the low will stay in southern california for a couple days. hang out over the weekend. if you have travel plans down there, keep an eye on the sky. the end result is wind. it will be a windy day. especially in the hills and out to the valley. temperatures 20s and 30s. we'll end up with 50s and 60s. steve, good morning. traffic is doing well around the bay area. as you can see from these live pictures we're off to a nice start. this is a look at the commute on westbound highway 4 we are doing very welcoming up to the willow pass grade. also the morning drive looks good in oakland. northbound and southbound as you pass the coliseum. there is road work southbound 880 between broadway and 23rd. not causing a big delay because it's so early. this mornings drive on 680 southbound on the sunol grade looks much better than it did

yesterday. 4:30 let's go back to pam. in overnight news san jose police are investigating an officer involved shooting. one man is dead. ktvu paul chambers joins us from san jose with what led up to the shooting. good morning, paul. >> reporter: i can tell you we have very little information about this. san jose police did release a press release saying it happened in this area here. investigators say about 11:30 last night several officers tried to contact an adult man. that's when the man displayed threatening behavior. one officer shot the man in what they say was self-defense. the man was taken to the hospital where he died just after midnight. we have very little information about this. i will tell you one thing. it's an interesting incident. when you come out here where a shooting happened, there would be police out here and crime scene tape. i have not seen nothing. we even talked to two neighbors

in this area. said he was sitting outside at that time and heard nothing. this is a very interesting situation. we will talk to more neighbors. and we will stay in contact with san jose police. live in san jose i'm paul chambers. the city of berkeley has had enough of occupy protestors at civic center park. calling the situation unacceptable. the city is threatening more arrests and citations. police point to an increase in violent crimes, disorderly conduct, and unsanitary conditions. berkeley is considering issuing stay away orders to repeat offenders. another occupy camp has been dismantled by oakland police. this one on lake merit. half a dozen protestors set up a small vessel they called

aquapy lake merit. oakland's municipal code prohibits private boats on the lake without permission. >> if anyone approached us about what our options were earlier and told us the cops were beginning to come we -- were coming we would have been a little more cooperative. for occupy protestors their resentment toward oakland mayor jean quan came to a head last night. >> brutalizer. >> demonstrators heckled and shouted her down during a forrum in san francisco. mayor quan became the target for audience members and fellow panelists. they are angry how she and oakland police handled the camp and port shut downs.

distinguish themselves from the rest of the pack. overnight firefighters in san leandro are investigating a fire. firefighters say they were called after smoke was seen coming from the building. investigators believe the fire started in the kitchen of a second floor apartment unit. everyone was able to make it out of the building. >> person reported an incident online. knocked the fire down relatively quick. >> it was a tax business on the first floor of the building but it wasn't damaged. the people on the second floor of the building were able to return home. barry bonds will be back in a san francisco courtroom to find out if he will be spending time in prison. ly be sentenced -- he will be sentenced on one count of

junior. he's the little boy that was shot in the head. he was taken off life support last week. police still have not made any arrests in that shooting. three people are under arrest in connection with a stabbing at the mall. that happened yesterday afternoon. daly city police said it started with a fistfight between a group of people. one man was stabbed several times. his injuries are not life threatening. volunteers at san francisco glide memorial church are up this morning to fill grocery bags for people in need. 5500 bags will be given away in a few hours. the bags will be filled with things to make a good holiday meal. volunteers will fill those bags at 6:00 this morning. they will be given away between 7:30 this morning and 12:30 this afternoon. 4:37 is the typewrite --

right now. i want to check in with sal. >> hopefully we will have friday light out there for you. let's see what we have with the morning commute on 80 it looks pretty good as you drive out to the mccarthur maze. it's a nice looking drive. and it's light. there are no problems. i think a lot of people like to go this time because even if there is road work and there was some overnight it doesn't effect traffic that much. in the south bay we are off to a nice start. this is downtown san jose. see traffic is moving along nicely heading up to highway 17 southbound 280 they have three cars with bright headlights coming down. now let's go to steve. >> just three? >> yeah. we had our rain yesterday. that looks like it could be it for awhile. the ten-day outlook is very, very dry. unless there is a little hiccup our forecast models have been

nipping on the eggnog it looks really dry. we will see wind events. this is a month we are getting more wind and sun than any rain and clouds. and it looks like the lows will stay cold. the days will be mild. in fact, maybe if the forecast models are great toward the end of the month we could be flirting with record highs. if you are looking for rain you don't have much. see it all the way down there. we get a north, northeast wind. so far it's in the higher elevations and out to the valley. i think the breeze will kick in here for awhile. if not it's 50-degrees out in fairfield. 30s and 40s redwood city 36. livermore has a southeast i think. san jose calm at 39. our system in southern california will sit down there and hang out. as it does it will get that north, northeast wind. cold mornings and sunny. windy in the hills and valley. i think everybody gets in on the breeze.

good morning. some locations are breezy to windy. others calm. we have 30,40, to 50s on lows. new this morning russia stopped a shipment of radio active metal being smuggled into iran. radiation alert went off at a moscow airport. they found 18 pieces of metal hidden in a passengers luggage. it contained radio active ice sew taupes. gauges show radiation levels were 20-times higher than

normal. the work to reopen a southern california freeway after that big tanker truck fire is facing another delay. take a look at that. crews have began dismantling parts. originally the freeway was supposed to reopen by this afternoon but workers had to stop the demolition after finding potentially hazardous phone wires. at & t is working to find a solution. for now the freeway will remain closed indefinitely. cal osha is investigating the death of a maintenance worker killed if a workplace accident. investigators say the man was working under a bus yesterday when it rolled off the concrete risers and killed him. late last night he was is identified at walter of costello. >> failure on whatever the bus was on was mechanical failure is part of the bus. that's where we try to

determine how this accident occurred. >> now the maintenance yard is just off caesar chavez street. the woman charged in a hit and run accident that left a bay area firefighter injured is back in court today. tim da is the girl friend of suspected driver eduardo. she's accused of trying to cover up the accident. prosecutors say he can heard on the surveillance tape saying he's going to run over the firefighter. bartell remains hospitalized in critical condition. the hearing of defensive marriage act is set to begin. in weight karen and her female partner were married in san francisco. galinski wants to add her partner to her health insurance but has been denied. the defensive marriage act

forbids the government from recognizing same sex marriage. now the case goes if a u.s. district court. representatives from the obama administration are expected to attend in support of the couple. states new hearing on the lethal injection. the judge says alternative procedures were not given proper consideration. today's hearing will examine that ruling. a federal judge is also considering a separate legal challenge. in election news this morning. the republican presidential candidate made one last pitch for votes in their last debate before the upcoming iowa caucuses on january 3rd. >> i have something different to offer. i emphasize civil liberties. >> i'm going to fix this countries trust deficit. because we are too good as people to be in the hole we're in. we deserve better.

its nuclear power plant is in stable condition called cold shut down. the plant is no longer leaking substantial amounts of radiation. that is according to japan's prime minister. the facility was hit by the tsunami last month. that sent three reactors in meltdown. experts say the plant remains vulnerable to problems and it will take decades to decommission it. the first identifiable piece of debris japanese tsunami has washed up on the coast. two oceanographers that have been tracking the debris field says the float was pushed by the wind. it arrived earlier than under water items. some may take years to make landfall on the west coast because of shifting ocean currents. today is the day the online

truck operation tour is covering four puncture wounds. freeman was caused to the police station to raise a pickup truck. he says he was standing away from the truck when the police dog suddenly latched on to his arm. >> like somebody took my arm and put it in a vice and tied it up. expect this vice had teeth. >> police say a flashlight may have grabbed the dogs attention. the dog has been on the force for six years with no similar incidents. the dog behavior specialist has been called in for an evaluation. freeman opens to be back at work in the next week or two. 4:50 is the time right now. he's not quite santa claus. the unusual rescue of a teenager stuck in a chimney. how he wound up there in the first place. cars without drivers.

he's no santa. a stockton teenager had to be rescued after he got stuck in a chimney. firefighters were called to a home and could see 18-year-old george's feet sticking at the bottom of the chimney. the rest of his body was stuck. >> i would guess he had his hands on the edge and released into the chimney. thinking it would be a nice smooth transition into the house. >> firefighters actually had to break part of the chimney. they were able to get him safely out within 15 minutes. there is confusion how he ended up in the chimney. they say he was trying to sneak back in after missing curfew. they later said he was cleaning the chimney when he got stuck.

a bell ringer in san francisco is going for a world record. >> thank you, sir. merry christmas. >> he's trying to ring longer than 36 hours straight. soriano started ringing yesterday morning and still going strong. he hope to stay out there until 9:00 tonight. he's been ringing bells for the salvation army for nine years. he's one of 23 bell ringers across the country that are signing up for that challenge. oakland has an early holiday gift for drivers. the city is offering free parking for the next two saturdays in order to help boost local shopping. drivers will not have to feed the meters but they will have to obey by the time limits posted on the meters. the parking holidays will cost the city $125,000. but that will likely be absorbed, hopefully, by business revenues. google is move into the auto business with addresser

invention. driverless cars. the company just received a patent for two important components. one is a landing strip where the vehicle stops. the other receives precise data where the vehicle is and should go. technology experts say google will license the technology to auto makers but could be years before any driverless cars are actually for sale. our car could just take us to work. we could get extra sleep on the way. >> remember there was supposed to be flying cars by this time. when we were kids. well, they are not quite here yet. let's take a look at the commute now. traffic is moving along pretty well if you are driving north or southbound here on interstate 880. the traffic is moving along nicely. no major problems on 580 either. and speaking of mccarthur. mccarthur maze looks good. traffic is light.

southern california. seven-ten day outlook shows nothing for us. north wind at vacaville. north, northeast at concord. livermore has a little breeze. hence the temperature. if you get that wind it's mild, if not it's cold. 39 oakland. and 37 at san jose and hayward. it's a cold morning. the breeze sends temperatures up. you can see high pressure is built in. the low down in southern california will give them more rain. they are taking all our rain. very little fog if there is any fog. it's mainly a breeze event. cold morning 30s and 40s. windy at times up in the hills. it will be sunny. 50s to 60s. again all these highs forecast anything in the 60s. that's if you get the breeze. it will be dry. we'll take that into your weekend as well. the mornings will be cold.
