the conditions all morning long. at 5:00 a.m. we will go live to ktvu claudine wong for a look at some of the trouble spots. now we're looking at the golden gate bridge here. you can see traffic is pretty thick. also thick in some of the hills around the bay. it's thick near the caldecott. here in san jose it's not all that bad 37 steve andly be on fog patrol and we'll have a live report coming up in a little more than a half hour. berkeley police are investigating the city's first homicide of the year. ktvu noelle walker is near the scene. >> reporter: police are just now wrapping up their investigation. they have been working out here on the street and up there in that second floor apartment where the light is on and it appears windows were shattered in the shooting. last night witnesses flooded

911 dispatch with calls to report shots fired just before 7:00 in the evening. the suspects were long gone when they arrived. medics worked on the victim that had several sun got wounds but pronounced dead at the hospital. police are not releasing his name. investigators peppered the street with evidence tags. they say this shooting was not random. >> homicide detectives are going to do a walk through. what the evidence suggests very preliminarily is that this victim was certainly focus of someone's attention. it was not a random shooting. we don't believe that the public is at risk that the suspects or suspects are long gone. >> reporter: police say the public is very helpful with the 911 calls to dispatch but they want to know more. if anyone heard anything, seen anything, even if you don't think it's significant it could lead to a break in the case.

this is berkeley's first shooting of the year. reporting live in berkeley noelle walker. three people are in the hospital following a dramatic rescue at san francisco's ocean beach. a small boat capsized shortly after sunset. several people on the beach immediately took action to help the boaters that are fighting for their lives in rough seas and chilly waters. dense fog made the rescue even more difficult. one good samaritan was on his nightly jog when he spotted the commotion and raced to pull one man out of the surf. >> took my clothes off. took his clothes off and wrapped them up in the surf and held him trying to rub his body to get the circulation going. >> the three boaters are sought to be in their 30s and 40s. all three at uc medical center. one boater is in critical condition. san francisco sheriff ross mirkarimi won't be staying with his wife or little boy any time

soon. the judge refused to lift the order barring him to have contact with his wife or two- year-old son. the judge told mirkarimi he won't get special treatment just because he sheriff. he spoke outside the courtroom after that ruling. >> this has been enormously crushing the fact that i haven't been able to see my family be with my wife or be with my son. >> prosecutors opposed lifting the state siting an e-mail that mirkarimi's wife wrote to a neighbor back in october. lopez writes in the e-mail she found her child wet, hungry, and sick after leaving him in mirkarimi's care for two hours. at one point, the toddler was left alone in a car. mirkarimi's newly hired lawyer says an earlier investigation

found these investigations to be untrue. there is two groups gathering signatures to recall oakland's mayor. recall jean quan now got the go ahead to begin its petition drive. another group began collecting signatures last month. the first group to obtain 20,000 valid signatures will have its recall petition on the ballot. mayor quan has come under firing. time is 4:34. this morning president obama will reveal details of his plan to make college affordable. this is the third and final day of the president's road trip focusing on themes from his state of the union address. at the university of michigan this morning the president will outline a plan to provide more federal aid to colleges and universities that keep tuition costs from rising. hillary clinton says she will not stay on in her

position if president obama is reelected. she told state department staffers she is ready for a break after 20 years on the quote high wire of american politics. she did not rule out a return to politics in the future. the republican candidates for president faced off in their last debate before last tuesday's florida primary. coming up the reprimand from rick santorum that got the biggest applause of the night. police in vallejo are investigating a string of break ins on businesses. more than half a dozen businesses were broken into. police say they happened sometime between 9:00 tuesday night and 8:00 wednesday morning. now police say the only thing that was taken were some coins from a check cashing business and a chinese restaurant. more police officers could soon be patrolling downtown walnut creek. the contra costa times reports

walnuts police chief is asking the city council to add two more officers to the force. if approved those officers would be placed on the downtown beat to help crack down on recent violence. earlier we reported on one fight involving 15 people outside the restaurant and lounge. a final decision is expected in just a few months. also today petaluma police are cracking down on a bicyclist who don't obey traffic laws. although accidents are down, the city still ranks number eighth on the worst places for bicyclists in the state. officers will be out looking for violators from 7:00 a.m. to 5:00 p.m.. good news for people who commute to the south bay. express toll lanes are scheduled to open in one month. the lane willing be along the highway 237 and 880 corridor between dixon landing road and first street. transportation officials tell the mercury news they are working to avoid problems that plagued the opening on express

lanes on 680. lanes have been restriped and metering lights up and running. they open on february 27th. 4:36 is the time right now. let's check in on the friday morning commute. >> sounds pretty good there, pam. the way you said friday. >> yes. >> you know we are starting off pretty well out on the roads. let's go out and take a look at some of these commutes here. highway 4 looks good. highway 680, 24, interstate 80 it's a little foggy though as we have been telling you. visibility will be a little low in some areas. keep that in mind. when you get to the toll plaza you can see what we're talking about here. we can barely see some of these cars coming up to the toll plaza. normally we have a clear view here. and the morning commute is okay here in san jose. it's clear on northbound 280 getting up to highway 17. at 4:37 let's go to steve. yes, we do have very thick fog out there.

you can see the layer hanging around. visibility eighth of a mile or zero. come areas don't have any fog just high clouds. around the bay there seems to be really thick pockets there. most of the higher clouds will clear out. for morning hours areas of fog very thick. again visibility zero to a quarter of a mile. most of it is around zero to a quarter. 40s for some instead of mid 50s. 52 in the city. but a little cooler toward san rafael. even though it's in the 40s it's not the mid 50s like yesterday. high pressure will be large and in charge. a little north wind will cower out the clouds. mid 60s again. upper 50s and low 60s.

the fire started on beckham way. as many as eight marijuana plants were confiscated from the house. they rewired the electric call system so they wouldn't pay high energy bills. >> it looks like it was directly related to the pg&e being bypassed in the garage which is common in the marijuana growers. >> the fire caused $225,000 in damage. authorities are now looking for the couple who rented the house for the past year. milpitas police say they have arrested a school employee on embezzlement charges after thousands of dollars went missing from a safe. police took 60-year-old mae gardina in custody on wednesday. $28,000 was missing from

milpitas high. stolen money was earmarked for the senior prom and transportation. pg&e updated the public on what charges have been made to the pipeline network since the devastating san brew knee explosion. 100 people attended the forum last night. hill says the utility has made important improvements. now according to pg&e crews tested 160 miles of pipeline last year and they plan to do another 10 miles this year. >> really what we want to do is educate our customers about our presence in the community, why we are there, the work we are doing, and how it will improve the safety of the system. >> the head of the state public utilities commercial came under fire last night. one person in the audience reportedly called for his resignation. assembly hill agreed but said the decision rests with the governor. time is 4:49.

good morning. we have a lot of fog around. there is already a north wind toward santa rose and vacaville. eventually it will get out of here until then it will be thick. plans to make bart more earthquake safe is under way. they improved an $8 million contract. they will install steel plates inside the tube to make sure it can withstand a major earthquake. the work is expected to begin in the spring and be completed two years later.

there is controversy over aircraft noise. some people that live in brisbane are complaining about planes heading to los angeles, las vegas, and phoenix. the planes are supposed to fly north for four miles before turning left over candle stick and heading south. critics say pilots are cutting their routes south. >> we didn't move to a place that undernewt public flight plan. there is a public flight plan and nobody has found it. they have a publicked port three departure and do not follow it because they are cow towing to the airlines. >> now an sfo spokesman says planing leaving from the oakland airport also fly over bris bane and sfo says their planes are turned before candle stick to maintain safe separation from the oakland planes. an air canada flight was grounded for four hours after a

cat escape on the plane. ten-year-old tabby managed to get out of his pet porter. he ran into the cockpit and got into an electrical panel. they did not properly close her cats container during a security check. >> we put him back in. and one of the back things wasn't snapped down. when i walked on the plane it let loose and he escaped. he went underneath the captains feet. they didn't see him run in there. and scooted up underneath the duct tape. >> boarding was stopped. passengers were taken off the plane as crews worked to get ripples out. after he was removed the wiring and electrical panel had to be checked for any damage. this is the cats first and last plane ride. it's coming up on 5:00 let's go back to sal to check on traffic. >> all right we do have a

pretty easy commute. although fog is going to play a role. so if you drive in fog and that could be you on the peninsula or you here in the east bay just give yourself an extra few minutes if you can. let's go outside. this is a look at san jose. this traffic looks good getting up to highway 17. also the morning commute looks good on southbound 101. again the fog is going to be thick on the golden gate bridge. and if you're driving on the east shore freeway we can't show you too much of it. the camera is fogged in. between pinole and richmond it looks good. at 4:55 let's go to steve. we do have some areas of fog out there. some of it is really thick. some locations are already starting to clear out. there is a north wind starting to kick in. eventually that will cower out and clear up thing to. higher clouds will clear out fast. after that high pressure will really build in a big way. areas of fog, bay and inland
