welcome to mornings on 2. it's saturday, december 17th. >> good morning. let's check in with rosemary for our first look at your weekend forecast. >> good morning to you! another patchy, frosty start out there as well as a little fog and we're cold once again, although we're looking at some light winds in the hills. those will continue to decrease into the afternoon, but some areas like napa sitting in the 40s, where santa rosa you're calm and sitting in the 30s. we do expect a cool to mild day with mostly sunny skies and our extended forecast looking dry. coming up, whether or not we expect any rain between now and the big holiday and what you can expect for the afternoon. back to you. >> a fire shut town a busy part of berkeley for days, prompting ace disaster declaration from the state. it's all finally back open and today the mayor is asking people to head on down to do some shopping. allie rasmus is live now from telegraph avenue with the holiday street fair. and what people can expect.

good morning,alee. >> reporter: good morning. people can expect to see arts and crafts, booths, up and down telegraph avenue. we have seen some people just come up and start to set up. you can see vanover there with the tent set up with looks like selling some shirts, t-shirts over there, and then on this corner they have what appears to be a food stand they're going to be setting up. you see a lot of fruits and vegetables and stove or refrigerated -- there. this is all because of the annual telegraph avenue street fair. they do this every year for the holidays. but the merchants association hopes all the foot traffic will lead to an increased sales in some of their brick and mortar stores. this is part of the reason why some of the -- they've had some problems here. some of the stores in this stretch have been hurting since the fire destroyed the 96-year- old sequoia building on the corner of telegraph and hayes. the fire on november 18th made the building completely unstable, and it took about three weeks for work crews to tear it down while that demolition work was going on. this stretch of telegraph was closed to vehicle traffic and

restricted pedestrian traffic. the telegraph avenue merchants association reports during that time, the demolition process, some businesses reported a 60% drop in sales. some of those stores are getting help in the form of government disaster relief, loans, but the hope is with the holidays just a week away, some shoppers who support this area will come here to do their shopping, especially with all the extra vendors who will be set up, up and down on the street. the telegraph avenue street fair starts at 11 a.m. and goes until 6 tonight. it also goes on tomorrow and ice going on next weekend as well, all the way up until 6 p.m. on christmas eve. allie rasmus, ktvu channel 2 news. a federal grand jury has indicted a former sheriff's deputy. 48-year-old steven faces four felony counts in connection with an alleged dui arrest scheme. prosecutors say a private investigator was hired to go after men involved in a divorce battle and he allegedly paid

the man to pay the men over in the hopes a criminal record would hurt their custody cases. he is already facing state charges from two cases in danville last january. as he awaits his appeal, barry bonds is a free man this morning in what prosecutors call an almost laughable sentence, the former giants star received 30 days house arrest and two years prohibition, plugs a $4,000 fine and 250 hours of community service. [cheering] some fans cheered as he left courthouse. he thanked the fans and left without speaking to the photographers. prosecution want prison time for his conviction but the judge said the sentence was consistent with other athletes convicted of similar crimes in the same balance balco investigation. the attorneys are appealing. >> we believe barry was wrongly convicted of a felony and intend to fight it on appeal and overcome the judgment so he

can return to public life as a citizen, free of criminal conviction. >> when you're prosecuting you have the benefit of charging a number of counts and if you win on only one, you get to claim victory. >> the legal fight has taken more than eight years, could take another year and a half for the courts to rule on his appeal. some fans are relieved he won't go to prison but admit his reputation has been tarnished. >> his legacy has been diminished. he was accused of steroids, and he'll have to live with that. >> one of jurors said he thinks bonds on the off easy. bonds will be eligible for the hall of fame next year. sportswriters doubt he'll get in immediately but will be eventually inducted. a funeral service for a college football player from the bay area who died last week. 19-year-old fred thompson was a freshman at oregon state university and collapsed last

week. the medical examiner says he died of enlarged heart. his funeral is set for 10:00 this morning on the football field of his alma mater, oakland tech high school. a woman murdered three years ago, 14 and family are hoping someone will remember what happened that night. last night a vigil was held where ashley's body was found. her family says she stopped at the tavern to watch a monday night football game in december of 2008. the next morning her body was found behind the bar. she had been raped and strangled. >> frustrates me every day. we have a good idea of when down, we can't prove who it went down with. >> police say they have had her eyes on one man from day one, but the rain the night of the crime washed away evidence and any chance of a dna match. a $50,000 reward is offered for any information that leads to an arrest. ktvu.com has details on a tip line and e-mail address set up

live look at oakland estuary. beautiful start to the morning. it's a cold start once again. out sonoma county sheriff's office is looking into a stun gun incident that put a suspect in the office. deputies noticed the man running through traffic in santa rosa last night. they tried to subdue him but they fired a taser when that didn't work. >> deployed the taser, and i'm not sure -- if it was effective or hit him or anything yet. and after that point, a passing car just coming by as he jumped out in front of the car and gets hit. >> the man is now reportedly in critical condition. his identity has not been released. occupy concord plans a freedom rally today featuring anti-war activists cindy sheehan. it's welcoming the return of service members from iraq but protestors will also march against defense spending, which they say is leaving social services and public schools destitute. today's demonstration begins at

noon. police say they know about the protest and are planning accordingly. demonstrators with the occupy oakland movement are as committed as ever. more than a dozen pro festers returned to frank ogawa plaza yesterday but police arrested several people, citing several others. officers confiscated their belongings including sleeping bags. >> there's some irritation about the action on monday, and the closure of the port and that this is some kind of attempt to kind of pay back or -- or make it harder for us. >> some of the protestors tried to set up a tent but officers removed it. meanwhile, the city is working on legislation to prevent future port shutdowns. the occupy wall street movement began three months ago today. demonstrators planned to mark the occasion with a rally at a church in lower manhattan. protestors first occupied the park on september 17th. when police cleared that area, demonstrators tried to take over a nearby lot and may

attempt to occupy that same property today. a car dealership in oklahoma is facing a federal investigation for allegedly funding terrorism. yesterday federal agents raided the dealership, taking away documents and questioning workers. on thursday allegations sur that the dealership was part of a network selling cars and drugs and using the money to support terrorist attacks against the u.s. >> they're making big-time money, and the money is going right into weapons acquisition, terrorist training, recruiting, corruption, things needed to carry out terrorists acts across the world. >> agents say this is just one of 30 operates around the country set up to fund terrorism. cars are being shipped to several west african companies, then they're sold and the profit is given to hezbollah. some of the money comes back to the u.s. to buy more cars. a fresno area car dealership is set to reopen today after a huge fire yesterday afternoon the ford

dealership. take a look a little those pictures. the plumes of black smoke were seen from miles away. it took firefighters about 30 minutes to control the flames. everyone inside escaped safely but the cause is under investigation. a busy section of a southern california freeway damaged by a tanker truck fire is expected to be fully reopened by midday today. repairs for the 60 or pomona freeway hit a snag yesterday with phone lines in asbestos. but the work should be completed by today. the freeway has been closed since wednesday. that's when a tanker truck crashed and caught fire, damaging the overpass. the cause of that accident is still under investigation. check your number campaign is launched to stop california drivers from wasting motor oil. officials say the long held belief that oil should be changed every 3,000 miles is no longer accurate. they say almost millions of gallons of oil are being wasted.

they just don't want no more violins. >> the mayor was one of more than 20 speakers at the three hour service. hiram would have celebrated his second birthday just after christmas. we now know the identity of the gunman who went on a shooting rampage at a los angeles county office park. police say 48-year-old andre turner walked into the southern california edison building yesterday and opened fire. he shot and killed two people, and critically wounded two more, before committing suicide. survivors say he spared some coworkers while picking off others. officers are investigating whether the threat of layoffs set him off. the nevada ihop that a way scene a a deadly shoot something back open. the restaurant had been closed since september following the suit engine which a gunman killed four people then himself. the ihop opened again for business on thursday. members of the nevada national guard along with nevada governor were among those who attended. many say the reopening is part of the process of rebuilding

no one was hurt but that left neighbors angry so the sheriff's office is sponsoring a community meeting at 11 this morning at the al mada county office of emergency services building. it's super-saturday and stores are dropping prices as christmas quickly approaches! yesterday we were at mall in san bruno where discounts up to 80% are enticing shopper. super-saturday is just another promotion to increase holiday sales. all designed to help people save money. >> i am picky about what i'm buying because the economy is sod bad that the prices are going up and down. >> earlier this week the national retail federation announced sales were expected to increase 3.8% from last year. many malls and shops are planning to stay open longer from now until christmas. officials in hayward are working hard to get the shop in that city. so the third year they're offering a special promotion. if you spend more than $150 in the city today or tomorrow, you

can receive a special gift bag. the offer is good for the first 150 people to show their receipts at city hall on monday morning that that gift black include two free movie tickets are a gift card and gift card do other local restaurants. it's an early holiday gift for drivers in oakland as well. the city is offering free parking today and next saturday in an effort to boost shopping there. drivers will not have to feed the meters but they are going to have to stick to the parking time limits. the parking holidays will cost the city $125,000 but the city believes it will be absorbed by business revenues. berkeley's police and fire departments are teaming up with the marines to make this a great christmas for needy children. allie rasmus is live in berkeley now where a toy giveaway is just about to get underway. hi,alee. >> reporter: yes, berkeley police here behind us where you can see it a line of about 2 to 300 people standing out in front of the billing.

this is where are year berkeley police and the fire department give out thousands of toys for the toys for tots program. some told us they were waiting in line to be among the first parents to pick out toys for their kids, as early as midnight and 1 a.m. this morning. but apparently, when we got here about 20 minutes ago, there was a dispute about who was in line first. we did hear some shouting and arguments in the here. no physical altercation fortunately, but now it's calmed down because about 10 minutes ago berkeley police started handing out tickets, numbered tickets, to the people who were waiting so that place in line didn't matter quite as much. that defused the situation. and i talked to police lieutenant about 10 minutes ago, he he is there's usually a long line, a big crowd gathered in front of the building before this toy drive starts of year. and sometimes he says things can get a little chaotic. but the lieutenant says they have plenty of toys to go around. last year they gave out 3,000 toys as part of their toys for tots program. allie rasmus, ktvu channel 2

freshman at oregon state university and collapseeses during a basketball game last week and oregon's medical examiner said he died of an enlarge heart. his funeral is set for 10:00 this morning on the football field of oakland tech high school. concord police have arrested a teenager on suspicion of killing geese and ducks. police arrested a 17-year-old boy yesterday. he is held juvenile hall. police department is not releasing any details but say the case is still under investigation. from october to december, 24 ducks and geese were found shot to death in new hall and willow pass parks. as family gathers to remember a murdered three years arc, they are hoping someone else will remember what happened that night. last night a vigil where the woman's body was found. her family says she stopped at the tavern to watch a monday night football game, back in december of 2008. the next morning her body was

for most of us although you can see from that shot, low clouds and patchy dense fog around the delta and the inland east bay. it took more than three dozen firefighters to contain this huge blaze. a fire broke out at clovis car dealership yesterday, senn, plumes of black smoke into the sky. there are reports of workers where when it ignited and spread to other shrieks. officials shut down a portion of the nearby freeway, tying up traffic during the evening commute but no one was hurt. this sheriff's office is looking to a stun gun incident that put a suspect in the hospital. deputies noticed a man running through traffic in santa rosa last night. he tried to subdue him but when that didn't work they fired a taser. the suspect ended up if front of a car and was hit and now in critical condition. his eye dent not released. the occupy wall street movement gun three months ago today. and in an hour demonstrators plan to mark that occasion with

a rally at i church owned lot in lower manhattan. they first occupied the park on september 17th. police cleared the area and demonstrators went another lot. they're hinting they will try to occupy that same lot today. occupy concord plans a freedom rally today featuring anti-war activists cindy sheehan, welcoming the rush of service members from iraq but occupy protestors will also march against defense spending, which they say is leaving social services and schools destitute. today's demonstration begins at noon. police know about the protest and say they're planning accordingly. demonstrators were the occupy oakland movement say they're committed as ever. more than a dozen returned to frank ogawa plaza yesterday but police moved in a arrested several people, citing several others. they confiscated their belonging, including a table and sleeping bags. >> i suspect there's some

a long line outside the berkeley police department where officers expect to give out thousands of toys. welcome back to mornings on 2. some people lined up hours to go to be among the first to choose toys for their children. and that caused some problems this morning. allie rasmus is live in berkeley. >> reporter: things were a little chaotic this morning, there was a group of 250 people waiting outside the police department, there's still a large group of people here. they're being very careful about how many people they let inside to pick out thighs toys. we just got our first look inside the toy room that is located inside the berkeley police department. and it looks like a toys-r-us in there. there's thousands of toys in the room. some parents got in line as early as 1 a.m. this morning so they could be first to pick out toys for thinks kids. earlier this morning, in that

line outside of the police station there were a few arguments about who was in line first. no physical altercation and police defused the situation when they started handing outnumbered tickets. one mother explained how much this toy drive helps her family. [speaking in spanish] >> there isn't money for toys so she was gritful for the toy drive. you can see it there's a group of about 100 people waiting outside the berkeley police department. we have seen some parents walking out with big plastic bags filled with toys. lot of people have toys. each child and family gets two free toys. however, all of this is for families who have already pre- registered so you can't just show up here unfortunately at this point and expect to pick

police say 48-year-old andre turner walked into the southern california edison building yesterday and opened fire. he shot and killed two people and critically wounded two others before committing suicide. survivors say a he picked co,es officers are investigating whether the threat of layoffs sparked the shooting. police will hold a community meeting monday to discuss a fatal officer- involved shooting. police say a man open fire on police after running from a traffic stop. officers returned fire, hitting the man in the torso. he died thursday night at the hospital. monday's meeting is at 4 p.m. at the northern police station at fillmore and turk streets. a fatal officer involved shooting in san jose is now being scrutinized by a police watchdog group. thursday night police stopped 24-year-old manuel fuentes for carrying an open container of beer. police stay he ran into this house, and tossed a handgun into a bedroom. the gun was then picked up by

47-year-old galindo. >> the officer gave him commands shouting to drop the gun, and the individual then raised the gun up to the officers, and the officer did what he needed to do to protect himself. >> galindo died early friday morning at the hospital. fuentes is in custody. this is the 8th officer- involved shooting this year. the watchdog group says this is a trend that needs to be closely examined. prisoners on season quinn continue a death on row have more time before they might see the inside of a new death chamber. yesterday a federal judge struck down the state's newly adopted lethal injection procedure. the judge says the department of corrections didn't give enough consideration to the three drug cocktail including a lethal injection used by states such as ohio and washington. >> it creates a risk that the inmate will be suffering excruciating pain from the third drug, but unable to express that pain because the

outside our doors. tension between egyptians and the military continue to escalate. several hundred demonstrateddors gathered in central cairo this morning and hurled rocks at soldiers. this is the second straight day of fighting. at least eight people have died, hacktivists are demanding an end to the military rule that began in february. more than 40 people dialed in clashes just last month. the death toll continues to rise from flooding in the philippines. the country's red cross now says at least 436 people have died. a typhoon triggered flash floods in two coastal cities, most of the victims were sleeping last night when raging floodwaters tore through their homes. some areas experienced 12 straight hours of rain. there are two new developments this morning between iran and the u.s. tehran says it waited to announce a recovery of the american drone to test u.s. reaction. it says its armed forces intercepted the aircraft, while washington says it went down to a me can cal problem.

and they announced they arrested a person of suspicion of spying for the u.s. tehran claims it arrested the alleged spy when he crossed in from afghanistan. atlanta-based rapper slim duncan is dead. police say she was gunned down in atlanta music studio as he prepared to record a video. apparently slim mario hamilton was arguing with another person when they pulled the gun and shot him. he was taken to a local hospital where he later died. and police are now interviewing witnesses. they say at least 13 people were in that building when that shooting happened. there's more fallout from the penn state sex abuse scandal. a judge ruled there is enough evidence to send two administrators toe trial. tim curly and gary schultz are accused of little to a grand jury and failing to report the alleged abuses. coach mike mcqueary testified he saw jerry sandusky in a locker room shower with a boy in 2002. he said he told the two administrators and head coach

joe paterno. >> you saw the inaction by a number of very supposedly important, responsible adults. >> neither have been charge in the case. sandusky is facing 52 child molestation related charges and could take a year to start the trial. the attorney for former illinois governor rod blagojevich is asking for a new trial and accusing a juror of misconduct. the foreman in the trial violated court rules. attorneys say wilson made multiple public appearances to discuss the trial earlier this year. they also say she used a questionnaire from one of trial in one of the appearances. attorneys are asking for an emergency hearing to discuss the evidence against wilson. a bay area judge is set a trial date for the lawsuit filed by san bruno residents affected by the dead long island pipeline explosion set for july 23rd of next year. the judge asked pg&e to clarify

the admission of liability it made this week. pg&e is expected to respond next month. the september 2010 blast killed 8 people, injured 52 others, and destroyed 38 homes. the power is now become on for people in santa cruz county who removed their smart meters. five customers had their meters replaced with analog meters because of health concerns. they refused to center a smart meter reinstalled. but after criticism from county supervisors, the power is become on without the use of any meter at all. and a farm is recalling more than 40,000 pounds of ground beef products because of e.coli contamination. tyson fresh meats recalled 10- pound chunks of fine ground beef, 8020. the meat has a best day date of november 13th. it was distributed in california and 15 other stays. so far no illnesses reported. the recall of raw organic milk products from a fresno dairy has been lifted.
