explosives. 7:14. in about a half-hour from right now, president obama will make his first-ever appearance in the pentagon briefing room. alison burns reports he's unveiling a new strategy for a smaller military. >> reporter: i just talked to a defense analyst about what this new strategy is going to mean for military bases in the bay area and across the country. i -- he tells me it's going to mean less people, less training and older equipment. the pentagon is facing a potential trillion dollars in budget cuts over the next ten years and this morning, president obama and defense secretary leon panetta will reveal how they are dealing with it. the plan shrinks the size of the military and makes clear the u.s. will no longer be able to fight two sustained ground wars at one time. there will be fewer soldiers

and marines, a refocus on threat from the china and iran and they will make surge cal spending cuts to weapons programs -- surgical spending cuts to weapons programs. back to you. >> thank you. 7:15. president obama has sparked a legal showdown with senate republicans over his recess appointment of the first watchdog bureau individual. jamie dupree has more. president from both parties have made these recess appointments. why are they calling this illegitimate? >> reporter: you are right. ronald reagan had them, bill clip ton had them, too. the -- clip ton had them -- clinton had them, too. the democrats started doing this back in 2007, tori, because they didn't like george w. bush making so many recess

appointments when congress was gone. now the republicans are returning the favor. basically what the white house has done here, they've changed the rules, how they apply them and say, no, these recess appointments can be made at any time. that's what has republicans hopping mad because they argue, no, the senate has been here every day in recent weeks and there's no reason this needed to be done. the federal courts have not been excited about meditating differences between the two branches of government. so we'll have to see what happened here. >> can you talk a little bit about richard cordray. what exactly is this bureau supposed to do? >> reporter: this is all part and parcel after the wall street collapse. republicans don't like this new watchdog agency. they say it really won't work and that's why they've been slowing down. let's be frank. they've blocked the core dare

deadline to file tax returns is april 17th. april 17th falls on a sunday. and the 16th is emancipation day. don't forget. this is a leap year. so february has 29 days. well, a group of economists want to get rid of the rotating calendar. they like the idea that in the past few weeks both new year's eve and christmas day fell on a sunday. the contra costa times reports that they want a new calendar where the dates fall on the same dates every year. the calendar we have now moves everything forward by a day, maybe two days in a leap year.

7:29. oakland police are investigating a shooting overnight that left one man dead. it happened at an apartment complex on the 1800 block of east 25th street last night about:30. paramedics -- about 8:30. paramedics rushed him to the hospital where he was pronounced dead. a neighbor said she heard three shots. this morning police told us no

arrests had been made. this is oakland's first deadly shooting of the year. a teenaged girl was detained on charges of distributing pastries laced with pot to her classmates. the 14-year-old attends lower lake -- school in clearlake. one of the students who ate the pastry reportedly became sick. how she obtained the marijuana pastries is under investigation. very serious charges face a sonoma pilot who was arrest on tuesday. two chp officers say his plane was driving recklessly over

infineon raceway. it was 50 feet off the ground. dangerously close to traffic. officers followed the plane to the petaluma airport. that's where they say he failed a sobriety test. >> this guy was kind of all over the place random. >> he rolled the aircraft inverted, rolled inverted, rolled back, did that three times. >> he faces dui charges and may possibly lose his license. this man reportedly approached a child playing in the 2300 block of arrow drive the day after christmas. he reportedly tried to lure the child in the car with candy. when he said no, the man tried to grab his arm and he was able to get away. a man accused of rape returns to court. antonio mutone is suspected of raping one woman and expected of trying to sexually assault two others. yesterday, a judge ordered him to stand trial.

if convicted, he faces 25 years to life in prison. a hearing is scheduled for january 23rd. >> there is a new allegation against a san francisco man accused of posing as a doctor. carlos guz gangarza is suspected of running a bogus dermatology clinic. a second woman has come forward and said she's a victim. she said she consulted with the fake doctor for a skin treatment. she accuses him of inappropriate contact and of making sexually explicit comments. he faces charges for working on a woman when he didn't have a

license. jury selection will continue in the trial of a suspected gang member accused in the fatal shooting of a san francisco man and his two sons. edwin ramos is accused killing -- accused of killing tony bologna and his two sons. they were shot in the car after driving home from a picnic. ramos mistook them for a rival gang member. that are people who want to repeal california's dream act it collect 500 signatures for a referendum. coming up, what their chances are to making it onto the 2012 ballot. hayward police are investigating a robbery at a nonprofit organization that helps day laborers. police say someone broke into the hayward day labor center over the weekend the thieves

is not allowed inside. gabriel was one of the youngest victims. he was shot on interstable boulevard around 8:00 or 8:30. he was standing next to his father ataco truck at the time he was murdered. after his murder, a huge memorial sprang up on the screen, not whreeferning a boy -- believing a boy who was as young as 5 years old was shot and killed. there is going to be a funeral service tomorrow or saturday. we hope to actually speak to somebody here at the cooper chapel in just a few minutes. the memorial starts at 8:00 a.m. this moving.

reporting live in oakland, kraig debro, ktvu channel 2 news. 7:35. this is also inauguration day for district attorney george gascon is san francisco. later today he will be sworn in as san francisco's first elected latino district attorney. gascon was apointed po to -- appointed to that coast to replace -- to that post to replace kamala harris. he will be celebrating with an inauguration ceremony this evening at san francisco's mission high school. this sunday will be one year since the deadly shooting rampage in tucson arizona. congresswoman, gabrielle giffords, who, as you know, was seriously wounded in the head, she will be at the vigil and so will her husband. she was meeting with with constituents at a supermarket last january when she was shot. the suspect is still in federal custody. while the event is called a candlelight vigil, participants will receive glow sticks

instead of kandals -- candles. a fire started around 7:00 last night and neighbors captured it on a cell phone video. five people including three babies were trapped. a grandmother saved it them by throwing them in the arms of a neighbor. firefighters say the crews and everyone worked as a team so everybody made it out okay. >> i'm so proud of these guys right now. i honestly believe we saved five lives tonight. >> the red cross is assisting. the fire in the gentry circle home that broke out about 10:30 monday morning, firefighters discovered 52-year- old bobbi mitchell's body in the bedroom. police say investigators discovered cigarette butts in her bedroom.

stocks are down this morning. the r roy -- the euro fell to a 15-month low against the dollar and stocks fell in italy and spain. right now, the dow is currently down 95 and the nasdaq and s&p are down as went -- are down

well -- are down as well. there were 372,000 claims for initial jobless benefits. that's down 15,000 from the week before and it's down 11% from the same time in 2010. economists say when first-time applications stay consistently below 375,000, it's a sign that hiring is strong enough to reduce the unemployment rate. the december unemployment numbers come out tomorrow. bloomingdale's is making some changes to its operation at stanford shopping center. the company plans to open a new r smaller store in 2014. it will replace the larger store that's there now. the company says there are no plans to cut any jobs. there will be a bloomingdale's outlet's in livermore and that's scheduled to open this fall. right now, local candy workers are out on the picket

calfire on alert. calfire says its crews responded to more wildfires last month and is typical for december. as a result, they are increasing -- their increasing staff levels and burn days have been cancelled. they are asking the public to be extra careful, especially when conditions are windy. local cattle ranchers are praying for rain. this hay at the ranch should be thicker, taller and greener. but without rain it's thin and short. on top of that, there's less grass on the hills for grazing. with the cost of hay selling for more than twice of the usual price, we could see the effects at grocery stores. >> we lost a lot of cattle in the drought in texas and fires. if that happens again in california, which is a high beef producing state, beef prices in the grocery store are

good morning. i'm tori campbell. >> i'm dave clark. it's jurs, january 5th. -- it's thursday, january 5th. hours ago officers moved in again on the occupy protesters in frank ogawa plaza. we know this latest raid targeted a teepee. alex is out there with more. >> reporter: that's right, a symbolic teepee that had been a fixture here at frank ogawa plaza, it's gone. all that's left are a few dozen

protesters. police removed the teepee because they revoked the permit for the structure. >> behind the line! >> all right. >> what line? >> hey! >> tell me what line? >> reporter: this was the scene around 11:30 last night as officers in riot gear showed up at the plaza, at least a dozen people were arrested although we don't have a specific number yet from oakland police. police pushed back a group of protesters who had been holding vigil here and the city group took down the teepee that had been here. protesters had a permit for the teepee but earlier this week, the city revoked that permit in part because they say there was overnight camping going on here. one demonstrator disputes that.

allowed in the chapel. the father of the boy does not want to talk to anybody. he's very, very upset. he was standing next to his father's tahoe -- taco truck on international boulevard around 8:30. it was a friday night. he was shot. police don't believe he was the target of the shooting. it this doesn't make it easier for the family to take. a memorial immediately sprang up at the location and that brings us essentially back here. it's already underway. tomorrow the funeral is scheduled at st. mary's here in oakland. the time is yet to be determined or at least given to us. oakland police are investigating the first

have been caused by fog and smoke from a nearby wildfire. this happened about three hours ago. this is on a highway near port arthur, texas. that's east of houston. investigators say the bomb combination of smoke and fog made it almost impossible to see. you can see the wreckage. no one was killed in this chain reaction crash. but eight least 40 people had to be treated for injuries. 8:35. cleanup of an old crude oil spill is making some concord residents pinch their knowses. it's stemming from an underground conocophillips pipe line that burst two two months ago. the contra costa health department says the area began to smell again this week. once cleanup crews got back to work after the hoyle days. they're monitoring the situation. they say the sulfer -- sulfur odor is harmless -- harmless. police say arson charges are spending -- pending against a student.

brought here to golden gate park just last month. you can see the top of one of those babies just over this hill. they are kept in this area and certainly this is a big tourist attraction for people who want to come see this bison. we're hearing this incident happened yesterday afternoon and we're able to confirm a few things for you. what happened according to the person i talked was that a dog actually made it underneath this fence. some people tell us there are a lot of coyote hills. the bison got scared and ran into the electrical fence. you take a look at this fence and then there's another fence in there, that is an electrical wired fence and apparently the baby bison ran into that and was severely injured. we don't know the condition of the bitsen now.
