bonds to prison. she followed sentencing guidelines that gave bonds two years probation, 30 days of home detention, 250 hours of community service and a $140,000 fine. perela called the sentence a slap on the wrist and almost laughable. >> this is the end of that for him at least until the end of the ordeal. i think you saw some of that frustration come out. >> reporter: that's expected to take 17 months. >> at the moment he's branded a felon, we think unjustly. just like we fought the case on trial, we intend to fight it on appeal. >> reporter: bonds failed to comment on the sentencing. what prosecutors said in court that brought a sharp rebuke by the judge and laughter and applause in the courtroom.

for now reporting live in the courtroom, david stevenson, ktvu channel 2 news. while barry bonds didn't get any jail time, other high profile people involved in similar cases did receive similar sentencing. mairon jones was also involved in the balco scandal. she was convicted of lying, she received six months in jail. martha stewart was accused of lying in a stock sale, she served five months in prison and home confinement. and scooter libby was sentenced to 30 months in prison and fined $250,000. his sentence was commuted by then president george w. bush voiding the prison term. one legal analyst says the bond sentence is not unusual with one exception. >> the only surprise that was consistent was that mr. bonds

the utility as a systems analyst. some employees locked themselves in offices and barricaded the doors with office equipment. others hid under desks before officers escorted them out of the building. at this hour police are investigating an officer involved shooting in san jose that left a man dead early this morning. ktvu's robert handa is live at police headquarters where new information is now coming in, robert. >> reporter: just about an hour ago, an investigation was launched by an internal affairs department after a complaint was filed by someone concerned about the very unusual officer involved shooting last night. according to police, a special unit of officers who monitor gang activity started off questioning a young man around 11:30 last night who was carrying an open container of beer and police began chasing him. police say when officers caught up to him inside he called a handgun from his waistband and

tossed it into a bedroom. >> there was an individual clearly in that building, the officer gave him demand to drop the gun. the suspect pointed it at the officer and the officer shot one time. >> reporter: the 47-year-old shooting victim died at the hospital this morning. the 38-year-old man who was initially stopped is now in custody. family and friends refused to comment. but a -- >> our job is to audit the investigation. by that we mean we will determine if the investigation was fair and thorough. >> it's really to make sure that we did due diligence at a time of tragedy. both the officer, the victim

and their families are owed that. >> reporter: now just a few minutes ago here at police headquarters they released the name of the person shot in this case. 47-year-old valente galindo a man they say has an extensive report. robert handa, ktvu channel 2 news. a pennsylvania judge today ruled there is enough evidence to send two former penn state officials to trial for perjury in connection with the university's child sex abuse scandal. the judge ruled the prosecutors had proved probable cause against former penn state vice president gary schultz and tim curley. they are accused of lying to a grand jury and are not properly reporting a properly assault allegation against jerry sandusky. >> perjury cannot just be one person's word against anothers. >> reporter: penn state assistant football coach mike

the east side memorial building in japan house to remember the japanese who suffered here when they were put in interment camps following the attack in pearl harbor. this demonstration is just parts of what they are calling the demonstrations they are holding on financial friday. reporting live from downtown san jose, janine de la vega, ktvu channel 2 news. a group of oakland protesters occupy protesters was back out today at a familiar spot. a group of about 20 protesters showed up outside city hall at frank ogawa plaza. so did police. some protesters threw things, some even tried to pitch a tent but the officers took it down. there were no reports of any arrests but some protesters received citations from the police. oakland mayor jean quan responded today to the commonwealth club in san francisco. >> she brutalized our citizens. >> she brutalizes our citizens. >> like oscar grant. >> like oscar grant. >> reporter: we first showed

you these pictures of the scene at the meeting last night on the 10:00 news. protesters heckled and shouted down mayor quan, they are upset over the way she and oakland police handled the occupy protest. we spoke with mayor quan today about last night's disturbance. >> i think it's interesting that they take no responsibility of all the violence that took place. i think that movement can't grow that way. >> reporter: mayor quan talked about shutting down two of her facebook pages. she said it was hard to manage all three of her pages and determined it was better to manage just one of the pages. there has been a flurry of activity on capitol hill as congress looks to extend payroll tax for working americans and to try to avert a government shutdown. looks like a deal may have been

struck within the last hour. scott macfarland is live with the update. >> reporter: leaders are wondering if it's just a signage of breaking government. the house has passed it but look at it. it was just approved this morning and it's more than 1,000 pages long. we found corrections, scribbled in the margin. language penciled in at the last minute. >> the brink is always too far to the right. >> reporter: this time the government came just 10 hours from shutting down. thousands of federal workers had already been notified they might have to go without paychecks this christmas. this is not the first, second but third shutdown avoided in year. >> when something like that happens and you look and no one is coming in for a month, it gets your attention. there's no question about it. >> reporter: but what took so long to get the deal to fund

the government this time? huge but predictable battles over taxes, over how much to spend on schools, homeland security, border patrol, over to include more job growth. even a bill on lightbulbs in your house. >> here's the latest. late this morning the u.s. house approved this bill to fund the government and avert a government shutdown. the senate will likely do so tomorrow morning and extend that payroll taxes and extend taxes as well. a lot of movement just before the christmas holiday here in washington.

scott macfarland. the unemployment department reported california added 6,600 jobs in december. the federal unemployment rate came in at 8.6%. bay area zynga made its wall street debut today. the social network game developer rang the opening bell on the nasdaq this morning from its san francisco headquarters. zynga makes farmville and mafia wars which are found on facebook. the price started at $10 a share and quickly went south. sales closed down by 9%. an early rally fizzled leaving the dow slightly lower. the nasdaq did gain some ground. the dow was down more than two points, the nasdaq was up 14 points. a letter went out to

now turning to some developing news, we're getting word that l.a. lakers basketball kobe bryant is getting divorced. you may recall he was in the middle of a media frenzy when allegations were made several years ago that he sexually assaulted a woman while

straying in a colorado resort. a representative for the couple released a statement saying quote, the bryants have resolved all differences concern their divorce. the couples have two daughters aged eight and five. funeral services were held today for an oakland toddler caught in the cross fire in oakland. jade hernandez is live with the message that was sent loud and clear at the service. >> reporter: the family put together this funeral program, hirum's picture graces every page. meanwhile those responsible for his death are still out on the loose. forces led a carriage carrying the body of lawrence jr. to a church in east oakland. the service gathered hundreds of mourners including this man. he sympathized with the family.

>> very hurt and it's going to hurt for a long time. i don't know if we can ever get through it. >> reporter: talking to the mother, the father, uncles everybody, they just don't want any more violence. they want the violence to stop now. the toddler was one of four people to be hurt in the cross fire. hirum and his father was watching the making of a music video. the toddler was the only one to die. officials say there has been no change in the case and still have made no arrests. during the nearly three hour funeral service this morning, more than 20 people got up and spoke to the family offering words of encouragement. and the message to the community. >> he is at peace, know that. we have to use these gifts that we have and that's love and compassion and we shouldn't always have to use them for a funeral. >> reporter: the mayor defended her strategy to keep the city safe. >> i think it takes a mother

barbituate was superior to the two drug system. they found the process was flawed. law enforcement officers from the bay are stepping up patrols beginning tonight to try to make sure that everyone on the road is sober as the unofficial holiday party season begins. the chp, police and deputies will be setting up dui checkpoints throughout the area. officers are reminding drivers to plan for safe rides home or to volunteer to be a designated sober driver for other partygoers. if you are going to the oakland raiders game, you will want to make sure you have a safe drive home. alameda county plans to dispatch a 25 officer dui strike team right near the coliseum at about 3:00 in the afternoon. speaking of driving, more people are expected to travel this christmas compared to last year and most of them will do it by car. here's a live picture of interstate 80 in emeryville and traffic is really heavy right

now. this time of day as usual, aaa estimates that almost 92 million people will travel more than 50 miles from home between december 23rd and january 2nd. 83.6million are expected to travel by car. if the numbers are correct that will be a 1.4% increase from last year and the second highest increase in the past decade. if you're headed up to the sierra for the coming week into christmas, the forecast shows mostly clear weather for the next seven days. bill is going to talk to us more about that in a minute. but first to the roadways, here is a live look at the roadways at truckee. looks pretty good. i just checked the caltrans website and it says there are no delays on the roads. >> it definitely warmed up today. it started off cold. you probably had frost in the morning. a little bit of patchy fog but not much. the fog comes back tonight. it's going to be really chilly, down to 29 degrees perhaps down in the north bay. one of the things i'm noticing

here are wind directions. these are live buoy readings. you have a west-southwest wind at 13 miles per hour gusting to 17. so why is that significant. here's west-southwest. this is the direction, it's coming off the water and it's up over 10 miles per hour. what that's doing is it's keeping temperatures on the mild side. the other day we had numbers in the 40s up by san francisco and oakland. this westerly wind keeps things a little bit warmer and there are the current temperatures right now. so santa rosa 58 degrees. two nights ago at this time, santa rosa was about 46 degrees. so temperatures are running a good five to 10 degrees warmer at this time. that's mostly because the westerly flow that developed. as we go through tonight. things are really going to cool off rapidly. high pressure sets up, the air pressure sinks. almost could be a spare the air night. the environment is such, that the air is going to really settle down. overnight lows in those inland

bay valleys. 32 in napa, maybe some patchy valley fog but there's a little bit of a north-west wind blowing so that will keep the fog from being a big issue. what you will notice is you're going to find that patchy frost. the frost can be a problem especially vallejo, napa. it's not just ice on roadways, it's to get up and the windshield wipers are stuck on the wind shield. the layer of frost, and when you're getting ready in the morning there's that little extra frost on the car. upper 30s, so you know cool. then sunny and cool around lunchtime, 57 degrees, another broad brush. mild in the afternoon up to 56 degrees. that's your saturday forecast. as we head into sunday, conditions change just a little bit. we will talk about that and we will talk about the chance of rain in the forecast as it would be snow in the mountains. we're up to the point now that it will be nice and it's important that we will begin to see rain in the area. when we come back we will go

sanford university is taking back its bid to build a new science and engineering campus in new york city. officials say after several weeks of negotiations they decided it was not in the university's best of interest to continue with the project to make new york the new center for technology. the university says it still plans to move forward in it's partnership with the city university in new york. the city took a step to reduce emissions from toxic agents. republicans are against it, argues it will push energy prices up and cost jobs.

but democrats agree with the epa and say it will save lives. >> all of these things cause cancer, all of these things are dangerous to all of us particularly to the children. particularly to pregnant women. >> the epa estimate it is new rules will save as much as $1.5 billion in health care costs in california alone within the first few years of being implemented. there is a chance however the new rules will become a bargaining chip in the debate over a payroll tax cut. republicans attached a provision rolling back epa limits on emissions to a bill to extend the payroll tax cut and unemployment benefits. if it's passed the new emission rules will take effect in 2015. there's a change in the law that will change the lightbulbs you use. the law sets new energy saving standards for lightbulbs it'll now go into effect in october. gop lawmakers say they are just

trying to head off more government interference in people's lives. environmentalists and the lightbulb industry say the move is short sided. you can say the vatican is always in the christmas spirit but today it added some holiday cheer. it now has an 80-foot tall christmas tree in st. peters square. it's from the carpatian mountains. the late pope john paul ii began the tradition of erecting a tall christmas tree in the square. pope benedict has continued it. we talked to baseball fans across the bay area who weigh in on whether barry bonds' punishment fit his crime. the america's cup, i'll tell you why activists say it might not be such a go after all. there's serious flaws in an environmental report. he is a pay area sports legend but he has an uneasy relationship with fans even before the balco controversy. it's been five years since bonds' was indicted for steroids use. now he's facing what some call a slap in the wrist. two years probation, 250 hours of community service and a $4,000 fine. all of that is on hold while he appeals his conviction.

ktvu's patti lee is joining us with what people are saying. >> reporter: we're at a training camp, you can see teens are engaging in batting practice for the night. the sport of baseball is revered here, and today coaches, players and fans debated the lessons learned from barry bonds. >> reporter: here's the 2-1 pitch. bonds is as high as. >> reporter: whether barry bonds leaves the legacy of a legend. >> i'm a huge bonds fan. >> reporter: or a liar is still up in the air. >> i don't think he was innocent but like i said before, he was just being made an example of. >> reporter: for martha freeman and gigi almazen the punishment fit the crime. >> other players out there i'm sure have been in his position as well and got away with things, so. >> reporter: at the clubhouse training school in south san francisco, baseball fans debated whether bonds deserved to be tried as a criminal at all, after prosecutors failed to prove him guilty of taking

performance enhancing drugs. >> to me it was a waste of a lot of money, for a lot of years and i think it was someone that wanted to bring a player with a big name down. >> reporter: bay area native price kendell who now plays professional baseball in canada says bonds' legacy should be about home run records. >> to me just what he exemplified on the field just as a player was amazing, he could do it all especially early on in his career. >> reporter: instead, the would be hall of famer has become an example of what could happen if you're everyone suspected of taking drugs. and a cautionary tale about telling the truth. most everyone we talked to today called themselves a fan of barry bonds as a player, even if they didn't particularly like him as a person. they said you can't be a bay area person and not appreciate

his accusement. even if those sentiments are not appreciated by fans in other states. we asked what you think of barry bonds' sentence today. jennifer dion richards said, it was a waste of taxpayer money. if you really wanted to punishment, a month in mansion ain't going to do it. our coverage of barry bonds' sentencing continuing on ktvu. go to ktvu, you can also tell us if you think he should have been sentenced to prison or not. authorities have now put a price tag on a sassoon city girl's false report that she had been abducted. police say they spend more than $30,000 trying to find cristina almanza after she texted a relative she was being held against her will. officers later found almanza safe at a home in vallejo. the $30,000 included the cost of personnel and equipment used

in the search. almanz a has been charged with filing a false abduction report. karen laginski works for the court of appeals, the federal government denied her spousal filing. a lawyer joined with their attorney in arguing that that is unconstitutional. a day after the republican iowa debate, michelle bachmann made her way across the state by bus. the minnesota representative is lagging in the polls. she stopped at a family restaurant where she told supporters she's the only candidate that can take on barack obama. >> they launched barack obama, now we can connect that misjudgment and we can put into place the candidate that's going to take out barack obama as the next president of the united states.

>> reporter: the iowa caucus is scheduled for tuesday january 3rd. romney also toured the city. the governor also campaigned in greensville south carolina where he gained an endorsement from governor nikki haley. romney is the second favorite candidate after newt gingrich. ktvu has learned construction could begin as early as monday to prepare for the america's cup competition in san francisco. this is where the construction would begin at pier 27. that is north of the bay bridge and across the street from the fog city diner. we want to show you a map where pier 27 is near fisherman's wharf. but there is some controversy over the project. john fowler is live in the city with details on some of the environmental concerns, john. >> reporter: we've discovered several unresolved problems

with this environmental report even though the mayor today declared full steam ahead for america's cup. with the first race just eight months away, swimmers said they will shut down the bay. >> potential dredging of toxic sediments that have been in the bay for many many years that will affect people who swim here every day. >> reporter: just as the mayor celebrated its passage -- >> this event is moving forward. the cruise ship terminal is going to move forward, a billion dollars of economic impact is going to move forward. >> reporter: hold on activists say the eir is inadequate that no one has considered the effect of massive crowds in neighborhoods. that's 10s of millions short of what's needed and that dilapidated pier, still no plans to fix it.

some holiday shoppers in oakland will have one fewer thing to worry about, the city is offering free parking for the next two saturdays. it's an effort to attract more shoppers. drivers won't have to feed the meter but they will have to stick to the parking enforcement. cyclists enthusiasts celebrated the installation of 18 miles of new bike lines. oakland city officials along with the east bay bicycle coalition met at broadway and webster street today to outline the location of the new bike lines and hundreds of new bike racks throughout the city. >> i'm all for more bike lanes. it's helped send a signal to car drivers that cyclists are

there sharing the road. >> reporter: oakland major jean quan says making oakland more bicycle friendly will not only cut down on greenhouse gases but will attract a younger work force who are more likely to bike to and from work. palo alto oak tree that's more than 100 years old is going to have to be cut down. that's a ruling from an independent arborist hiring by the city. people have named it george. the consul at consultant says that george does not have an adequately have a root structure. scientists at the university of san francisco have discovered the cause of a neurological disorder. it causes epilepsy in baby and movement disorder in older children. they laced the disorder to a mysterious gene in the brain.

valley. don't worry so much about the fog but there will be plenty of frost. we're looking for things to be a little bit cooler around here. 70degrees, 71 degrees in santa rosa. highs tomorrow are going to be more likely in the low 60s for most of us. this low pressure center sets up north. it will continue to keep us dry but it's going to give us those cold overnight lows. you're looking at 61 in napa, 60 in fairfield, 61 in concord and 60 in vallejo. so those are down but still a nice day as you head to the southern part of the map, what you're going to see down there are temperatures still on the mild side. 61 in san jose, 61 in morganhill and 61 in gilroy. your five day forecast with your bay area weekend in view looks just like this. what you're going so see is plenty of sunshine. clouds move in but none of the rain that we need around here. we're looking at dry conditions and just more of the same. i think the real weather headline here is it gets cold in the morning hours and that
