. complete bay area news coverage starts right now. this is the 10:00 news at ktvu channel 2. >> developing news right now. a young boy seriously injured in a shooting that happened less than 90 minutes ago. good evening. >> a 5-year-old is at the hospital after a shooting in east oakland. it happened as his family stood in front of a taco stand. we are near 54th we arrived there just moments ago. >> reporter: police had a very large perimeter set up. both directions closed as you can see. we are right here, we understand this shooting

happened around 55th. in fact moments ago i spoke to an uncle of the little 5-year- old who was shot. he said he was with his father who owns that taco truck and they regularly do business around here. we want to show you video of the scene before police pushed back the perimeter. there aren't a lot of details but we know the shooting happened around 8:40. paramedics were doing cpr on the boy. this is just a lock or two away from where a 3-year-old was shot and killed just recently in august. one man who has a relative who works at this truck said he is beyond frustrated. >> she called me and crying like -- the boss son -- she didn't say where, what spot. >> reporter: bosses son. . >> yeah. he was laying on the floor bleeding. >> reporter: we have yesterday

yellow of family rushing in to the hospital. the uncle i talked to as also on his way there to the hospital tonight. again the 5-year-old is reported in critical condition. we are hearing he was shot in his stomach. as for the suspect, police say they are looking for a black man in his 30s with a goatee. i may we -- he may be with a black woman in a red shirt. they are believed to be in a silver car, possibly a pontiac. all of the details are fluid as police gather information and spread information out to other officers who are probably looking for the suspects in this case. we are monitoring the scene where this shooting happened just around 8:40 tonight. again a 5-year-old shot here with his family at this taco truck. we will continue to gather details. live in oakland. >> new information in the killing of michelle lei.

transcripts appear to show evidence of the suspect's growing hatred of li. the suspect is facing murder charges. the transcripts show several angry texts allegedly sent by her to the father of her daughter and a former boyfriend of le. among them she told him cut her out for our family's sake, otherwise be prepared to be held responsible and you deserve to die for your lies as does she. this is your last and final warning. she is scheduled for arraignment in mid-january. >> tonight there is a five thousand dollar reward for a monkey stolen from the san francisco zoo. officials say the monkey is likely in danger. >> >> reporter: it's not the same. the monkeys stressed because they know one of them is gone. just before the zoo opened they

found someone snuck in to the back of the exhibit, climbed up the stairs and on to the roof. they cut two holes in to the fencing grab a 17-year-old male. >> like having a member of your family gone. >> reporter: while there are cameras none captured the theft. police are investigating. visitors appalled. >> that's pretty low. pretty low. >> reporter: even the youngest was troubled. >> he needs something to drink. it can't just be all loan. >> reporter: she is right. the monkeys live in families and shouldn't be alone. >> stress can kill a monkey that small. they are very social. he shouldn't be alone and he has cage mate its he has lived all his life that he is friends with. he needs to be with them. >> reporter: they are worried because sam is fairly old and eats a special diet. she said while the monkey may look cute he has very sharp teeth and will bite. it could cause serious

infection. the zoo said they will take the monkey back no questions asked. >> i just want the animal back. >> reporter: they closed the exhibit to permanently repair the fencing this hope to have it open next week. ktvu channel 2news. >> more details, someone is tweeting on his behalf. one said went to monkey bars in golden gate playground, left disappointed. another heading for something called the rain forest cafe. sounds promising. at least check he had more than 1,000 followers. stay with us for the latest on the missing monkey case. we will tell you about any developments. >> new, late word that police have caught a hit and run suspect accused of running down a man while escaping from police. authorities detained the 27- year-old this evening at an apartment complex in haywood.

they say she drove onto a sidewalk in oakland on wednesday hitting a 54-year-old man while fleeing arrest. he was thrown 50 feet but survived. she is already wanted on warrants. in san francisco, a man plead not guiltyo charges in a fatal hit and run on saturday. the 23-year-old john martinez is charged with manslaughter and hit and run and is being held on a million dollars bail. police say he admitted he had 13 or 14 beers before getting behind the wheel last saturday morning. the victim still not identified has found near highway 101. >> drivers across the bay area can expect to see dui checkpoints on the hunt for drunk drivers throughout the next to you few days. they report more than 600 arrests in the bay area since a crack down started in mid- december. next year there will be a new

deterrent. drivers convicted of three or more di's face the possibility of having the license suspended for ten years. several local transit agencies will play the role of driver. muni and the vta are all offering free trips saturday evening through early sunday morning. >> it's the place to be if you are looking for a party, and amber live in san francisco now. wherere tens of thousands are expected tomorrow night. >> reporter: we are in front of the ferry building. tomorrow fireworks will be launched at the stroke many midnight. preparations underway for the big celebration fireworks show producer jeff thomas showed us the barge where thousands of lose explosives are being prepared. every year they attract people from all over the bay area. thomas said this year there will be something new to see. >> he will launch into the water and have effects rising

out of the water. >> reporter: across the street from the ferry building the staff at the hotel is gearing up for its sold out party. 700 people are expected to attend. dan director of rooms said they sold faster than previous years. he said the celebration caps a year that has seen slow improvements. >> we had a bit of a dip same time this year a few years ago and definitely it's picked up, especially on the hotel side. we are seeing a big improvement. >> bring me just one --. >> reporter: at a restaurant the chef said he expects tomorrow will be the busiest day since it opened about a year and a half ago. the restaurant plans to stay open later, new year's falling on a saturday boosting demand. >> once a year but it's like everybody's birthday so everybody is excited to come out and they know that -- it's going to be expensive for them.

. a collarbone police and protesters turnnd into a street fight this afternoon. police say they were providing support for public works crews trying to clean up part of the plaza. protesters say they were defending a tree sitter. a photographer was there when the situation escalated. >> protesters erupted when oakland police arrested one of their own for obstructing an officer. >> she started it. first one we had to arrest everybody else. >> reporter: moments later another arrest sparked a shoving match between

protesters and police. someone even jumped on our photographer as he tried to record a dispute. police say they arrested ten people by the time it was over. >> we are really standing right there defending the tree. the cops ran over to the information desk. >> the protester people were running up to -- looked likely were trying to fight the cops. . >> reporter: that man who had a front row seat saw is different. >> it wassa aggressive toward the police. it wasn't a people thing at all. >> reporter: police did not make an effort to start stop this march. they paused for a moment outside the jail. >> this is jail solidarity. people are waiting for us. >> reporter: more than one came up to say someone threw water on them as they marched past police headquarters.

there are still about 70 people out here now. >> new information tonight about a house fire in livermore. after knocking down the flames firefighters made a horrible find. a man dead inside. debra is in the court where the fire happened and said it was a big house but the victim was a recluse who lived in the garage. >> reporter: this garage now gutted had been converted into an apartment. the separate tenants in the main house might have perished to but one of them was up before dawn. >> a lot of smoke, a lot of smoke. >> reporter: neighbors woke to find their cul-de-sac full of fire engines and the garage of this house full of flames. >> i believe they thought everybody was out by the time they were able to put the fire out it was pretty obvious he was dead. >> reporter: he was an elderly man in his 80s neighbors say who lived in a converted garage for several years but was frail and reclusive rarely seen.

>> a walker and -- he had a guy that took care of him. he would go do his shopping. you didn't see him out that much. >> reporter: these neighbors closest to the burning garage were evacuated. >> its scary, to be woke up and such a tragic thing to happen. >> reporter: police detectives and arson investigators looked at the wreck and found nothing suspicious. no conclusion yet an the fire's cause. >> smoked a lot. the idea is -- i don't know what the investigation proved but the -- that he fell asleep smoking or something caught on fire. >> reporter: the fire of four lives in the main house escaped because one son up before dawn to go to work smelled smoke. those tenants are safe. their possessions mostly spared, they are burned out of this house, it's red tagged and investigators will look at if the garage apartment was legal and complied building codes.

>> this neighborhood it's a little different. we have seen -- we see it regularly especially with times changing, people are converting garages to living quarters to make rent and stuff like that. >> reporter: the corner is tracking down next of kin for the elderly victim before the name can be released. the home owner landlord here is a long time alameda county educator and old school superintendent. we tried but couldn't reach her tonight. we are live in livermore. ktvu channel 2news. >> four people are recovering minor joins suffered when a light rain train hit a muni bus. the train slammed in to the police cars driver's side door. two officers, the driver and a passenger were hurt. a spokesman said tonight that the cause of the accident is still under investigation. they also are investigating another crash that happened

about 9:15 at third. the train struck a silver hatch back. it left a large dent in the drivers side of the car. nobody was hurt. muni temporarily replaced train was buses while both were cleaned up. >> pg&e customers can expect to pay more for gas and power this sunday. the utility said the average electric customer can expect their monthly bill to increase between three and five dollars a month. gas customers will see the increase of nearly 2% from this month. pg&e called the increases modest and said the extra money won't be used to pay for the cost of the explosion. verizon has dropped a plan now to charge a 2-dollar convenience fee. the company admitted late today that a backlash from angry customers prompted the move. the fcc had promised to look into it. the company said they would charge the fee on one time

highlighting his personal life. at an event he teared up when asked a question about his family. >> you know -- >> reporter: he said neither he nor his campaign are giving up. >> if on the other hand you are fed up with the people who have made a mess of it then i think i'm a better candidate. >> reporter: and rick santorum is picking up momentum at the right time. if christians go around him more some say he could see a bigger boost in the final days. >> it would not surprise me if he wins. i always said in this environment iowa will break late and it'll breakfast. i have never seen anything like this. >> reporter: though they have been campaigning for weeks, analysts say this race remains up in the air because of so many undecided voters. in washington. >> more details on the gop race. herman cain won't endorse any of the candidates before the iowa caucus.

. a shooting in daylight injuries two men. one of them a veteran. alex reports oakland that it happened as one of the crews was just blocks away covering a funeral for another victim of street violence. >> reporter: a photographer captured the chaos moments after today's shooting. it happened just before 10:30 near 82nd avenue. one man appeared to be shot in the leg and was conscious. another was treated by paramedics and we watched him loaded in to an ambulance. neighbors say they heard at least five gun shots. this man who didn't want to show his face said he was scared. >> someone wants to go inside and i went inside. >> reporter: someone came up to this red ford explorer and

opened fire on the two men inside. the motive is not clear. >> this is a very bold act. it's during the day, there are people around. we have people who see things and hear things and that is what the police are following up on. >> reporter: at the scene a friend said one of the victims is a father and military service member who just finished a tour of duty. in a sad twist this shooting happened a block away from a church where funeral services were getting started for a young man gunned down in oakland a week ago. today's shooting wasn't connected to the funeral. both of the men hit are expected to survive. police searching for the shooter or shooters and they are asking witnesses to come forward. in oakland. ktvu. >> that funeral he just mentioned was for charles butler june junior. he was supposed to start his first assignment with the merchant marines.

his liver helped save another church member and other organs saved another man. his family said knowing he saved lives helps were some of the sting. >> a number of people being sentenced to death row in california is at a historic low. this year only ten were sentenced to death. that's compared to 29 during each of the previous two years. experts say the drop is part of a national trend but despite that drop california still has the largest death row in the country with more than 700 prisoners. the beautiful trees of me, r wood wills cost more to visit. visitors without a park pass will pay $2 more for a total of $7. some of that extra monday write will be used to help keep samuel p taylor park open. it's one of many state parks threatened with closure. they will still offer free admission on several major holidays including martin

. the new year will brink a welcome change for some of the homeless. catholic charity social security opening a new shelter

for families. a former convent will be their new home. >> reporter: the convent dates back to 1937. its been empty about five- years. it'll be a home again for women, homeless mothers and children. >> this has been great. you know it's rare that you get an opportunity like to renovate the building, adding beds and beds and cribs. it got a grant to help house some of san francisco's estimated 250 homeless families. the first four are set to move in tuesday. >> our lease is only for 18 months. we have been very clear from the front -- the front end this is only a temporary solution. obviously what we wants permanent housing. >> reporter: they are adding a

cyclones battered the southern coast and left 33 dead. most of the deaths were from wall that collapsed or downed power lines. the storm brought heavy rains and strong winds that were clocking up to 85 miles an hour. it's expected to weaken over the next few days but fishermen are being told not to go out in to the ocean. >> in chile a fire is burning out of control in that country's most popular national park. so far 32 square miles have burned and the fire is spreading quickly. firefighters say it could take weeks to bring it under control in part because of 60-mile an hour winds. 400 tourists were evacuated and that park is now closed. in canada a back country skier died in an avalanche. the man survived but died overnight as a friend waited him for help. rescuers couldn't get to him today because of darkness and the rick of more slides.

. fought hard for fremont as police chief, city councilman and then mayor. he died yesterday and robert honda tells you his friends say there were several things that never changed during his long career. >> place that we produced electric cars. >> reporter: for many years he was the public face of fremont appointed police chief in 1976. he served 15 years before retiring becoming a city councilman in 1992. that ended thursday when he passed away. police chief and family friend said he never changed his leadership style. >> had a high ethical standard that he set for himself and the people that worked for him. >> reporter: he dealt fought to keep the numi plant from closing. he tried unsuccess think to bring the a's to fremont. >> a lot of people take

10:30 . >> the light showers and sprinkles have moved out of the bay area. still low clouds in -- dense fog forming up in the santa rosa area and napa. here is a look at some of the current fog reports that you can pick out for san jose, livermore and parts of the north bay all the way to santa rose a visibilities down a quarter of a mile and temperatures down in to the 30s. santa rosa 36 degrees, hayward 51. today a weak cold front dissipating over the state. produced clouds in the bay area and a few spotty light showers or drizzle. high pressure returns and with that the familiar dry forecast right on in to the weekend. we will have patchy morning fog from saturday morning and little bit sunday morning. the afternoon high also be warming back up.

away, five-years old. here at a toco truck with his father and possibly other family members. his father owns the business when this shoots happened near the 5500 block, police have responded -- the little boy was rushed to the hospital in critical condition at the time but again we are -- learning information,esting confirmation that the boy did not survive. this is very close to where another little boy, a 3-year- old was shot and killed back in august. family members obviously extremely upset to learn this news. police investigating exactly what happened here and still looking for the suspect for that matter. we are told they are looking for a vehicle, a silver car of some kind, possibly a pontiac, a man and woman with him. of course we will continue to gather the details and bring you more throughout the weekend. we are live. >> sports is next.
