mall. they took him to the hospital where he later died. the officers shut down the intersection for a few hours while they conducted their investigation. >> i don't have any information about the suspect at this time but we are trying to identify the vehicle and trying to determine what happened here tonight. >> well a friend tells us, his friend was in the crosswalk. allie rasmus is following the story and she will have more in a live report from the scene coming up. the 77-year-old man suspected of killing four women will be in the marin county courtroom later this morning. a preliminary hearing for joseph will be held today. today's hearing will be the first time prosecutors will publically hear details in the case. he has pled not guilty and he is representing himself.

the inmate in dublin is back behind bars this morning. sheriff's deputies captured jose not far from the prison grounds. now the 57-year-old inmate is doing time for a burglary charge. he slipped away earlier in the day and his escape prompted a massive man hunt. they used an old trick to find him. >> you call off the search and the person thinks you are no longer looking for them and they think you are away so they will come out. >> they are trying to determine how he made his escape. jail breaks there are extremely rare with only three since 1989. dispatch tells us it has been the first fire free night

. welcome back to ktvu channel 2 news, we want to get back to our top story this morning. a fatal hit-and-run, allie rasmus joins us with what the victim's friend is saying about the late night crash, allie? >> reporter: traffic investigators are on this case trying to find the fatal hit- and-run. it happened at 11:30 last night. the victim was crossing the street next to where a gas station is located and that corner. he was struck by a car while he was in the crosswalk and the car just sped off. >> i could see my friend laying on the ground and i just called for help. >> now the man was rushed to hyland hospital with very serious injuries and he died from those injuries. they don't have a description of the vehicle involved. they don't have any witnesses

there is surveillance cameras on the corner and later this morning investigators will see if any of this was caught on video. allie rasmus ktvu channel 2 news. he died at the statehouse on the final day of the legislative session. he collapsed last night and governor chris christie talked about his death two hours later. he served in the assembly since 1989 and became the gop leader in 2003. shocked after the sudden death of the well respected clerk. she was found dead by her husband early saturday morning inside their oakland home. foul play is not suspected.
