dissuading a witness. christien kafton is live now in the city with more on what could be next for san francisco's new sheriff. >> reporter: good morning. ross mirkarimi served here in san francisco's city hall for seven years as a supervisor. she was born in as sheriff a week ago and now the mayor has to decide whether to temporarily suspend him from office as the criminal investigation continues. mirkarimi surrounded himself last night, he was photographed and fingerprinted like any other suspect. he is now out and is facing charges of spousal abuse, child endangerment and dissuading a witness from a new year's eve dispute with his wife. he left the jail last night but is not allowed to go home because of a judge's order bargain him from seeing his wife and young child. his lawyer says he is staying with friends, yesterday before turning himself in mirkarimi with his wife at his side said he plans on fighting the charges against him. >> i believe that these charges

are very unfounded, and we will fight these charges. whether this was utely elected sheriff or any other san francisco resident, this time of behavior is inexcusable, criminal, and will be prosecuted. >> mirkarimi will likely be in court to be charge with the three misdemeanors on tuesday. mayor ed lee has the authority to charge mirkarimi with misconduct and to spend him from office as sheriff. no word if that's what the mayor will do. if that's a route that mayor lee takes, he would need to notify the city's ethics commission 3 file written charges. the office would be filled by the undersheriff. there would be a hearing where he could fight the charges and finally the board of supervisors has to decide whether or not to permanently remove mirkarimi from office. we will continue to follow any you this developments here in san francisco. we're live, christien kafton ktvu channel 2 news. the mayor says -- new york

there's people inside walking around in this neighborhood. and we found some people in a group of 17 friends from the bay area who decided to get the tailgating started early. they told me they tapped their keg at 5 this morning. they all went together and got one of their friends to convince them to let them use their rv. they have a designated driver, deejay. they're all set. they've got their -- everything. they are definitely ready for the game. but we talked to other fans here, some of whom came from far away. we talked to one guy who drove here from southern california. he said he got off work al:30 last night. at any time stop driving until he got here to candlestick park. >> i grew up in fremont. all my life. and i say every season as the niners get to the playoffs i'll go, i'll go. and finally i got to make my promise to myself and go. >> we checked online on

night on empire and webster streets near the fairfield civic center. flames engulfed the building and it took firefighters several hours to put it out. no one was injured. the building housed several businesses, including a law office and the offices of the american cancer society. >> with all the patients that we would not be able to help and all the volunteers that helped raise money, for us. that's what i thought about. sorry. >> investigators say the building is destroyed. workers from the american cancer society say they'll tried to find a new office and get back to serving patients. some witnesses say they heard an explosion before the fire broke out but the cause is still under investigation. officials in rio vista are blaming a ruptured pipeline for start this is fire yesterday evening off highway 12. officials and witnesses say flames shot up to 100 feet into the air. firefighters had the flames

so if you have a trip to the airport, just above freezing at the airport and oakland at this time. satellite radar, california still with mostly sunny skies, but today you can see we have active weather to the south. this is the weather to the north that will eventually impact us as earliest tomorrow. so this will continue to sink south into the pacific northwest. we're not going to see any rain out of this first system but we'll see an increase in our onshore flow e meaning low clouds tomorrow morning and for the afternoon, it will be a lot cooler, could be breezy. look here, starting this morning with mostly clear skies. by tonight, right up along the coastline by tomorrow morning, spilling into the bay. we wake up tomorrow morning slightry warmer because of low clouds but in return, for the afternoon, we're going to be anywhere from 5 to 10 degrees below what we see this afternoon. rain will stay to the north. we will remain with mostly sunny skies for sunday afternoon. but in addition to cooler weather we're looking at pretty gusty conditions. the sierra will see a red-flag

john edwards will be delayed because of a life-threatening heart condition. a federal judge disclosed the diagnosis during a status hearing yesterday. the 58-year-old former presidential candidate is expected to have surgery next month. edwards faces six felony and misdemeanor counts surrounding accusations he used almost a million dollars in campaign donations to help hide his pregnant mistress from the public during his 2008 run for the white house. four homeless man have been stabbed to death in orange county within the last few weeks. the latest happened last night behind a carl's jr. restaurant in anaheim. police had detained a man suspected in the killing but they won't say if that man might be responsible for the other stabbings. investigators had indicated the deaths were the work of a serial killer. the hearing in marin county to determine whether there's enough evidence to send an accused serial killer to trial there will continue on tuesday arch the holiday weekend. the hearing for 78-year-old joseph naso started this past week in san rafael.

naso is accused of killing four northern california women starting in 1977. yesterday's court session focused on the crime scenes of the four homicides. naso's former girlfriend also testified from florida via video feed. naso was defend himself and pleaded not guilty. the man accused of sexually assaulting three women in san francisco says he is not guilty. 32-year-old frederick dozier made the plea yesterday in court. he faces more than two dozen charges for three attacks in the city's mission district. he is being held without bail, his next court appearance scheduled for february 23rd. the nation's largest drugstore chain is facing a new lawsuit this morning. a nutritional supplement company based in san diego is accusing walgreens of coupon fraud. they say the drugstore chain wants reimbursement more than half a million dollars worth of coupons supposedly used by

customers but they say they are never used. walgreens denies any wrongdoing. india is threatening to prosecute some of the world's most popular websites, including some in the bay area. the prime minister says he is insulted by some of the images on 21 sites, including google, yahoo and facebook. some of the illustrations show government leaders in compromising positions and pigs running through mecca on holiest city. going approximately facebook say they've removed hateful images that violated their standards. free wi-fi is coming to one city in contra costa county. brentwood is installing wireless network equipment for the downtown and city park areas. the service should be available by the end of next month. it's costing the city about $90,000, but loaders hope it will attract more visitors to the downtown area. a mistake on a national monument honoring martin luther king, jr. what was wrong -- done wrong and what is now being done about it.

petitions drivers. she attended her first anti- recall rally yesterday and says she has the support of labor groups. opponents say they need to collect 20,000 signatures by may. mater expects at least one of the recalled drivers to go to a vote. hundreds of internal e- mails obtained by ktvu show tensions in oakland during the height of occupy protests. and one message from october said he was confronted by protestors camping at frank ogawa ms.a and one implied they would remove officers by force it they end erred the camp. interim chief jordan received one e-mail from the mother of an oakland officer detailing how her daughter was bombarded with bottles of feces and urine during a confrontation with protestors. another e-mail on washington, d.c. crisis manager recommended oakland apologize for police force against protestors. the mayor's team disagrees. across the bay protestors

with objection pie san francisco are holding a protest in the mission district today to call attention the continuing eviction of renters for condo convention. the group says real estate speculators working for well fashion are line the effort. the protests start at noon today. oakland police are examining whether two sexual assaults in the past week are connected. the first attack happened on january 6 on the 1200 block of market street. the most recent assault occurred thursday night, just a half mile away on the 600 block of 11th street. in both cases the victims were 28-year-old women. they say the assailant carried or pretend today carry a gun and that he is between 16 to 18 years of age. a san francisco restaurant owner remains in critical condition who morning with life- threatening injuries. police say 76-year-old rose chung was attacked with a hammer and knife on thursday night. she had just walked home from one of her restaurants in the sunset district when a man forced his way inside the house. friends dropped by, bringing flowers and offering comfort.

chung's niece told amber lee she is too distraught to talk. >> really sorry about what happened. >> thank you. >> everybody try to see the way the case is -- that's what they've been calling me. >> a second woman delivering food to chung was also attacked. she is now in stable condition. police have increased patrols in that area. san francisco mayor ed lee called the family to offer his support. a union city high school teacher is still in jail this morning accused of having a sexual relationship with a 16- year-old female student. police arrested 38-year-old peter cole on thursday. he is a teacher at james logan high school and the fourth bay area teacher to be arrested this week in four separate cases of alleged sexual misconduct. >> this is not something that is a new phenomenon. but i'm glad that it's more in the media so people can be more aware of it. >> livermore high school math teacher marie johnson was arraigned yesterday and admits she sexually assaulted a male

student and san jose teacher craig command we are was arrested accused of sexually assaulting a student on campus. his attorney says he plans to fight the charges. a san jose school is investigating how two middle school students got ahold of cookies that may have been laced with marijuana. san jose school district officials found two eighth grade girls throwing up at school yelled morning. the school is work to identify the substance in the cookies. posted offices are cutting their hours of operation intent month. most will open 30 minutes to an hour later than they do now. and some will close a half hour earlier. the changes are set to take effect on february 20th. jobs are not expected to be affected. the fate of palo alto's police headquarters will be discussed on tuesday night. it has long been feared that the 41-year-old forest avenue station is vulnerable to a major earthquake. the palo alto city council on tuesday will review a report

years. they just showed us. as early as 4:45 this morning we met another fan who drove here from southern california. he says he got off work at 10:30 last night, drove through the night to make it up to canned. stuck park. >> i group in fremont so i've been a niner fan all my life and i say every season i'm going to go to the playoffs. and finally i get to make my promise to myself. >> some fans who didn't want to wait for the parking lot to open tried to start a tailgate out in the middle of the street. they already tapped their keg. there's 19 people in the street there. security though about an hour ago told them they had to leave. so at this point, just a half hour to go until the parking lot opens. then we'll see the rv's and fans pour into the parking lot at candlestick. allie rasmus, ktvu channel 2 news. the demand for precious playoff tickets is prompting a

warning about counterfeit tickets. police have confiscated some fake batches and the nfl is urging fans to review their tickets and only deal with reputable vendors sump as ticketmaster. the league is warning people they're at risk if they buy tickets on craigslist and other non-official sites. today's big game does mean big business for some local merchants. new orleans saints fans have come to the bay area to root on their team and it seems they're spending plenty of cash. popular sites include fishermans wharf and the golden gate bridge. a favorite hangout for louisiana transplants is the black magic voodoo lounge. >> the 49ers can drink with us, they can play with us. but i doubt they can drink with us. we went to miami for the super bowl, and they ran out of liquor three days in a row. >> city of san francisco takes an almost 4 million-dollar in revenue for a regular season game at candlestick park.

investigation continues. ross mirkarimi surrendered at his own jail last night, was photographed and fingerprinted. he is now out and facing charges of spousal abuse, child endangment and days staying a witness, all stemming from an alleged new year's eve dispute with his wife. mirkarimi left the jail last newt but is not allowed to go home because of a judge's order barring him from seeing his wife and young child. yesterday before turning himself in, mirkarimi vowed to fight the charges against him. >> believe that these charges are very unfounded, and we will fight these charges. >> when this was the elected sheriff or any other san francisco resident their type of behavior is inexcusable, criminal, and will be prosecuted. >> mirkarimi will likely be in court to be formally charge with the three misdemeanors tuesday. mayor lee has the authority to charge mirkarimi with misconduct and suspend him from office.

people have been reported dead, 70 others still missing. 3200 passengers and more than a thousand crewmembers were onboard. while many escaped on lifeboats, some passengers swam ashore on their own. two of the survivors are from the seattle area. we are expected to learn more this morning about a massive fire that ripped through a large office building in fairfield. the fire started just before 7:00 last night on empire and webster streets near the fairfield civic center. flames engulfed the building and it took firefighters several hours to put out that fire. no one was hurt, and the building housed several businesses, including a law office and the offices of the american cancer society. >> all the patients that were not going to be able to help and volunteers that raised money for us. that's -- what i thought about. sorry. >> workers from the american cancer society say they will try to find a new office and get back to serving patients.

we're counting down to kickoff as the niners hosted their first playoff game in nearly a decade. and welcome back to mornings on 2. it has been a long time coming for the niners and their fans. and we're now just about five hours away from game time.

allie rasmus has been outside candlestick park and joins us live. fans are excited and getting ready for the game. >> reporter: that's right, we're seeing the faithful work, toward the stadium. the parking lot where the tailgating happens just opened up about 10 minutes ago so short time ago we saw a flood of rv's and cars pulling in to get the tailgating on. we've met a lot of 49ers fans here this morning. up until the lot opened there was a long line of rv's parked up and counsel the street basically all around the stadium. people got here as early as midnight, 11:00 last night. they wanted to make sure their cars were the first in the lot to start their tailgating. we met one man who says he has been a life long niners fan even though it's the first time he's ever within to san francisco. we also met 84-year-old twins who designed their own 49ers

jewelry and they were pretty popular out here. a lot of people wanted to come talk to them. they're dressed up identically, 84 years old. and we also met another guy who has been a niners fan his entire life and excited this is the first time he has been to san francisco. >> first time i came up from san diego, and since we didn't make the playoffs here i am! >> but how are you a 49ers fan if you've never set foot in san francisco until now? my family is here. i've got family here! they ride me town in san francisco. that's why i'm here. >> the lot opened just before 8:30. and i can tell you you can already smell some of the barbeques going across the street here you can see it they've got a grill at the church across the street, and there's a long line of cars pulling into the parking lot here at candlestick park. and kickoff starts at 1:30 this afternoon. allie rasmuss ktvu channel 2.

the south bay i bay. opponents of the loan have been collecting signatures to put a referendum on the ballot. but the city attorney says it's too late to reject the proposal. voters approved the entire stadium project by passing a measure in june of 20 tennessee. the group behind the petition has not yet commented on the latest developments. san francisco sheriff is ordered to stay away from his wife and son for a week after being booked on three counts tied to an alleged domestic violence incident. christien kafton is live where ross mirkarimi's office and where his future just may be decided. >> reporter: that's right. ross mirkarimi was sworn in less than a week ago. now his future may be decided in the mayor's office here in san francisco where the mayor could decide to temporary is spend him from office as the criminal investigation continues. mirkarimi was photographed and fingerprinted at his jail last night, facing charges of spousal abuse and dissuading a

witness all stemming from an alleged new year's eve dispute with his wife. he left the jail last night but is not allowed to go home because of a judge's order barring him from seeing his wife and child. yesterday before turning himself in, mirkarimi vowed to fight the charges against him. his wife by hiss side. >> he's my family, my husband and my son. this is unbelieveable. this is completely wrong! >> i believe that these charges are very unfounded, and we will fight these charges. >> the d.a. will prosecute and mirkarimi will likely be in court to be formally charged with three misdemeanors on tuesday, mayor lee has the authority to charge mirkarimi with misconduct and suspend him from office. the board of supervisors could vote to permanently remove him fromleast the

uncertainty surrounding his future as sheriff could make it very difficult to recruit top quality candidates to fill vacant positions within the sheriff's office here in san francisco. three young children killed in oakland over the past five month will be honored today at two oakland churches. the tower of faith and acts chump are holing a block party called save our babies. the two events will honor these three children. boeing events are scheduled from 11 to 5. the san francisco restaurant owner remains in critical condition this morning with life-threatening injuries. police say 76-year-old rose chung was attacked with a hammer and a knife on thursday night. she had just walked home from one of her restaurants in the sunset district when a man forced his way into the house. friends have been dropping by bringing flowers and offering

support. chung's niece told amber lee she is too distraught to talk. >> really sorry about what happened. >> everybody tried to see the way this case is really -- >> a second woman delivering food was also attacked and is said to be in stable condition. police have increased patrols in the area. san francisco mayor lee also called the family to offer his support. oakland police are examining whether two sexual assaults in the past week are connected. the first attack happened on january 6 on the 1200 block of market street. most recent assault occurred thursday night, just a half mile away, on the 600 block of 11th street. in both cases, the victims were 28-year-old women. they say assailant carried or pretended to carry a gun and that he is between 16 and 18 years of age. a man accused of sexually assaulting three women in san francisco says he is not guilty. 32-year-old frederickier to made the flee yesterday in court. he faces more than two dozen

charges for three attacks in the city's mission district. dozier is held without bail. his next court appearance is scheduled for february 23rd. a union city high school teacher is in jail this morning accused of having a sexual relationship with a 16-year-old female student. police arrested 38-year-old peterson thursday. he is a teacher at james logan high school. and he is the fourth bay area teacher to be arrested this week in four separate cases of alleged sexual misconduct. >> this is not something that is a new phenomenon. but i'm glad that it's more in the media so people can be more aware of it. >> in the other cases, livermore teacher marie johnson was arraigned yesterday. she admits she sexually assaulted a male student and schoolteacher craig chandler was arrested this week accused of sexually assaulting a student on campus. he plans to fight the charges. the hearing in in win county to determine whether there's enough evidence to send an accused serial killer to trial will continue on tuesday

after the holiday weekend. the hearing for 78-year-old joseph naso started this past week in san rafael. naso is accused of killing four northern california women starting in 1977. yesterday's court session focused on the crime scene of the four homicides. his former girlfriend testified from florida via video feed. he is defending himself and has pleaded not guilty. oakland mayor quan says she is ready to save her administration. she currently faces two recall petition drivers. mayor quan attended her first anti-recall rally yesterday and says she has the support of labor groups. opponents say they need to collect nearly 20,000 signatures by may. mayor says she expects at least one of the recall drives to go to a vote. hundreds of internal e- mails obtained by ktvu show tensions in oakland during the height of the occupy protests. one message from october, a sergeant said he was confronted by protestors camping at frank

pulled the family to safety. we have new information and new video of a deadly cruise ship crash near tuscany, italy. the pictures are the closest we've seen of the vessel. it continues to lie on its starbird side. the ship was sailing across the mediterranean sea last night when it hit a sandbar. the italian news agency has just reported that two french passengers and a peruvian crewman are dead. 70 people at this point remain missing. the luxury loiner was carrying 3200 passengers and more than a thousand crewmembers. a terror plot in thailand has been foiled. thai officials made the announcement this morning. officials say two lebanese men linked to pro iranian hezbollah militants want to target americans in the capital city of bangkok. it is not clear yet what sort of attack the men may have been plotting. one of those individuals is in custody and being questioned. the other man is reportedly on

the run. iran is blaming the u.s. and england for the assassination of an iranian nuclear scientist. the government has sent diplomatic notes accusing them of having an obvious role in wednesday's attack. someone planted a bomb on the car of the scientist, killing him and a bodyguard. the u.s. has already denied any involvement. joran van der sloot will serve 28 years in prison for the murder of a peruvian woman. a three-judge panel sentenced the 24-year-old man yesterday. earlier this week he confessed to killing 21-year-old stephany flores two years ago. he could be eligible for parole after serving half his sentence. he remains the prime suspect in the disappearance of american teenager natalee holloway. india is threatening to prosecute some of the most popular websites, some based here in the bay area. prime minister is insulted by some of the images on 21 sites, including goggle, yahoo and
