residents of this apartment complex to evacuate. >> we're tired. i can't believe this. i heard loud noises and sound asleep with my daughter and my dog, and then knocked on the door -- told us to get out. >> police are not releasing the name of the man holed up, but you can hear on that tape they're calling him scott asking him to come out. police say he's a 44-year-olds man. they're trying to convince him to come out. a security guard says he went to the man's apartment, number 514, at 2:45 this morning and asked the man to turn down the music. man refused and according to the guard threatened him. the guard called police, who went to the apartment and say the man met them with a machete and was seen with a handgun in recent days. one neighbor calls them the crazy guy. >> once he makes a connection with you he always talks about the same thing over and over. he doesn't make sense. i can't say he's ever been

violence to me, no. >> some scanner traffic this morning, that's not official but police are telling one another of the radio that the suspect is telling police they won't leave here alive. we haven't heard much recently in the way of either scanner traffic or yelling from the apartment or to the apartment. but we do have a spokesperson with the police department on scene and hope to get an update and interest have that within the next hour here. kraig debro, ktvu channel 2 news. also happening height now, another developing story from the south bay. a transit bus has been involved in a serious crash. lorain blanco is live at the scene in san jose with some new information. lorain. >> reporter: good morning! they just towed away the bus, and the truck, and you can still see a mess on the road here, on the side of the road. there are remnants of the bus and the truck still on the side of the road, and over there across the street as well. we're told by the vta that one

of its buses collided with the recycling truck and it happened when they were pulling into division. both the driver of that truck and the driver of the vta bus are expected to be okay. let's take a look at the video we shot just a little bit earlier, before they towed the vehicles away. you can see there's quite extensive damage to both vehicles. the vta driver was transported to valley medical center with non-life-threatening injuries. the bus was empty at the time of the crash because it was around 4:15, the beginning of vta service. if you're commuting in the area -- glasses on road out here, you can hear it crunching as cars are driving by. but they cleaned up most of the mess on the roadway, and it is reopened to traffic. reporting live, lorain blanco, ktvu channel 2 news. this morning investigators are look for the cause of a fire that badly damaged two homes in the berkeley hills. that fire started shortly after 8:30 last night on miller

avenue. the fire sent huge flames and sparks shooting into the night sky. no one inside the homes was hurt. but two firefighters suffered minor injuries battling the big flames. it took crews two hours to get the fire under control, and crews are still on the scene watching out for hot spots. investigators are also still looking for a cause. we're going to have a live update for you coming up at 7:30. the highway patrol investigating a deadly motorcycle accident in livermore that followed a police chase. it happened late last night. a man on a motorcycle was killed after crashing and getting pinned underneath a van. investigators say the motorcyclist was trying to evade police at the time and had been racing at speeds nearly 100 miles an hour. the driver of the van suffered minor injuries in the crash. a search is on for a man who police say assaulted a woman while she was walking with her child. it happened tuesday night on a trail between kelly avenue and filbert street in half moon bay. police say the woman was

pushing her two-year-old in a stroller when a man knocked her to the ground. he began pulling at her jacket. and when the child started to kriek the suspect ran off. anyone with information about the incident is asked to call police. there's a major new development involving the san jose mother accused of tossing her toddler out of a window on christmas day. prosecutors have now decided not to charge 24-year-old woman with attempted murder. instead, she is going to face felony child abuse charges. prosecutors made that decision after determining the woman's severe mental problems led to the incident. child survived the fall from a second-story window after nearly missing a concrete path below. this morning the search is on for a hit-and-run driver who police say was already a wanted felon, wanted on two warrants, one for auto theft if another for drug charges. yesterday police attempted to serve those two warrants in oakland. when she saw police watching her, she sped off, jumping a curb and hitting a man.

he is expected to recover but roja fled the scene, driving a white mitsubishi. it does have damage on the front right bumper and this california license plate. the california supreme court is expected to hand down a decision today on whether state legislators were within the law when they eliminated money for the state's redevelopment agencies. at stake is $1.7 billion in property tax revenue that governor brown and lawmakers want to use to help with the budget deficit. cities and counties used redevelopment agencies to promote construction projects as well as revitalize flight areas, but the agencies have benefitted private developers. the internet hosting site go daddy is feeling the effects of customer backlash. coming up at 67:15, we'll have a live report from our washington, d.c. newsroom with the legislation that the company had voice support for, that has so many internet users

upset. if you're walking out the door you might want to give yourself a little extra time because it's certainly foggy, especially on the bridge. >> that's right. it's affecting flights as well out of sfo this morning. you're looking at one hour delays until 3:00 this afternoon. they've also got some fog in texas and other parts of the u.s. that isn't helping the situation. right now this is a look at how the fog is rolled into contra costa county. this is highway 4 near pittsburg. the carquinez and bridges under a heavy fog advisory this morning. alsond a fog advisory the richmond-san rafael bridge, which can't even see here. and the bay bridge as well. up next we have a look at the maps with a decouple hot spots in the south bay. this is in milpitas and just disabled vehicle on the side of the road 880 northbound at dixon landing road. and a hazard here, 101 southbound north 13th street, some debris in the roadway. then a accident where a car rear-ended a semi-truck. it went off the side of the

road, flipped over. we had an ambulance having to respond. it's still in the ditch off the side of the roadway there. so hopefully crews will get it cleaned up pretty soon. all right. let's head over to steve. >> very good morning. we have a lot of low clouds around, fog. wasn't too much earlier this morning, but now some of this really filling in as it does around sunrise. it will be a foggy morning and then a break until the clouds come in. but very hazy skies today. temperatures starting off 36 to 50. fog, otherwise fair. but then increasing clouds by noon, probably be partly sunny to mostly cloudy, 50 to 60. if you're starting off at 50, it's a mild air mass. for others it's cold and foggy. get out of the way, you can see the fog is getting enhanced by the system beginning to move in and that's probably going to give us drizzle tonight. i don't think there will be much in rain but we'll get a lot of clouds and there's going to be rain to the north. you can see this is rather good- looking system but we're on the southern edge of it and the jetstream with supports everything stays way to the

north. so from crescent city north some good rain. for the north bay only in line for anything decent and even that looks weak. 39 now napa. 35 fairfield. 49 san francisco. 48 santa rosa, 48 in mountain view. san jose at 45. 47 concord. so some areas not too bad, others are keeled cold. this system will drag across the north and as it does drag in a lot of clouds for us as well. so we'll go mostly cloudy to cloudy by this afternoon. temperatures though starting off 30s to 50s. and lot of those high clouds in the fog combination of the two give us a gray day. this is a weak system that's coming in tomorrow, but cloudy skies, drizzle coast and bay tonight and tomorrow morning. any light rain -- lake county will get some but north bay looks really light. mild afternoon, fog near the coast, not going anywhere. so 50s for some. 60s for others. get a little south wind in advance of that. higher humidities so if you do any exercise, you may notice that even though it's december. cloudy skies with maybe light rain, more likely drizzle on

uniform shot and killed two french nato troops today in afghanistan. he opened fire on a base northeast of kabul. the taliban has claimed responsibility for the attacks and gunman was shot and killed by other troops. the shooting and others like it recently have raised fears of increased taliban infiltration of the afghan police and army. a new biography of david petraeus says he almost resigned back he he was commander of the war in afghanistan because of president obama's decision to quickly draw down surge forces there. the book says petraeus decided resigning would be selfish, so he didn't. this is video here of petraeus's military retirement ceremony in august in virginia. before becoming director of c.i.a., he was a four star general who oversaw the wars in iraq and afghanistan. the online pro defendant of a controversial internet bill in congress is reaching a new level today. allison burns is live in our washington, d.c. newsroom with

why some are calling this move your domain day. allison. >> reporter: claudine, the outcry online over a bill here in congress that would give the government new powers over the internet is bad news today for one of the largest domain name registrars in the world. today is the day that protestors have designated to target godaddy for its initial support of a stop online piracy act. godaddy is emphasizing it no longer supports the bill, but the horse left the barn and we found plenty of talk on twitter about a boycott. godaddy's rivals are offering special deals to users who dump the company. the movie and music industry and the lot of u.s. manufacturers are supporting the legislation and congressional leaders are hoping to move on it right away in the new year. but the protestors and all of these critics, including some in congress, are vowing to block it. so we're going to have to see how much this outcry, how much

impact, it has on the vote. reporting live from washington, d.c., allison burns, ktvu channel 2 news. there's word this morning that a third baby has been sickened by a rare bacteria that can come from baby formula. this illness was not linked to enfamil. the two other infants are recovering. so far, tests found no trace of the bacteria in the formula. a new state law that takes effect on january 1 requires utilities to install remote controlled shut-off valves on natural gas pipelines that run right through highly populated areas. the new legislation is in response to the pipeline explosion in san bruno. national transportation safety board investigation concluded that the time it took pg&e operators to manually shut off the gas supply contributed to the severity of the disaster. and another new law january 1 makes it illegal to openly carry an unloaded handgun in

california. people who violate the new law will face a fine of $1,000 and possibly up to a year in jail. there are ex else's for people have concealed gun permits. open carry advocates oppose the restrictions. a new system is in place in redwood city to help catch people shooting off more than fireworks this evening. a series of microphones connected to computers at police dispatch. it reports the sound of gunfire and where the shots were fired. people hope this will cut down on a dangerous new year's eve tradition. >> things fall out of the sky around here. >> bullets? >> i would think so, yeah. i don't think they're firecrackers. >> police say every new year's they respond to dozens of reports of gunshots. anyone found recklessly firing a gun will face a fine up to three years in prison. just five days ahead of the iowa caucuses, the shake-up

among the republican candidates continues. a new cnn poll puts mitt romney back on top with 25% support. he is followed by ron paul with 22%, rick santorum comes in third with 16%, more than triple the support he had at the beginning of the month. and newt gingrich is dropping to 4th place, with 14%. rick perry 11%. and michele bachmann with 9%. and a blow to michele bachmann's campaign in iowa a state senator who used to be a high-profile bachmann advisor has switched his support to ron paul's campaign. >> tonight's tough. i've been serving as michele bachmann's state chair over the last year. and why michele has fought tremendously for my values, i believe we're at a turning point in the campaign. >> he says he believes there are now two tiers of candidates and ron paul is in the top tier. bachmann accused him of being paid by the ron paul campaign to switch sides.

he says that's not true. talk about a bad way to start a marriage. a vermont man apparently proposed to his girlfriend with a stolen ring. 25-year-old ryan jarvis pleaded not guilty to theft yesterday. police say he stole a white gold solitare fringe a israelis store. investigators tracked it down after jarvis' fiance post a picture of the $3,000 ring on facebook. >> he was in there for approximately an hour, and there was some inkling from the employees that it was kind of a legitimate interest that they in getting this ring some there was some thought that quite frankly it would pop up on facebook. >> jarvis's fiance was wearing the stolen ring when authorities arrived to question the couple. investigators don't believe she knew her ring was stolen and do not plan to file criminal charges against her. it's foggy morning out there. heavy fog advisory is in effect this morning. we'll give you a live look at

we're learning more about the circumstances surrounding the death of a skydiver in southern california earlier this week. authorities say 32-year-old canadian michael unger died while performing a dangerous high speed maneuver message to at swooping. it involves skimming over the ground at up to 60 miles an hour, just before touching down. his parachute was open when he landed hard in a shallow pond. the september 11th memorial in new york city has reached a milestone. it has had one million visitors since it opened to the public just three months ago.

the memorial features two large square fountains that mark the friends of the world trade center towers. it a taxes about 10,000 people a day. two new red-light cameras are going up at a busy san francisco intersection. they're going to be at the corner of felled and masonic avenue, among the city's top intersections for injury collisions. the area is popular with both buys cliffs and drivers which can create problems especially during the rush-hour traffic. >> there's a bottleneck that happens to people want to get through the light, so before it changes, so they'll come right here and then the bikers are supposed to cross too. so i saw someone get hit that way. >> the cameras will be turned on in early january and fines can reach $350. this new year california courts are offering drivers a way to clear the slate of traffic tickets. certain traffic related fines may be eligible for a 50% discount, they must have been due before january 1, 2009. and the tickets cannot be for

the scene where the standoff has been going on for more than five hours. >> reporter: good morning. near capitol expressway and snell. behind me is the apartments, swat team members or san jose calls them their merge team members arriving here constantly for the last hour. they've been trickling in, canine dogs on the scene. we've been hearing reports that the man inside the apartment seems to increasingly be making threats or suggest that perhaps the officers will get hurt. so that's why the negotiators will be so important to this ongoing situation here. so when the security guard working at the apartment complex asked them to turn town music. police made contact with the person, he threatened them with a machete. police say the man was being -- making threats throughout the ordeal. >> i can confirm the specifics as far as the conversations, but i can toll you that the officers have been in contact

with him verbally. he has apparently brandished a machete at times, charged the officers and made threats some it's been an ongoing thing where he has been uncooperative and threatening towards the officers. >> an hour ago, police began evacuating portions of the apartment complex. not everybody is being asked to leave, just those who are living near this man. this is where he is living in the apartment complex at 514. you can see members of swat team and san jose merge team, which is like a swat team, continuing to arrive this morning. this is going to be negotiators are very important, they're beginning to arrive. it's sounding more like he is thinking about the officers being hurt. we just heard recently the scanner that the person inside said it was too late for you device, referring to the officers. so it looks as though right now this man doesn't have very many -- very much intention of coming south so the negotiators

will have their work cut out for them here in san jose. kraig debro, ktvu channel 2 news this morning investigators are looking for the cause of a fire that badly damaged two homes in the berkeley hills. that fire started last night on miller avenue near bridgely peak boulevard. paul chambers joins us live from the fire scene with the latest. paul. >> reporter: good morning, claudine. within a half hour investigators expected to come back out here and resume their investigation. but i talked to crews and they say basically they believe the fire may have started right there on the second or third level. firefighters got the call just after 8:30 last night. once on scene, crews say the fire quickly spread to the neighboring house sending flames and sparks shoot into the sky. it took 35 firefighters a little more than two hours to get things under control. but the fire wasn't the only dangers crews had to deal with. this home is up in the berkeley hills, so it was hard to navigate the big engines to the small windy roads. if that wasn't enough, a possible live power line

briefly delayed the crews. >> power line dropped across our first engine so we had to bail off the first engine and get a second engine and supply water to sustain the fire attack. no reported civilian injuries, we treated two firefighters for heat exhaustion. >> because of dry conditions up here, officials also evacuated 15 homes just to be safe. it's unclear what caused that power line to come in and hit the firetruck. but fire officials say they'll work with pg&e to figure out that. once again, fire marshals expected to be back out here within a half hour or so to resume their investigation. of course we'll let you know what that happens. paul chambers, ktvu channel 2 news. police did not waste any time tearing down the latest occupy oakland camp. last night dozens of officers moved in on the camp. police took down the small tent city as quickly as it went up. the raid came shortly after the property owner urgened the city

to remove the protestors on to the land earlier this week. police also received complaints from several neighbors. >> it became a nuisance, high volume, a little marijuana smoking here i'm assuming because you can smell it in the air. >> a handful of defiant demonstrateddors returned last night. it's not clear how police will respond. mayor quan is facing numerous criticism over her handling of the occupy protests, and now she is the focus of a front page article in the new york times. the story details her recent struggles in dealing with the occupy camps outside city hall and elsewhere in oakland. the arm also mentions her tense relationships with the oakland police department, as well as the recall campaign to remove her from office. a state university student started everything is a jail intense for a fatal crash that killed a toddler. the press democrat reports 19- year-old caitlin done away was booked in the jail late tuesday. she is accused of texting behind the wheel when she hit

and killed a two-year-old girl and seriously injured the little girl's mother last year. she will also have to spend 115 days in home deoe detention, perform community service and pay restitution. today the man a accused of shooting a soldier at his homecoming party is due in court. rubin ray girardeau faces attempted murder charge for the shooting at a homecoming party for 22-year-old afghanistan war veteran christopher sullivan. police say an argument broke out, and girardeau fired a gun hitting sullivan. he was trying to leave when he was attacked by drunk party guests. the government has been ordered to pay nearly $18 million to a san diego family following a fatal fighter jet crash. the marine corps jet on a training flight in 2008, when its engines failed and it crashed into a house. a mother, grandmother, and two babies died. the marine corps admitted a series of mistakes that led to

pilot to fly over the area. the pilot ejected safely. this morning a 15-year-old girl is recovering at san francisco general hospital after being hit by a bullet. it happened tuesday night on eddie street in the western edition. investigators say the teenager was standing with friends when she heard several shots then felt a sharp pain in her leg. doctors are now treating her for the leg wound and police are still looking for suspects. a deadly trend on the rise among law enforcement officers. according to the national law enforcement officers memorial fund, in the line of duty deaths jumped 13% this year. gunfire counted for the largest number of deaths, killing 68 officers. that's a 15% increase from 2010. the memorial fund says budgets accounts are partly responsible for putting the lives of officers at risk and they can't afford the safety equipment. here in the bay area, james capoot is most recent officer to be killed shot to death

while pursuing a bank robbery suspect. he is one of 10 officers killed in california this year. a funeral will be held tomorrow for an oakland man who gave the gift of life after his tragic death. 23-year-old charles butler, jr. was shot and killed last thursday while driving home from the store. he had just graduated from the maritime academy and was planning to work as a merchant marine. his organs were donated, helping save the lives of two men. his funeral starts at 11:00 tomorrow morning at the center of hope community church on macarthur boulevard in oakland. two men are facing felony charges in connection to a series of jewelry robberies. police arrested 27-year-old darryl dove and 32-year-old matthew howard. investigators say the men targeted older asian people wearing gold jewelry at busy stores like wal-mart. police say 65-year-old woman's arm was broken during one of those robberies. the crimes happened over a four- month period. both men are scheduled in court next month. check in now with tara,

you've been following something in the south bay? >> that's right. we have two accidents in the mountainview area, 101 northbound north of san antonio avenue, a two-car crash. there it is there. and then we have another one, 101 southbound at north rings dorf going on or a long time. a car rear-ended a semi-truck which kept going so we're not sure if it knew that the car was hit but it rolled over and went into a ditch so they're trying to get the car to the ditch now. minor injuries in that one. let's look at 101 through san francisco, the fog just rolled in for our cameras. the right-hand side folks are headed towards sfo, where we have delays this morning. about an hour long so you definitely want to check your flight before you take off this morning. all right. finally at the bay bridge toll plaza, this is even thicker than it was before. we do have a heavy fog advisory in effect for the bay bridge as well as the san rafael, carquinez and benicia bridges, so keep those low lights on and

drive a little slower than the speed limit. let's check in with steve. >> thank you very much. a very good morning as we have a lot of fog, and also little bit of sunshine breaking through some higher clouds up above. so if you get the sun it won't be bad for a while in the morning. but that fog makes it tough. visibility really reduced and if you're stuck in the fog, it can be darned cold! lot of clouds increasing and i wish i could say this would be a pretty good rain producer but it's not, unless you're watching us up in portland or seattle. then it will be up there. but for us, just too far south and this is not much of a system. looks good, looks good -- just -- not enough die national us to support it. we do have the moisture for the fog, so coast fog and also inland fog. so it's all over the place. lows mainly in the 40s. few upper 30s and a couple locations that were near 50 for a while. but start off foggy, then some morning sun here. jenny e-mailed me from benicia says we're heading up to napa. i would wait for the fog to rift, then go.

mostly cloudy today, mild afternoon for some. if you're near the coast it can be cool with lot of that low cloud deck around. 50s and 60s for temperatures today. and the extended outlook after tomorrow, it looks like we're back to dry. there's a hint of rain about a week from today, but until then warmer weather, especially on sunday. thank you, steve. the holiday season is causing gridlock at disneyland. yesterday crowds became too much for the park to manage so the park closed down ticket sales for several hours. visitors already in the park were also complaining of long lines and waiting hours just to get on a ride. >> it's a little frustrating to pay $300 for three people to go into the park and only get to ride three rides. so $100 per ride, almost. so i would say it wasn't worth, it definitely. >> disney says the holidays are one of its busiest times and people should expect the crowd.

the dow is up 94 points this morning, markets doing well in early trading and stocks not doing well. amazon made misexceptions and netflix after reports say customer satisfaction numbers have dropped. both those stocks down a couple percent. there's good news however from the housing industry. pending home sales rose 7.3% last month. that put pending sales at their highest level in 19 months. they rose almost 15% in the west. but not all pending sales make it through a final sale in 2011 is still headed for the one of the worst years ever for the housing market. for the first time in four weeks, the income of people filing for first-time jobless benefits has increased. 381,000 new applications for unemployment insurance were filed last week. that's up 15,000 from the week before. continuing claims also increased by 34,000 to 7.6 million. right now shares in the

led to his arrest. the 44-year-old white male now in custody, the whole thing took about four hours p no one is hurt except the suspect. a security guard for the apartments near snell and capitol expressway called police at 2:45 this morning. the guard went to the apartment to complain about loud music. he called police because the man threatened him. so ever since police arrived around 3:00 all morning long he made threats to police. he sometimes come to the door and yell threats but this morning he stepped outside. it was a mistake. police officers were positioned and moved in. >> we wanted to make sure he didn't get back into his apartment or into the apartment so the canine was deployed with and the officers took him into custody, no officers were injured. he sustained some injuries because the canines and biting him. >> so officers are already in position and when that man stepped just a few feet away from the door, you heard the officer say they released the

police dog, and police dog and team members which is the san jose swat team pounced on the suspect, took him into custody. you can see some swat team members out live, everybody is basically wrapping up the scene here. again nobody else hurt. but this man when talking to the people that live in the apartment complex, one woman said she called him the crazy guy, because the way he behaves, engaging people in extended conversations she said, for long periods of time, and using a lot of none sequiturs and i tried to ask police if they had further previous contact with this person, and that information is not yet available. neither is the man' identity s identity. the investigation is underway into an early morning crash involving a santa clara valley transit bus and the semi- truck. it happened about 3 hours ago on south 7th street.

the crash sent the bus driver to the hospital with minor injuries. no passengers were on the bus and no other injuries were reported. there was extensive damage to both the bus and the truck. it's still not clear what led up to the crash. this morning investigators are looking for the cause of a fire that damaged two homes in the berkeley hills. the fire started shortly after 8:30 last night on miller avenue. the fire sent huge flames and sparks into the night sky. no one was inside the two homes, and no one was hurt. but two firefighters suffered minor injuries battling the flames. it took crews more than two hours to get the fire under control. crews are still on the scene watching out for hot spots and investigators are still looking again for that cause. we'll have a live update from the scene at 8:30. the california spectrometer supreme court is expected to hand down a major decision today, deciding were legislators were within the law when they eliminated money from the redevelopment agencies. lorain blanco is live with that

story. >> reporter: good morning. in just two hours, the state supreme court will rule on whether the state can see billions of dollars from funding from redevelopment funds and give it to schools. the city says here in san jose and in union city, that move is illegal. they join redevelopment agencies that argue the $1.7 billion at stake can't be seized because it violates the prop 22. the measure bars the state from taking local funding to pay its bills. the case follows two related laws passed by lawmakers earlier this year. one dissolves redevelopment agrees sis and redirects property tax to states, the other new law lets the agencies stay intact if they agreement to give up a large part of funding to pay for schools. the california supreme court ruling is expected to come down by 10 a.m. today. whatever the outcome, the decision will affect all the state's nearly 400 redevelopment agencies as well as potentially many schools across the state. reporting live, lorain blanco,

ktvu channel 2 news. the chp is investigating a deadly motorcycle accident in livermore that followed a police chase. it happened last night in livermore. a man on a mosquito was killed after getting pinned upped a van. the motorcyclist was trying to evade police at the time and had been racing at speeds nearly 100 miles an hour. the van driver suffered minor injuries in the crash. the accept is on for a man who assaulted a woman walking with her child tuesday night on a trail between kelly avenue in half moon bay. she was pushing her two-year- old in a stroller when a man knocked her to the ground. he began pulling at her jacket when the child started to cry. that made the suspect run off. anyone with any information is asked to call police. there's a new development involving the san jose mother accused of tossing her toddler out of a window. prosecutors have now decided not to charge 24-year-old woman with attempted murder. instead the young mother will

face felony child abuse charges. prosecutors made that decision after determining the woman's mental problems led to the incident. the child survived the fall from a second story apartment house window after narrowly missing a concrete path below. this morning the search is on for a wanted felon who police say was also just involved in a hit-and-run. police say erica row hoe is wanted on two warrants, one for auto theft and another for drug charges. yesterday police attempted to serve those two warrants and tracked her to 95th avenue in oakland. when she saw police watching her, she sped off. hitting a man. he is expected to recover but rojas fled the scene. and she's driving a white mitsubishi endeavor similar to this one. it has damage to the front right bumper and this california license plated. the internet hosting site godaddy is feeling the effects of customer backlash. coming up at 8:15, we'll have a

are recovering. so far tests found no trace of the bacteria in the formula. in a new law that takes effect on january 1 requires utilities to install remote controlled shutoff valves on natural gas pipelines that run through highly populated areas. the new legislation is in response to the pipeline explosion in san bruno. a national transportation safety board investigation concluded that the time it took pg&e operators to manually shut off the gas supply contributed to the severity of that disaster. another new law that takes effect january 1 makes till legal to openly carry an unloaded handgun in california. people who violate that new law will face a fine of $1,000 and up to a year in jail. there are exemptions for people who have concealed gun permits. open carry advocates oppose those new restrictions. iran says one of its surveillance planes has shot video of a u.s. aircraft carrier near a waterway in the

some stunning ice sculptures are now on display to the public ahead of an international ice and snow festival in china. the display features 45 colored sculptures, most of them are reproductions of some of the most iconic buildings in the world. the festival begins next month. the september 11th memorial in new york city has reached a new milestone. it has had one million visitors since it opened to the public three months ago. the memorial features two huge square fountains that mark the footprints of the world trade center towers. it attracts about 10,000 people a day. a tourist from tennessee could face three years in prison for bringing a loaded gun to the world trade center memorial. the new york post reports the 39-year-old woman was visiting the site when she saw a sign this ted, no guns allowed. so she asked the police officer if there was anywhere she could check her pistol. but instead of helping her, he arrested her on a gun

just about 30 minutes ago a police standoff in san jose ended peacefully. and kraig debro was there when it happened and joins us now with the details on the mistake a man made that led to his a rest. >> reporter: police are beginning to dig in the background of the man they arrested here at the water apartments. one every his neighbors called him the crazy guy, police say the threat le presented was very real. police securing the suspect in the back of an ambulance about 30 minutes ago. it was at the end of a confrontation that took about four hours.

it began in the wee hours of the morning near the intersection of capital expressway and snell. a resident said a neighbor complained to the suspect about loud music. suspect became angry, no blows were thrown. police were called and they were met by the suspect at his apartment with a machete. other residents told police they had seen the man with a handgun in recent days. the suspect -- says police used bean bags during the attempts to arrest the suspects. >> i didn't feel him get hit but assuming he did because he yelled out, ow! then went back into his apartment. he had been opening the door, e was just on the threshold in the apartment front entrance door. but this time he actually went downstairs and confronted the officers. >> and when police say he did that, the man stepped outside a little further than in the past and police were ready. they released a dog, and right after the dog the members of the swat team here called it

the merge team here did the arrest. they came in and apprehended the suspect. the suspect was bitten i did the dog at least one time and was back of the ambulance. police are not releasing his identity and say they'll do that with a book him but we do know he's a 44-year-old white male now in custody. this morning investigators are looking for the cause of a fire that badly damaged two homes in the berkeley hills. that fire started last night on miller avenue near grisly peak boulevard. paul chambers is there and joins us with the latest. paul. >> reporter: good morning. we're still waiting for fire investigators to come out here on the scene. but i did just speak with the deputy chief. they believe the fire may have started on that second or third level because the bottom level is no issues. there are crews here just in case anything or any hot spots may develop. firefighters got a call just

after 8:30 last night. once on scene, crews found the fire spread to next door homes sending flames and sparks into the sky. crewmembers say it's possible the fire started on the second level as i said of the original home because most of the bottom level has minor damage. it took 30 firefighters a little more than two hours to get things under control. during the process a couple firefighters were hurt. >> so we had issues with the terrain, so if you look at it you can see there's even grade. and so working in the dark, we have some individuals that tripped -- so result are even greater. >> and because it's so dry in the area, officials evacuated 15 homes as an added precaution. the fire wasn't the only danger crews had to deal with. this home is up in the berkeley hills, so it's hard for the big engines to navigate the small roads. and a power line dropped across the first engine, briefly delaying it in the. crews could bring a second engine to respond. it's unclear what caused the power line to come unattached but crews will work with pg&e

to figure that out. paul chambers, ktvu channel 2 news. police did not waste time tearing down the latest occupy oakland camp last night. dozens of officers moved in on the fenced in camp on mandela parkway. police took down the small tent city. the raid came shortly after the property owner urgend the city to remove the protestors who moved on to his land earlier this week. police had also received complaints from several neighbors. >> it became a nuisance, got real high volume -- a little marijuana smoking here i'm assuming because we could smell it in the air. >> a handful of demonstrators returned last night determined to stay. it's not clear how oakland police will respond to those protestors. mayor quan faced tremendous criticism over her handling of the protests and now she is the focus of a front-page arm in the new york times. the story details her recent struggles in dealing with the

occupy camps outside city hall and elsewhere. the article also mentions her tense relationship with oakland police as well as the recall campaign to remove her from office. a student has started serving a five-day jail sentence for a fatal crash that killed a toddler. the press democrat reports 19- year-old caitlin done away was booked into the county jail late tuesday. she is accused of texting behind the wheel when she hit and killed a two-year-old girl and seriously injured her mother last year. she will also have to spend 115 days in home detention, perform community service and pay restitution. today the man accused of shooting a soldier at his homecoming party is due in court. rubin girardeau faces an attempted murder charge for the december 23rd shooting. he was at a homecoming party for christopher sullivan. police say an argument broke out and girardeau fired a gun hitting sullivan. i guess attorney says girardeau

was attacked by guests. this morning a 15-year-old girl is recovering at san francisco general hospital after being hit by a bullet. it happened tuesday night on eddie street in the western edition. investigators say the teenager was standing with friends when she heard several shots and then felt a sharp pain in her leg. doctors are now treating her for that leg wound. police are still looking for suspects. it has been an especially dangerous year for law enforcement officers. according to the national law enforcement officers memorial fund, in the line of duty death jumped 13% this year. gunfire accounted for the largest number of deaths, killing 68 officers, a 15% increase from 2010. the memorial fund says drastic budget cuts across the country are partly responsible for putting the lives of officers at risk and says they cannot afford to buy safety equipment and the number of officers has been greatly reduced. police officer james capoot is the most recent officer to be killed in the bay area.

capoot was shot to death while pursuing a bank robbery suspect. he is one of 10 officers killed in california this year. a funeral will be held tomorrow for an oakland man who gave the gift of life after his tragic death. 23-year-old charles butler jr. was shot and killed lasts thursday while driving home from the store. he had just graduated from maritime academy and was planning to work at the merchant marine. his organs were donated, saving the lives two men. his funeral starts at 11 11 tomorrow morning in oakland. in oakland, two men are facing felony charges in connection to a series of jewelry robberies. police arrested 27-year-old darryl dove and 32-year-old matthew howard. investigators say the men targeted older asian people wearing gold jewelry at busy stores like wal-mart. police say a 65-year-old woman's arm was broken during one of those robberies. the crimes happened during a four-month period and both men are scheduled to be in court next month. time is 8:36.

this morning police responded to reports of a threatening man armed with a machete. he was litter arrested when she stepped out of his apartment. this morning investigators are looking for the cause of a fire that damaged two homes in the berkeley hills. the fire started shortly after 8:30 last night on miller avenue near grisly peak boulevard. two firefighters suffered minor injuries. and the investigation is underway into an early morning crash involving a santa clara valley transit bus and a semi- truck. it happened a few hours ago on south seventh street. the crash sent the bus driver to the hospital with minor injuries. no passengers were on that bus. the california supreme court is expected to hand down a major decision today. the justices will decide about legislators were within the law when they eliminated money for the state's redevelopment agencies. lorain blanco is live with that story. lorain. >> reporter: good morning. san jose and union city say taking their redevelopment

funds is illegal. the state high courted will decide in just about an hour. those cities joins hundreds of agencies that argue the $1.7 million at stake can't be seized violating prop 22. it bans the stat from taking that funds. one redirects property tax revenue to the state and the other new law hits the agencies stay intact if they give up funding to pay for schools. the ruling is expected to come down by 10 a.m. today. of course, we'll have an update on our noon newscast. new this morning, the turkish government says turkish warplanes aiming for kurdish rebels in iraq instead killed 35 civilians. reportedly many were teenagers who were smuggling cigarettes. the government says drones had detected a group of people approaching turkey at a

early january. fines can reach $350. the new year is offering drivers a way to clear the slate of traffic tickets. according to california courts, certain traffic related fines may be eligible for a 50% discount. the fines must have been due before january 1 of 2009 and the tickets cannot be for parking violations, reckless driving or driving under the influence. state officials say more than 6 million tickets may be eligible. the lowered fines must be paid by july. tonight when people in samoa go to bed it will be thursday. but when they wake up it will be saturday morning. that nation is wiping friday december 30th from its calendar this year. they're switching time zones to be closer to its major trading partners. the current time zone was set in 1892 to work with american traders then, and trading partners for samoa are now in australia and china.

apple could launch a new television set before next year. apple is not commenting but says the company is revving up its supply chain to start shipping parts from the new tv after the first of the year. asian newspapers say the new i tv will not be a set top box, and they say it's going to be an all in one tv with a 32 or 37" screen. steve jobs biography indicated the company founder want to revamp the tv industry with what he called intuitive controls. and people interested in an extra serving of apple can find it at stanford. the university silicon valley archives is home to the world's largest collection of apple related artifacts. moment of the items were donated to the university by apple in 1997. the exhibit includes photos, computer blueprints, user manuals, software, and financial records. and the music is coming to
