water front. some rebillers squirted champagne in the air. some estimated 200,000 people showed up for that celebration. most were bundled up in jackets but some came in top hats and tuxedos. >> basically this is my son and newly husband. we are newlyweds this year. we will ring in the new year here. our first year celebrating here in san francisco. we just moved here this year. it will be fun. >> i'm hoping my family, friends, are healthy and safe. >> so far there are no reports of any major violence from the event. police provied extra patrols. this is what it looked like in oakland. fire works it will up the sky. this video was taken on skyline video. petaluma police say a 15- year-old boy was hit in a crosswalk by a drunk driver. the teenager was transported to a hospital with major injuries.

allie rasmus is lye in the north -- is live in the north bay with details. >> that's is right. that new dui law allows the courts to revoke a driver's license if that driver has three or more dui convictions. this of course is the time of year that chp and police across the state are look out for drunk drivers. and in petaluma early this morning a suspected drunk driver struck and seriously hurt a 15-year-old boy who had been walking across the street. it happened at the intersection of east washington and e death street. the 15-year-old victim has been in the crosswalk police say and the driver that hit him did not brake in time. the teen was taken to the hospital with serious injuries but is in stable condition. they suspect the driver was drunk. they did sobriety tests and the driver was ultimately arrested on suspicion of dui. the new dui law we mentioned earlier it was passed in 2010

but goes into effect today. drivers with three or more convictions will have your driver's license suspended for ten years. or you can have it cut in half if you install a breathing unit in your car. all night and into this morning highway patrol officers have been busy cracking dun on drunk drivers this new years. san francisco police set up a dui check point along eighth street near folsom. extra motorcycle officers were in the downtown area. part of the strategy was to spot drivers on cell phone and texting and pull them over to see if they were under the influence. it's an effort many drivers say they appreciate. >> my husband was almost killed in a drunk driving accident. he was injured very badly. it was terrifying. and it would break my heart if somebody else lost a loved one. >> i don't drink at all.

it would help. a lot of the times i see drunk drivers around. >> the maximum enforcement period for the new years holiday weekend began on friday at 6:00 p.m. and ends tomorrow at midnight. violence overnight in oakland made it a busy start to the new year for police. officers were called to 14th and franklin after getting reports of shots fired. police found a woman that had been shot in her hand and rushed her to the hospital. while investigators were on the scene they drove up to another woman. the driver left with police. police say the two shootings are not related. no arrests have been made. occupy protestors will march with supporters of oscar grant today. on new years 2009 grant was shot and killed by bart police officer johan necessary mehserle. civic groups are outraged that mehserle served less than a year. at 12:30 this afternoon marking the third anniversary of the shooting.

activists will march from frank ogawa plaza to the fruitvale station. new year brings new laws. the minimum wage stands at $10.24 that is a 32-cent increase. san francisco is the only town in the country where the minimum wage tops $10. the state minimum wage is $8 an hour and $7.25 for the federal minimum. californias cracking down on businesses such as home builders paying employees cash under the table. chronical reports the so-called under ground economy costs the state $7 billion in a year in lost revenues. the businesses withhold payroll taxes for south carolina, medicare, and unemployment insurance. california has assembled a tax force which includes the department of industrial relations, employment development, and board of equalization. unlicensed contractors face fines and jail time. we have an undate on the squirrel monkey that was stolen

from the san francisco zoo. police say he was found yesterday near stern grove and returned back to the zoo. bystanders spotted the monkey and was able to coax him into the backpack. he was hungry, trembling and thirsty. the zoo has increased security after thieves cut through mesh fencing surrounding the exhibit. a reward of $5,000 is being offered for the culprit. blackbirds have fell dead from the sky in a town for the second new years eve in a row. police are working with animal control officers to figure out the exact number of birds that were killed. it's not year if year end celebrations again are to blame. last year fire works were blamed for the deaths of thousands of birds. last years deaths were caused by the birds being jolted by fire works. firefighters and police in los angeles are patrolling neighbors after another day of

students that illegally immigrate to the united states can receive public aid at college. there is a challenge to the probation that goes into effect next january. that allows undocumented immigrants to apply for state funded scholarships as well as financial aid. a front runner for the republican nomination says he would veto the federal dream act. congress has been debating the measure. it allows illegal immigrant teens to earn permanent residency and -- it would add enough patrol agents so guard it. with just two days until the iowa caucuses a new poll shows romney and ron paul in a statistical dead heat. the des moines register survey found 24% favor romney. 22% back powell. rick santorum comes in third. followed by newt gingrich. however 41% say caucusing with

ground. police a57 arrests were made overnight. city workers have cleared nearly 50 tons of waste near the harbor. 80% of that will be recycled. a powerful earthquake struck japan this morning no major damage is being reported. 7.0 magnitude quake was centered south of tokyo. buildings in the tokyo area shook but no one was hurt. high speed train services in northern japan were suspended. everything is now running as normal. ohio officials are looking into whether a 4.0 earthquake there is linked to drilling or so-called fracking operations. this is the 11th earthquake to hit that area since march. the ohio department of natural resources director said tracking is not causing the quakes but thought the injection of waste water is creating enough pressure to cause sizic activity. yesterday's quake caused minor

damage but no reports of any injuries. a severe wind storm is being flame blamed for a freak accident that killed one man in colorado. a tree branch came crashing through his window. meteorologists say winds reach up to 175 miles an hour. the strong gusts knocked trees into homes. one man described what he heard when a tree came crashing down. >> i thought it was another huge gust of wind that blew trash around and then i heard a little bit of screaming or yelling. >> the wind storm also blew down power lines. this morning thousands of residence are still without power. many roadways remain closed until debris can be fully cleaned up. >> kind of a wild intoner colorado. they've had a lot of snow out there and winds. quite the opposite of what we have been experiencing. >> we are dry. that is the way we will start 2012 this morning. santa rosa checking in right

a 15-year-old boy in the hospital this morning after police say he was hit by a drunk driver overnight. good morning, and welcome back to mornings on 2 i'm claudine wong. >> and i'm mike mibach. petaluma police say it happened 30 minutes into the new year. a teenage boy in a crosswalk hit by a 20-year-old driver who officers say admitted he had been drinking. ktvu allie rasmus is live in the north bay with details on the incident and how a new law could effect the case. >> reporter: that new law was passed in 2010 it goes into effect today. drivers that have three or more dui convictions can have their license revoked for up to ten years. however, this new law also allows you to reduce that amount of time if you agree to

2 news. new this morning investigators are examining whether alcohol attributed to a deadly crash in sonoma county. it happened before 3:00 this morning along the russian river. authorities say the driver of a pickup truck slammed into a guardrail and went down an enbankment. witnesses say he was going at a high rate of speed. first responders say they smelled alcohol inside the vehicle. >> upon arrival we found a pickup had gone through a guardrail several hundred feet over the bank. and landed on its side. after searching the area we found deceased male in the brush right below the vehicle. >> the impact of the crash ejected the driver from his vehicle. his identity has not been released but he's described as a man in his 20s. police and the chp are on the lookout for dui drivers all over the bay area this holiday weekend. sheriffs deputies pulled over

the driver of a red accra on suspicion of drunk driver. when police approached the driver he sped off. he smashed into a telephone pole. authorities arrested two people and found a loaded assault weapon. two men are in custody after leading police on a wild case through san francisco. the pursuit happened in the tenderloin. the officer said the fleeing suspect hit a car and pedestrian that suffered minor injuries. the chase ended when the suspects hit another parked car. >> they went and grabbed somebody else and held them hostage. it was kind of scary when they came. i was glad there was so many police here so fast. >> investigators think the two men were trying to steal a lab top. an overnight fire displaced its four residence. firefighters contained the fire about 90 minutes later managing to keep it from spreading other

houses. no one was hurt but firefighters say the home is a total loss. the is cause is under investigation. walnut creek police have arrested two men in connection with an assault at a nightclub. it happened early yesterday morning at the vice a track lounge. the victim says he was pistol whipped by a group of people. he suffered a serious but not life threatening head injury. they recovered a bloody metal object that may have been used in the beating. san jose police have arrested a woman for allegedly killing another woman with a machete type weapon. authorities first thought sagal moe ha mod sadiq was a victim. when officers arrived they

found the unidentified victim already dead. the assailant had escaped on foot. police are searching for two men that robbed a pizza delivery man from gunpoint. police say when the delivery man arrived two men walked up to him, took the pizza and his money and ran off. one of the men had a gun but police say no one was hurt during the robbery. the deliver address turned out to be a vacant home under construction. oakland police chief promises to catch those some for shooting and killing a five- year-old boy. loved ones of gabrielle martinez junior have set up a makeshift memorial at 55th avenue and international boulevard. that is where the boy was shot in the stomach. the boy's siblings say they are devastated. >> i called my dad and he said they shot my brother. >> the boys were just playing around. and then out of nowhere you

hear these gunshots and my dad is like don't get scared. when he checked it was a little boy that had gotten shot. >> oakland mayor jean quan and interim police chief howard jordan attended a memorial honoring all the victims in 2011. with the communities help 2012 will be a safer year. oakland's homicide rate rose for the first time in four years. the official count is 103. that is 11 more homicides compared to 2010. gabrielle was the third young child killed by gunfire last year. three-year-old carlos nava and hiram lawrence junior was also killed. there are now three separate recalls against her. people have been collecting signatures to take the recall to a special vote. they need 20,000 valid signatures by the middle of

fire crews spent the night watching for hot spots following an unusual winter fire. it erupted friday and sealed by 50 miles an hour winds. it burned 318 acres and at one point threatened several structures but calm winds help firefighters contain the flames. warm temperatures in new york may have lead to the largest new years crowd at time square. authorities say the person jumped into the water from pier 14 south of the ferry billing. the persons condition is unknown at this time. officials with the upcoming america's cup in san francisco have released the race course which they say is going to make a challenging competition. there will be a four course option. the longest is estimated at a one hour race. the shortest will be 30 minutes. organizers say the race will be action packed and push the sailing crews to their limits. niners and raiders enter the final week of the regular season with a lot on the line. the raiders kick off this afternoon at home against the chargers. a win along with help from teams. the raiders will be playoff bound. as for the niners they are already in but with a win today on the road in st. louis they would clench the first round bye and host the first game at the stick. it has been a decade since the 49ers have made a trip to the post season and playoff fever already starting to

a story that comes on the same day a dui law l goes into effect. >> reporter: that is right. we'll get to the details in a second. first we want to tell you about overnight accident in petaluma. it happened just after midnight this morning. a suspected drunk driver struck and seriously injured a 15-year- old boy that had been walking across the street. it happened add the intersection of east washington and edith street. the 15-year-old victim has been in the crosswalk according to police and the driver that hit him failed to break in time. the teen was taken to the hospital with serious injuries but he is in stable condition this morning. petaluma police suspect that the driver in this case was drunk. they conducted sobriety tests and ultimately the driver was arrested on suspicion of felony dui. that new dui we told you about was passed in 2010 it goes into effect today. drivers that have three or more dui convictions can have their licenses revoked by the courts for up to ten years. chp officers explained how that

punishment can be cut in half after the first five years. >> after five years driver can go back in and apply for a restricted driver's license with ignition interlock device. as long as the person complying with the ignition interlock device requirements they will be allowed to drive. >> reporter: an ignition interlock device is a device that attaches to your cars ignition. you breathe into it before you can start your vehicle. if you are over the legal limit, your car won't start. allie rasmus ktvu channel 2 news. all night and into this morning highway patrol officers have been busy cracking down on drivers. they set up a dui checkpoint. extra motorcycle officers were also in that downtown area. part of the strategy was to spot drivers on cell phones or -- it's an effort that many drivers say they appreciate. >> my husband was almost killed

in a drunk driving accident. he was injured very badly. it would break my heart if somebody else lost a loved one. >> i wouldn't drink at all. it would help. a lot of times i see drunk drivers around. they do cause big problems. >> the maximum enforcement period began on friday at 6:00 p.m. and ends tomorrow at midnight. violence overnight in oakland made it a busy start. officers were called to 14th and franklin after getting reports of shots fired. police found a woman that had been shot in her hands and rushed her to the hospital. while investigators were on the scene a car drove up with another woman that had been shot in the leg. that victim was taken to the hospital. the two shootings are not related. no arrests have been made. san jose police responded to three violent incidents overnight. police tell us ten last night a man and boy were stabbed on ridge glen way. one of them suffered life threatening injuries.

about the same time another man was stabbed. he was not seriously injured. but then later that night at 12:20 a brawl broke out on skull drive. six people were hospitalized with nonlife threatening injuries. occupy protestors will march with supporters of officer grant today on new years 2009 they were shot and killed by bart police officer mehserle at the fruitvale station. civic troops were outraged that they served about a year for the involuntary manslaughter conviction. activist will march from frank ogawa plaza to the fruitvale bart plaza. with the new year comes new laws. it stands at $10.24 an hour. that is a 32-cent increase. san francisco is now the first city in the country where the minimum hourly wage tops $10 an hour. in comparison the state minimum wage is $8 an hour and $7.25 for the federal minimum. california is now cracking down on businesses such as home

francisco. it began in the tenderloin. officers say the fleeing suspect hit a car and pedestrian who suffered minor injuries. the chase ended when the suspect hit another parked car near peru avenue and naple street. >> they could have grabbed somebody else and held them hostage. it was kind of scary when they came. i was glad there was so many police here so fast. >> investigators think the two men were trying to steal a laptop overnight fire displaced four people. it started close to 1:00 this morning at a victorian style home on north fifth street. firefighters contained the fire about an hour and a half later. they imagined to keep it from spreading to other homes. no one was hurt but the house is a total loss. the cause is under investigation. san jose police have arrested a woman for killing another woman with a machete type weapon. authorities first thought sagal was a second victim in saturday nights attack. they took her into custody following an investigation.

the homicide happened inside the home on johnston avenue. sadiq claimed the assailant escaped on foot. they promise to catch those responsible for shooting and killing a five-year-old boy. loved ones of gabrielle martinez junior have set up a make ship memorial. father runs a taco truck in the area. investigators have canvassed that area but so far there is no clear motive. siblings say they are devastated. >> i had called my dad and he said they shot my brother. >> the boys were just playing around. and out of nowhere you hear gunshots and my dad is like don't get scared. and when he checked it was a little boy that shot got. >> oakland mayor jean quan

attended a church service yesterday. honoring the victims in 2011. gabrielle's kill her be brought to justice and with the community help 2012 will be a safer year. the city's official count is 103 and that is 11 more homicides compared to 2010. gabrielle was the third young child killed by gun tire in 2011. three-year-old carlos nava. the city violence is a common complaint heard against mayor jean quan. there are three separate recall drives against them. they need about 20,000 valid signatures by the end of may. >> i'm distraught. i'm an educator a long-time educator. 35 years and my children are killing each other. somebody's got to stop it. >> mayor quan thinks she can

but calm winds yesterday helped firefighters contain the flames. warm temperatures in new york city may have lead to one of the largest new years eve crowds at time square. the city predicts at least one million people turned out for the ball drop. celebrities there included carlos santana and gaga. gaga wore a giant mask while dancing with new york city mayor bloomberg. the temperature hovered around 50 degrees. quite the opposite for the typical new years eve flow there. for adults a big new years eve bash happened in sin city. las vegas ran in the new year with fire works from eight casinos along the strip. colorful display lasted nearly nine minutes with an estimated crowd of nearly 300,000 people in the city this weekend.

good morning, to you. a pretty fabulous afternoon expected for the first day of 2012. outside our doors partly cloudy be cool with patchy dense fog in the valley. starting today it is going to be illegal to sell or buy shark fins in california. the fins are used to make the asian delicacy shark fin soup. they will be allowed to sell their stock until july of 2013. that low is meant to protect declining shark populations. retailer can no longer give out single use plastic bags.

it also applies to paper bags. they must contain 40% recycled content and they will have to charge 10 cents per bag. nonprofits and restaurants are exempt from the rule. fines could go as high as $1,000 a day. starting today children age seven and younger will have to sit in booster seats in the car. previous requirement was limited to children age six or younger or weighing less than 60 pounds. while most parents are thinking safety first, not quite everyone likes the new law. >> we want them to be as safe as possible and long as possible. >> hey nathan do you want to sit in a booster seat again? no. >> while some six and seven- year-olds may resist, booster seats cut their risk of injury by 60% to make sure the seats are safe highway patrol officers offer free inspections. and new this morning iran

long anticipated 9/11 museum will not open to mark the occasion as planned. >> reporter: work on the under ground 9/11 museum has come to a halt because of a dispute over money. the museum as seen was supposed to open its doors next september 11th. new york city mayor michael bloomberg that chairs the memorial and museum foundation says that won't happen. >> there is no chance it will be open on type. >> reporter: the port authority of new york and new jersey which owns the world trade center and building the museum claims it is owed $300 million in infrastructure cost. port authority spokesman told fox news this is an issue that has been present for years. the port authority is actively negotiating appropriate parties to resolve it. the museum foundation says it owes it $138 million because of delays in finishing the product

hollywood to san fernando valley. there have been 39 fires since last night. this is a worst wave of arson fires. they are considering a plan to restrict the use of leaf blowers to three days a week. this plan was proposed after a number of complaints about noise from those blowers. if the proposal approved they would be allowed to use one day per week plus weekends. sears, k mart revealed the location of the 80s store that will be closed. it's in the state of indiana. there are no bay area closures on the list. stores in the san diego area will be shut down. the two department stores merged back in 2005. they announced the closures after a disappointing holiday season. the company previously announced it would close as many as 120 stores. disney plans to celebrate leap year by keeping two of its

water main break left a busy intersection under water. a lot of water. thousands of gallons of water rushed on the streets. dozens of cars in that area were damaged as the water rose and flooded the streets. officials say this is one of the worst water main breaks that area has seen. >> i always come home from university and as i pull up there is cops and fire trucks everywhere. >> the pools of water that accumulated on street did take hours to drain. ohio officials are looking into whether a 4.0 earthquake there is linked to drilling or

so-called fracking operations. yesterday's quake hit shortly after 7:00 p.m.. this is the 11th earthquake to hit the area since march. the ohio department of natural resources directors says fracking is not causing the quakes but thought the injection of waste water near the fault line is creating enough pressure to cause seismic activity. yesterday's quake caused minor damage but there were no reports of any injuries. officials with the upcoming america's cup in san francisco have released the race course which will make for a challenging competition. there will be four course options. the longest is estimated at a one hour race. the shortest will be about 30 minutes. the race will be action packed and will push the sailing crews to their limits. that race is set for september of 2013. the niners and raiders enter the final week of the regular season with a lot on the line. they kick off at home against the chargers. a win along with help from other teams and the raiders will be playoff bound. the niners are already in.
