> reporter: the diesel is all over the fair oaks neighborhood. hundreds of low cost homes and elementary school two thirds low income i kids. and two parks are in the high risk area. researchers say deciding to develop in such areas may seem less expensive, but not when you consider pollution caused, school absences, lost work and
