cool and breezy. temperatures in the low to mid 50s. here is sal. steve, good morning. traffic is moving along pretty well. i apologize for my voice. traffic is moving along well if you are driving on the commute here. no major problems heading out to the mccarthur maze. if you are driving on san francisco freeways, it looks nice approaching the 80 split. on this holiday we might have much lighter than usual conditions which are what most are hoping for. at 4:29 traffic is moving along pretty well. getting up to highway 17 on northbound 280 through downtown san jose. it's 4:30 let's go back to maureen. we begin with breaking news out of the east bay. ktvu tara moriarty has arrived to the scene of a shooting in richmond. what can you tell us at this point? >> reporter: we are told they are searching for the gunman right now. i don't know if you can see the tail end of the train.

it just pulled out of the intersection where we are standing right here. now the train was stopped for about an hour and a half as police continue to comb the area. they are not talking to us right now. from what we can gather of the freight train. it was on its way from oakland to richmond when the operator spotted a man lying in the ground next to the tracks over there to the right hand side. we will step out of the way here. because there is people here. if you can pan off in the distance here you can see the building over there. they are thinking there was a gunman perched on top of that building that may have shot a bicyclist in the legs we are told. he was lying on the train tracks right next to the tracks actually on the ground when the train operator came through, noticed him stopped the train and called police. we are on let's see ohio street between jarard and first.

police are still searching for the gunman. bnf railway is the company that was running the rail here. they would not speak to us and tell us what was going on. hopefully we will hear from a spokesman this morning. it's unknown the condition of the bicyclist. all we are told he was shot in the legs and taken to a nearby hospital. we will continue to stay on top of this story. live from richmond i'm tara moriarty. in oakland a man is recovering after get caught in the cross fire of a shootout just after 10:00 last night police received a report of a shooting at 63rd avenue and mccarthur boulevard. they found bullet casings at the scene and the victim on the next block. he was shot twice in the arm and is expected to survive. investigators he's an innocent bystander no arrests have been made. this morning firefighters are still watching out for hot spots from a fire in san

rafael. it started ollas night at a 90- year-old building. christian joins us live. >> reporter: they are trying to figure out this started. fortunately nobody was injured. this was a four unit building here in san rafael. there is a fire truck right over here. a couple minutes ago we saw firefighters going back into the back of the building using this line right here trying to get more water on this. i had a chance to walk through this building and look at the damage. this started at 7:30 last night. it started in the back upper unit and engulfed the whole billing. in the tour i saw the back deck is where the area it might have started. i can tell you from firsthand experience i saw extensive charring in that area. crews have been on the scene here putting water on the hot

spot every half hour overnight making sure there are no flair ups. >> there have been no injuries to any of the residence nor any of the firefighters. firefighters are still working. it's a stubborn fire in this attic area working aggressively top put it out. >> reporter: the hot spot is somewhere in the back. it's hard to see from our advantage point. coming around here you can see that fire trucks still over here on the side. this crew here tells me they will be here until at least 6:00 this morning. that they will be leaving at that point. another crew almost take over to make sure they can continue to monitor that hot spot. later on this morning a group of fire investigators are set to come out hire and see how the fire started. again there was so much charring the whole back part of the building is gone. it may be difficult to find out how this fire started. for now we are live in san

rafael. christian krafton. another building was on fire in san francisco. your time is 4:34. this sunday the san francisco 49ers will host the nfc championship game for the first time in 14 years. this is after the giants upset the packers yesterday. giants quarterback eli manning threw three touchdown passes including this hail mary. nix came down with the ball for the 37-yard touchdown. green bay had only lost one game all season but turned the ball over four times yesterday and ended with a stunning 37-20 loss. it's a look at how our niners made it all the way to the nfc championship. it was a thrilling finish with a four lead change. pass to vernon davis feeled a

36-30 victory over the new orleans saints. tickets for sunday's nfc championship game will be going on sale this wednesday. presale for season ticketholders begin at 10:00 wednesday morning. at 1:00 seats will open to the general public. there is an order of four tickets per order. they will be sold through ticket master and through phone. they won't be available through candle stick park. the 49ers will host the new york giants on sunday to to see who goes there the super bowl. kickoff is at 3:30. ticket brokers and scalpers already selling tickets to the game. we saw prices ranging from $300 to $1200 each already. bay area bars, restaurants, and hotels are preparing for a jump in business. the intercontinental san francisco is expecting more guests and offers special

over several times. she was sarsed on suspicion of drunk driving and vehicular manslaughter. 14-year-old brian glasper may be armed and dangerous. the first attack happened january 6th near 12th and market streets. six days later another woman reported being assaulted on 11th street. anyone with information on glasper's whereabouts is asked to call oakland police. santa clara police and district attorneys office will jointly investigate the fatal shooting by a santa clara police officer. he pulled over a 42-year-old santa clara man suspected of drunk driving saturday night. the man became uncooperative and reached for a gun in his car. that's when the patrolman shot and killed him. >> that's why we were shocked. there was two fire trucks and two paramedics. probably eight or nine cop cars. >> the officer has been a patrolman for two years.

they have not released his name or identified the motorist killed. 4:38. san francisco's new sheriff is scheduled to be arraigned tomorrow on criminal charges he physically abused his wife. on friday prosecutors charged sheriff ross with domestic violence, child endangerment and persuading a witness. a sheriff was booked and released from the jail he oversees on $35,000 bail. he says he's innocent and refuses to step down. today the nation remembers martin luther king junior. the civil rights icon that would have turned 83 this year. here in the bay area there are several events honoring dr. king. one of them is the annual freedom train. it will leave deere don station at 9:30 this morning. it will stop in sunny vail and palo alto before arriving in san francisco.

course and didn't follow evacuation procedures. it happened early yesterday morning at a fresno apartment complex. a woman in her 20s shot and killed her 18-month-old daughter, three-year-old son, and another man believed to be a cousin before taking her own life. police also found another man that had been stabbed. silver police don't have a motive for the violence. former marine and iraq war veteran accused of killing homeless men will be arraigned on friday. his father tole tells the associated press he started drinking too much after he returned from iraq. this morning investigators are looking for a san francisco woman that ran away from her oning apartment house. it started early yesterday

morning on 42nd avenue and balboa street. the fast moving flames quickly spread through the entire building. the woman that lives here panicked when she first spotted the fire. she took off running and hasn't been seen sense. >> she tried to stop the fire herself. but the fire was moving far too quickly. >> two firefighters did suffer minor burns. investigators are still searching for the cause. but there is no evidence the fire was intentionally set. time is 4:48. former utah governor john huntsman is dropping out of the republican race for president. and this morning he's set to endorse mitt romney. huntsman placed third in last weeks new hampshire primary. he has said his campaign would continue in south carolina. which will hold the next primary this coming saturday. huntsman has been pulling at the bottom of the pack in south carolina and nationally. the five remaining gop

candidates will take part in a debate tonight in south carolina. mitt romney, ron paul, newt gingrich, rick santorum and rick perry will take the stage tonight in myrtle beach. and again on thursday. analysts say more candidates may drop out if they don't do well in south carolina. the next contest is florida's primary on january 31st. meanwhile vice president joe biden is coming to san francisco this week for campaign fundraising. the vice president will attend a luncheon fundraiser at the bentley reserve. the money raised will go to if president obama's reelection campaign and the democratic national committee. 24 million zap pros -- zappos customers are being told their personal information has been hacked.

good morning, and welcome back. iced in alaskan community hopes they will get much needed fuel starting today. russian fuel tanker has arrived in the city of nome after a u.s. coast guard cutter had to break the ice it was stuck this. officials are hopeful the transfer of fuel will begin today. a storm prevented the city from getting the deliver in november. without the supply that just arrived the town would have ran out before the next scheduled deliver. time is 4:54 we want to turn it over to sal on the holiday. how are the roads look something >> it's looking pretty good. traffic is moving along very nicely in san francisco along northbound 101 approaching the 80 split. as you drive to downtown or
