saturday, january 7th. another cool, dry start to your morning. let's check in with rosemary. >> good morning to you! a dry, mild afternoon expected for your saturday. this morning we're breezy in the hills, most of us mostly clear and cold. a little soggy out there over parts of north bay. but it's minimal compared to what we had seen recently. afternoon will be sunny, a little breezy, extended forecast looks mainly dry. we'll look at what you can expect for your area, coming up. we begin with developing news out of bay point, where investigators are on the scene of a fatal fire at this hour. the flames broke out a couple hours ago and now firefighters are confirming one person has died. ali rasmus is live on the scene with the latest details. ali. >> reporter: the fire marshal in contra costa deputies investigating what caused the fire. arson investigators are also here, that is common procedure every time there's a fatality in a fire. and officials are confirming

one person did not survive this fire. they're not releasing the victim's identity but several neighbors told us the victim is a woman in her 70s, who was staying with her friend in one of the townhomes. the garage is burnt out. now we've tilted up and you can see where the flames and smoke have damage the soaked story window where this fire originated. this is tammy circle, in the pittsburg-bay point area. firefighters are here, even though the fire started before 5:00. they contained it quickly. when firefighters went into the townhome, there were flames on the first and second floor. the second florida they discovered one of the occupants of the home did not survive. and a neighbor told us the elderly woman was con find to bed for the past couple months. . >> as she explained to us in spanish, she said she couldn't walk, talking about the victim of this fire, because she was sick. she had lost her home so her

friend the man in his 70s who also lived in the building tried to help her by letting her stay in his townhome. of course, that is where the fire started early this morning. that man, the other person who was in the home at the time of the fire, was not injured, taken to the hospital for observation. four townhomes in this complex behind us were damaged by some of the smoke and some of the water used to put out the fire. so we just saw the red cross arrive. there's the red cross there, they're helping the people displaced in the four apartment units find other housing this morning. ali rasmus, ktvu channel 2 news. a sonoma county family is out of their home after an overnight house fire. firefighters responded to the home higher in santa rosa around 12:30 this morning. flames could be seen coming from the roof of the home. the family of four did manage to get out without any injuries. votessors say that fire started in the chimney and spread to the first and second floors of the home. right now oakland police

are looking for the parents of a child found alone in a parking lot around 3:20 this morning. a six-year-old boy was found by himself in a chase bank parking lot off international boulevard. police notified child protective services and began searching for his parents. the child is still in the custody of oakland police. all lanes of highway 84 back open after a two-car accident. it happened around 10:30 last night on niles canyon road between fremont and sunol. two cars collided head-on, blocking both lanes. children were involved in the accident, including an infant. those injured were transported to a hospital. the lanes reopened before 1 a.m. and a woman is recovering after allegedly being shot at while driving in san lan throw. highway patrol says the woman was on highway 2:38 we she heard a pop and her driver's side window blew out. she took the next exit, pulled over and called the police.

officers say she was not shot but was treated at the scene for minor injuries. a man suspected of sexually assaulting women in san francisco's mission district is now in police custody. police say they arrested the man seen in this surveillance video. they say since june he's attacked and robbed three women along 24th avenue. the most recent attack last month. police say a citizen's tip led them to the 32-year-old suspect and they did arrest him yesterday afternoon. >> it's just such a relief. i have so much family and friends in this neighborhood, and i mean, i walk home every day, my friends walk home, and it's very uncomfortable. >> police have not released the identity of the suspect yet but did say he has an expensive criminal history of robbery. they are now investigating whether he was responsible for any other attacks. opponent of a 49ers stadium in santa clara are continuing to gather signatures to stop construction. the group santa clara plays fair says it is behind the signature campaign and wants

residents to vote on the stadium yet again. santa clara plays fair argues that voters who approved the measure in 2010 did not know the exact cost for that stadium. a signature drive is set for 9:00 this morning at the santa clara farmers market. >> look at the facts. there's never been an area where stadium has gone into an established residential area and the property values have done anything but go down. so if they care, they need to get off their behinds, out of their lazy chairs, and come down and vine this. >> meanwhile, an electrical workers union is now part of the stadium fight. ibew local 332 posted on its website that the 49ers asked the union to act as interacceptors to stop the referendum. the union tells ktvu it wants to give the public an alternate view. the 49ers say they have nothing to do with the union's plan. despite the signature campaign, the 49ers have managed to clear one more hurdle for that

stadium. the mercury news reports this morning that the great america theme park has agreed to drop its lawsuit over construction. great america initially opposed the stadium because it did not want to give up its land. in exchange for dropping the lawsuit, the city of santa clara will allow great america to keep a higher percentage of its parks profits. there's a big push to get a four-year-old boy from san ma fayeo a life-saving bone marrow transplant. last month kyle crawford was diagnosed with a bone marrow disease. in order to extend his life, he needs a donor of multi-ethnic or asian descent. anyone who matches that description is asked to get tested and join the registry starting today at this school on clearview way. it begins at 11 p.m. until 2. there's another registration drive next saturday in san francisco. the father of the five-year- old boy shot and killed outside an oakland taco truck is pleading for the public's help this weekend to find his son's killer.

a band played the favorite song last night at this family gathered for his funeral. someone shot and killed the boy one week ago. oakland police are releasing few details on the case. his father tells ktvu he is frustrated. >> you think somebody knows who did this? >> probably. probably somebody knows. and i know a lot of -- couple people that i believe they know who it is. >> his family believes the killer might have brought food from the taco truck before shooting the boy in the parking lot. the three young children killed in oakland are going to be honored one week from today at two oakland churches. the tower of faith ministry and acts gospel church are holding a block party called save our babies. the events will honor these three children. both are scheduled from 11 to 5

next saturday. today waves are expected to decrease in size after the biggest swells of the season battered the northern california coast. this is yesterday in pacifica. 15 to 20-foot waves rolled on to the shores, both there as well as in santa cruz. extra lifeguards were dispatched and the coast guard was called to assist boats in distress, including a sardine fishing boat that sank. the captain sent out a mayday call. the crew was able to board a smaller boat before the larger one sank to the ocean floor. good morning to you! a live look here at san jose. we've got low clouds out there this morning. but we've got plenty of blue sky up above. good air quality today. temperatures going to be warmer by five or seven degrees over friday. satellite radar here, we watch the system sweep to through, bringing us cooler conditions. that shifting over into utah. we have a ridge of hi pressure building in overhead and the

difference between the two bringing us breezy conditions over parts of the hills and that offshore wind will help heat us up through the afternoon. atlas peak now 21 miles per hour. we're looking at 15 in some of our oakland hill area. but for the most part here at the surface, most of us are dealing with just very calm conditions or maybe a light breeze. but the winds will pick up in increase into the afternoon so sunny skies in store today. winds 10 to 20 miles per hour. so some of the breezier areas will hit 20 miles per hour or so. temperatures will be fairly mild but if it's very breezy outside, it could still feel chilly. 33 degrees at santa rosa. talk about chilly. 30 in napa. fairfield 55 degrees. 25 warmer than napa because right there at the airport the winds are gusting pretty good. vacaville reporting strong winds. 37 in concord, mid-30s livermore, 39 in hayward. 40s around san francisco as well as oakland. 42 outside your door in san

good morning, san rafael! gorgeous blue sky overhead. we're looking at the official sunrise in about 10 minutes or so. tomorrow marks the first anniversary of the tucson shooting rampage. and congresswoman gabrielle giffords is in tucson for a series of events to mark the tragedy. just yesterday the congresswoman attended a ceremony at her office in honor of stamper gabe zimmerman. he was one of six people killed in last year's shooting. the photo from her facebook paining shows her helping unveil a permanent memorial to zimmerman. tomorrow giffords will attend a vigil in tucson. and another memorial to zimmerman stands on a hiking trail in pima county. the arizona trail association unveiled it yesterday. a memorial hike will take place in zimmerman's honor later today. and in walnut creek, a group of people rang a bell last night to remember those who have lost their lives to gun violence, including the victims from the tucson rampage

and other recent shooting sprees across california. the group says it is calling for stricter gun laws. >> i'm not against people being able to carry a gun, go hunting if they're properly regulated and people are held their licensed and liable and respectful of one another. >> the laws have to be federal laws, because california has the strictest gun laws in the nation and the guns are being trafficked in from neighboring states. >> another vigil for the tucson shooting spree will take place this sunday in san francisco. in this morning's weekly online video address, president obama is defending his recess appointment of richard cordray. >> i nominated richard last summer and yet republicans in the senate kept blocking his confirmation. not because they objected to him, but because they wanted to weaken his agency.

that made no sense. >> consumers deserve to have some -- >> republicans argue the new consumer protection agency. they're holding ceremony sessions to keep mr. obama from making appointments. new this morning, in the last hour g.o.p. candidate for president mitt romney wrapped up a campaign event in new hampshire. >> i've watched polls come and go, things change very quickly. it's very fluid. i need to make sure you guys get your friends to go out and voted and you vote as well. >> he made those comments in derry with just three days to go until the primary. polls show romney leading his rival by more than 20 points. newt gingrich will also be in new hampshire today, set to hold a town hall meeting at 8:00 pacific time. a family of republican candidate for president jon huntsman is calling a new campaign ad from supporters of rival ron paul "vial."

the group new hampshire liberty for ron paul released the ad on youtube. it questions whether huntsman is a manchurian candidate because he speaks chinese and has adopted daughters from that area. >> someone wants to poke fun of they for speaking chinese. that's okay. what i object to is bringing forward pictures and videos of my adopted daughters. and suggesting there's some sinister motive there. >> i haven't looked at it you i understand it's an ugly ad, and obviously all campaigns have to suffer these consequences when somebody goes up and they put the candidates name on there and you get bad press for it. >> a paul campaign spokesman has called on the new hampshire group to take down that ad. a federal judge is now considering whether to delay the trial of john edwards. yesterday the judge met with a

federal prosecutor and a lawyer for edwards. the former presidential candidate is seeking to clay the january 30th start date for an unknown medical condition. he is facing a trial for charges he used campaign finances to cover up an extramarital affair. if convicted he could be sentenced to 30 years in prison and a $1.5 million fine. a georgia man is in jail after police say he walked inside a hospital intensive care unit. and opened fire on his wife and mother-in-law, killing them. it happened last night in fort oglethorpe near georgia. the man opened fire while the woman visited with a family member. the motive is not known yet. investigators in new zealand trying to determine what caused a hot-air balloon accident that killed 11 people. yesterday police say five couples sped off on a hot-air balloon tour on the north island. witnesses on the ground say after takeoff it became clear something was wrong.

suddenly the basket went up in flames. >> the whole basket was on fire, just a ball of flames. all the way to the bottom of the basket, and horrible to be inside. >> police say all the couples and the pilot were killed. they're working to identify some of the bodies. they say the balloon could have hit a power line but they're trying to determine what happened before that. a u.s. navy destroyer came to the rescue of a iranian fishermen held by pirates. the pentagon released this video of the iranian fishing boat in the arabian sea, showing the pirates are their arms raised. 13 said they took over their boat in november. >> the u.s. navy took the iranians onboard, provided them with food, with water, with medical care. they were obviously very grateful to be rescued.

>> the iranians returned home wearing u.s. navy baseball caps and the boat's captain thanked their rescuers. right now a coast guard icebreaker is helping a russian fuel tanker get to an iced in community. they encountered ice through the bering sea to nome. it's running out of supplies. without the tanker the city will run out of fuel and diesel oil. the coast guard icebreaker is now working on leading the tanker through 300 miles of sea ice. they're scheduled to reach nome by tomorrow or monday. pulling out all the stops, the sweet deals offered by ski resorts to lure visitors during this dry winter. >> and amazing pictures of a target truck in the middle of a frozen lake. how it got there and how the driver managed to stop. >> mild and dry weather expected for your weekend. this morning mostly clear and cold. we'll look at the numbers outside your door, coming up.

check out this video. there were some scary moments for this driver in minnesota after his tractor-trailer crashed into a frozen creek. this happened yesterday about 40 miles from minneapolis. the driver lost control of and plunged into the water. he was able to escape and crawl across the ice to safety. the man was taken to the hospital and treated and released. 2011 was the driest year on record for texas. the national weather service says less then 15 inches of rain fell last year, and as a result texas suffered its worst caught and largest agricultural lost. it was also one of hottest years for the state with an average temperature of 67 degrees. the long range forecast is bringing hope to ski resorts trying so salvage the season. this is kirkwood. it's just one resort offering special deals and homemade snow to bring in business after a

dry holiday season. but good news is in the forecast. predictions are that on or around january 22nd, the high pressure on the northern california coast will start to break down and storms will start to roll in. ski resorts aren't the only ones hurting from the lack of snow. some bay area considers are finding less business in tahoe means less business for them. the owner here said the numbers are down but some big items are still selling. >> our hardware sales are boots, skis, aren't off very much. but the little things, little things that you don't realize you need until you go skiing. >> not everyone is feeling the pinch of a dry winter season. we also spoke to to employees at a bicycle shop. they say more people have been buying bikes and take advantage of the warm weather. i know a lot of people itching to get on the slopes and just kind of waiting for this system to come. but rosemary has another dry forecast. how is that 22nd looking?

that's what they're talking about? >> yes, the rest of this week and into next week looks dry. these are long-term models, and once you get long reference it could change. but for the most part we're going to be dry for the first half of january. and then into perhaps the 22nd or so we will see some rain. we will keep this week open to see what is going to come in the next week or so. for the weekend, mostly sunny skies, we will be cool to mild. we'll be warmer than we were yesterday by several degrees. we could be breezy at times. this morning we're seeing 30s and 40s out there. by 9:00 or so, notice we see a nice improvement. most of us in the 50s by then. into the lunch hour even a few low 60s in the forecast. afternoon highs mid and upper 60s. 67 santa rosa. 67 morgan hill. mid-60s san jose. 64 expected in oakland. low to mid-60s around the city. the extended forecast here, a dry one, temperatures will be even warmer for tomorrow, less breezy in afternoon. so sunday may be the better day

a fatal fire breaks out in the east bay just hours ago, and right now investigators are still on the scene trying to figure out what caused it. good morning. and welcome back to mornings on 2. one person is dead and right now the search is on for the cause of that fire in bay point. it started just about two hours ago. ktvu's ali rasmus is live for us this morning with more information. ali. >> reporter: a contra costa sheriff's sergeant told me that their investigators distribute find anything suspicious about this fire, so their investigators have left. however, fire investigators are still out here trying to pinpoint the cause of this fire. it happened in this townhome that you're looking at and the smoke and fire damage is very visible from where we're standing. this is part of a townhome complex on tammy circle in bay point. it was around 5:00 this morning when the fire started.

you can see the burned-up garage and some smoke and fire damage on the second floor of the building. neighbors describe to white house they saw and heard, before the fire started at 5. >> it sounded like rain, and i thought it was raining. and then i looked out and it was just fire. just coming out. >> two people were living inside the townhome when the fire started this morning. one person did not survive it. investigators won't reveal the identity of the person who died in the fire. but neighbors tell us she's a woman in her 70s who recently been ill and was confined to her bed. she lived in the townhome according to the neighbors with a friend of hers, a man also in his 70s. officials tell us that man was able to get out of the home. he was taken to the hospital for observation and he was not seriously injured. red cross representatives are still out here trying to figure out how many people have been displaced by the fire. you can see the red cross working with some of the homeowners. this fire did not spread but

there is smoke and water damage to at least four units in this complex. again, red cross trying to figure out how many people lived in those units and trying to finds them alternate housing this morning. allie rasmus, ktvu channel 2 news. new details this morning about the domestic violence investigation involving san francisco's shave elect ross mere. his neighbor called police about the incident described as a heated argument and police have confiscated an iphone and video camera from that neighbor. she claims the phone contains text messages describing the incident and the camera shows the mayor's wife with a bruise. >> it's unfortunate. there's serious allegations. i need to allow the process of investigation to move forward and determine whether or not there's adequate evidence there. >> mayor's wife was spotted yesterday saying her husband

has never been abusive. the mayor is said to be sworn in as sheriff tomorrow. mayor lee tells ktvu he will announce a replacement for mayor creamy on the board of supervisors on monday. mayor ed lee is being nag inaugurated tomorrow. mayor willie brown will serve as the master of ceremonies. senator feinstein will administer the oath of office beginning at 11:00 tomorrow morning, open to the public. san francisco's economy is getting a boost from tech companies sales. the company signed a lease at 50 fremont street. the $340 million lease is the largest office lease in the city in the past decade. it's an 18-year deal and gives sales force enough space for 2,000 employees. the company can move in as early as april. sales force says it is still planning on building a two million square foot campus at

mission bay in the next decade. historic bar in san francisco's union square could be forced to close its doors. the owner of the gold dust lounge on powell and geary streets says he received an eviction and lease cancellation notice from his landlord last month. we spoke with the bar's manager who says nothing is for sure. he says the owner of the bar plans to appeal. the gold dust lounge opened its doors in 1933, and the notice gives the bash three months to shut down. the tribune is threatening legal action this morning against occupy oakland. they have been publishing a newsletter in blog called occupied oakland tribune. the tribune says the newsletter and blog are trademark infringements because they used the name and image of the tribune tower. the publisher of the occupied tribune has not commented yet on the possible legal action. a state assemblywoman sentenced in a shoplifting case. in october she allegedly stole

$2500 worth of clothing from a san francisco neiman marcus. yesterday her attorney realized a brain tumor caused her behavior and affected her judgment. the charge was taken down to a misdemeanor. >> she is a first time offender. she has no other criminal record. so while what she did is unexcusable and she needs to be held accountable, i think it's appropriate to examine and explore all different possibilities. >> she was sentenced to three years unsupervised probation and court fee. she's also ordered to stay 50 feet away from neiman marcus stores. a woman will spend life in prison for the torture death of her niece. a contra costa county judge handed down that sentence to 41- year-old shamika davis yesterday. after she apologized in court. in september of 2008, the body

of 15-year-old jasmine davis was found in her home. the girl had been starved, beaten and burned. her twin brother survived similar abuse and testified at the trial that that abuse had gone on for years. this morning the mother of a suspected serial arsonist and her son remain in jail. federal prosecutors are seeking to deport dorothy berkhardt back to germany to face frau charges. her son harry is charged with 37 counts of arson in connection with 50 fires set across los angeles over new year's eve weekend. he could face additional charge. arson investigators are looking for a man who they say left some kind of explosive device inside a seattle bank. this is an image of the suspect captured by surveillance camera yesterday morning. two customers found the device near an indoor atm. police say it comprised of two bottles filled with liquid with the lighter attached. a robot was brought in to secure the device that did not

explode. san francisco is planning to temporarily wide on a busy street for chinese new year. yesterday mayor ed lee announced plans to widen the sidewalk of stockton street through chinatown and every chinese new year thousands of shoppers and tourists descend on that area. the project will close the parking lanes on both sides of the street to make room for more people to walk. it's going to be in effect from saturday the 14th until sunday the 22nd. good morning to you! starting with a live here san rafael. a few high clouds, few patches of fog as well and temperatures chilly, cold, just as cold as yesterday, maybe a few degrees below that in some cases. 33 degrees right now in santa rosa. 30 degrees in napa. so below freezing. 1. up! mid and upper 30s around concord, oakland airport reporting 38 degrees. low 40s in the city of oakland. mid-30s livermore. mountainview also reporting mid to upper 30s.

low 40s. and calm in and around the city. we do have a light breeze santa rosa, light offshore breeze in san jose. if you look at vacaville, and fairfield, the northerly breeze to about 20 miles per hour, that is really impacted the temperatures around fairfield and vacaville this morning. and the gusts are blowing in the hills. lock at mount diablo, 47 miles per hour. atlas peak 21. from 9 to 15 miles per hour right around the oakland hills. these will come down to the surface and we're expecting breezy conditions for the afternoon. but it's that offshore wind that is bringing less fog this morning because it's drying our atmosphere out. and it will warm up us in the afternoon. satellite radar, ridge every high pressure beginning to amplify once again. that system that passed through yesterday now sinking to the east of us. and the pressure gradient between the two bringing on the winds. so sunny, breezy conditions expected for today. we do have just a few patches of fog reported right around the north bay. cooler start in both cases. afternoon highs for some it will feel a little lining

that is the san mateo bridge. seven miles long. one of the longest bridges in the bay area. traffic moving great both east and westbound directions. look at this video. a lexus plowed into an art studio a 56-year-old fremont woman was trying to park when she went over a curb and right through the studio's front window. the car did not stop until it hit the back wall of the building. the art studio was closed at the time. the driver suffered minor injuries. the silicon valley auto show is underway and the future of cars is going high-tech. automakers such as ford will show up to reveal what will be rolling off its line. for example, a trunk that comes with the sweep of a foot. it opens on its own. and ford is planning on setting up shop. think of the universities here. the pool of talent is amazing

deal with and most of us dealing with chilly temperatures this morning. in this morning's news of the world, japan says it will soon require all nuclear reactors in the country to shut down after 40 years of service. that new rule comes after the meltdown at the fukashima daiichi plant last year's earthquake and tsunami. it went into service in 1967. right now there are 54 nuclear reactors in japan and several are set to hit the 40-year mark in the coming years. japan does not currently have a limit on how long they can be in operation. 800 people in the netherlands are evacuated over flooding concerns. officials say high-rising waters caused by intense rainfall could breach a critical dike. they say that dike is along a major canal and could give way to destroy hundreds of acres. residents have pitched in to help officials pile sandbags in an effort to strengthen the dike. many are getting the assistance from the red cross. indonesia christians are

the internal revenue service estimates 17% of american citizens and businesses did not pay the proper amount of taxes. and they owe the federal government $450 billion. these numbers are from 2006, the most recent year available. the i.r.s. says $450 billion it more than the federal budget deficit at that time. we're learning more about the impact governor brown's proposal would have son state programs. if passed the state would no longer accept juvenile offenders starting next january. that would affect the juvenile justice system and put counties in charge. it would also eliminate nearly 3,000 jobs from california's department of corrections and rehabilitation. >> it really makes sense because the -- it's a good thing when young offenders are kept closer to the home. when you have only a small number of state facilities, that means for many of the

this fire. firefighters are packing up after they put out this fire shortly after it started at 5:00 this morning. it originated in the townhome, the garage you can see there, the heavy smoke damage, a plymouth in the garage burned up. this started just after 5 -- just before 5:00, lot of smoke damage in the garage and up to the second story there you can see the heavy smoke and fire damage there. this is what the complex looked like after the fire started. smoke still pouring from the roof of the building long after the flames were out. when firefighters got to the second floor of the townhome, they discovered one of the people who lived here had died in the fire. and investigators are not revealing the victim's identity. but she was in her 70s, living in the townhome with a friend, a man also in his 70s. she had been ill recently and was confined to her bed. she was not able to walk. the man who also lived in the townhome with her was able to

get out of the home uninjured, and this is what he told his neighbors afterwards. >> didn't know what happened. says he was in the backroom, telling her to get out. door got locked so he wasn't able to get her out. so he just kept going get out, get out! but at that point, the flames were too big. >> just a short time ago the coroner just arrived here as they are doing some of their work in there. they're in the process of trying to remove the body from this townhome. the fire did not spread to some of the other townhomes. they have shared walls. but the fire didn't spread. however, firefighters did have to break open the roof of some of the nearby townhomes and there was some smoke and water damage to at least four units here, so the red cross is out here trying to figure out how many people have been displayed by the fire and trying to find people who will be able to return another place to stay.

allie rasmus, ktvu channel 2 news. all lanes of highway 84 are now back open after a two-car accident. it happened around 10:30 last night on niles canyon road between fremont and sunol. police say two cars collided head-on blocking both lanes. they say children were involved in the accident including an infant. those who were injured were transported to a hospital. the lanes reopened just before 1 a.m. a woman is recovering this morning after being shot at while driving in san leandro. highway patrol says the woman was on highway 238 around 10 p.m. when she heard a pop and her driver's side window blew out. she took the next exit, pulled over and called the police. officers say she was not shot, but was treated at the scene for minor injuries. right now oakland police are looking for the parents of a child found alone in a parking lot. around 3:20 this morning, a six- year-old boy was found alone in a parking lot near 21st avenue.

police notified child protective services and searching for the parents. the child is still in the custody of oakland police. a man suspected of sexually assaulting women in san francisco's mission district is now in police custody. police say they have arrested the man seen in this surveillance video. they say since june, he has attacked and robbed three women along 24th avenue. the most recent attack happened last month. police say a citizens tip led them to the 32-year-old suspect. they arrested him yesterday afternoon. >> it's just such a relief. i have so much family and friends in this neighborhood, and i mean, i walk home every day. my friends walk home. and it's very uncomfortable. >> the attacks happening on 24th street, not 24th avenue. police have not yet released the identity of the suspect, but did say he hassance extensive criminal history of robbery and they're investigating whether he's responsible for any other attacks.

the father of a five-year- old boy shot and killed outside an oakland taco truck is pleading for the public's help this weekend to find his son's killer. that band played five-year-old gabriel martinez's favorite song last night, after his family gathered for his funeral. someone shot and killed the boy one week ago. police are releasing few details on the case. his father tells ktvu he is frustrated. >> do you think somebody knows who did this? that probably somebody knows. and i know people know who it is. >> the family believes the killer may have bought food from the truck before shooting the boy in the parking lot. the three young children killed in oakland over the past five months will be honored one week from today at two oakland churches. the tower of ministry and acts church are each holding a block party called save our babies. the two event will honor these

the motive is not yet known. tomorrow marks the first anniversary of the tucson shooting rampage and congresswoman gabrielle giffords is there to mark the tragedy. yesterday the congresswoman attended a ceremony at her office in honor of staffer zimmerman killed in the shootings. this is a picture from giffords' facebook page which shows her helping unveil a permanent memorial to zimmerman. a group of people rang a bell last night to remember those who have lost their lives to gun violence, including the victims from the tucson rampage and other recent shootings across california. the group says it's calling for stricter gun laws. >> i'm not against people being able to carry a gun, go hunting, if they're properly regulated and people are licensed and liable and respect funnel of one another. >> the laws have to be federal

were killed. they're still working to identify some of the bodies. the balloon could have hit a power line but are trying to determine exactly what happened before that. a u.s. navy destroyer came to the rescue of iranian fishermen held captive by pirates. the pentagon released this video showing the pirates with arms raised ready to surrender to the u.s. navy. the 13 iranians said they took over the boat in nevada. >> the u.s. navy took the iranians onboard, provided them with food, with water, with medical care, they were obviously very grateful to be rescued. >> the iranians returned home wearing u.s. baseball caps and the captain thanked the rescuers. a coast guard icebreaker is helping a russian fuel tankers get to an iced-in alaskan community.

the tanker encounted ice on the bering sea to nome. nome is iced in and running out of supplies. without the tanker, the city will run outs of fuel and diesel oil. the coast guard is now working on leading the tanker through 300 miles of sea ice. they are scheduled to reach nome by tomorrow or monday. and there were some scary moments for a driver in minneapolis after his tractor- trailer crashed into a frozen creek. this happened yesterday about 40 miles from minneapolis. the driver lost control and plunged intothe water. he was able to escape the cab and crawl across the ice to safety. the man was taken to the hospital and treated and later released. as we approach tuesday's new hampshire primary, the republican candidates for president are setting much time in that state. right now newt gingrich is holding a town hall meeting with veterans and this is a live look inside that town hall

we continue to following developing news. a fatal fire in contra costa county. an elderly woman died in the fire. and ktvu's allie rasmus is live now in bay point, where investigators have been on the scene all morning. >> reporter: i just got an update from the fire marshal. he confirms that a 60-year-old woman was the victim of this fire. it happened in the townhome you see here behind us. he says the fire appears to have started in a downstairs living room. and right now you can see through the heavily dark.

ed townhouse, that there are still fire investigators inside trying to pinpoint what caused the fire. just before 5, the fire started and by 5:30 firefighters had put the fire out. but smoke was still coming from the roof of the building. one neighbor described the flames. >> they were huge. they were coming out and the neighbors behind the townhouse they were yelling, get out, get out! and it was just after that just so fast. just moving. >> firefighters got to the second floor of the townhome and that's where they discovered that one of the two people living here had died in the fire. fire marshal says it's a 60- year-old woman who lived here. they aren't revealing her exact identity yet. but several neighbors mentioned that the woman was living in the townhome with a friend, a man also in his 60s or 70s. and neighbors say the woman had been ill recently, was confined to a bed. one neighbor said she had not been able to walk recently. the man who lives in the

townhome got out of the home uninjured and this is what he told his neighbors after he got out. >> didn't know what happened. said he was in the bathroom. calling laura to get out. door got locked, so he wasn't able to get her out. so he just kept going, laura, get out! at that point, the flames were just too big. >> the fire itself did not spread. but there is some structural and smoke and water damage to two adjoining units. townhomes on either side of the town hole where the fire originated. and the fire mar shall says there are five adults and four children who have been displaced. the red cross is working with them to find -- get some assistance and find another place to stay. the fire marshal told us that the gentleman who lives in the townhome reported to them that he did not hear any smoke alarms going off. a couple neighbors also said they didn't hear smoke alarms some the fire marshal says now is a good reminder for folks to

economic batteries in smoke alarms, make sure they're working properly. allie rasmus, ktvu channel 2 news. a family is out of their home this morning after an overnight house fire. firefighters responded to the home near santa rosa around 12:30 this morning. flames could be seen coming from the roof of the home. the family of four managed to escape without injuries and investigators now say it appears that fire started in the chimney and then spread to the first if second floors of the home. today marks five years since the unsolved murder of a san francisco man shot and killed while driving his car. there's a $250,000 reward for information that leads police to these two men. inspectors say they believe these men shot and killed 20- year-old alberto castilla in january of 2006. police believe the two suspects had argued with him inside a bar before the shooting. new details about the domestic violence investigation

involving san francisco sheriff- elect ross mirkarimi. the examiner reports mirkarimi's neighbor called police about the incident on new year's eve, describing it as a heated argument. now the examiner reports police have swift an iphone and video camera from that neighbor. she claims the phone contains text messages describing the incident while the camera shows mirkarimi's wife with a bruise. >> it's unfortunate, there are serious allegations. i need to allow the process of investigation to move forward and determine whether or not there's adequate evidence there. >> mirkarimi's wife responded yesterday saying her husband has never been abusessive. he is said to be sworn in as sheriff tomorrow. mayor lee tells us he will announce replacement for mirkarimi on the board of supervisors on monday. san diego mayor ed lee is inaugurated tomorrow, a ceremonial per formsance. mayor brown will serve as

neiman marcus store. her attorneys says the tumor is being treated with medication. the oakland tribune is threatening legal action this morning against occupy oakland. occupy oakland has been publishing a newsletter and blog called occupied oakland tribune. the tribune says the newsletter and blog are trademark fringements using their name and image of the the publisher of the tribune is not commenting on the possible legal action. san francisco's economy is getting a boost from tech companies sales force.com. the company signed a lease on 50 fremont street. the lease is the largest office deal in the city in a decade. it's an 18-year deal and gives sales force enough space for two thousand employees. the company could move in as early as april. sales force says it's still planning to build a two million square foot campus in the next

decade. an historic bar in union square could be forced to close its doors. the owner of the gold duck lounge says he received any vox and lease cancellation notice last month. we spoke with the manager who says nothing is for sure and the owner of the bar plans to appeal. the notice gives the bar three months to shut down. we are learning more about the impact governor brown's budget proposal would have on state programs. if by lawmakers and signed into law, the state would no longer except juvenile offenders starting next january. that would affectively put an end to the state juvenile justice system and instead put counties in charge. the proposal would also eliminate nearly 3,000 jobs from the california department of corrections and rehabilitation. >> it really makes sense because the -- it's a good thing when young offenders are kept closer to the home. when you have only a small

number state facilities, then that means for many of the young offenders they are moved a long way from the home. >> the elimination of the state juvenile system could mean young offenders might wind up being prosecuted as adults, critics say it would increase juveniles' risk of reoffending and going back to jail. the effort to overturn california dream act has failed. organizers did not get enough signatures to put the measure on the november ballot. asking voters to overturn the bill. governor brown signed the bill into louisiana this past october allowing illegals to receive a financial aid to attend a state university. opponents need a half until signatures and fell short by 57,000. there were a big waves for the opening day ceremony at mavericks. but the contest has yet to be called. surfers told ktvu the conditions yesterday were not quite right, but the competition at the spot on the san mateo coast. there was even some doubt that the opening ceremony would take place.

the labor department announced friday the unemployment rate is down to 8.5%. most are calling it good news but the g.o.p. candidates for president say it is not good enough. the candidates used the jobs report yesterday to attack president obama. mitt romney said an unemployment rate more than 8% is no cause for celebration, and rick santorum said the rate is still too high despite the president's job policy. one professor of economics disagrees. >> they may want to have a broader message than simply hammering that the president won't show results. >> jobs, the economy, the regulatory burden and the deficit are absolutely critical factors and sitting from where i'm now in january, i still see all of those issues being critical in november. >> the government says the economy added 200,000 jobs last month. a book based on the obamas is published this week and details tension between the first lady and political aides.

a family dog has shown up alive, four days after an avalanche that killed his owner. last week eel was on a cross- country skiing trip with his owner's in billings, montana when suddenly an avalanche overtook them, burying olie and his owner. a woman was able to escape by grabbing on to a tree branch. rescue crews were able to recover her husband's body but there was no sign of olie. but then four days later the dog shoulder up at the hotel where the family was staying exhausted but alive. an ohio man claims he is responsible for the new video diary featuring casey anthony. earlier this week someone leaked her video diary on to youtube. now john says he is responsible for that leak but says he found the video on the internet and quickly posted it to youtube. >> you can't be sued for something that isn't
