good afternoon. i'm tory campbell. the 12thage memorial for the homeless started one hour ago in san jose. it is a somber ceremony to remember the 61 people who died on the streets this year. ktvu's lorraine blanco joins us live to tell us why the memorial is held. good afternoon. lorraine. >> reporter: good afternoon. the people here say that the service honors their memory. you can see where there is a

permanent memorial sitting in memory of the homeless people who died in years past. today, there was a reading of those who died just this year. >> jaime barajas >> reporter: you can hear area leers reciting the names of all 61 people. the number peaked in 2008 when 82 people died in the streets of santa clara county. it's been requesting down steadily since then until this year. jenny nichols says this has been a tough year noting that their fight against homelessness has gotten worse. >> we get to know these people. we get to know how old they are, we know how they died. it breaks my heart to know that you can live your life and die and there is no one there to claim your name. it is a true honor to be able to do this for them. >> on any given day, 7000

people sleep on the streets of santa clara county, nichols say. there are some nights they are forced to turn away dozens of people over here in the winter. lorraine blanco, ktvu channel 2 news. in just the past two hours, two suspects in the brutal beating of san francisco giants fan appeared in court. today, the judge set a preliminary hearing in the case for january 17th. both men pleaded not guilty and are being held without bail. brian stowe is continuing therapy at a rehabilitation facility and celebrated thanksgiving with his family. a judge this morning refused to reduce the bail for a woman accused of helping her boyfriend cover up the hit-and- run assault on a cal

firefighter. the boyfriend, eduardo scoville deliberately ran down 29-year- old edward bartol with a rented car at 9th avenue and garibaldi avenue after an earlier altercation and that the girlfriend tried to help him reparrot rental car before turning it in. tejada is charged as an accessory. tejada's attorney had wanted to reduce her $250,000 bail but the judge said no richmond police are looking into why one of their police dogs bit a tow trucker as officers were impounding the vehicle. the dog's handler was checking under the vehicle when the dog bit the tow truck driver who was standing next to the dog. the man was taken to the hospital with bites on his hand and arm. the dog has been taken out of service while officers look into what happened. oakland police are investigating an overnight shooting that injured one man. police found the shooting

victim in an apartment complex parking lot on 81st avenue, just after midnight. he was rushed to the hospital in serious condition. so far, police say there are no suspects or a known motive for the shooting. an ex-convict who police say is linked to last month's fatal shooting near the occupy encampment in oakland now faces charges of sexual assault. according to the oakland tribune, isaac mcdaniels is one of the ones involved in the beating and shooting of coyote foster. while looking for them, police say that dna evidence linked him to a sexual assault. police say that he attack add 21-year-old woman at gunpoint on november 15th an elementary school teacher's aide is facing serious charges. stephanie elliott worked at spring hill elementary in lafayette and she is arrested on charges of sexual assault on

an unconscious woman back on july 2010. elliott is due back in court on december 22nd to enter a plea. a soccer coach with ties to vacaville is accused of molesting a 14-year-old boy and authorities say there could be more victims. police arrested 29-year-old christian runes. they say that the victim is a 14-year-old boy from vacaville and that's where he was a youth soccer coach for two leagues. police say that the abuse occurred over a four-year period. neighbors are reacting to news of the arrest. >> i'm very shocked. i just can't believe that he would do something like this. deputies say that he was a foster parent to a six-year-old who has since been removed from his care but investigators say there is no evidence the foster child was sexually assaulted. this is a big day for the people in berkeley who were i am packed by a devastating -- impacted by a devastating fire. last month's blaze devastated a

that many people don't note street is back open again and they are hoping to get the word out about that as well. reporting live from berkeley, kraig debro, ktvu channel 2 news a middle school van in the north bay is getting some wig time help. new york yankees pitcher and vallejo native cc sabathia donated $1000 -- thinks actually the wrong video -- this is actually the wrong video. leon pan panetta didn't have anything to do with this. >> cc sabathia gave 1000-dollar to replace the 700-dollar band. the band held the fund raiser because the school no longer -- the district no longer funds bands. and his wife went to the school. the u.s. military mission in iraq is now officially over. in ceremonies in baghdad this morning, u.s. forces retired the flag for the mission that began with an assault on iraq nearly nine years ago. defense secretary leon panetta

transportation for over 30 years. transportation is the engine that put people to work. transportation is the engine that will regenerate this country. >> the u.s. and california voters wanted to vote on this again. they want to change the vote that took place before. >> the u.s. house transportation committee staging a formal investigation of the train's progress today republicans on the many pam like the one you just heard said that costs are spiraling out of control and there is too much opposition to proposed tabs for the train and ticket prices on the train. that's why they want to consider a freeze on all federal money. another plan will redirect money already spent on road projects. the mayor of fresno here in washington today to lobby for the bullet train saying it will create jobs and keep businesses in the fresno area from closing but the u.s. house

transportation committee has not scheduled a formal vote on plan to either freeze the money or redirect the money. of course, we'll keep you posted once they do. president obama and the republican leadership today said warnings of a government shutdown tomorrow are primeau temperature the president again repeated his call for congress to extend the payroll tax cuts and expiring unemployment wen fits. he said that lawmakers should not go home for the holiday billion the work is done. congress must pass a spending plan or a stop gap measure by tomorrow. >> there is no reason the federal government should shut down because of. this i expect all of us to do what is necessary in order to do the business. >> i think everyone needs to step back and take a deep breath. there is an easy way to unstage

will. this we need to let everyone to take a step back. >> in belmont, a woman in a wheelchair was hurt after an elevator in her living facility started to free fall. it happened at the leslie terrace senior facility where the 67-year-old woman lived. she said that the elevator suddenly dropped, throwing her from her wheelchair. an emergency brake system stopped the elevator before it reached the second floor. a state investigation has begun into the elevator malfunction. some parents are scrambling to find a new school for their children after a surprise closure announcement from the contra costa jewish community center. as ktvu's tara moriarty reports, the center's abrupt shutdown is affecting many families. >> total shock. >> it is appalling. >> reporter: parents dropping their children off to the

preschool were angered. >> it is a tragedy that has befallen the jewish community. >> reporter: parents received a notice that the school would be closing. >> 48 hours, no indication. >> teachers and other staff will be let go, the property sold, the contents removed. >> it is a huge undermining of our community and given my background, you know, this is really important to me and to my family. >> this facility not only houses a preschool but it's a state licensed adult day program which services seniors with alzheimer's. no word on what will happen to them. >> there is also a gym and other classes run by the city. >> there are no answers. that's what got us all very frustrated. >> reporter: parents say they would have held fundraisers if they had been told about a fiscal problem. 13 teachers will be laid off

including vanessa terro to has been here eight years. >> it is our job to do what is in the best interest of the children and thinks not in the best interest of the children. >> reporter: now, parents who have already paid tuition for the full year are scrambling to place their children in other schools and are considering legal action. a huge tanker firetruck yesterday shut down a highway in california. a huge tanker truck exploded on highway 60 east of los angeles. the overpass suffered major damage and that's expected to keep the freeway closed for days. the cause of the truck fire is under investigation. transportation officials

released the cause of death in nascar driver weldon. the report said that he hit a pole with his head. he suffered a non-survivable track. highway was shut down to two lanes in petaluma. the collision knocked down a utility pole that left live electrical wires on the roadway for a time there were no reports of any injuries. >> speaking of wet weather, let's check in with meteorologist steve poulson. are we done with the rain? >> we are. >> this system is flying south. it's on its way now. to southern california and we'll start to see more rain as this system intensifies. as it does, that should start

toys at toys'r'us and babies r us stores around the bay area the lobby of the palace hotel in san francisco is now serving as a gallery for their annual gingerbread house competition. each house was designed by a guest builder teamed with a palace hotel chef. this is video of the gingerbread house that i helped design with chef campbell, no relation. the staff had a good time with the competition. >> it really gets us into the holiday spirit, you know. we are sitting there, putting candy on and icing and you have to take a little taste here and there everybody is getting together, having fun, talk about how there are going to put their gingerbread house. >> if mine gets the most vote, the hotel will make a donation. visitors can stop by and vote for their favorite display at the palace hotel lobby from now

stronger reports on the job market and manufacturing are seaning stocks higher today. and fed ex, which is considered a bellwether for the economy is jumping 7%.

taking a live look at the big board, the dow current i up 65. s&p is up 6. tomorrow is sentencing day for barry bonds. bonds will return to the same federal courthouse in san francisco where he first gave his grand jury testimony in the balco case eight years ago. he was later convicted of obstruction of justice for lying to that grand jury about his alleged steroids use. prosecutors are urging the judge to send bonds to prison for 15 months lawyers for baseball's home run king want a punishment of probation while they appeal bonds' conviction. a local prosecutor in ohio says he will not file criminal charges in connection with the brawl between basketball teams from xavier university and the university of cincinnati last sat day the fight came at the end of a nationally televised game between the crosstown rivals. hamilton county prosecutors say that he feels that the
