valley. very foggy and cold for some. some areas will get that fog and only in the upper 40s and low 50s. here is sal. steve, good morning. traffic looks pretty good if you are driving on the richmond bridge. there is no major problems here. 6:00 let's go back to the dave and claudine. thank you. the occupy protestors caused real fire works late last mights at the oakland city council. a resolution to prevent further port of oakland shutdowns had to be tabled. kraig debro is here now. he's at oakland city hall to explain what happened inside council chambers. >> a lot of fire works. we used to seeing a lot of the fire works happening here. last night it was inside city council chambers. no word on when organizers will try to shut down the port again. council members decided it was past time to strengthen the

city's administrator hand in case there is another attempted shut down. city council met last night to vote on an urgency resolution. the resolution calls on the city administrator to use whatever lawful tools to prevent future shut downs or disruptions of any port operation. members of occupy oakland movement were at the chambers last night to voice their opposition. the movement shut down port operations twice in the last six weeks. on dis12th and on -- on december 12th and on november 2nd. port commission urged the yes vote. >> we welcome all support to keep our port important. the reason because it's vitally important to our city's economy and to our regions economy. >> the port belongs to the people. the people need to go down there and claim what is their. just like dr. king claiming what is his. there is a real distribution of the ports resources to the

people of oakland and particularly west oakland. [ cheering and applause ] >> reporter: resolution did not pass. there was a port authority vote. it needs two-thirds. now it's going to follow a longer path. opponents of the resolution say one of the reasons they moved to shut down the port are the lower wages and job conditions of the people that work at the ports. supporters say shutting down the port only financial lichters the very people protestors are trying to help. i've been trying to reach some of the people at the meeting last night. including council members to get more reaction and find out what is their next step in the emergency resolution path. reporting live in oakland kraig debro. your time now 6:03. computer hackers are helping occupy protestors. the washington times reports hackers are publishing the personal information of law enforcement officers all over the country. now in the past week there have been three different postings and following the police raid

on occupy oakland the personal information of oakland police officers was also published. that includes e-mail addresses, home addresses, phone numbers, and in some cases their salaries. time is running out for congress to extend the payroll tax cut. the republican controlled house approved a measure to take the issue back to the negotiation table. members rejected the bipartisan two month extension of the tax cut that the senate passed over the weekend. republicans say both sides can work out a better deal benefiting the 160 americans the tax cut is expected to help. >> let's not play brinksmanship. the american people are weary of it. they are tired of it. they expect better. >> senate majority leader harry reedmaces decide whether to bring senators back from their holiday break. he previously said he wouldn't negotiate with the house until it passed the two-month stopgap

measure. the white house insists a congressional stalemate will cost a typical american family $40 a paycheck. the administration characterizes the family of earning $50,000 annually. later on today the faa will release new rules to prevent airline pilots that are tired and exhausted from flying. the rules come almost three years after this deadly crash near buffalo, new york involving two exhausted pilots. we will take you live to our washington, d.c. newsroom for reaction from the victims families. also international airlines that use european airports will soon have to pay for the carbon gases they emit. europe's highest court rejected the appeal. the court dismissed the argument that the program was just a back door tax. airlines will be forced to pay for $15% of -- pay for 15% of

yet. we will see. we will see which day it is where you will not have any backup at all. yesterday we did have one between 6:00 and 7:15. this is a look at the -- again we mentioned highway 4. you can see in antioch it's a little slow. as you move the traffic over the maps over to vallejo that traffic is moving nicely and then hayward and juneon city that looks pretty good. 6:08 let's go to steve. >> sal, thank you, sir. we have foggy conditions. frosty conditions as well. that fog has prompted a fog advisory until noon out to the delta. only change really is that we've lost a lot of the breeze so the northeast wind is not as strong today. the pattern is in place. that means another low will drop in. this time into more of northern arizona. flagstaff will be a winter wonder land if you are heading in arizona. the pattern shows no signs of really changing. high pressure stays built in.

why the changes were spurred in part by a crash where 50 people were killed. allison. >> reporter: that is right pilot fatigue has been blamed on 18 crashes in the past 20 years. the crash that led to the new rules that are being announced today was in buffalo nearly three years ago. 50 people were killed when the commuter plane went down. it was blamed on pilot error. the investigation revealed the captain had been awake for 15 hours before the flight and the copie -- and had very little sleep. the new rules will limit pilot work hours but they have been delayed because airlines complained about the cost. flight 3407 family members have been relentless in their push for safety improvements. >> i can't tell you how many times we walked the hall of congress. >> reporter: we'll have live coverage of the faa

announcement during our next update in an hour. for now we are live in washington, d.c. alison burns. our time now 6:15. later on today investigators in new jersey will continue to clear the wreckage from that plane crash yesterday that killed five people. two men, two children, a woman and a dog were on their way to georgia yesterday when this plane crashed right on an interstate. it crash the on to the highway. spread debris about a half mile. surprisingly no one on the ground was hurt. air traffic controllers just talked to the pilot about icy conditions moments before the crash. the cause of the crash is still being investigated. today the defense will make its case in the trial of an army intelligence analyst that is blamed for the biggest leak of national secrets in american history. the prosecution called its final six witnesses yesterday in the case of bradley manning. he's accused of leaking

information to the wikileak's website. they have been portraying him as a troubled man. 6:16. wounded bay area soldier is being honored for his military service and the fact he beat the odds given to him by doctors. 23-year-old brian jergens was injured when a humvee hit an explosive device. sergeant ben was also in the humvee when it exploded. he too received a purple heart. >> it's something you really don't want but when you do get it you are just glad you are like in my condition where you can talk about it. >> jergens wife says doctors didn't expect him to wake up or talk but he has done both. yesterday in therapy he was able to walk 20 feet on his knees. he says the purple heart is another reason why he's celebrating the holidays. a san francisco man is in

the hospital after being hit by a car. it happened on monday night in the south of market neighborhood. police say the man stumbled and fell on the street where the driver neared howard street. the man that is believed to be homeless suffered life threatening injuries. very important step in the plan to relocate the metropolitan transportation commission from oakland to san francisco. the mtc will hold a meeting at 10:30 this morning. they will discuss contracts totaling more than a million dollars. they want the new office to -- east bay businesses and political leadiers oppose the move. some are against using bridge tolls to help pay for the estimated $74 million move. the bay area's clipper card topped a major milestone. more than one million bay area public transit riders use the clipper card. right now bart, cal train, ac transit, sam tran, and muni all

forward saying he molested them in the 1980s. yesterday he retired from the philadelphia daily news where he worked at more more than 40 years. prosecutors say there is little they can to because of a statue of limitations rule. the head of pg&e was there at candle stick park in the sky box when the power went out monday night. in the meantime a forensic lab will analyze an electric line that split minutes before the 49ers game. pg&e says a problem with a 12,000-volt line outside of candle stick park caused that first power outage. smoke forced as many as 40 people out of two luxury boxes. >> it was not a transformer that went out. it was unfortunately one of the power lines separated from itself. >> pg&e says it's not sure what caused the second power outage at the game.

mayor ed lee called the incident an embarrassment. he went with the fire department and utilities commission to make sure there is no more candle stick outages. especial liturgy 49ers playoff game in january. amy's kitchen is putting plans to open a new east coast facility on hold. the organic frozen foods producer planned to open a new plant in south carolina next year. the new plant won't be opening for a few years. round table pizza is scheduled to merge from bankruptcy today. a judge approved the concord based restaurant chain reorganization. it saves 2300 jobs but includes closing 200 restaurants. the sales are increasing and has expansion plans that include opening 20 restaurants in vietnam. today marks the official start of winter. why warming up by the fire could land you a hefty fine.

we're on the eighth spare the air day this month. we had four spare the air days in all of last year. we have essentially had bad air quality about every three days. we're in a really dry weather pattern right now. that lack of rain combined with wood burning fireplaces are contributing to this smoggy recipe. if you are someone who likes to work out outside again as you said working out indoors is probably your best option. consider this. we have $1.7 million fireplaces in the nine county bay area. those can pump out really unhealthy stuff into the air. >> the kinds of particles you find in wood smoke are really responsible for a lot of health problems including about 90% of risk and premature deaths. so you know it's really public enemy number one when it comes to air pollution. >> reporter: if you are someone

welcome back. here's a quick look at some of the top stories we are following for you right now. the golden state warriors and some of their star players monta ellis have been hit with a sexual harassment lawsuit. a former employee filed that lawsuit. now her attorney says monta ellis sent unwanted text messages and a graphic image to her cell phone. today is the eighth spare the air day of the season. because of bad air quality. wood burning is banned both indoors and outdoors. a $400 fine is possible. and just about 15 minutes from right now the federal government is due to release new rules for resting pilots. the changes come almost three years after this fatal crash of a regional airliner blamed on exhausted pilots. it will now be next year before oakland considers a proposal to prevent touch shut downs at the port. a resolution banning -- ktvu kraig debro is at city hall

with the sights and sounds of that uproar. >> reporter: not literally fire works but based on what people were saying and how loud they were saying it just about. the resolution was delivered to the city council last night. with the anonymous vote. but when it came time to use the rick pen just four council members voted in favor. it was standing room only in council chambers. this urgency resolution directs the city administrator to enforce all regulations in connection with any proposed rallies, rallies, or any activity that would require city permit. the resolution implies that requests for permits for those activities be denied if they interfere with commerce or workers earnings their wages. two occasions over the past two weeks occupy oakland effectively shut down the port of oakland. not all of those who the resolution is supposed to protect the workers favored the action and not just for economic reasons. >> i'm a posed to it.

for two reasons. one as far as i know organized labor played no role in it. two i think the occupy movement should have played a role in development. that department happen. that's why i'm opposed to it. >> the port of oakland is where the 99% work. it's important to keep those jobs moving forward. it's important to promote our economic development. >> reporter: that was omar benjamin. he was interrupted several times. the city losses were between $4- $8 million. it's unclear where this resolution goes from here. it has to go to the beginning if it wants passage. i have called the first amendment lawyer to see if the city of oakland can even prevent a protest like that if it doesn't have to do with safety. reporting live in oakland kraig

problems out there. let's start out with san francisco northbound 101. that traffic looks pretty good. approaching the 80 split. no major issues. the morning commute looks good at the westbound bay bridge toll plaza. certainly people are going. if you are used to the normal commute, i think you will like this. this is a look at san jose. some of the busiest freeways. 85 for example we usually never have any traffic this light on a wednesday. let's go to steve. i think they have shut it down. >> this may be the day. >> i think so. it's cold out there. winter begins tonight. a lot of 20s and 30s. very, very quiet pattern. we do have the fog out in the valley. delta advisories go until about noon for some out in that direction. if you are stuck in that, it will be similar to what we had. if you start off clear and cold it will warm up. upper 50s and 60s.

cold pockets of fog and just areas of really cold readings this morning. but after everything is said and done 50s to 60s. unless you're in the fog prone areas it's tough to get out of the low 50s. in fact it stays warmer up in the sierra nevada. breezy to windy in the higher peaks. things calm down friday with your weekend always in view it will be quiet. it will be warm on saturday. this morning air ways announced it will start serving the west coast its new boeing dream liner. they announced flights between the airport and san jose. that will be the first u.s. service for the new plane that boeing first delivered in september. the airline says those destinations make the best use of the new fuel efficient jet. several retailers are offering free shipping to online shoppers this year. nordstrom, saxes, will pick up
