complete bay area news coverage starts right now. this is ktvu channel 2 news at noon. >> former giants great barry bonds has just learned his fate in a san francisco courtroom. good afternoon, i am tori campbell. a san francisco judge has chosen probation over jail time for the home run king. barry bonds could have spent up to 21 months in prison for

giving missouri miss leading testimony but the sentence is stayed pending appeal. we that have the latest. >> reporter: barry bonds just left the courthouse, he waved to the crowd, that is the most emotion i have seen out of him. let's get right to what the judge handed down. he was sentenced to two years probation. he has also got a 30 day home detention. 250 hours of community service and a $4000 fine, all stayed, now he arrived in the courthouse around 10:30 this morning and walked right in, had family members with him and went directly upstairs to floor 19 and as a result in front of the judge, she gave away what she was going to do right away, she told us she had the recommendation from the probation people, the federal sentencing guidelines and the recommendation from the prosecutors, she said right away she was going to abide

merely by what the probation report suggested, joining me is william keene one of the things she said she report is not going to be released publicly. is that rare? >> no, it is not filed publicly, it is only goes to the parties, the judge and the bureau of prisons. i think what we saw today was no surprise given the judge's other prior sentences in the balco sentences including in the false statement of obstruction cases where she gave probation, i think everyone expected we would see probation today. under the sentencing guidelines she could have given him up to a minimum of 15 months prison but was within her desecration to sentence him to probation. >> on this charge he was convicted of the judge says i think the jury got it right but it didn't work, what did she mean by that. >> i think the judge is saying she thinks the jury got it right but my sense in listening to the judge when considering everything about his life and the dynamics about how the grand jury was working, she

didn't think it was the type of offense serious enough to warrant prison. the prosecutor was upset about those recommendations, he said barry bonds had lived a double life and everything he had done was and obstruction and his testimony during the grand jury testimony was exactly what he had been doing so he thought he should get the mitigating circumstances, should not have an effect. the prosecution was suggesting to the judge to look beyond the count of conviction to look at his life generally. they obviously think he was using performance enhancing drugs, commented on the personal aspects of life and hoping the judge would consider those things and he should be punished generally for a course of conduct that included misleading people about his drug use, on the other hand he was not convicted of that. >> do you think he knew the

judge was not going to consider that considering he wasn't convicted of any of that? why would he bring that up? >> once you are the government prosecutor, you know the sentence is going to go the way you don't want it to go, you still are going to make your case for the public, to the press to let everybody know the government thought he should have done prison time. the problem was against the backdrop of the other cases the judge was not giving that type of sentence to the others so it would have been surprise if she had done that today to mr. bonds. >> reporter: thank you very much. the defense has 10 days to file an appeal, which they plan to do, we will have a full report later today. kraig debro, ktvu channel 2 news. >> thank you. we are also awaiting word on sentencing this noontime for a suspected gang member convicted in the attempted murder of a fremont police officer. 21-year-old andrew barrientos could get 50 years to life in

prison at sentencing in oakland, prosecutors say last year he fired 10 shots and almost killed officer todd young, he was trying to take him into custody. officer young suffered nerve damage in one leg but is expected to return to the police force. they are investigating their 8th officer-involved shooting of the year. paul chambers explains why the neighborhood where the shooting happened has a tough reputation. >> reporter: police say this neighborhood is known for gang activity. last night two officers were on a department's gang suppression unit were patrolling the area when officers saw a man on the street. >> that male was walking down the street drinking what was believed to be an alcoholic beverage, which was a violation that would have given them

reason to contact him. they said he ran and they were threatened. they would not say if he used a weapon but did take two people from the home interest custody for questioning. >> we are trying to determine who that person was, but needless to say, the situation was hazardous, he fired one round. >> he was taken to the hospital and died. he may be linked to a gang. his relatives who lived in the home did not care to comment. this the 8th officer involved shooting of the year. paul chambers, ktvu channel 2 news. >> a man wounded in an exchange of gunfire with san francisco police officers wednesday afternoon has died. authorities have not released his name. they pulled him over and he got out of his car and ran off. as officers chased him he fired

at him and they fired back, hitting him. the officers were not injured. a funeral service is underway in oakland for a little boy who died from injuries he suffered during a street shooting. hiram lawrence , jr., was shot in the head during a shootout outside a liquor store last month. he was taken off last support last week. police still have not made any arrests in the shooting. the service is open to the public. it is taking place at acts full gospel church. hiram would have turned two on december 28th. the san francisco coroner's office has identified a man killed yesterday at a bus maintenance yard. walter patillo of san francisco was working under a bus when it rolled off risers and killed him. it is still unclear what caused the accident. cal osha is investigating. investigators are looking for the cause of a fire that did damage at an apartment

building. it broke out around 10:30 last night in an apartment building. investigators belief the fire started in a kitchen. firefighters were able to keep the flames from spreading from the second floor unit. no one was injured. the resident was not home at the time and is now displaced because fire officials say the apartment is no longer liveable. the latest occupy protest in oakland is now out of the water. at lake merit a half-dozen protesters had set up a small vessel on the lake and equalled it aqua-pie. late last night officers in a boat towed them ashore and cited them for violating the ordinance that prohibits boats on lake merit without a permit. time could be running out for protesters of the occupy berkeley encampment. they are threatening arrests and citations at the park after an increase in violent crimes

disorderly conduct and unsanitary conditions. berkeley is also considering issuing stay away orders to repeat offenders, so far no action has been taken. protesters heckled and shouted down oakland mayor jean kwan when she appeared there last night. they were upset over the way she and the police department handled the occupy protests. several hecklers were escorted from the building. >> i am out here peacefully protesting for a cause that i actually believe in and why am i being attacked by the police? >> they had a lot of demonstrations in the bay area whose main task seem to be to break windows in our city and vandalize buildings and/or to fight with the cops. >> some commonwealth club members said they are not fans of the mayor but they did feel badly about all of the

disruptions. go to ktvu.com for more on last night's commonwealth forum and the very latest on all of the occupy demonstrations. a penn state assistant football coach today testified in court that he saw retired coach jerry sandusky molesting a boy in a shower. mike mcqueary was testifying in a preliminary hearing for tim curly and gary schultz. those two are charged with lying to the grand jury about the abuse described by him. jerry sandusky says he is innocent of all charges. there is some good news this noontime. on the california job front the state's unemployment rate fell to 11.3%, that is the lowest rate in more than two years. according to the state employment development department, november's rate is down from 11.7%, the previous month. that is a gain of 6600 jobs. lars are arguing today in san francisco's federal court

over case challenging the federal defense of marriage act. a married lesbian couple filed suit, after one of them, who is an employee in the 9th circuit court of appeals was denied spousal benefits for her wife. the lawyers say that it is unconstitutional. the obama administration has filed briefs in support of the couple. a marin county judge was scheduled to hold a hearing this morning on her tentative ruling yesterday that put the state's new lethal injection procedure on hold. the judge could issue a permanent ruling as soon as today on the procedure. she said the state did not give enough consideration to alternative procedures. pg&e says it is stepping up its testing on its lines to see if more steps need to be taken to enhance their safety. later today a top pg&e executive will reveal their latest modernization and strength testing efforts on its natural gas transmission system. yesterday the state public utilities commission gave the

in russia today customs agents stopped a shipment of radioactive metal from being smug illed into iran, radiation alert went off at an airport and they found it in luggage. the metal contained radioactive isotaups, gauges recorded raid ration levels 20 times higher than normal. japan announced it's fukushima power plant is now in

tracker here. that rainmaker from yesterday now over southern california. a ridge of high pressure building in for the weekend. as it does it has helped to kick up winds. still gusty in some of our hills, mt. diablo reporting 60 mile per hour gusts, the rest anywhere from 25 to 30 miles per hour. we are breezy, right around fairfield and vacaville. a breeze santa rosa, calm right now, sfo, calm conditions in san jose. these winds have actually made a pronounced impact in some areas around the north bay. i am going to show you that in just a moment. again if we get in a little bit closer you can see through the delta, fairfield reporting 20 miles per hour, the gusts to 25. we will continue to weaken throughout the afternoon but has made a difference in some spots, santa rosa 65 right now. looking at upper 60s in time for the second half of the afternoon. 68 will be a record tie or breaker. so we will see if we actually hit that, looking at about 67 for santa rosa, 61 fairfield, 61 napa, so where we do have
