afternoon prosecutors said they haven't decided whether to try him as an adult. his family had a lot more to say about how they plan to fight his case and we will have that at six. >> a judge in los angeles today set a date for a hearing in a case of those two men accused of attacking brian stow. marvin norwood and louis sanchez have pled not guilty. the hearing in their case is now scheduled for march 13th. that's almost a year after spow was attacked in a stadium parking lot. he suffered severe brain trauma and is now at a rehabilitation facility. >> mitt romney drew fire today over whether he plans to release his tax records. he answered a question. >> it's probably closer to the 15% rate than anything because my last ten years i have -- my income comes mostly from

freezing or cold weather inmode meaning will open up it's shelter facilities to anybody on the street suffering the cold and that could be a big crowd. about an hour ago they opened up it's shelter on montgomery street. they offer a number of programs to help the homeless but the main one is to get people out of the cold even during the day. >> it gets hard to keep your body temperature warm so a lot of times we have to double up on the clothes, maybe an extra shirt or coat or pair of socks, that helps to take the cold away, just a little bit. >> people die out there when it gets so cold it goes freezing then gets the precipitation happens. >> reporter: the public health department is also recommending people take precautions during the cold snap saying people can underestimate the impact of cold or freezing temperatures. >> if you are taking kids outside bundle them up and don't leave kids in the car, pets in the car, or even pets outside over night.

off italy friday. these photographs were taken that day showing damage to the ship's hull. at least 11 people died. divers found five bodies today, 24 people are still missing. a new recording today released -- they offer a chilling look in to the frantic minutes after the wreck of that cruise ship that sent 4200 people rushing for their lives. are you about to hear the anger of italian coast guard official who ordered the captain back to that sinking vessel >> reporter: you don't need to understand italian to feel the fury of this coast guard official. it shows new light on the captain's actions after the cruise ship ran aground and started sinking. he got into a life boat and was escaping the wreck but the coast guard told him to return to his ship and help save his passengers the coast guard

commander said get on board the ship and you tell me how many people are on board and what do they have? clear? you tell me if there are children, women, people with special needs and you tell me how many there are of each of the categories s that clear? but the captain couldn't say how many were left on the sinking ship. that's when the coast guard commander got fed up and made threats against the captain. the coast guard commander said look you may have been safe from the sea but i will make sure you go through a very rough time. i will make sure you go through a lot of trouble, get on board [bleep]. the captain faces charges of manslaughter, shipwreck and abandoning his ship. his lawyer says after the crash the captain steered the ship in such a way to save hundreds if not thousands of lives. >> the captain was in an italian court today telling a judge his version of the

. you can hear the anger. authorities released these tapes revealing its rescue efforts after a cruise ship ran aground last weekend. the recordings shout anger of the italian coast guard when they found that the captain of the cruise ship abandoned his ship while many of the passengers and crew were still on board. >> and mariners here say they are furious over what they are hearing in those tapes. rob roth live in vallejo where they are weighing in on what the captain did and what he should have done. >> reporter: here at the academy you can see the ship students use for training and they are taught that unlike what happened in italy the captain of the vessel should be the last one to leave a sinking ship. six years as a cruise ship
