i'm ken wayne. >> i'm heather holmes. a dark cloud hung over the swearing in ceremony of san francisco's new sheriff. the former supervisor took the another in the middle of acquisitions of domestic violence. alex is live in san francisco where he talked to the new sheriff. >> reporter: and just a short time ago the new sheriff made it clear that he never physically abuse his wife. he addressed the media offer the public swearing in here at the herb's theater. he talked about the accusation, he calls it a misunderstanding. >> i hope -- the office of sheriff as the sitting county of san francisco. >> congratulations. >> reporter: taking over as san francisco's sheriff, he took the another this afternoon inside the herb's theater but acknowledged today's celebration was over shadowed by controversy.

best sheriff i possibly can be. >> and the accusations impacted the ceremony. the judge who was going to swear him in decided to step aside to avoid potential conflict of interest in the future if she got the case in court. the da now reviewing the evidence in this case and he will make the final decision on whether to file charges against the new sheriff. we are live in san francisco, alex savage. >> san francisco mayor said on friday that he will announce a replacement on the board of supervisors tomorrow. that person will represent district five and serve the remaining year left onto term. the board is scheduled to hold it's first meeting of the new year on tuesday. it was a big day in san francisco politics and coming up later in ten minutes the mayor is officially sworn into office for his first full term. what he said his number one

it takes more than a hell to sway voters. you sound like you don't know what you will do? >> not yet. >> reporter: a university poll done yesterday shows the gingrich in the single digits. 15% of the voters in that poll -- so they could soften a big win by romney or could make that battle for a second place finish a -- a finish that someone could hang their hand on. they will make it a strong battle. ktvu channel 2news. >> mean tile both rick perry and rick santorum are not spending any significant time in new hampshire right now where they are both polling low. instead they are focusing on south carolina. that state's primary is set for january 21st and it's considered significant because it's the first vote in the south. the pair may still have an uphill battle there.

rather than followed. >> he said if nothing changes the iraqi people will get increasingly influenced by iran they said could lead to chaos. it was one year ago today that a mass shooting in tucson shocked the nation. today people all over the country are remembering what happened there. hundreds of people rang bells at the moment of the shooting, some of those in tucson went onto the safeway parking lot where the shooting took place. coming up in about 20 minutes we will have detail its on how gabreille giffords marked the day and the event planned to remember the victims. >> a stolen gold chain led to a large tree find in walnut creek. that find happened after one. police say about 15 people were involved and when officers tried to break it up smaller fights broke out. they used a taser to subdue one. two of them were arrested for

assaulting officers, the lounge had been hosting a private party. there is word in the last half hour that a man who allegedly kept police at bay for hours this afternoon is finally under arrest. the swat team said for the man who had an outstanding warrant. he was believed to be hiding in the backyard of a house on elizabeth court. it's not clear if the man was armed. officers nearby agencies helped in that search. >> a 13-year-old boy is recovering tonight after being trapped under a boulder in pacifica. the accident happened around 5:00 at a cliff side near the 800 block of palmetto. fire officials say he was climbing on the rocks when a boulder came loose and crushed his legs. it took an hour and a half to free him. he is now at the hospital with serious injuries. >> now to marin and the search tonight for a suspect arsonist. we went to the neighborhood where more than a dozen

suspicious fires were set. >> reporter: the leaves dry, the grass is brown.trees bare. this is not a good place to light a fire. that's what happened last night in the neighborhood near redwood and seacrest. >> we are looking at, are some fires. >> reporter: more than a dozen in five different locations during a six hour period over night. at nine last night the firefighters put out a dumpster fire near the bike path. three hours later they put out a small fire next to a neighborhood wall that burned part of a pg&e power pole and by three they were in lynnwood hills park putting out 15 to 20 grass fires, the largest burned a 20 by 45 part. an arson legislation is underway. this is where one of the fires was set. it's relatively small, you can see it's less than 20 feet from the nearest home. >> very upsetting.

improve gas pipeline safety. jerry hill who represents san bruno, wrote the bill. he said they will hold utilities and regulators more responsible for the safety of the pipelines. the bills would also require regulators and utilities to put in ntsb regulations, mandate whistle blower protection and require the regulators to consider the safety performance when setting gas rates. >> a new economic outlook plan predicts the america's cup race will generate about $1 billion for the local economy. a san francisco chronicle report says the race will create 8,000 jobs. the plan requires organizers to hire all union years and put aside 20% of all construction hours to san francisco residents. it's scheduled to kick off in august of next year. >> not even his swearing swearing in ceremony could stop

680. it happened around 7:30 just north of scott creek road. the highway patrol said a van crashed in to the back of a car, lost control and then hit two other cars and finally want down into a ditch. the driver was hurt and the van's passenger died there at the scene. investigators say alcohol doesn't appear to be a factor it. police in san francisco are investigating a hit and run crash that left a bicyclist seriously injured. it happened just after midnight right along the muni tracks near san francisco's city college. the bicyclist was taken to the hospital. his condition is not known. police have not yet released a description of the car or the driver. >> a new so-called pay to play immigrant vica plan may be the way oakland tries to fund the ballpark for the a's. the mayor is considering the plan that matches up foreign investors willing to pay for a green card were with those in

. demolition crews in texas took a big piece out of the skyline today. the former life insurance building was destroyed after six decades. it opened in 1952. officials decided to take down the building to make room for new facilities but not before removing a 4 million-dollar

mural . hundreds of small bells were given out across tucson to mark the moment of that deadly shooting a year ago today. the community was asked to ring them at 10:11 a.m. local time, the moment of that shooting. many gathered the safeway where the incident happened. gabreille giffords who was injured in the shooting made an emotional visit to the scene yesterday. >> she wanted to stop by. she hadn't yet and i was with her for that experience and you know it's a very intense feeling to stand in the space where six people died and 12 were hurt. the memories started to come back yesterday which was interesting for her. >> the vigil is set for an hour from now at the university of arizona to remember the six people killed in that tragedy. >> the three term congresswoman has until may to decide if she will put her anytime name on the ballot.

. the national transportation safety board is set to do a hearing on the safety of air shows. this in the wake of the tragedy at the reno air races that left 11 people dead and 70 hurt. officials from the air racing association are scheduled to testify before the committee. 75 people have died over the past 25 years, none of them but the reno disaster included people watching. the army said stolen military equipment has led to the confinement of a hundred soldiers as a base in washington. a flyer posted said someone stole sensitive military gear over the holidays. the base is about nine miles tacoma.
