lawsuit against monta ellis. the suit claims monta ellis kept a secret cell phone that he used to text erika ross smith. she claims it included texts like i want to be with you. hey, sexy. when monta ellis' wife found out she worked to get erika ross smith fired and 9 days after smith was contacted by a reporter asking if monta ellis was stocking her the warriors fired her. police are at a hotel where an officer shot a suspend this afternoon. ktvu's yawn s live with what brought police out to the hotel in the first place. john? >> reporter: this all started at that hotel, the extended stay america and it ended here at the courtyard marriot. an officer shot the suspect. investigators say they got the call this afternoon of a man with a gun who was threatening guests at the extended stay america. by the time they got here, the

man disappeared, over a fence and fast the social security building next door. he was then spotted at the courtyard marriot. one officer stopped this car. then armed with a gun, the officers spotted the suspect behind the courtyard marriot and then the officer felt threatened and he opened fire. >> we are still investigating, some kind of dispute between him and the hotel, i don't know what that is at this point but there might have been a dispute prior to him returning with a gun. >> he might have been despondent? >> we had a report he was crying but that's all under investigation. >> reporter: the suspect is at the hospital with a wound in serious but stable condition. the officer who shot him is on

administrative leave. live, john sasaki, ktvu channel 2 news. authorities in the east bay announced an arrest in a string of arsons. thomas hartman faces felony charges for setting 50 dumpster fires fires since january of 2010. officials say the fires caused tens of thousands of dollars of damage. the man accused of master minding a murder for hire plot is scheduled to be sentenced tomorrow. he was convicted of first- degree murder. he plans to file a motion seeking a new trial. he was shot outside his house. authorities say he paid to have him killed because he was obsessed with the woman he was

dating. an armed carjacking suspect. yesterday police searched for jarek brown of san jose. he is a suspect in a carjacking. police say while on the run, jarek brown broke into a garage, threatened. >> the owner and stole the man's car. today the city of oakland announced details of its investigation into the police response to the occupy protestors demonstrations. they will look that use of force, police tactics and compliance. actions of other law enforcement agencies will also be studied. >> there are lot of other departments here. i at this point don't know who did what. >> the police department was required to come up with its current policies after protesters were injured during a war demonstration. >> reporter: they come with

spending. john fowler, ktvu channel 2 news. >> the bay area will receive more than $4 million in federal grants to try to improve the lives of children in poor neighborhoods. the foundation will receive $3.9 million. it is earmarked for improving education. the agency in san francisco will get a $500,000 planning grant. the christmas spirit was on display today in san francisco. the salvation army opened this morning. volunteers helped children from low income families choose gifts from hundreds of toys for all ages. >> if you are a struggling family today, if you have a choice between toys or food,
