4,000-dollar fine and serve 250 hours of community service. tonight alex is live on union street in san francisco where he has been asking people about bond's legacy. >> reporter: the giants fans we talked to here at the bus stop sports bar in san francisco were glad to hear bonds wasn't given prison time. a lot of the people we talked to looking ahead to the future are hopeful this trial and the steriod scandal won't over shadow his career. sentencing day for the home run king gave giants fans a chance to reflect on what barry bonds means to baseball. >> i think he is going to always have that mark against him that he did steriods and i think that's not a good thing. >> reporter: charles has been a giants fan since he moved here 35 years ago. he said bonds was a special player but made mistakes. >> his legacy has been diminished.

away but eventually will be voted into the hall of fame. we are live in san francisco, alex savage. > today's sentencing decision angered prosecutors one calling it laughable. in court this morning the lead prosecutor pushed to send bonds to prison. he called the former slugger as showing no remorse and asked for the judge to send a message but the judge opted to follow sentencing guidelines meaning bonds wouldn't spend time in jail. the prosecutor called it a slap on the wrist. >> reporter: he has been on the case for seven years this is the end of that for him. at least -- until the appeal and so i think you felt that emotion, the frustration. >> the next step in this case is the appeal of the obstruction of justice conviction by bond's legal team. that will take more than a year. our coverage continues at ktvu.com. lue find the reporting on the

the utility company including the gunman. the ceo called it one of the most horrible days in the company's history. reports indicate the gunman may have targeted two managers. there is no official word on motive or the gunman's name. the two wounded people are in critical condition. police on the peninsula say officers have taken seven pounds of marijuana during raids on indoor growing operations. one of the places raided is in daily city. this photograph is from inside. three people were arrested during the sweep and are due in court next month. police say the raids targeted an asian network they had been watching for months. the plants take are valued at a quarter million dollars. one part -- political protest. california's ban on same sex

a report done in june by nasa indicate itself would be less expensive to restore historic hanger one than to demolish it. they think it'll cost about $40 million to replace the panels tearing down would cost $44 million. if additional improvements are made it would then cost slightly more than demolition. crew reasonable demolition. the occupy movement remains a pesky one for the city of oakland. more than a dozen protesters returned to the plaza today. their protest didn't last long as police officers moved in. at least two people were arrested and several received citations. police took a table, chairs, blankets, sleeping bags and other items. those cited said the officers also took issue with the protesters having umbrellas in the park. >> i suspect there is some irritation about the action on monday and the closing of the port and this is some kind of

attempt to kind of pay back or make it harder for us. >> reporter: some of them did try to set up a tent but it was removed. a small but loud group of demonstrators went carrolling today in san jose. they went to various banks singing frosty the poor man instead of snowman. they then went to the east bay memorial building in japan town to protest the passing of the national theorization act of 2012. a complaint has prompted an independent investigation into a police shooting late last night. the shooting happened at a home in east san jose and left one man dead and another in jail. robert honda reports on what police say prompted the shooting. >> reporter: police say a unit of officers specializing in gang suppression stopped a 24- year-old at around 11:3 for carry an open container of

beer. he ran into an house and when officers caught him he pulled a gun and threw it into a bedroom where another man picked it up. >> he was told to drop the gun and the individual pointed it at them and the officer did what he needed to do. >> reporter: he died at the hospital early this morning from a single gun shot wound. police say he has a criminal history including incidents of resisting arrest, assault and battery and domestic violence. late this afternoon someone filed a complaint that triggered action by the police auditor and the police internal affairs department. >> we determined if the investigation conducted by internal affairs was fair, and objective. >> reporter: the incident is the 8th officer involved shooting year, the third highest since 1996. a local police watch dog group said that trend needs to be looked at. >> it's about not only the

tragedy but the wake of distrust that happens in the community. >> reporter: officials say police investigations could take months to wrap up. the officer involved has been identified as a 9 year veteran. in san jose. >> deputies say a man is in the hospital in an incident involving a taser. it started about 5:30 this evening in santa rosa. deputies say they spotted a man walk agriculture long santa rosa avenue who they say ran through photograph across the road. deputies stopped and tried to subdue him. they then tried to taser him. >> they deployed a taser and i'm not sure -- if it was effective or if they hit him. after that point a passing car is coming by as he jumped out in front of the car and he was hit. >> reporter: the man is reported in critical condition. his name has not been made

death penalty. a judge threw out the new lethel injection procedure saying the state didn't give proper consideration to another method. we explain the decision and how it could affect future executions. >> reporter: prisoners doing time on death row bought a little more time before any of them may see the inside of the new death chamber. the clock stopped today, right here in marin court division e. the judge struck down the state's adopted procedure. >> if the department of corrections had done this right the first time we wouldn't be here. >> reporter: the judge's ruling said in part that the department of corrections didn't give enough consideration to an alternative to the cocktail. two states use a one drug injection. >> the three drug protocol creates a risk that the inmate will be suffering a lot of pain

from the third drug but unable to express that pain because the second drug is paralyzing. >> they are talking about whether there is potential pain in the last ten minutes of a remorseless killer's life. i don't understand why anybody cares. >> reporter: victims rights activist mark klass said he never thought about the death penalty until his daughter was murdered. >> i can't look at pictures much. >> reporter: she is frozen in time forever daddy's little girl. she would be 30 now, her killer still on death row. >> no, he will not be executed, he may out live me. >> reporter: this ruling effectively delays any executions from taking place for a year. the department had no comment. reporting outside the state prison. >> on our facebook wall we asked about the death penalty.

josh whichs i support it, the only problem is it takes to long for the prosecute process to go through. one appeal only. david comments i think the death penalty should be abolished. it's not a deterrent to crime and sends a wrong message that killing okay under certain circumstances. san francisco online game maker zynga's ipo was a bits of a dud. the stock was priced at ten dollars a share but closed at 9:50 and then lost another ten cents after that. this morning they rang the opening bell from its headquarters south of market. analysts say a variety of factors contributed to the poor debut including a weak business model. they make words with friends, farmville and other popular games. on wall street stocks came out of the gate strong but the

rally fizzled. the dow dropped two points, the nasdaq boosted and gained 14. a medical marijuana club near sacramento made an unusual gesture today. it gave away marijuana. the shop is going out of business. it's one of several clinics around the state closing after the federal government cracks down in october. more than 100 people lined up to receive the parting gift of one gram of marijuana. members say it provides much needed relief from their ailments. >> very been opened up and this is works for me. >> they offered discounts on larger quantitiys along with food for those who showed up. >> a single mother here is asking big corporations to have a heart.

months ago and wasn't able to pay the rent. 1350 which is due on december 1st. she told us she received this notice yesterday. >> your file will go to the attorney on tuesday december 20th. >> reporter: she said she told management she wouldn't be -- would be able to pay by the end of the month. she found a job two days ago. >> how can you put a single mother out? >> reporter: the on site property manager said the company is forcing her to start the eviction process next tuesday even though this is the first time she is late on rent. the regional managere mailed this response, we certainly care about our residents however as mentioned we are obligated to enforce the language of the lease. >> they need to take a second look. there are good people among them. take a second look. >> reporter: she said she is fortunate her new employer

restaurant this past monday. police say they arrested a 25- year-old of oakland. he has not been charged and police are looking for a second suspect in the shooting. the victim is a 23-year-old sacramento man and he is expected to survive. the 23-month-old victim of a shoot out in west oakland last month was laid to rest today. jade hernandez tells you how the community hopes his death will serve as a catalyst to stop violence. >> reporter: horses led a carriage holding the body of hiran lawrence junior to a church. hundreds of mourners came. >> very hurt, going to hurt for a long time. i don't know if you ever get over it. talking to the mother and father. uncles they don't want no more violence. they want it to stop. >> reporter: the child was one of seven hurt when shooters opened fire on this parking lot along 7th and willow.

she signed the papers on december 1st but the news didn't leak until late today. in the filing she asked for joint custody of their two daughters. the couple married in 2001 when she was only 18 years old. in 2003 bryant was charged with sexual assault. the lakers star admitted adultery. britney spears is engaged. they met five-years ago. spears hinted at the big news on twitter saying jason surprised her with a one gift she has been waiting for this will be her third marriage. not yet say some. the challenge launched today today as officials celebrate major progress toward hosting the america's cup. and bill is tracking more chilly weather for the weekend.

. the america's cup race is just eight months away and san francisco says is needs to start getting ready. sources say this is where the construction could start as early as monday. a key part of san francisco's waterfront that will be redone for the big race. john fowler says some environmentists are saying not so fast. >> reporter: with the first race just eight months away activists threaten to occupy the bay. they say they will shut it down over failures to address concerns. > dredging of toxic saidments. >> reporter: the group and three others appealed last night's planning commission approval of the america's cup impact report. just as the mayor celebrated its passing.

>> a community meeting is set for tomorrow after last week's incident where a cannon ball hit a house. the stunt was part of myth busters. the ball was fired at the bomb range and was supposed to go through barrels of water, a wall and hit the dirt hills. it went way off course and ended up in the neighborhood. the meeting is scheduled for 11:00 a.m. at the office of emergency services. a coast guard cutter returned to its port. the 120 member crew reunited with their family just in time for the holidays. the cutter has been on a two month deployment off the pacific coast of central america where earlier this month it helped intercept a huge shipment of cocaine. waters of san francisco bay were sparkling tonight for the holidays. check this out. the parade of lighted boats streamed along the waterfront.
