50s and low 60s. here is sal. good morning, traffic is moving pretty well if you are drying on highway 4. no major problems getting up to the willow pass grade. also interstate 80s good. in overnight news one man is dead after being shot by a san jose police officer. it happened in east san jose. ktvu paul chambers was the first reporter on the scene and has information on what led up to the shooting. paul. >> reporter: good morning, pam. there is several officers out here on the scene. we are not allowed to get more information from them. it's basically happening here on waiverly and endman here in east san jose. just before 11:30 several officers responded to an incident involving an adult man. the man displayed what they called threatening behavior. one officer shot the man in self-defense. that man was take ton the area hospital where he later died. once again back out here live there is several officers out

here. they say they will probably be out here for another hour or so. i tried to talk to the public information officer about it. the officers on the scene are not allowed to discuss this incident. we are at waiverly and endman. there is also the main truck out here. officers have been out here since 11:30. trying to figure out what went on. they gave us another address which is a half a mile away. eer not sure why that address was given to us initially. but of course we are on the proper scene right now. live in san jose i'm paul chambers ktvu channel 2 news. your time now 6:02. in about five hours from right now barry bonds will find out if he's going to prison. barry bonds will be sentenced on one count of obstruction of justice in connection with the steroids case. ktvu kraig debro is outside the federal courthouse in san francisco now. kraig. >> reporter: good morning,

dave. prosecutors want barry bonds to go to prison. defense attorneys are hoping to win an appeal. whatever the final outcome here today will be eight months this months since the case began. it will end here with the sentencing this morning. barry bonds was acquitted of obstruction of justice. federal sentencing guidelines call for a sentence of 15-21 months. bonds will not likely serve any sentence until the appeal is final. there are things that bonds could do/should do while his appeal is heard. >> the court of appeals will look more favorably on his case if he's already engaged with the community. he's done a fair amount of community service. the question is will he do any community service related to this. he's never admitted to steroid use. he can't go represent to the community about steroid use. on the other hand once the case

is done, he doesn't have any jeopardy. he's only worried about the hall of fame after this case. >> reporter: so far no baseball player admitted taking steroids had received the votes needed to get into the hall of fame. bonds' major league baseball all time hall of fame leader. bonds is accused of taking steroids to approve his power. anderson served more than a year in jail following that for refusing to testify against bonds. reporting live in san francisco kraig debro. >> make sure you stay right here with ktvu channel 2 and ktvu.com for continuing coverage. we will bring you the sentencing decision on barry bonds when it's announced later this morning. another occupy camp has been dismantlinged by oakland

police. this one was on lake merit. earlier protestors set up a vessel called aquapy lake merit. oakland's municipal code prohibits private boats on the lake without permission. protestors said they tried to get a permit for the boat but was denied. >> if anybody would have approached us about your options, we would have been a bit nor flexible -- bit more flexible. >> they have issued citations to three people for having unauthorized boats on lake merit. the city of oakland wants to make sure there are no more port shutdowns. $4million in economic activity was lost during this big protest on monday. city council members have fast tracked a new resolution allowing the city to use whatever lawful tools may be necessary to prevent future shutdowns. make sure if you want more information about that port

distributed here at glide at 7:30:00 a.m.. in about an hour and a half. volunteers are already hard at work here. they are boiling water here to make soup for the hard working volunteers. i can already smell the turkey here this morning. we are right where they are filling the bags. they are just getting organized as we speak. they will have several volunteers out here from different organizations as well as people in the community that would like to volunteer. i'm here with mike kim. this is the second year volunteering for the glide grocery bag give away. mike, tell me what you are giving out this morning. >> tons of good stuff. everything that makes a really good holiday dinner. we have obviously the turkey, we've got bread, corn, potatoes, pasta. all the good stuff. it's a good baggy. >> we shot video a little bit earlier if you can see that video of people lining up around the block starting at

see. this is highway 4 bay point area. we still see slow traffic here or some crowded conditions. for example on highway 4 we've seen slow traffic in some areas. and here as we follow traffic on the willow pass grade it looks pretty good. it's not really as bad as it normally is. certainly there are cars out there. just not as many. move along and take a look at the westbound bay bridge. when they turn the metering lights on today we will see the real test. if there is a big backup it will be there. we'll let you know about it. if not, you can tell that we are getting closer to christmas. what is it nine days left? steve, you know. any way, southbound 680 between concord and pleasant hill. the traffic is moving well this morning. you know sometimes i call steve on the weekend and say hey steve, how many cups of sugar. any way. refrigerator. santa is on his way. we do have a little bit of breeze for some. well it's windy in mount diablo. 60 miles an hour. i doubt anybody is watching. in other locations it's clear, calm, and cold. all the rain has moved down to southern california. 28-48 on the lows. any breeze? even 50s on the low. sunny and breezy. that is about it. lots of sunshine. 54-62 getting in the mild category. east at seven. that is at fair field. north wind at san jose. oakland was north at five. now it's calm. sfo still west at six. 35 at sfo. calm santa rosa. north 13 at vacaville. there are areas that get that breeze. fairfield has gone from 50, 42. to 37. 28 santa rosa.

30s and 40s all over the place. san jose colder than livermore. san rafael at 35. mill valley at 35. san carrless 37 -- san carlos 37 degrees. there is cold readings. yet if that breeze kicks in temperatures go up into the 40s and 50s. southern california will have to deal with that system. in southern california we only get patchy fog. a cold morning. 30s and 40s. a little windy at times. does not look like a howling wind event. thankfully. some of the higher elevations will have to deal with it. 50s and 60s here on temperatures yes santa rosa will go 61. that is all dependent on if the north wind continues. same out toward vacaville. the weekend will be quiet. the days will be sunny and mild to warm. >> wow. radio active material stopped at the airport. how the illegal shipment was

6:14. we have developing news from russia this morning. customs agents have stopped a shipment of radio active metal from being smuggled into iran.

a radiation alert went off at the airport in russia. that metal contained radio active isotopes. radiation levels 20 times higher than normal. in washington a man accused of trying to assassinate president obama is due in federal court today for a preliminary hearing. today's hearing will focus on the mental health of oscar ortega hernandez. people that know ortega hernandez said he had been weird and became obsessed with president obama. he drove by the white house last month and fired nine shots from his car. one of the shots cracked a window at the first families living quarters but did not break the bullet proof glass behind it. by the way the president was out of town at the time. in washington, d.c. this morning the house and senate are expected to okay a massive budget deal that will avert a

government shut down tonight. as ktvu alison burns reports although it is a trillion dollar agreement, it is taking a backseat to the fight over the payroll tax cut. allison. >> reporter: that is right. the house just came into session and we do expect votes today on the trillion dollar budget deal that will fund the government most of the government through most of next year. this deal cuts funding for the environmental protection agency, grants for local first responders, and president obama's race to the top program. that is barely making headlines as democrats and republicans remain at odds about how to extend a payroll tax cut and unemployment benefits that expire in two weeks. >> this congress cannot and should not leave for vocation -- for vacation until they have made sure that, that tax increase does not happen. >> the biggest sticking point

is how to cover the cost of the payroll tax cut. democrats are dropping their demand for a millionaires surtax and a temporary extension could be in the works. reporting live from washington, d.c. alison burns ktvu channel 2 news. new this morning we have the first pictures of two penn state administrators arriving in court for their preliminary hearing. former vice president gary schultz and athletic director tim curly are inside that court right now. they are charged with failing to report allegations of sex abuse and lying to the grand jury about the case. assistant football coach mike mccreery has taken the witness stand and has begun to testify. he reportedly witnessed jerry sandusky molesting a boy in the locker room showers and then says he reported the incident to the two administrators. >> today marks the third anniversary of an unsolved homicide in san rafael. family members and friends of

ashley will gather at the fourth street tavern for a candle light vigil. the 3-year-old single mother was found dead in the parking lot behind the tavern on the morning of december 16th, 2008. she was last seen alive the night before leaving the tavern with a man she met there. she was sexually assaulted and died of affixuation. there is a $50,000 reward for information leading to an arrest and conviction in that case. time now 6:18. police in oakland trying to identify a woman that was found along the waterfront who later died. now she was barely conscious when a security guard found her yesterday morning right near jack london square. she wasn't able to speak and did not have identification. she passed away a few hours later. police describe her as an african american woman between 30-40 years old. there were no signs of blunt trauma. 6:18 is the time.

sal is keeping an eye on what right now? >> well, we are looking at all the commutes. we want to show you the bay bridge toll plaza because they have switched the metering lights on. the crowd isn't that big. leads me to believe we might have friday light here for what is the last day of work for some people last day of school before the christmas holiday comes up. some people have two to three weeks off during this time of year. it's amazing how many things shut down during the christmas time period. let's take a look at northbound and southbound 880. don't worry not everyone has all of the days off next week. i'm still here. i will be working. traffic is moving along nicely here past the coliseum. and the morning commute on southbound 680 between concord and walnut creek that looks nice. westbound 24 looks good. at 6:19 let's go to steve. thank you. we have mostly clear skies. patchy fog. cold for some.

not too bad for others. anywhere from upper 20s to low 50s. the 50s if you get that north, northeast breeze. hasn't made it to the surface for most. 28 santa rosa. a lot of 30s here. you can tell there is not much of a breeze anywhere close to the ground of the surface. livermore has one. that's why they are 44. southern california will have to deal with that low. the rain we had yesterday is wrapping itself up. any travel plans to palm springs you might want to keep updated on the forecast. it will be sunny and windy at times and clear skies. 50s and 60s on the temperatures with your weekend always in view. very quiet and dry expect for cold mornings. sunny, mild, warm days. off and on occasionally north, northeast wind. this will likely be another online shopping day. this is the fourth annual free shipping day. nearly 2600 merchants offering

good morning. traffic on the bay bridge is crowded but not as bad as it normally is. we definitely have lighter than usual conditions for drivers getting from oakland to san francisco. your time now 6:24. a new delay this morning in the effort to reopen a major southern california freeway following a tanker truck fire this week. crews have been out there dismantling parts of the overpass. it was damaged by wednesday's big fire. highway 60 was supposed to reopen by this afternoon. the workers had to stop the demolition after finding potentially hazardous phone wires. at & t has been alerted. they are trying to find a solution. for now the freeway remains closed indefinitely. a cal trans worker that was fired last month is appealing that decision and it's not the

first time. last month dwayne wiles was fired from cal tran accused of falsifying structural integrity test reports. he's now appealing his fire. in 1998 that very same board reinstated wiles after he was fired for misusing his state credit card and cell phone. santa cruz native chris rene has sung his way into the finals of x factor. [ music ] last night rene learned that viewers voted him through to compete for the $5 million grand prize. we were with rene supporters that say his story which includes a past addiction to drugs is inspiring. >> i got 80 days today clean. i will put his songs on when i'm feeling down. >> rene's sister also competed

welcome back to the ktvu channel 2 morning news. pretty exciting morning for san francisco based zynga. they are going public today. priced last night $10 a share. that is top of the reigns they were expecting. you play with online money. they are making real money today though. they are expected to raise a billion dollars with this ipo. so we're watching for that.

we'll see typically just to let you know when a company starts trading for the first time it takes a little while. especially when it's popular like this one. we'll let you know when it starlet -- starts trading. we'll smile and say good morning, to you. thank you for joining us. it's friday, december 16th i'm pam cook. >> good morning, i'm pam cook. time now is 6:30. we do have overnight news to tell you about. one man is dead after an officer involved shooting in san jose. it happened overnight on the east side of town. ktvu paul chambers was the first reporter on the scene. he is talking about what led up to the shooting. >> i spoke to the public information officer with san jose police and asked him about originally they gave us another location. about a half a mile away. he said that was a pure accident. as you can see behind me officers are on the scene. working the scene here. we have a little bit of information about this. san jose police say the

shooting happened in this area. waiverly avenue. just before 11:30 several officers tried to contact an adult man. that's when officers say a man displayed threatening behavior. one officer shot the man in self-defense. the man was taken to the hospital where he died just after midnight. now once again when i spoke with the public information officer he's waiting for investigators on the scene to report back to him and the chief to give them the latest about what is going on. of course when we have that information we'll bring that to you. investigators on the scene right now are not allowed to talk to us. that's why we have to wait to get that information from the public information officer and of course we'll bring that to you. not sure if the man had a weapon or anything like that. police could not talk about that. once we have that information we'll pass it along to you. live in san jose i'm paul chambers. very sad story. a public funeral service will be held for hiram lawrence

junior. he's the 23-month-old that was shot in the head outside of a west oak lands liquor store last month. he was taken off life support last week. the service begins at gospel church in oakland. police have not made any arrests in that shooting. three people are under arrest in connection with a stabbing. that happened yesterday afternoon. it all started with a fistfight between a group of people. one man was stabbed several times. his injuries though are not life threatening. time now 6:33. the city of berkeley reportedly has had enough of occupy protestors at civic center park. calling the situation unacceptable. the city is threatening more arrests and more citations. police reporting to an increase in violent crimes, disorderly conduct, and unsanitary conditions since the occupation started two months ago. the city of berkeley is considering issuing stay away orders to repeat offenders.

building in san francisco's mission district that was the once preppiesed new home of the city's occupy camp is being considered for something else. the san francisco examiner reports mayor ed lee is considering using the former phoenix high school building as work force housing for police officers, firefighters, and teachers. mayor lee spokesperson says the high cost of living prevents many police officers from living in the city. they could have a greater asset if they actually live in the community they serve. to get more information about past demonstrations plus a photo library of the occupy protest, go to our channel if website ktvu.com for continuing coverage. right now in washington, d.c. a congressional committee is taking a look at the european economic crisis. the house oversight and government reform committee is investigating what the economic problems in europe mean for

u.s. taxpayers and the american economy. again you can see going on live we just wanted to tell you about that. in just a few hours a hearing that challenges the defensive marriage act is set to begin. in 2008 karen galinski and her female partner were married in san francisco. she wants toed a her female -- she wants to saturday her female partner to her health insurance. but it forbids recognizing same marriage. a hearing on the states new lethal injection procedure is scheduled for today. yesterday a marin county judge issued a ruling rejecting the new procedure. now the judge says alternative procedures were not given proper consideration. today's hearing will examine that ruling. a federal judge is considering a separate legal challenge. 6:35. right now hundreds of people

are outside shivering in the cold by lined up at san francisco's glide memorial church. lorraine blanco is there as well where an annual food and grocery bag give away will start in an hour. >> reporter: good morning, dave. you know, they have been lining up out here in the tenderloin since 4:30 yesterday afternoon believe it or not. but as you can see, there are new barricades this year keeping the crowd in better control. they are expecting up to 6,000 people by the time distribution which is around 7:30 this morning. that is in about an hour. right now i'm with the founder of the amazing event reverend see sill williams. does it appear you how long the -- does it amaze you how long the lines are? >> yes. i think the central thing we found out there are poor people that are really in need in san francisco. and in the broader bay area.

you know. people are still poor. people are having difficulty trying to make ends meet. people are going through a lot of negative relationships and people are going through a lot of negative ways of doing things. people are suffering. severely. what we need to do is not only recognize that but doing in about it. this today is doing something about it. because we are passing out over 5,000 bags of groceries to people. we hope to continue to do this. >> now you have been doing this you have been helping for almost 50 years. what keeps you going? >> the people. the fact that i know jan knows, and the people that work here know that it is not easy to make sure that people are being healed. that people are having jobs. that people are finding their way. that people are being uplifted.

norrally is. let's move along and take a look at walnut creek and concord. highway four you know it's a different day when antioch they have a little bit of a slow down and not a big one. that is good. we're having a nice friday there. northbound 680 they are clearing debris from the freeway causing momentary delays. let's go to steve. sal, thank you, sir. a very happy friday. i was just looking mount diablo has gusts to 60 miles an hour. yet other areas calm and cold out there. the system we had yesterday has flown off to southern california. you can see a little component that offshore breeze kicking. that is your north, northeast wind. we don't get much with the daylight here. our system yesterday now might be it for the month. might i say. the seven, ten day outlooks are very, very dry.

everything goes into southern california. we get occasionally the wind and cold mornings. but any north, northeast wind is not favorable to fog. some patches though. only santa rosa and napa reporting anything. this afternoon looks mild to warm. if you can get enough of that in the sun, it's not too bad. again the angle of the sun is so low. we need a little bit of help from north, northeast breeze to get in the low 60s. clear skies. you can see that. as the system moves down and some of the areas drop into calm conditions, 28 santa rosa. fairfield two hours ago was 50. now they are 37. breeze still kicking up at livermore airport. san jose colder. hayward 35. san rafael at 35. so is mill valley. san carlos to 30. gilroy 33. there is a lot of 30s out there. high pressure large and in charge as we say. and it's not going anywhere any

store. today's funeral begins at 11:00 a.m.. oakland police removed an occupy protestors boat from lake merit. the protestors calling themselves aquapy lake merit set up camp earlier this week. three people were sited and later released. we have developing news from the penn state sex scandal. assistant football coach mike mccreery is on the witness stand right now. he says he truly believes he saw jerry sandusky sexually molest a boy in the locker room shower in 2002. now he's been describing in pretty graphic detail what he saw and says that boy looked about 10-12 years old. now this just in as well. mccreery just told -- just said he told former head coach joe paterno about what he saw and he also told two penn state

administrators. right now that's who he's testifying against. testifying against the two penn state administrators that are accused of failing to report the sex abuse allegations. we are continuing to monitor this case. baseball's all-time home run leader could end up behind bars. sentencing is scheduled this morning for barry bonds. kraig debro is outside the courthouse right now with the possibilities facing barry bonds. >> reporter: pam, the maximum sentence for conviction in this particular case is five years. but the court the federal courts work with sentencing guidelines which consider things like prior convictions. behind me later this morning is the federal courthouse where the sentencing will be handed down by judge susan. the guidelines she will be working with call for a sentence between 15-21 months. legal observers we have spoken with say it's unlikely barry bonds will be sentenced to 15 months. the prison term if any will likely be less than 15 months. in april a jury convicted barry

bonds of obstruction of justice. it began eight years ago this month. 11 people have been convicted. including olympian marion jones. bonds will never go to jail and the government shouldn't spend anymore money or time on this case. >> my opinion is tens of millions of dollars have been spent and i just think at some point enough is enough. there are better uses for those federal tax dollars. a lot of people going without heat and food and medical care. >> bonds' childhood friend greg anderson was also convicted. conte was sentenced to four months in jail for his part. jason was among a number of athletes that was testified. no matter what happens today
