moments. hi sal. good morning, rosemary. traffic is moving say long pretty well as you drive out to the commute here. westbound highway 4 looks pretty good. also the morning commute looks good here on 880 north and southbound. there is road work southbound 880 near broadway. they will picking it up now. at 4:30 let's go back to the desk. there has been another holiday shooting at a san leandro walmart. a shopper got into an argument with a gunman in the parking lot. we are there to tell us exactly what happened. >> reporter: for the second time this month this very walmart parking lot is a crime scene. i will step out of the way and give you the proximity of these two shootings. the first one on black friday happened at the edge of the parking lot. as you follow that up the center aisle about 30 yards away it happened again last night right there. it was just before 10:30 when

police say a man that was waiting in the parking lot for his wife to come out of walmart got in a fight with a suspect in the parking lot. the suspect pulled a gun and shot the man in the leg. and it didn't stop there. >> the victim got into his vehicle and drove home. the suspect and this is what we have been told. that he possibly did follow them and continued to shoot at them as he drove. >> reporter: now that victim went to the hospital by ambulance from his home which is about two miles away from where the shooting happened. he is expected to recover. you might recall on black friday surveillance video caught a shooting at the same parking lot. the victim in that shooting is out of the hospital now and recovering at home. the suspect in that case surrounderred in front of our tv cameras after a standoff with police earlier this month. back here live this walmart is expected to open at 6:00 this

morning but by all appearances that will happen because the crime scene appears to be cleared upright now. the suspect in this case by the way is still on the run. reporting live in san leandro noelle walker. investigators in investigation are investigating the cause of a major fire that left as many as 60 people homeless. that broke out at pierce street and golden gate avenue. it took 150 firefighters more than three hours to bring the fire under control. four people were hurt including two firefighters. none of the injuries however are serious. san francisco fire chief said it started in a victorian house and spread to another home and nearby apartment building. >> i could see the smoke was coming into the building. i saw the flames through the windows. >> the red cross is helping the displaced residence. at least 16 people have been put up into hotel rooms until wednesday.

kraig debro is at the scene. a pedestrian was hit and kill by a car while crossing the street in daly city. it happened on highway 35 shortly before 6:00 laciniate. police tell ktvu the victim was in a crosswalk when he was hit by a car. he's only been identified as a 45-year-old man. the driver wasn't cited but they impounded her car. a traffic stop ended with two people taken to the hospital. deputies pulled over or tried to pull over a small compact car in hayward. the driver refused to stop the car. while attempting to enter northbound 880 hit the freeway sign. police say both people will likely be arrested when they are released. south san francisco police are cracking down on gang violence. we want to show you video or extra patrols that are put on

the streets last night. the shooting was gang related even though the families of the three victims disagree. since then the city has hired four extra officers to focus on gang violence. a community action group was also established. those three men were -- the suspects fled the scene. new zealand southern island is being rattled by more earthquakes. there you see people running for cover. several hours ago a series of earthquakes hit christ church. the first was a magnitude 5.8 followed by a 5.3. the final one registered 6.0. buildings and airports were shut down. this of course comes after that devastating earthquake in february that killed 182 people and destroyed the downtown area.

early christmas gift for five bay area police agencies. those agencies received big checks for their role in a drug bust. back in 2006 federal agents rated a hay ward store and seized more than $1 million in assets. hoe leo call agents that aided that investigation were given a share of that money yesterday. the police department each received $475,000. police departments in livermore, vallejo, and south san francisco each received $95,000. this morning the house and senate will convene on capitol hill to approve the stopgap measure extending payroll tax cuts and unemployment benefits. today's rare session comes after house republicans agreed to a bipartisan deal. house republicans tried to hold out for a one-year extension but eventually caved after pressure from the senate, president obama and the

bush says he's supporting romney because of his stability, experience, and principles. the former president lives in texas and supports perry. his attorneys filed the paper work and paid a $450 fee on wednesday. bonds is asking the ninth circuit court of appeals to throw out his conviction. last week the judge sentenced bonds to 30 days in house arrest, two years of probation and a $40,000 fine. the start of the sentence has been delayed until bonds finishes his appeal. striking nurses will be locked out of work until tomorrow. an estimated 4,000 nurses walked off the job yesterday. the california nurses association the union behind this one-day walkout has objections to changes and sick

leave. sutter health says a significant number of nurses did crosses picket line. a search for two missing men in the moe ha bee desert comes to a sad end. they were last seen on sunday when they wasn't out to test small terrain vehicles early in the night. their bodies were found in a ravine but no further details have been revealed. it was a wild bus ride in the east bay that passengers did not expect. seven people were injured when a transit bus lost control and crashed through a fence. it happened yesterday afternoon and one witness waiting for another bus described what she saw. >> she started hitting the curb and knocked out a light. she has a full bus. she came this close to hitting our bus. our bus driver said to get off the bus get off the bus fast. >> fire officials say a lot of the passengers were thrown around. they reported neck pain,

dizziness and other injuries. an investigation is under way into what caused that accident. california high speed rail authority is responding to a report that the bullet train project will not create one million jobs. the mercury news story which we reported on was correct when it explained how the number of jobs was figured but that does not change. san jose police say they have linked a gun at the center of a recent police shooting to the killing of a woman more than two months ago. last week a police officer shot and killed valenti galindo. now the same gun was used to kill valerie. she disappeared october 2nd and her body was found dumped in the south bay. they arrested her husband in connection to the death. oakland police are are investigating the death of a man shot while driving his car.

yesterday morning neighbors near west and 46th street called police after hear ration series of gunshots. that was followed by what they said sounded like an explosion. the man crashed into several parked cars. >> you wouldn't even know it was a car there because there was so much smoke. all you heard was a motor running. the 23-year-old victim was rushed to the hospital where he was pronounced dead. they have not released information on a suspect for a motive. starting nine days from now san jose police will stop responding to many burglar alarms. they are sending out thousands of mailers explaning their policy. officers will not show up if there is no independent verification of a crime. that will include a witness or surveillance spotter. that could send the wrong message to criminals. >> it's saying knock knock nobody is home. or something. it's an invitation.

it's a big invitation for burglars. >> police say they responded to 16,000 burglar alarms. 48% of them were false alarms. they say that takes more staffing than they have because of layoffs. firefighters spent the night looking for a hot spots for a fast moving fire. it all broke out yesterday afternoon at a junction between highway 37 and 29. high winds spanned those flames feet from homes. neighbors had to jump in with their own water hoses. no structures were damaged. this winter is an unusually dangerous one for fires because of the recent dry conditions. >> we have not experienced significant rain fall. in fact no rainfall in the entire month of december. >> the lack of rain and strong winds has led cal fire to call for an outdoor burn ban for all of the bay area south of the golden gate. that goes into effect for today. 4:49. it was a major policy change that led to hundreds of
