a little cooler today as temperatures stay in the lower 60s for many. here is sal. >> steve, good morning. traffic is moving along pretty well around the bay area as a matter of fact. traffic is moving along well here as you go to the will low pass grade. here in oakland north and southbound traffic looking very nice. and in san francisco along northbound 101 that traffic is easy. coming up on 4:30 let's go to pam. we begin with overnight gunfire causing a very tense situation in san francisco south of market neighborhood. swat teams race to the scene after getting reports of multiple gunshots coming from a building on ninth street. ktvu tara moriarty joins us now from the scene with information about men who are being detained. good morning, tara. >> reporter: good morning. we are here off of ninth street. we are just off of central freeway where police had to shut down one of the off ramps

here. while they search for the gunman. where they were was in that apartment building. that you see right there. they were firing off their guns and jumped a couple of rooftops until they were all the matily found. came down the fire escape of that building. police were able to arrest the two men around 1:00 this morning. that is after two hours of trying to find them. the chp blocked off the freeway and had a helicopter here. but backed off because of the fact shots were still being fired when police arrived. a swat team was here. tactical units and fire department. they quarantined off several blocks. established a perimeter and told people to stay in place. >> shots were fired off. i heard about three shots. and then kept walking a little further. about four more rounds go up. cops told me to go back inside the store. >> reporter: police tell us they believe the two men were firing off their weapons at random. they have no reason to believe

they had any target in mind. they will face various weapon targets. now a lot of neighbors around here were told not to leave their apartments and they were not allowed to until about a little bit before 3:00 this morning. once the suspects were detained police did do a thorough sweep of the building. just to make sure they had everyone they needed. live in san francisco i'm tara moriarty. san jose police are investigating their first homicide of 2012. police were called to alexander avenue in east san jose around 8:30 last night. they found a man suffering from multiple gunshot wounds. he later died at the hospital. no suspects have been identified. police are investigating the possibility that the shooting is gang related. hundreds of people are without power this morning. a car hit a power pole just before 10:30 last night.

crews are replacing the pole and all of the equipment on top of it. nearly 600 customers are without power. it will be restored by 6:00 this morning. right now a high surf advisory remains in effect for the san francisco coastline. i want to show you video of the waves. this was yesterday afternoon. forecasters say today's waves will be the biggest we have seen all year with swells up to 16 feet. steve said maybe 20 feet in some areas. the high surf is expected to cause beach erosion especially on san francisco's great highway. people are being warned to stay off the beaches and the rocks along the coastline. today's high waves are rolling in just as the opening ceremony of mavericks is about to take place. professional surfers are excited. almost two years ago 13 people were injured at mavericks when two surges of water crashed on

the shore. last night a meeting was held to address changes at this years competition to prevent that from happening again. >> all the surfers everybody will be in the water. the judges, the camera people will be in the water. we are moving for the observation of the event to be at a festival. >> spectators will be able to watch the event at the oceana hotel. security will be on patrol to prevent people from watching at the beach or the cliff. the woman charged with murdering nursing student michelle le is due back in court this morning. j sell esteban is scheduled to enter a plea. esteban was schedule yewed to

enter a plea last week. they indicted esteban on murder charges to allow prosecutors to move ahead without a preliminary hearing. the antioch woman convicted of torturing her niece and foster daughter will be sentenced this morning. 41-year-old shamika davis will face two life sentences in prison. she is accused of jazmine davis in 2008. her attorney claims dais suffered from severe mental illnesses. last year a martinez jury ruled that davis was sane at the time of the killing. a funeral is being held today for the five-year-old boy shot in oakland. gabriel martinez junior was killed last friday night near his father's taco truck. police do not believe martinez

was the intended victim anyone what information about the case is asked to call police. meantime today's funeral is open to the public. it's being held at st. elizabeth church. the service begins at 11:00 a.m.. an account has been set up to help the family pay for the funeral. a former school bus driver of san francisco is in jail accused of sexually abusing two special need students. roberto marty was ordered to stand trial. he allegedly assaulted an 11- year-old special needs girl in 2004 and last year. the incidents happened on the bus before the students were dropped off at home. there is concern there are more victims out there. >> does anyone out there have their child aboard this bus,

with this bus driver driving them. we are asking them to contact the police department. >> marty reportedly drove routes all over the city starting in 1994 through last april. the first student bus company in ohio says he passed the criminal background check and is shocked by the allegations. san francisco police are once again reminding the public that there is a $250,000 reward for information on a five-year- old homicide case. tomorrow marks five years since 20-year-old alberto was shot and killed while driving his car near 13th and folsom in san francisco. police have released a sketch of the shooters. the men confronted him earlier that night inside the nearby club. in southern california police are searching for a serial killer. coming up in nine minutes the

group of people being targeted. during his inauguration last night san francisco attorney gascon promised to make the streets safer through prosecution. >> and the constitution of state. >> the swearing in ceremony was held in the mission district with a lot of big names in attendance. gascon chose the location saying the neighborhood reminds him of where he grew up. they say san francisco is their new adopted city. >> what about higher office for you? >> i'm so happy with this. this is such a great time to be a district attorney in california. >> last night's inauguration was a historic. fast con is san francisco's

first latino elected attorney. mayor ed lee takes his oath of office at city hall. ross merck reny will be sworn in as sheriff. meantime san francisco's sheriff elect is the focus of a criminal investigation. police are looking into a possible incident of domestic violence between ross and his wife. allegedly tied to a larger pattern of abuse. he has declined comment but his wife strongly denies the neighbors change. he will be sworn in as san francisco's new sheriff on sunday. 4:39 is the time right now. police will canvas a sunnyvale neighborhood today in hopes of getting information on a hit and run driver that killed a pedestrian. benjamin lind was hit by a

in overnight news bombings in afghanistan have killed five u.s. members. killed four troops in southern afghanistan. since the start of the new year, the coalition has had nine deaths in afghanistan. 544 nato troops died in afghanistan in 2011. oakland police plan to increase security at city hall

after the latest show down with occupy protestors. our ktvu news cameras were there during the confrontation at the front door of city hall yesterday afternoon. police clashed with the demonstrators that demanded a meeting with the mayor. they used plyers to try to unhinge the city doors. >> we have two big demands. one is the immediate release of all the political prisoners. second demand is an immediate end to police harassment of people exercising first amendment rights. >> the protestors were angry about the raid late wednesday night. officers arrested about a dozen protestors that refused to take down a tepee outside city hall. police in orange county say a serial killer is responsible for the murders of three homeless men. anaheim police released these

surveillance images yesterday. police say it shows the killer approaching a sleepless homeless man -- sleeping homeless man. two other homeless men were found dead under similar circumstances. the killings began on december 20th. 4:46 is the time right now. tonight the mount diablo peace and justice will hold a vigil for last years massacre. arizona congresswoman gabrielle giffords was one of 18 people shot last january 8th after she met with voters outside a safeway mart. the san francisco zoo confirmed ktvu news that a bison calf died overplant force

trauma. we first told you about the incident yesterday morning when it was suspected a loose dog startled the bison and ran into a fence. a police incident report detailed how two dogs got into the golden gate park and chased seven bison on wednesday afternoon. >> watching the buffalo herd die off has been sad. now we finally got some new ones. it's so sad. yesterday evening ktvu news reporter amber lee went to the address listed on the report for the woman that was caring for the dog but she was told 38- year-old cover recent has not lived there for years. the new state budget unvailed by governor jerry brown contains deep cuts to state programs. the governors budget plan proposes $4.2 billion in cuts.

up with the lack of parking in front of their stores. business owners tell ktvu news many of the street side parking lots are filled for hours with cars bearing handicap placards. those let the drivers park for free and for an unlimited time. yesterday we found 13 of 30 spots occupied by such cars. business owners say they need better parking for everyone. >> people will come shopping in china area. hopefully we are able to often a parking issue. so that we can -- >> one idea being floated is for the city to lower prices in the nearby garages that are rarely full. city is in the process of creating a committee task force with finding a solution. it's coming up on 5:00. we want to check in with sal. any problems out there sal? >> it's pretty light out there. there is not a lot going on. which is nice. there is not a lot going on.

we hope it will stay quiet. every time i say that sometimes things pop up. right now i think things are doing pretty well. there is not a wait at all as you are driving in san francisco. if you are driving there from oakland it's a nice looking drive with no major problems. this mornings commute looks good here in oakland. san francisco northbound 101 that traffic looks nice approaching the 80 split. we are off to a very nice start. the fog is there. it's not as much of an issue now. we'll ask steve about that now. we do have a low cloud deck. some areas are clear and very cold. a little system moving into the north. also has increased some pretty good systems out of the gulf of alaska has increased the high surf. we started on wednesday and kicked in yesterday and continues today. 8:49 high tide. after that things should calm

down. system right there to the north will give a lot of cloud cover and eventually it will dive down. 31 santa rosa. 34 for napa. 36 san rafael. 48 hayward. temperatures 38 in san jose. redwood city at 36 degrees. system will give us a cool down today. temperatures will struggle to get out of the low 60s compared to the mid and upper 60s we've had. it's still a dry pattern. low clouds. a cold morning. and then a few high clouds coming in. cooler today. wind picks up later. by that i mean later tonight into tomorrow. fog, sun, cooler. low clouds. a cold morning. especially toward the north bay. low 60s or upper 50s.
